REPORT TO PLANNING COMMISSION TO: HONORABLE CHAIRMAN AND MEMBERS OF THE PLANNING COMMISSION FROM: TOM WEINER ACTING DIRECTOR OF COMMUNITY DEVELOPMENT DATE: OCTOBER 20, 2009 SUBJECT: LAKE ELSINORE MOTOCROSS CONDITIONAL USE PERMIT AND COMMERCIAL DESIGN REVIEW APPLICATION STATUS APPLICANT: LAKE ELSINORE MOTOCROSS PARK, INC., 45367 AGUILA COURT, TEMECULA, CALIFORNIA 92592, ATTN: RANDY HINER OWNER: CEREAL PARTNERSHIP 11292 PINECONE STREET, CORONA, CALIFORNIA 92883, ATTN: KRIS KAKKAR Project Location The motocross facility is located on two irregularly shaped parcels that are located northerly of Corydon Street and westerly of Mission Trail. Access to the site is taken from an unimproved road northeast of Cereal Street (APN 370 - 030 -012 and 370 - 020 -003). Background The motocross facility has been in operation since early 1998. During the time the facility has operated, two (2) Conditional Use Permits (CUP's) have been approved, with a third CUP currently being processed. Conditional Use Permit No. 96 -8 — Approved February 4, 1998 The Planning Commission approved Conditional Use Permit No. 96 -8 for a three year interim motocross racing and training facility on February 4, 1998. The approval consisted of a pee -wee track, 1/10 mile oval for 250 cc bikes, a 60cc /80 cc track, low speed /balance practice area, circle track motocross track, sponsor and visitor parking, viewing areas, and picnic areas. A maximum number of fifty (50) bikes were approved per day. Review was pursuit to Section 7.2.8 of the original 1993 version of the East Lake Specific Plan. /-GE'NMAI @.v3 �I P/C' CUP No. 2008 -12 and CDR No. 2009 -03 October 20, 2009 Page 2 of 4 Noise and numerous emergency treatment calls related to the motocross facility on the site became issues that need to be resolved. The applicant worked with Staff and was able to resolve these issues to the satisfaction of all parties. The applicant submitted a second application to extend the CUP beyond the three year approval and add additional activities to include night racing, a skate park, go -cart park and water coaster facility. This application for additional uses was withdrawn. The project continued to operate, although there were ongoing noise, air, traffic, safety and operational issues. A letter was sent from the City Attorney's office dated June 28, 2001 to the operator (Randy Hiner) informing him that the Conditional Use Permit had expired, however a 90 day interim use term was granted until August 31, 2001. Conditional Use Permit No. 2001 -05 — Approved August 7, 2002 A second Conditional Use Permit was requested by the motocross operator. This review was now under the regulations of the newly approved East Lake Specific Plan, Amendment No. 2 (aka Liberty Specific Plan), Section VIII.B.9.2.2. The Planning Commission approved this new CUP along with Mitigated Negative Declaration No.2002 -02 on August 7, 2002, A Condition of Approval of this application stated that this new approval would expire three (3) years from the Planning Commission approval (August 7, 2005) unless the applicant requested an extension. A total of two, one -year extensions were available, making the maximum extension date to August 7, 2007. A City letter dated April 30, 2008 was sent to the applicant notifying him that Conditional Use Permit No. 2001 -05 expired on August 7, 2007. The applicant was advised that the motocross facility would be required to cease operation unless a new Conditional Use Permit application was submitted by May 16, 2008. CONDITIONAL USE PERMIT NO. 2008 -12 Proiect Description The applicant is now processing a request to continue the operation of the motocross facility. The facility includes an entrance structure, ticket booth, mobile trailer that is used as an office and first aid station, a man made hill for viewing races, a fueling area with fuel tank, visitor parking, portable restrooms and a variety of racing tracks. Tracks include a pee wee track, 60cc /80cc track, beginner track, vet track, main track, and UTV /Buggy track. The latest request includes the use of off road trucks also known as "Lucas Series Trucks." The applicant states that a maximum of 75 motorbikes will use the tracks at any one time. The proposed hours of operation are lam to 10pm Monday thru Saturday. Other activities the applicant is requesting are overnight camping during racing events, live music during CUP No. 2008 -12 and CDR No. 2009 -03 October 20, 2009 Page 3 of 4 racing events, and the sale of beer and wine during certain events. He is requesting approval of this Conditional Use Permit for a continuous period of ten (10) years. Staff is analyzing the operational request presented by the applicant and appropriate conditions and /or modifications will be recommended. Site Plan Status As mentioned, the applicant submitted a new CUP application on May 13, 2008. Staff provided a Comment Letter dated June 12, 2009 deeming the project incomplete and listing the items necessary for completion. A meeting took place on July 22, 2008 between City Staff and the applicant to discuss items required to continue the CUP process. Various Staff members provided written comments to the applicant. The City's environmental consultant stated that a Noise and Air Quality Study would be required in addition to an Initial Study to determine what types of environmental clearances would be necessary. It was also determined that the Lake Elsinore Acquisition Plan (LEAP) application would be required since the project was located within the jurisdiction of the Multiple Species Habitat Conservation Plan ( MSHCP). The focus shifted from meeting Planning Division's CUP requirements to complying with CEQA and MSHCP requirements. Staff began sending monthly letters to the applicant, beginning in October 2008, to ensure that the items needed to bring the project forward to a Planning Commission hearing were clearly understood and agreed upon by all parties. The letters are included as Attachment No. 4. Currently there are only minor items needed in order to bring the project forward for Planning Commission review. This includes a 300 foot Radius package, which is still outstanding. The environmental and MSHCP requirements are the main items that are outstanding and are detailed below. CEQA & MSHCP Status The applicant has contracted with an environmental firm, LSA Associates, to complete the environmental and MSHCP requirement; however, LSA is currently holding all documents until the applicant completely funds the CEQA/MSHCP third party contract. Once the CEQA and LEAP applications have been reviewed they will need to be circulated to the appropriate parties. The CEQA document will be circulated to the required agencies for thirty days. The LEAP application will be circulated to the Regional Conservation Agency (RCA) where it will be reviewed for approximately two weeks. First, thank you Randy for depositing a portion of the $15,000.00 you had promised last month. We received $11,000.00 on August 3, 2009. As you know I divided that deposit between LSA at $5;90000 (total` contract is $14,980.00) and Planning at $5,100.00 (total estimate to complete the process is $8,400.00), which means that both accounts are still short by a total of $7,380.00 ($4,080.00 for LSA and $3,300.00 Planning)`. On August 18, 2,009 you contacted me via email to request that I transfer, my portion of the deposit to LSA .because LSA is requiring that the full contract amount be deposited before they will release any documents. Unfortunately, the Planning account was already in a negative state and I used a significant portion for the review and circulation of the Site Plan Package. Therefore, as of August 19, 2009 I had _$2,,Q130.0 left which would not resolve the LSA request. Since LSA has held up submitting their documents, I have had to again, postpone the Planning Commission Hee ojb October 20, 2009. This date may need to be adjusted again depending on when [receive the environmental documents. As mentioned, the Site Plan was circulated and 1 have received C'ondit'iohs of Approval and /or verification that the previous comrnenfsor conditions still are still in offect. It is understood that LSA has continued to move forward with the Initial Study and Biological Survey Report pursuant to their invoice received June 23, 2009. They have been flexible and proceeded prior to obtaining a signed contract from the City. The contract will be forwarded to the City Manager's office and once signed, payment of LSA's first invoice of $5,001.71, will be authorized. Pursuant to your request to make payments for the CEQA contract and Planning Staff's processing, you were to deposit $9,200 ($5,000 CEQA and $4,200 Planning) by June 12, 2009 and a final payment of $9,180.00 (CEQA $4,980 and $4,200 Planning) by June 26, 2009., As you know we cannot proceed with the processing of your project until these funds are deposited, essentially putting the project on hold. 1 spoke to your Drafting Consultant, Will Buck, last week and he indicated that a revised Site Plan would be submitted this week, but as of today it has not been submitted. Please discuss this with Will and submit the revised Site Plan as this needs to be circulated to the various Divisions: to obtain Conditions of Approval. We are still proposing an August 18, 2009 Planning Commission hearing, therefore, please make every effort to submit the Site Plan and deposit the funds necessary to continue the process. The contract is currently in the hands of our City Attorney's office for review. Our last correspondence was April 13, 2009 via Email. The last status letter was dated March 18, 2009. We discussed the need to replenish your Cost Recovery account in the last Email. You stated that you will be deposited monies to replenish the Cost Recovery account on April 25, 2009. An April 9, 2009 Email stated that Will has almost completed the Site Plan, but to date he has not submitted it to the City. Remember your deadline for approval or denial is July 1, 2009. Last month the priority was the request for a Matrix that clearly identified three (3) lists that will be used for the environmental review and Staff Report. The items needed were: 1) a list of what your original Conditional Use Permit (CUP) was approved for including the size of each track, operational characteristics of each tract; maximum number of vehicles allowed on each track, number of employees, hours of operation and number of paramedics required; 2) a list of what the current operation includes (including the details above) and 3) a list of what the proposed operation will include (include the details above). This information has been provided to me and I have forwarded it to your environmental consultant LSA. The current priority is to provide me with the status of the following two items: 1. Site Plan 2. Environmental Consultant; LSA, progress on providing an Initial Study and obtaining a Biologist to determine whether the project is in compliance with the MSHCP. A third party contract for services needs to be provided to the City. You will need to fund the approved contract. My last letter was hopeful in that we could have the project ready for a May 2009 Planning Commission, but May is fast approaching and the project seems to be lagging again. I have made some revisions to the requested items where indicated in bold italics since some requests have been met or changed: Site Plan (Note: The text items that need to be added to your Site Plan were listed on the red -lined plans that were attached with the previous City letter dated February, 12, 2009) 1. List the existing and proposed Land /Zoning Designations as Residential 1, Residential 2, Residential 3, and Open Space. 2. List the existing and proposed General Plan Designation as Specific Plan — East Lake Specific Plan, Amendment No. 8. 3. Please note all of the surrounding existing land uses, Zoning and General Plan Designation on the Site Plan. I have provided this information for you since this is somewhat confusing. 4. Please locate where the mobile trailer is and provide the square footage of this unit. 5. Are you currently contracted with CR & R for trash pick up? If not, you will be required to contract with them. Is the trash container shown the only container you use? Please locate all trash containers you proposed to use. 6. The plan notes chain link fence. Can you add "typical' to that notation? 7. Handicap Accessibility a. A certain number of handicap parking spaces are required. Based on the 600 parking spaces shown you would be required to provide twelve (12) handicap parking spaces. If these hours are approved, the hours listed would be incorrect. There is no mention of the 4) off -road trucks (aka "rhinos ") in either report. A reference is made to Section 7.2.8 of the Liberty Specific Plan (correct name is ELSP, Amendment No. 1) regarding interim uses, but this reference could not be found. Staff will require Urban Crossroads to provide material to support this claim. The report states that there are five tracks. The Site Plan shows 6) six tracks. Please send a revised Site Plan to Urban Crossroads so they can include it in there report, but be sure to revise the Site Plan before sending it to them, although you can send them the current plan now, so they have something to work with. There is no mention of the neighboring 7) Laing Homes project, ELSP, Amendment No. 6. Even though it has not been constructed, I would think some mention of this project should be made and an analysis for sensitive receptors. Access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be surfaced so as to provide all- weather driving capabilities. Secondary access is required in the opposite direction of the primary access off Cereal Street; preferred direction will be in the North East direction toward the intersection of Mission Trail and Sedco Blvd. Access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be surfaced so as to provide all- weather driving capabilities. Where required by the fire code official, approved signs or other approved notices shall be provided for fire apparatus access roads to identify such roads or prohibit the obstruction thereof. TANK PERMITS Applicant and /or developer shall be responsible for obtaining under /aboveground fuel, chemical and mixed liquid storage tank permit, from the Lake Elsinore Fire Services and Environmental Health Departments. Plans must be submitted for approval prior to installation. Aboveground fuel /mixed liquid tank (s) shall meet the following standards: Tank must be tested and labeled to UL2085 Protected Tank Standard or SwRI 93 -01. The test must include the Projectile Penetration Test and the Heavy Vehicle Impact Test. A sample copy of the tank's label from an independent test laboratory must be included with your plans. Provide a minimum 40 BC fire extinguisher required in area mounted so the top is 4 feet above the ground and is visible.
