PROJECT REQUEST
The applicant is requesting approval of a Conditional Use Permit to establish live
entertainment at the Lake Elsinore Hotel and Casino located at 20930 Malaga Road.
Section 124.02.030 of the Lake Elsinore Municipal Code specifies the requirement of an
approved Conditional Use Permitforthe establishment of "Live Entertainment'. The project
review is pursuant to Chapters 17.124 (C2- General Commercial District), Chapter 17.168
(Conditional Use Permit) and 17.176 (Noise Control) of the Lake Elsinore Municipal Code
(LEMC).

PROJECT DESCRIPTION
The live entertainment proposed will consist of live music, dancing, and entertainment
venues within the lounge, restaurant, and poolside area of the existing casino building on
the Lake Elsinore Hotel and Casino property. The events are scheduled to take place on
Friday, Saturday and Sunday evenings, with occasional performances on other days during
the week that fall on holidays.
The activities proposed are as follows:
Lounge The lounge will offer soloist (singer /musician) performances and comedian
acts. The events are scheduled to conclude by 2:00 a.m. The lounge has a
maximum occupancy load of 41 people.
Restaurant The restaurant will offer an array of live music including blues, jazz,
country, rock -n -roll, and soloist (singer /musician) performances. The events are
scheduled to conclude by 2:00 a.m. The restaurant has a maximum occupancy load
of 116 people.
Poolside The poolside area will also offer blues, jazz, country, rock -n -roll, and
soloist (singer /musician) performances. The entertainment will come to an end
outdoors by 11:30 p.m. to allow time for clean up by 12:00 a.m. The area around
the pool is approximately 7,000 square feet with a maximum occupancy load of 100
people (self imposed by the hotel).

ANALYSIS
The live entertainment performances are proposed to take place in the casino's lounge,
restaurant, and poolside area. The entertainment will be held on Friday, Saturday and
Sunday nights from approximately 6:00 p.m. to 11:30 p.m. in the poolside area, and until
2:00 a.m. inside the lounge and restaurant. Occasionally there will be other events during
the week that fall on holidays. A description of the business operation that was provided by
the applicant has been attached for reference (Attachment 6).
No overlap of events is expected to occur within the casino building. The lounge,
restaurant, and pool area where the live entertainment is requested are separate and will
not be used in conjunction with each other. Special attention has been given to the request
for live entertainment in the poolside area, given that the performances will be held outside
and at night. The applicant has provided decibel (dBA) readings (as shown in the table
below) that display the noise levels generated by the "DJ" music system currently taking
place within the pool area in an effort to estimate the noise levels of future live
entertainment that could potentially impact adjacent residential neighbors to the east
across Malaga road in the City of Wildomar. The closest residence is approximately 320
feet away from the pool area. The noise readings show the exterior decibels (dBA)
generated by the DJ sound system on Saturday, July 9, 2011 at 9:30 p.m. and 10:30 p.m.
to be between 30 and 33 decibels along Malaga Road. These noise levels comply with the
Lake Elsinore Municipal Code (Chapter 17.176 — Noise Control) of 40 (dBA) for residential
districts between the hours of 10:00 p.m. and 7:00 a.m. Between the hours of 7:00 a.m.
and 10:00 p.m. the noise level permitted is 50 decibels. Staff has also contacted the Code
Enforcement Division and the Police Department to see if there were any complaints
against the Casino related to noise or loitering. There were no complaints or calls for
service registered to either department.

On July 13, 2011, staff received a letter from a resident in the area addressed to the Mayor
and City Council Members in opposition to the proposed use (see Attachment 7).
Specifically, the resident was concerned with the noise levels that will be generated by the
live entertainment. In the letter the resident states she "...experiences disturbances year
round and in the evening during the summer months occasionally due to laud music from
pool parties at the Lake Elsinore Casino pool area." In addition, the resident was
concerned with safety in the area. She referenced a nightwhen, aftera pool party, she was
approached by a man while she was watering her lawn and felt very unsafe.

Staff contacted the applicant to see if he received any complaints regarding previous
outdoor entertainment, and to see if he could adjust his outdoor entertainment activities to
reduce potential impacts to adjacent properties. The applicant informed staff that he had
not received any complaints as a result of the outdoor entertainment in the past 1.5 years
since he has been involved with the casino. In addition, the applicant clarified that the live
entertainment is proposed to occur no more than twice a month during the summer only
(Memorial Day weekend to Labor Day weekend), with the limited exception for some
holidays. The applicant was hesitant to modify the proposed request because the days and
times proposed are essential to the success of the live entertainment activities. However,
the applicant did say that the amount of live entertainment outside would be reduced in the
future when the casino remodel is complete. The expansion has been started but has been
on hold for the past couple of years due to financing. The applicant also indicated that he
verifies noise levels generated as part of every entertainment activity conducted outdoors,
and would continue to do so as part of this proposal.
While the applicant appears to have met the outdoor noise standards in the past, and that
there have been no Code Enforcement/Police Department complaints, staff is still
uncomfortable with allowing live entertainment outside until 11:30 p.m. Therefore, staff is
requiring that all outdoor events end by 10:00 p.m. (Condition 13). In addition, in an effort
to ensure limiting the potential impacts to adjacent properties and residents, staff has
conditioned the project as follows: noise levels must meet the 40 decibels (dBA) for
residential zones between 10:00 p.m. to 7:00 a.m. and 50 decibels between 7:00 a.m. to
10:00 p.m. (Condition 11); live entertainment may only take place during the summer,
starting on Memorial Day weekend and concluding on Labor Dayweekend (Condition 10);
no loitering is permitted in or around the business (Condition 12); ongoing noise
measurements shall be conducted by the applicant around the facility during outdoor
entertainment activities to ensure permitted noise levels are not exceeded (Condition 19);
maximum occupancy and security shall be as outlined in Conditions 17.
Staff believes the proposed use, as conditioned, will meet all applicable development
standards and criteria outlined in Chapters 17.124 (C2- General Commercial District),
Chapter 17.168 (Conditional Use Permit) and 17.176 (Noise Control) of the Lake Elsinore
Municipal Code (LEMC). To verify that the use will meet all noise and operational
requirements after it is in operation, staff is recommending that the project be reviewed by
the Director of Community Development at the end of September, or if the operation
triggers concerns by the adjacent property owners /residents related to parking, noise,
traffic, or other impacts, the Conditional Use Permit may be referred back to the Planning
Commission for review.
ENVIRONMENTAL DETERMINATION
Staff has determined that the proposed Conditional Use Permit is categorically exempt
from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.:
"CEQK) and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.), specifically pursuant to
Section 15301 (a) (Existing Facilities). The Project proposes to establish "Live

Entertainment' within an existing Hotel and Casino establishment.
RECOMMENDATION
a. Adopt Resolution No. 2011 -_ permitting the proposed live entertainment within
the lounge, restaurant, and poolside area of the existing Lake Elsinore Hotel and
Casino property, based on the Findings, Exhibits, and proposed Conditions of
Approval.

RESOLUTION NO. 2011-
RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT NO. 2011 -01.
WHEREAS, Greg Barton, Director of Operations, Lake Elsinore Hotel and
Casino, has initiated proceedings to request the approval of Conditional Use Permit No.
2011 -01 (the project) for the establishment and operation of a live music, dancing, and
entertainment venue within the lounge, restaurant, and poolside area of the existing
Lake Elsinore Hotel and Casino located at 209030 Malaga Road. The site is within the
(C2) General Commercial zoning district and has a General Plan Land Use designation
of Neighborhood Commercial (NC); and
WHEREAS, the City of Lake Elsinore recognizes that certain uses have
operational characteristics that, depending upon the location and design of the use, may
have the potential to negatively impact adjoining properties, businesses or residents
and therefore are permitted subject to the issuance of a conditional use permit, which
allows the City to comprehensively review and approve the use; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has
been delegated with the responsibility of considering and approving, conditionally
approving, or denying conditional use permits; and
WHEREAS, on July 19, 2011 at a duly noticed public hearing, the
Planning Commission considered evidence presented by the Community Development
Department and other interested parties with respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed
Conditional Use Permit No. 2011 -01 prior to rendering its decision and finds that the
requirements of Chapter 17.168 of the Lake Elsinore Municipal Code have been
satisfied.
SECTION 2. The Planning Commission hereby finds and determines that
Conditional Use Permit No. 2011 -01 is categorically exempt from the California
Environmental Quality Act (Public Resources Code §§ 21000 et seq.: "CEQA ") and the
Guidelines for Implementation of CEQA (14 California Code of Regulations §§ 15000 et
seq.: "CEQA Guidelines ") pursuant to Section 15301 (Class 1) (Existing Facilities)
categorical exemption.
SECTION 3. That in accordance with State Planning and Zoning Law and
the Lake Elsinore Municipal Code, the Planning Commission makes the following
findings for approval of CUP No. 2011 -01:

1. The proposed use, on its own merits and within the context of its
setting, is in accord with the objectives of the General Plan and the purpose of
the planning district in which the site is located.
Issuance of this Conditional Use Permit for "Live Entertainment' will facilitate the
creation of a well balanced and functional mix of residential, commercial,
industrial, open space, recreational and institutional land uses. The proposed
land use conforms to the objectives of the General Plan and the planning district
in which the site is located.
2. The proposed use will not be detrimental to the general health,
safety, comfort, or general welfare of persons residing or working within the
neighborhood of the proposed use or the City, or injurious to property or
improvements in the neighborhood or the City.
All applicable City departments and agencies have been afforded the opportunity
to review the use permit and their comments have been addressed in the
conditions of approval attached to the staff report for this Conditional Use Permit
for "Live Entertainment' conditions have been applied relating to the proposed
use, so as to eliminate any negative impacts to the general health, safety,
comfort, or general welfare of the surrounding industrial development or the City.
3. The site for the intended use is adequate in size and shape to
accommodate the use, and for all the yards, setbacks, walls or fences,
landscaping, buffers and other features required by Title 17 of the Lake Elsinore
Municipal Code.
The proposed Conditional Use Permit is for "Live Entertainment' for the existing
Lake Elsinore Hotel and Casino located at 20930 Malaga Road. Staff has
determined that the proposed use will compliment the existing uses, based on
the submitted plans and attached conditions of approval. .
4. The site for the proposed use relates to streets and highways with
proper design both as to width and type of pavement to carry the type and
quantity of traffic generated by the subject use.
The proposed "Live Entertainment' for the existing Lake Elsinore Hotel and
Casino located at 20930 Malaga Road has been reviewed in relation to the width
and type of pavement needed to carry the type and quantity of traffic generated.
The City has analyzed the proposed parking for the site against Chapter 17.148
(Parking Requirements) of the Lake Elsinore Municipal Code (LEMC) and based
on the submitted plans and the attached conditions of approval, has determined
that the proposed use will meet all requirements of Chapter 17.148 of the LEMC.
5. In approving the subject use, there will be no adverse affect on
abutting property or the permitted and normal use thereof.

The Conditional Use Permit has been thoroughly reviewed and conditioned by all
applicable City departments thereby eliminating the potential for any adverse
effects.
6. Adequate conditions and safeguards pursuant to Lake Elsinore
Municipal Code Section 17.168 have been incorporated into the approval of the
Conditional Use Permit to insure that the use continues in a manner envisioned
by these findings for the term of the use.
Pursuant to Lake Elsinore Municipal Code Section 17.168, the proposed "Live
Entertainment' use has been scheduled for consideration and approval of the
Planning Commission at the regularly scheduled meeting on July 19, 2011.
SECTION 4. Based upon the evidence presented, the above findings,
and the attached conditions of approval, the Planning Commission hereby approves
Conditional Use Permit No. 2011 -01.
SECTION 5. This Resolution shall take effect from and after the date of
its passage and adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning
Commission of the City of Lake Elsinore, California, this 19` of July 2011.

GENERAL CONDITIONS
The applicant shall defend (with counsel acceptable to the City), indemnify, and
hold harmless the City, its Officials, Officers, Employees, and Agents from any
claim, action, or proceeding against the City, its Officials, Officers, Employees or
Agents to attach, set aside, void, or annul an approval of the City, its advisory
agencies, appeal boards, or legislative body concerning Conditional Use Permit
No. 2011 -01 located at 20930 Malaga Road, also known as (APN: 365- 040 -016).
2. The applicant shall submit a check in the amount of $64.00 made payable to the
County of Riverside for a Notice of Exemption. The check shall be submitted to the
Planning Division for processing within 48 hours of the projects approval.
3. The decision of the Planning Commission shall be final fifteen (15) days from the
date of the decision, unless an appeal has been filed with the City Council
pursuant to the provisions of Chapter 17.192 of the Lake Elsinore Municipal Code.
4. Prior to commencement of the proposed use, the applicant shall sign and complete
an "Acknowledgement of Conditions Form," and shall return the executed original
to the Community Development Department for inclusion in the case records.
The Applicant is to meet all applicable City Codes and Ordinances.
The Conditional Use Permit approved herein shall lapse and shall become void
one (1) year following the date on which the use permit became effective, unless
prior to the expiration of one (1) year a building permit is issued and construction
commenced and diligently pursued toward completion on the site.
The Conditional Use Permit shall comply with all applicable requirements of the
Lake Elsinore Municipal Code, Title 17 unless modified by approved Conditions of
Approval.
8. The Conditional Use Permit granted herein shall run with the land and shall
continue to be valid upon a change of ownership of the site or structure which was
the subject of this approval.

9. An application for modification, expansion or other change in a conditional use
permit shall be reviewed according to the provisions of the Lake Elsinore Municipal
Code, Title 17 in a similar manner as a new application.
10. The "Live Entertainment' shall only take place twice a month during the summer,
starting on Memorial Day weekend and concluding on Labor Day weekend.
11. The noise level generated by the outdoor "Live Entertainment' shall conform with
the applicable noise levels allowed under Section 17.176; Noise Control.
a) Residential Zones. At any residential property boundary the noise level
shall not exceed 40 decibels (dBA) between 10:00 p.m. to 7:00 a.m.
and 50 decibels between 7:00 a.m. to 10:00 p.m.
b) Commercial Zones. At any commercial property the noise level shall
not exceed 60 decibels (dBA) between 10:00 p.m. to 7:00 a.m. and 65
decibels between 7:00 a.m. to 10:00 p.m.
12. There shall be no loitering in or around the business.
13. Hours of operation for the "Live Entertainment' shall conclude by 10:00 p.m. for all
of the poolside area events and by 2:00 a.m. for the lounge and restaurant events
as indicted on the staff report. In the event the applicantloperator proposes to
modify the hours of operation, the modification shall be subject to the review of the
Community Development Director. The Community Development Director may
approve the modification or refer the matter to the Planning Commission if judged
to be substantial.
14. The Lake Elsinore Hotel and Casino may continue with their regular business
hours.
15. The project shall be reviewed by the Director of Community Development at the
end of September 2011. If the operation of this use triggers concerns related to
parking, noise, traffic, or other impacts, this Conditional Use Permit may be
referred back to the Planning Commission at the discretion of the Community
Development Director for subsequent review. If necessary, the Commission may
modify or add conditions of approval to mitigate such impacts, or may revoke said
Conditional Use Permit.
16. The "Live Entertainment' use shall operate in compliance with all applicable laws
associated with this use.
17. The "Live Entertainment' use shall conform with the minimum age limit and
maximum occupancy as follows:

a) All attendees must be over 21 years of age.
b) Poolside area shall not exceed more than 100 people (self imposed by
the hotel).
c) The lounge shall not exceed more than 41 people.
d) The restaurant shall not exceed more than 116 people.
e) Security personnel must be present at all times.
f) The applicant can only have one event at one location, on any given
day.
18. The applicant shall comply with all conditions of approval prior to commencement
of the proposed use.
19. A copy of these conditions of approval shall be kept on site at all times and shall be
made available for review to any government official conducting official business.
20. The applicant shall conduct continuous noise measurements during all outdoor
entertainment activities to ensure the noise levels do not exceed the maximum
levels allowed.
21. The owner, manager, or person in charge of the establishment shall be 21 years or
older. At least one person shall be present on the premises during all business
hours of operation.
22. The Planning Commission reserves the right to hold a public hearing to consider
the revocation of the permit, or the imposition of the additional conditions, if the
Planning Commission determines that such action is warranted.
BUILDING AND SAFETY DIVISION
23. Any and all existing or proposed floor plan changes within the proposed "Live
Entertainment' areas shall be made accessible in accordance with Americans with
Disabilities Act (ADA) requirements.
RIVERSIDE COUNTY SHERIFF DEPARTMENT
23. The applicant/operator shall comply with all requirements of the Riverside County
Sheriffs Department.
RIVERSIDE COUNTY FIRE DEPARTMENT

Subject: Conditional Use Permit
We are requesting a conditional use permit for the Lake Elsinore Hotel and Casino to have a live
entertainment performances in our lounge, restaurant or poolside for our guests. We have enclosed a
site plan for your review and consideration.
Typically, live entertainment is limited to Friday, Saturday and Sunday evenings with the exception of
special events. We plan to utilize three servers for food and cocktails. As well, we dedicate two armed
on staff security guards for the events. Typically, attendance would not( ,exceed 100 people throughout
the course of the evening. The pool area in question consists of 7200, square feet and can sustain a
larger attendance not to exceed legal capacities. We are requesting your maximum occupancy
recommendation per code to ensure proper compliance. All attendeesare carded to ensure a 21 and
over only policy. As well, we have three additional armed guards on staff the evenings in question for a
total of five security personnel on the property.
The bands are responsible for dance lighting in the designated dance areas. They will perform four forty
five minute sets with three fifteen minute breaks. This will allow us to conclude the events
entertainment by 11:30 pm and be closed by midnight from an exterior perspective. Indoor
entertainment will always conclude prior to two in the morning. The ve ue consists of classic rock -n -roll
or Country and Western music and dance hits performed by professional studio musicians.

All food is prepared in our kitchen and is available for carryout only in Styrofoam boxes with plastic
service ware. No glass is allowed poolside. All alcoholic beverages are served from our bar in plastic 9oz.
or 16oz. see through plastic from an exterior perspective. Indoors, we serve all alcoholic beverages in
quality glassware.
We provide convenient men's and women's restrooms at the pool entrance from the hotel. We dedicate
two hotel rooms, properly identified for their convenience. This corridor also provides convenient access
to the casino, bar and restaurant areas of the property. Indoors we have two convenient restroom
facilities available to the public.
We have 95 available hotel rooms for our guests and provide discounted rates for players and event
participants to promote a safe event atmosphere.
In closing, we have ample parking to accommodate maximum capacity though out the pool, casino,
restaurant, hotel and lounge. No overflow scenarios exist that would create concerns related to our
parking field. As well, it is well lit and security cameras exist. We have enclosed copy of our occupancy
calculations from the City of Lake Elsinore Building and Safety for your review.

Dear Mayer and City Council Members 7/13/2011
There will be a public hearing July 19` at 6:00 pm located at 183 Main St. This
hearing is to allow the Lake Elsinore Casino to have live music. This will certainly be
very loud if not properly thought out. It is well known that low frequency base levels can
travel long distance. Live music can vibrate the walls of a house and keep one up until
wee hours of the morning.
The reason I am concerned is that the Lake Elsinore Casino is located across the
street from my home and entire neighborhood. We have already experience disturbances
year round and in the evenings during the Summer months occasionally due to loud
music from pool parties at the Lake Elsinore Casino pool area. Other disturbances include
late night foot traffic in our residential area and it is very scary.
For Example: One very hot evening the pool party finally shut off their music. After
several hours of lying awake waiting for them to shut down I was restless and couldn't go
back to sleep. I decided to get up and water my lawn. While doing this a patron from the
Casino approached my fence and it scared me. I was alone. He told me he just left the
Casino and wanted to know if I wanted to get high.
I would also like to mention that the map Lake Elsinore provided shows the Wildomar
boundary as vacant. I see no mention of the millions of dollars of residential property
that borders the Lake Elsinore Casino. I find this map very misleading. One would
assume that this is vacant property.
I moved to the city of Wildomar two years ago. Elsinore previously claimed this
boundary that was very recently annexed by Wildomar. Elsinore city must know there are
homes in this track. I intend on staying in my home for the rest of my life. I will retire
here and stay a member of the community. If the Lake Elsinore Cassino is allowed to
have a live music permit they will certainly exceed the noise level that is expectable in
any neighborhood. I don't think any council member would want live music at night
when they are trying to sleep and work pay taxes and be happy. I am afraid there will be
no peace and no quite. There will be no peaceful week ends and no rest full sleep for me
or my neighbors.
I ask you to please help us feel safe in our homes at night and even in our own yards. I
accept the Casino the way it is. I have had dinners there many times over the past years. I
except that they have their own traffic. I just think that this request is too much to ask for
especially due to their choice of bordering (within 100') a residential track. "
Please support this letter and reply to the city of Lake Elsinore regarding this public
hearing. I will be attending the hearing and speak in person. I am very worried. Sincerely,
