Regarding: Conversations with Warren regarding the general plan, zoning and the
implementation of zoning, regarding above listed property. CITY CLERKS OFFI(
10/17/11 1 Brian Dahl went to the City of Lake Elsinore today and meet with Cordy and Warren
to discuss the current zoning of my property. I mentioned to them that 1 have a Doctor
who is interested in buying my building and conducting his medical practice there.
My building was built out and designed for a doctor office years ago. A doctor Grant
had his practice there up until 2000. The current zoning is CP or Commercial Park
which is very restrictive as far as finding tenants or buyers for the property. I have a
doctor who is interested in my property and thinks it would be ideal for his practice BUT:
1) The CP zoning does not allow medical, even with a CUP (conditional use permit)
2) 1 was told by Warren (and others from the City) that when the General Plan is
approved and final, my property location is in the land use designation for
General Commercial (which allows for medical, dental and health related services)
The problem that I have, and the extreme frustration that I have with the City is that
I and others where led to believe that when the General Plan for the City was complete
and approved, the approved zoning on the maps that we've been shown for years,
would be implemented by the City. How do I know this to be true, well - approx. 2 years
ago people where getting up at City council meetings and voicing their frustration that
their zoning was going to be changed by the City to a less desirable zone or land use
designation. The City Never stopped and said the changes were not going to be
implemented. That was the reason why so many spoke up at the meeting and voiced
their extreme frustration.
In talking with Warren at the City counter on 10/17/11 he shocked me, in telling me
that I would have to implement the zone change myself and at a cost of 5000.00
dollars. He also told me that the zone change would have to be reviewed by council
for possible approval.
I also talked to Warren today 10/18/11 on the phone asking him if he could provide
me with some sort of assurance in writing that I could give to the Doctor, the interested
buyer of me property. Warren told me he could not help me or give me anything in
writing, that would help the Doctor to decide to buy my property, even though
my properties land use designation will be General Commercial according to the City.
The problem or frustration that myself and other have is when we're led to believe that
when the General Plan is complete and approved, that's it, the changes will be
implemented by the City and it's done. But come to find out, it's not going to be done,
it's just the beginning of another process that may be approved and is going to
cost you at least 5000.00 dollars.
If anyone who reads this letter can help me in any sort of way I would appreciate it.
The seemingly endless restrictions and regulations I'm up against have got me at
a point of frustration to say the least. Thanks for your help!!!
