REPORT TO THE PLANNING COMMISSION TO: HONORABLE CHAIRPERSON AND MEMBERS OF THE PLANNING COMMISSION FROM: WARREN MORELION, AICP PLANNING MANAGER DATE: SEPTEMBER 6, 2011 SUBJECT: RESIDENTIAL DESIGN REVIEW NO'S 2006 -13, 2009 -03, & 2010 -05 (MODIFICATION) — A REQUEST TO CHANGE THE CONDITIONS OF APPROVAL PERTAINING TO HOURS OF CONSTRUCTION OPERATION FOR THE PARDEE HOMES PROJECTS LOCATED WITHIN PHASE 5 OF THE CANYON HILLS SPECIFIC PLAN APPLICANT /: PARDEE HOMES, 10880 WILSHIRE BOULEVARD, SUITE OWNER 1900, LOS ANGELES CA 90024 Project Request/Location The applicant is requesting to change conditions of approval associated with Residential Design Review No's. 2006 -13, 2009 -03, and 2010 -05 located within Phase 5 of the Canyon Hills Specific Plan (ref. Vicinity Map). Background The condition of approval relating to the identified projects currently limits hours of construction to Monday through Friday from 7:00am to 5:00pm, with no construction activity on weekends or holidays. The origin of this condition began is the early 2000's when several merchant builders were constructing in -fill tract developments throughout the City. The condition was intended to limit hours of construction to reduce potential impacts (i.e. noise, construction traffic, etc) on adjacent or nearby residents. It should be noted that the Lake Elsinore Municipal Code (LEMC) (see Attachment 4) allows for construction activity to occur between the hours of 7:00am to 7:00pm, Monday through Saturday. The applicant is requesting to amend their conditions to allow for construction on Saturday's, consistent with the LEMC. Pardee will keep the same approved hours of construction (Monday through Friday from 7:00am to 5:00pm) and to include Saturday hours from 8:00am to 5:00pm. In addition, the Saturday construction activities would be lot specific, and not allow mass or rough grading, offsite land development, or large PC September 6, 2011 Item No. 3 Page 1 of 2 Planning Commission Staff Report Pardee Homes Hours of Construction September 6, 2011 material deliveries. Pardee would also agree to limit this amendment for only the remaining homes in the Silverthorne and Living Smart product areas in Phase 5 (ref. Attachment 2; Phase 5 Plotting Map). Any future proposed home products would be subject to new conditions adopted by the Planning Commission at the time of approval. On July 26, 2011, Pardee discussed construction hours with the Canyon Hills Home Owner's Association and received very little discussion at the meeting. In addition, Pardee has informed staff that each homeowner was notified that construction activities will be performed on Saturday's in their individual disclosures at the time they purchase their home. Staff has also sent out notices to all property owners within 300 feet of the site, regarding the request. To date, staff has received no comments. Analysis Given the fact that the applicant has conducted proper community outreach, and that staff has not received complaints or objections relating to the public hearing notice, and that the condition modification to add construction activity on Saturdays, is consistent with the Municipal Code, staff has no objection to the applicant's request. Recommendation It is recommended that the Planning Commission approve the requested changes to conditions relating to construction hours and activity for RDR No.'s 2006 -13, 2009 -03, and 2010 -05 to read as follows: Provisions of the City's Noise Ordinance shall be satisfied during all site preparation and construction activity. Site preparation activity and construction shall not commence before 7:00am and shall cease at 5:00pm, Monday through Friday, or 8:00am and 5:00pm on Saturday.
