On Februar 8, 201 Cit Council Awarded the desi surve portion of this project to
CNC En On April 26, 201 the Cit Council awarded KDM Meridian the desi
of the sidewalk improvements. The project included new concrete sidewalks where
existin curb and g utter exists with ADA access ramps and a pedestrian brid over the
existin improved channel. Rubberized sidewalks are bein placed where the ultimate
street improvements are missin The installation of the new sidewalk se will
provide a safe pedestrian access to Lakeside Hi School between Grand Avenue and the
west entrance to Lakeside Hi School. On Januar 24, 2012 Cit Council awarded the
interim sidewalk improvements to 4-Con En Inc. Construction - of these interim
improvements is schedule to start after cit receives Caltrans approval.

Proposals for desi services of a traffic si at the intersection of Grand Avenue and
Riverside Drive were re on Februar 27, 2012, with a due date of April 10, 2012.
Re for Qualifications and Proposals were sent to GHD, TKE En and DMC
Desi Group, Inc., staff reviewed the proposals from these firms and selected DMC
Desi Group, Inc. The review found these proposals to be consistent with the
re of the Re for Proposals. This pro will include the installation of a
traffic si at the intersection of Grand Avenue and Riverside Drive (State Route 74) and
ultimate street improvements that include new curb and g utter, street widenin and

A. Consultant is speciall trained, experienced and competent to perform the special services
which will be re b this A
B. Consultant possesses the skill, experience, abilit back certification and knowled
to provide the services described in this A on the terms and conditions described herein.
C. Cit desires to retain Consultant to render professional consultin services and related work
as set forth in this A

1. Scope of Services. Consultant shall perform the services described on Exhibit A which is
attached hereto and incorporated herein b reference. Consultant shall provide said services at the
time, place, and in the manner specified in Exhibit A, subject to the direction of the Cit throu its
staff that it ma provide from time to time.
2. Time of Performance. The services of Consultant are to commence upon execution of this
A and shall continue for a period of one (1) y ear or as specified in the Consultants
proposal.
3. Compensation. Compensation to be paid to Consultant shall be in accordance with the
Schedule of Char set forth in Exhibit B, which is attached hereto and incorporated herein b
reference. In no event shall Consultant's compensation exceed $96,963 without additional
authorization from the Cit Pa b Cit under this A shall not be deemed a waiver of
defects, even if such defects were known to the Cit at the time of pa

Consultant shall be entitled to compensation for services performed up to the effective date of
termination.
7. Ownership of Documents. All plans, studies, documents and other writin prepared b
and for Consultant, its officers, emplo and a and subcontractors in the course of

propert of the Cit upon pa to Consultant for such work, and the Cit shall have the sole
ri to use such materials in its discretion without further compensation to Consultant or to an

A ("Documents & Data"). Consultant shall re that all subcontractors a in writin

b. Confidentialit All ideas, memoranda, specifications, plans, procedures, drawin
descriptions, computer pro data, input record data, written information, and. other Documents
& Data either created b or provided to Consultant in connection with the performance of this
A shall be held confidential b Consultant. Such materials shall not, without the prior
written consent of Cit be used b Consultant for an purposes other than the performance of the
services under this A Nor shall such materials be disclosed to an person or entit not
connected with the performance of the services under this A Nothin furnished to
Consultant which is otherwise known to Consultant or is g enerall y known, or has become known,
to the related industr shall be deemed confidential. Consultant shall not use Cit name or
insi photo relatin to pro for which Consultant's services are rendered, or an
publicit pertainin to the Consultant's services under this A in an ma trade
paper, newspaper, television or radio production or other similar medium without the prior written
consent of City.
8. Consultant's Books and Records.
a. Consultant shall maintain an and all led books of account, invoices, vouchers,
canceled checks, and other records or documents evidencin or relatin to char for services, or
expenditures and disbursements char to Cit for a minimum period of three (3) y ears, or for an
lon period re b law, from the date of final pa to Consultant to this A

9. Independent Contractor. It is understood that Consultant, in the performance of the work
and services a to be performed, shall act as and be an independent contractor and shall not

10. Interests of Consultant. Consultant (includin principals, associates and professional
emplo covenants and represents that it does not now have an investment or interest in real
propert and shall not ac an interest, direct or indirect, in the area covered b this A

an manner or de b the performance of Consultant's services hereunder. Consultant further
covenants and represents that in the performance of its duties hereunder no person havin an
such interest shall perform an services under this A
Consultant is not a desi emplo within the meanin of the Political Reform Act

a. will conduct research and arrive at conclusions with respect to his/her rendition of
information, advice, recommendation or counsel independent of the control and direction of the
Cit or of an Cit official, other than normal a monitorin and

11. Professional Abilit of Consultant. Cit has relied upon the professional trainin and abilit
of Consultant to perform the services hereunder as a material inducement to enter into this

standard of q ualit y ordinaril to be expected of competent professionals in Consultant's field of

12. Compliance with Laws. Consultant shall use the standard of care in its profession to
compl with all applicable federal, state and local laws, codes, ordinances and re

15. Insurance Re
a. Insurance. Consultant, at Consultant's own cost and expense, shall procure and
maintain, for the duration of the contract, the followin insurance policies.
i. Workers' Comp Covera Consultant shall maintain Workers'
Compensation Insurance and Emplo Liabilit Insurance for his/her emplo
in accordance with the laws of the State of California. In addition, Consultant shall
re each subcontractor to similarl maintain Workers' Compensation Insurance
and Emplo Liabilit Insurance in accordance with the laws of the State of
California for all of the subcontractor's emplo A ny notice of cancellation or non-
renewal of all Workers' Compensation policies must be received b the Cit at least
thirt (30) da prior to such chan The insurer shall a to waive all ri of
subro a Cit its officers, a emplo and volunteers for losses
arisin from work performed b Consultant for Cit In the event that Consultant is
exempt from Workers' Compensation Insurance and Emplo Liabilit Insurance

Consultant shall complete and submit to the Cit a Certificate of Exemption from
Workers Compensation Insurance in the form attached hereto as Exhibit C.

A includin covera for owned, hired and non-owned vehicles, in an
amount of not less than one million dollars ($1,000,000) combined sin limit for
each occurrence.
iv. Professional Liabilit C Consultant shall maintain professional
errors and omissions liabilit insurance for protection a claims alle
ne acts, errors or omissions which ma arise from Consultant's operations
under this A whether such operations b the Consultant or b its
emplo subcontractors, or subconsultants. The amount of this insurance shall
not be less than one million dollars ($1,000,000) on a claims-made annual
a basis, or a combined sin 'limit per occurrence basis.

UNDERSTANDING
Our Project Team has thorou reviewed the Cit of
Lake Elsinore's Re for Proposals for Desi
Services - Traffic Si Installation and Street
Improvements, Riverside Drive and Grand Avenue.
The Project Team also reviewed construction plans for
sidewalk improvements proposed alon the northerl
side of Riverside Drive east of Grand Avenue and
alon the westerl side of Grand Avenue south of
Riverside Drive. Numerous site visits of the project's
street se were conducted b the Project Team
between March I and March 22, 2012. Specific
q uestions re the project scope and parameters
were discussed with the Mr. Peter Rame Project
En for the Cit of Lake Elsinore's En
Division. It is our understandin the Cit intends to
construct the followin improvements:
• Traffic si installation at the intersection of
Riverside Drive (SR- 74) and Grand Avenue;
• Widen an 800-foot se of the northerl side of
Riverside Drive east of Grand Avenue to its ultimate
width;
• Widen an 800 foot se of the westerl side of
Riverside Drive south of Grand Avenue to its
ultimate width to Jamison Street;
• Widen a 30o foot se of Grand Avenue
immediatel north of Riverside Avenue from
Riverside Drive (SR-74) to Riverside Drive (Cit
PCC curb and g utter on the southerl side of
Riverside Drive ( SR -74 at the intersection o Riverside Drive and Grand Avenue.
The proposed roadwa improvements will be constructed to match the Cit Major Hi Cross-
Sectional Standard, and will include PCC curb, g utter and sidewalk improvements.
The Cit is seekin a full-service Professional Consultant Team capable of providin civil and traffic
en topo surve base mappin ri en utilit
notification/coordination and environmental services necessar to successfull obtain environmental
clearance, desi and prepare accurate and cost-effective PS&E's for the proposed improvements as
outlined above. The Cit specificall anticipates the followin tasks will be completed b the Consultant
Team:
• Pro ect Coordination — Provide Project Coordination services as necessar to complete the pro
on time and within bud to ac project input from project stakeholders and to keep the Cit
full informed of the project's pro includin
✓ Development of a comprehensive project schedule to include realistic periods for final desi
approvals, reviews and construction, with specific milestone dates identified

compliance with all applicable Caltrans Standards and local re ordinances and codes.
• Costs Estimates — Prepare two (2) estimates of accurate project costs and construction q uantities.
The first estimate will be submitted upon completion of the 35% complete plans. The remainin
estimates will be submitted upon completion sta of the plans. The final cost estimate will be
consistent with the final Bid Proposal sheet and will be submitted with final plans.
Bid Support — Provide support services to the Cit throu the entire project bid phase, includin

TECHNICAL ISSUES
To demonstrate our thorou understandin of the Cit re for this project and our abilities to
complete this project on time, within bud and to the standards anticipated b the Cit DMC has
identified a number of technical issues associated with the proposed improvements that will re
special attention from the Project Team durin the desi phases of this project. The Project Team, with

its expert skills, experience and knowled will develop viable and cost-effective desi solutions for
each of these issues.
Environmental Clearance
The proposed project is subject to the re of CEQA. While an Initial Stud to support a
ne declaration is anticipated, there is possibilit the project ma q ualif y as Cate Exempt
under California Environmental Qualit Act (CEQA) as a Class 1(c) project, which allows for the repair
and/or minor alteration of existin facilities, includin existin streets, sidewalks, g utters, etc., with no or
ne expansion of use. In the earl sta of this project, PMC World, Inc., throu DMC, will
make this evaluation and the necessar recommendations to the Cit to support the direction to be taken
henceforth. PMC will complete all the necessar environmental anal compl with CEQA. Under
CEQA, this includes the completion of either an Initial Stud to support a Ne Declaration, or completion
of a Notice of Exemption to support a Cate Exemption findin
Caltrans Encroachment Permit
SR-74 is a District 8 Caltrans owned and maintained facilities. An encroachment permit will be re
from Caltrans to complete construction work within the limits of Riverside Drive/Grand Avenue (SR-74)
ri To expedite the review/approval of project plans for this project and the issuance of an
encroachment permit rider to the Cit for this work, DMC will utilize the experience and skills of Mr.
Blaine Werner with Trames Solutions to coordinate this effort. Based upon his previous experience on
well over one-hundred (100) traffic si plans submitted and processed throu District 8 Caltrans
Encroachments, Mr. Werner anticipates followin activities will be re for this project:

Caltrans for approval

Off-site Impr ovements
Off-site improvements are an element of the final desi effort that is all too often addressed
inade durin the desi sta It is t an afterthou addressed with notes on the plans,
such as "replace in kind" or "match to g rade." This approach often results in numerous and expensive
chan orders and/or field corrections durin construction. Off-site improvements that need to be
properl identified and addressed in the desi effort include:
1. Private Access /Drivewa — There are private accesses/drivewa within the limits of this project,
particularl alon the westerl side of Grand Avenue south of Riverside Drive that have to be
replaced with Cit compliant drivewa improvements. To accomplish this, topo
surve (to at least the ri limit) will be completed and existin improvements accuratel
mapped for each affected access point. Utilizin this information, profiles for each access will be
evaluated. Other improvements re removal and/or relocation will be identified. DMC will
identif the point of at which the proposed improvements match the elevation of the existin surface
on the preliminar plans.

2. Existin Improvements — Within the next several months, the Cit will complete construction of
permanent and temporar sidewalk improvements within the proposed limits of this project. DMC
will accuratel locate these improvements as the are finall constructed and incorporate this
information into the project base sheets. Ever effort will be made to incorporate these
improvements into the final desi of improvements proposed for this project. Where this is not
possible, the improvements will be removed and the new improvements desi to meet project
re The limits of all existin improvements (i.e. walls, pilasters, fencin g ates,
landscapin irri s components, trees, mail boxes, etc.) within the proposed ri
limits interferin with roadwa widenin improvements,, particularl alon the westerl side of
Grand Avenue south of the intersection of Riverside Drive and Grand Avenue, will be accuratel
identified throu our topo surve and mappin efforts. Where existin features encroach
into the ri the limits of the interferin portion of the feature will be accuratel located in
the field to determine the most appropriate point to saw cut and remove the feature that conforms to

fencin and g ates, wherever possible, will be removed, salva and relocated be the ri
wa limits. Removed fencin and/or g ates that cannot be reused will be replaced with new in-kind
fencin and g ates. Mature trees and their root balls will be completel removed and the hole made
b the removal of the root ball completel backfilled and compacted.

plans and desi completed that provide proper direction to the Contractor re the modification
and/or relocation of these improvements.

construction documents for this project will include the followin

DMC's project approach is based upon a proactive Project Mana Plan that ori with our
Proposal and is finalized with the initiation of the Notice to Proceed b the Cit In summar our
Mana Plan will communicate to each member of the Consultant Team the or and
communication procedures, task descriptions and assi schedule re cost and resource
bud project data and desi g uidelines. One of the ke steps in preparin a useful Mana Plan
is the development of a detailed Project Work Plan. To develop this plan, a series of interface meetin
will take place amon the members of the Consultant Team to clearl identif the multiple activities
re to complete this project. These activities will include not onl specific project tasks, but also
a reviews and approvals, q ualit y control processes and milestones for deliverables. Assi of
responsibilities for each activit will also be desi as g enerall y shown on the proposed
Or Chart for this project. Whenever necessar modifications to the Or Chart
w ill be made in order to stren the Consultant Team's abilit to meet chan project needs and as
specific re are identified. In developin this detailed Project Work Plan, man of the potential

this project, not merel "just checkin it" at the end of each task. The preparation and implementation of
the QC Plan will be inte into the work plan as a specific task and will be applied continuousl and

for both administrative and technical controls, such as project files, routin of correspondence, checkin

Based upon our current understandin of the project's re and needs, our Project Team

Task 1 Project Mana — The Project Mana will provide the necessar Project Mana

Task 4 Initial Site Visit — Existin conditions and supportin improvements, such as pavement surface
areas, existin curbs, g utters sidewalks, drivewa walls, stairwa mailboxes, trees, utilit poles, walls,
fences, street si and stripin will be inventoried. Pictures/videos will be taken of the entire project
area to confirm existin conditions.
Task 5 Desi Surve — DMC will meet with. appropriate Cit and State officials to obtain benchmark
data, intersection ties and other pertinent data relevant to the project. Desi level field surve will be
completed of the project area to sufficientl provide the vertical and horizontal control of the immediate

Task 7 Environmental Anal — PMC, throu DMC, will complete the followin
environmental clearance activities for this project:
Task 7. 01 Preliminary Anal
psis - PMC will obtain and review existin information for the pro site
and work with the Cit to prepare a detailed project description, includin the location of boundaries and
the timin of construction. PMC will reference and incorporate applicable technical studies and data
from the existin environmental documents prepared for other projects in the area, such as the most
recent Cit General Plan EIR, and an other known sources that ma provide useful data. PMC will also
conduct database searches and reconnaissance-level site surve to identif the potential or verif the
presence of or the absence of biolo cultural, and other environmental resources within the pro
area. PMC will advise Cit staff of the potential presence of sensitive environmental resources and
coordinate with Cit staff to identif opportunities in the project desi to avoid or minimize impacts to
these resources.
Task 7.02 Preliminary Environmental St - PMC will prepare a Preliminar Environmental Stud
(PES) form for this project, in conformance with the Caltrans LAPM. The PES will contain all re
components of a PES, includin a project description, re vicinit and project location maps, and a
project footprint map, and will respond to the checklist of q uestions provided in the PES form. The PES
will also include supportin documentation and photo from database searches and reconnaissance-
level site surve to support the determinations made in the PES checklist. PMC will attempt to provide
as much data as possible within the PES form in order to minimize the number of Technical Studies
Caltrans ma re for this project. As part of this effort, PMC will include database and
reconnaissance- leve site surve information in the PES form, and include a Visual Impact Assessment
form to the PES to provide Caltrans with sufficient information to support their issuance of a Cate
Exclusion for this project without completion of further technical anal or reports. tf Caltrans finds
that additional technical studies are re the Cit will be notified immediatel and the pro will
be re-scoped PMC will provide a cop of the PES form and supportin documentation to the Cit for
review and comment prior to submittal of the PES form to Caltrans. Upon submittal of the PES form to
Caltrans, PMC will provide additional information as ma be re b Caltrans.
Task 7.03 Cate Exclusion - Upon completion of Caltrans' review and approval of the PES form, PMC

Drive and Grand Avenue to obtain pavement samples and material from the borin for laborator testin
to evaluate in-situ moisture, densit corrosivit characteristics and R-Value of sub-base soils, compile
the g eotechnical anal of field and laborator data, and to prepare a final written report with
conclusions and recommendations re pavement sections proposed for the widenin of Riverside
Drive and Grand Avenue. The report will compl with the re of the Cit and Caltrans and will
include recommendations re pulverization of the existin AC section and its use as a sub-base
material for the widenin of Riverside Drive and Grand Avenue. The final g eotechnical investi
report will be submitted to the Cit as part of the Preliminar Desi Report submittal.
Task 9.03 Roadwa .Drain St - DMC will prepare a comprehensive draina stud in accordance
with the Cit of Lake Elsinore and Riverside Count Flood Control and Water Conservation District of
the draina area within the limits of the project for the purposes of locatin and q uantif y in g existin
draina patterns and deficiencies, and to sufficientl size and desi proposed storm draina
conve facilities, if an usin WSPG and CivilDesi software. As plan revisions occur throu
the desi phase, the draina stud will be modified to confirm storm drain desi recommendations. A
final Draina Report will be prepared and submitted to the Cit with recommendations that match the
proposed improvements shown on the storm drain improvement plans.
Task 10 Concept Development — Usin topo and mappin information developed in previous
tasks, DMC will develop alternative concept exhibits of the proposed improvements to Riverside Drive
and Grand Avenue for presentation to the Cit The concept exhibits will be prepared in a sin strip
format with aerial backdrop of a sufficient scale to understand existin conditions and project impacts.
In addition to showin the limits of existin and proposed improvements, the alternative concept exhibits
will also clearl demonstrate ri limits, utilit locations and other culture in the immediate
project area that ma be impacted b the proposed improvements, such as adjacent g rades, drivewa
accesses, existin sidewalk improvements, ramps,, street trees, fencin mailboxes, and so on. DMC will
develop concept level estimates of construction q uantities and costs for each alternative concept. DMC
will prepare a Preliminar Desi Report summarizin project issues and will include concept plans and
costs to 35% complete level after presentation to the Cit Three (3) copies of the draft Preliminar
Desi Report with all exhibits, includin the concept plans and costs, will be submitted to the Cit for

previous task, DMC will proceed with the final desi and preparation of complete and accurate PS&E's,

Task 1 Plans - All improvement plans will be prepared usin AutoCAD software on 24" x 36" sheets
in plan and profile format. The scale shall g enerall y be at a scale of I" = 20' or g reater, showin limits
of roadwa widenin and other ancillar improvements relative to the project. Traffic Si plans and
detail sheets will be prepared at a scale of I" = 10' or g reater, as re Si and stripin plans
will be prepared at a scale of 1" = 20' and will g enerall y have two (2) plan strips per sheet, wherever
possible. Additional plans include the proposed traffic control and sta plans. Based upon our
current understandin of this project, DMC will prepare the followin sheets:
