LAKE LSIIYOP-,E
DREAM EXTREME,
REPORT TO PLANNING COMMISSION
TO: HONORABLE CHAIRMAN
AND MEMBERS OF THE PLANNING COMMISSION
FROM: TOM WEINER,
ACTING DIRECTOR OF COMMUNITY DEVELOPMENT
DATE: APRIL 21, 2009
PREPARED BY: KEN A. SEUMALO,
DIRECTOR OF PUBLIC WORKS /CITY ENGINEER
SUBJECT: GENERAL PLAN CONFORMITY OF THE SUMMARY
STREET VACATION FOR A PORTION OF THE RIGHT -OF-
WAY KNOWN AS "FLINT STREET"
APPLICANT: CITY OF LAKE ELSINORE: 130 SOUTH MAIN STREET,
LAKE ELSINORE, CA 92530
Project Request
The Applicant is proposing a Summary Street Vacation of a portion of Flint Street ( "the
Vacation Segment") right -of -way lying between Lewis Street and Scrivener Street. It is not
generally used by the public for street purposes and is not a city maintained road. The
Vacation Segment exists only on paper and all adjacent parcels have access to the
surrounding public right -of -way.
Project Location & Siting
The Vacation Segment is located between Lewis Street and Scrivener Street, bordered on
the east by APN 377 - 180 -055 and west by APN 374 - 032 -008.
Project Background
A Summary Vacation of the right -of -way known as Flint Street within the incorporated limits
of the City of Lake Elsinore. The excess portion of right -of -way is held in easement by the
City of Lake Elsinore.

Summary Vacation Portion of Flint Street
April 21, 2009
Analysis
The Vacation Segment exists as a paper street; the proximity of the alignment next to a
steep ravine makes it unsuitable for development as right -of -way and it is no longer
necessary to provide access to the adjacent parcels. All existing lots in the vicinity have
access to Public Right -of -Way; Staff is in agreement with this request.
Recommendation
Staff recommends that the Planning Commission
1. Adopt Resolution No. 2009- finding that the Summary Vacation of Flint
Street as described on the attached Plat Map and Legal Description conforms to the
Lake Elsinore General Plan; and
2. Direct staff to forward a copy of this report and the Planning Commission Resolution
to the City Council for consideration.

RESOLUTION NO. 2009-
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL OF
THE CITY OF LAKE ELSINORE ADOPT FINDINGS THAT THE SUMMARY
VACATION OF A PORTION OF FLINT STREET CONFORMS TO THE CITY'S
GENERAL PLAN CIRCULATION ELEMENT
WHEREAS, Gary Morris, has filed an application with the City of Lake Elsinore
requesting the vacation of a portion of Flint Street right -of -way located between Lewis
Street and Scrivener Street adjacent to APN 377 - 180 -055 and 374 - 032 -008; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of making recommendations to the City Council
regarding whether a street vacation conforms to the City's General Plan Circulation
Element; and
WHEREAS, the Planning Commission has considered evidence presented by
the Engineering Division and other interested parties at a public meeting held with
respect to this item on April 21, 2009.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission hereby finds and determines that the
portion of Flint Street referenced above is excess right -of -way and the vacation of that
portion of the public street conforms to the City's General Plan Circulation Element.
SECTION 2. The Planning Commission finds and determines that the Project is
categorically exempt from the California Environmental Quality Act (Cal. Pub. Res.
Code §§ 21000 et seq.: "CEQA ") and the State Guidelines for Implementation of CEQA
(14 C.C.R. §§ 15000 et seq.: the "CEQA Guidelines ") pursuant to a Class 1 exemption
for existing facilities because the Project involves the vacation of a portion of a street
which involves negligible or no expansion of use. (14 C.C.R. § 15301).
SECTION 3. Based upon all of the evidence presented and the findings above,
the Planning Commission hereby recommends that the City Council find that the
summary vacation of that portion of Flint Street referenced above is consistent with the
City's General Plan Circulation Element.
SECTION 4. This Resolution shall take effect from and after the date of its
passage and adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Lake Elsinore, California, this 21 st day of April, 2009.
