COURY, PLANNING CONSULTANT SUBJECT: UNIFORM SIGN PROGRAM NO. 2009 -01, FOR CANYON HILLS MARKET PLACE APPLICANT/ SUDBERRY PROPERTIES, INC., 5465 MOREHOUSE DRIVE OWNER: SUITE 260, SAN DIEGO, CA 92121 Project Request The applicant is requesting approval of Uniform Sign Program No. 2009 -01 to amend the existing "Canyon Hills Market Place Uniform Sign Program" to allow for two (2) additional monument signs to be placed along Railroad Canyon Road and Canyon Hills Road. The proposed monument signs are no higher than six -feet (6') in height and are consistent with the existing signs in the immediate area. Review is pursuant to the applicable Chapters of the Lake Elsinore Municipal Code (LEMC), and the Canyon Hills Specific Plan. Project Location The project Site is located at the Canyon Hills Market Place Shopping Center, at the intersection of Railroad Canyon Road and Canyon Hills Road within Planning Areas 3 and 4 of the Canyon Hills Specific Plan. Environmental Setting The Site is located within the Canyon Hills Specific Plan. The Site is bounded by Open Space to the north, east and south, and vacant multifamily residential land (Planning Areas 1 and 2) to the west. PC March 2, 2010 Item No. 3 Page 1 of 9 PLANNING COMMISSION STAFF REPORT UNIFORM SIGN PROGRAM NO. 2009-01 Project I Canyon Hills I C -1 & C -2 (Neighborhood I Canyon Hills Specific Plan Site Market Place and General Commercial North Vacant OS (Open Space) Canyon Hills Specific Plan South Vacant OS (Open Space Canyon Hills Specific Plan East Vacant OS (Open Space) Canyon Hills Specific Plan West Vacant MF1 & MF2 (Multifamily Attached Residential) Canyon Hills Specific Plan Project Description The applicant requests approval to amend the "Canyon Hills Market Place Uniform Sign Program" to allow for two (2) additional monument signs to be placed along Railroad Canyon Road and Canyon Hills Road respectively. The objective of the proposed sign program is to provide standards and specifications regarding quality, composition, size and placement of the additional monument signage in order to ensure consistency throughout the Canyon Hills Market Place. Analysis The proposed sign program is consistent with the goals and objectives of Chapter 17.94 of the Lake Elsinore Municipal Code and the Canyon Hills Specific Plan in that it will avoid the indiscriminant and substandard assembly, locations, illumination, coloring and size of two (2) additional monument signs and will mandate proper maintenance within the Canyon Hills Market Place (Exhibit "B "). Additionally, the amendments comply with all applicable sections of the existing sign program for the Canyon Hills Market Place. Environmental Determination Pursuant to the California Environmental Quality Act, (CEQA), this project has been deemed exempt pursuant to CEQA Guidelines Section 15311(a). Section 15311 exempts projects that consist of construction, or replacement of minor structures accessory to existing commercial, industrial, or institutional facilities, including but not limited to on- premise signs. The proposed sign program involves the permitting of a private structure and topographical feature, the sign. The sign program involves a negligible expansion of use beyond the use which was originally permitted. Exhibits: 'A': Vicinity Map `B': Sign Program PC March 2, 2010 Item No. 3 Page 3 of 9 RESOLUTION NO. 2010- RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING UNIFORM SIGN PROGRAM NO. 2009 -01 WHEREAS, Sudberry Properties Inc., has initiated proceedings for Uniform Sign Program No. 2009 -01 to amend the existing Canyon Hills Market Place Uniform Sign Program (the "Uniform Sign Program "), which is generally located at the Canyon Hills Market Place shopping center, at the intersection of Railroad Canyon Road and Canyon Hills Road, within Planning Areas 3 and 4 of the Canyon Hills Specific Plan (the 'Property "); and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of approving Uniform Sign Programs; and WHEREAS, on March 2, 2010, at a duly noticed public hearing, the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has considered the Uniform Sign Program prior to taking action on the application. The Planning Commission hereby finds and determines that the Uniform Sign Program conforms to all requirements set forth in Chapter 17.94 of the Lake Elsinore Municipal Code and the Canyon Hills Specific Plan. SECTION 2. The California Legislature has determined that certain classes of projects do not have a significant effect on the environment and are therefore exempt from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA ") and the State Guidelines for Implementation of CEQA (14 C.C.R. §§ 15000 et seq.: the "CEQA Guidelines "). A Class 11 exemption exists for: "Construction or replacement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including but not limited to: (a) On- premise signs; (b) Small parking lots; (c) Placement of seasonal or temporary use items . . . in generally the same locations from time to time in publicly owned parks, stadiums, or other facilities designed for public use." The Uniform Sign Program qualifies for a Class 11 exemption because it involves the construction of two (2) additional on- monument signs that are appurtenant to an existing commercial facility; the "Canyon Hills Market Place" shopping center. PC March 2, 2010 Item No. 3 Page 4 of 9 PLANNING COMMISSION RESOLUTION 2010 - PAGE2OF4 Therefore, the Planning Commission hereby finds and determines that the Uniform Sign Program is exempt from CEQA and the CEQA Guidelines. SECTION 3. That in accordance with State Planning and Zoning law and the City of Lake Elsinore Municipal Code, the Planning Commission makes the following findings for the approval of the Uniform Sign Program: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The Uniform Sign Program complies with the goals and objectives of the General Plan and the Canyon Hills Specific Plan in which the "Canyon Hills Market Place" shopping center is located. The Uniform Sign Program will assist in achieving the development of a well - balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses, thereby diversifying Lake Elsinore's economic base. Moreover, the Uniform Sign Program will facilitate the efficient and orderly use of the proposed signs for the purpose of attracting new and returning customers to participating businesses. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The Uniform Sign Program for the "Canyon Hills Market Place" shopping center is appropriate to the site and surrounding developments in that the Uniform Sign Program has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further, the Uniform Sign Program will complement the quality of existing development and will create a visually pleasing, non - detractive relationship between the proposed and existing projects in that the architectural design, color and materials and design of the two (2) proposed monument signs are evidence of a concern for quality and originality. 3. Subject to the attached conditions of approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. The Uniform Sign Program was reviewed and conditioned by all applicable City departments to ensure that the Uniform Sign Program blends into existing development, creates the least amount of disturbance, and does not negatively impact the residents or businesses of Lake Elsinore. The Uniform Sign Program will not result in any significant adverse environmental impacts. PC March 2, 2010 Item No. 3 Page 5 of 9 PLANNING COMMISSION RESOLUTION 2010-, PAGE 3 OF 4 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to Lake Elsinore Municipal Code Section 17.82.070, the Uniform Sign Program has been scheduled for consideration by the Planning Commission at its regularly scheduled meeting on March 2, 2010. SECTION 4. Based upon all of the evidence presented, the above findings, and the conditions of approval imposed upon the Uniform Sign Program, the Planning Commission hereby approves Uniform Sign Program No. 2009 -01. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the environmental documentation, or Uniform Sign Program No. 2009 -01. 2. The decision of the Commission shall be final ten (10) days from the date of the decision unless an appeal has been filed with the City Council pursuant to the provisions of Chapter 17.80. 3. Prior to issuance of any sign permit the applicant shall sign and complete an "Acknowledgement of Conditions" form and shall return the executed original to the Planning Division for inclusion in the case records. 4. The applicant shall apply for a sign permit and pay appropriate fee for any sign installed at the project site. 5. The location, size, style, and color for all signs shall comply with the Sign Program (Approved herein) and the Canyon Hills Market Place Sign Program. Any additions or revisions to the proposed Sign Program shall require Planning Division review and approval. 6. No portion of the proposed monument sign shall be located closer than five feet (5') to any property line, nor be located in such a manner as to constitute a hazard to pedestrian or vehicular traffic. 7. The approval for Uniform Sign Program No 2009 -01 will lapse and be void unless building permits are issued within two (2) years. 8. Any alteration or expansion of this Sign Program approval shall be reviewed according to the provisions of Chapter 17.94 (Signs- Advertising Structures) of the Lake Elsinore Municipal Code and the Canyon Hills Specific Plan. 9. All exterior sign lighting shall be reviewed and approved by the Community Development Director or designee.
