SUBJECT: CONSIDERATION OF MODIFICATION, SUSPENSION, AND /OR
REVOCATION OF CONDITIONAL USE PERMIT NO. 2001 -05
FOR THE LAKE ELSINORE MOTOCROSS FACILITY

Discussion
On July 6, 2010, the Planning Commission held a public hearing to discuss the status of
remaining outstanding conditions of approval with the applicant and property owner in
association with Conditional Use Permit No. 2001 -05. However, neither party attended
the hearing. At that time, staff informed the Commission that the applicant, Randy Hiner,
had closed the facility. Furthermore, the Commission was informed that Mr. Hiner was
in discussions with various potential operators regarding the purchase of the facility.
Subsequently, the Commission voted to continue the hearing to tonight to allow for
ownership negotiations to continue.
Since that time, staff has not heard directly from Mr. Hiner or the property owner
regarding the status of the facility or the outstanding conditions. However, staff has met
with a potential operator and there could be others under consideration. Therefore, staff
recommends that the Commission continue the item to allow additional time for potential
operators to perform their due diligence.

Recommendation
1. Staff recommends that the Planning Commission continue the public hearing to
September 7, 2010.
