Planning Consult t Donahoe provided the Commission with a brief summary of the
project. , She stated that staff recommends approval of the project and the 'applicant
would be available to answer any questions the Commission may have. She noted
that she received a phone call from an owner in the Caraway neighborhood who felt
that the homes would affect her property value, and opposed the Centex project.
Jane Blasingham, applicant, spoke of the new product being presented to the
Commission for approval. 'She noted the prices have been reduced due to the
market conditions. She indicated the architectural design is similar to the other
product with the colors, materials and style.

Marcy Wilson, resident expressed her concern with all of the foreclosures in her
neighbor. She also mentioned that with, all of the current development they should
consider having a park or recreation center in the area.

Project Reauest
The applicant is requesting design review consideration of three (3) conventionally built two
(2) story single-family dwelling units located on Ar~old Avenue. Project review is pursuant
to Chapter 17.23 (R-1, Single-Family Residential), Chapter 17.82 (Design Review),
Chapter 17.14 (Residential Development Stariaards), and Chapter 17.66 (Parking
Requirements) of the Lake Elsinore Municipal Cdde (LEMC).

Water Availability/Fire Flow
The applicant provided staff with a "'Will Serve"iJetter from the Elsinore Water District
(EWD) that indicates that the project can be provided with sufficient water and fire flow:
protection. According to the letter, there is a "Dry::Barrel "hydrantlocated approximately .
(325') to the nearest point of the proposed development and that a minimum fire flow of .
1100 GPM for a two (2) hour duration at a twenty (20) PSI residual will be provided. (See <

Furthermore, the Elsinore Valley Municipal Water District (EVMWD) provided a map to
staff on November 4, 2008 indicating that service to public sewer is not available to the
subject parcels, with the nearest connection point at the intersection of Dryden Street and
Lakeshore Drive which is approximately 1800 feet away.

Section 713.4 of the 2001 California Plumbing Code which states:
The public sewer may be considered as not being available when such public sewer
or any building or any exterior drainage facility connected thereto, is located more
than two hundred (200) feet from any proposed building or exterior drainage facility
on any lot or premises which abuts and is served by such public sewer. .
Also, Chapter 16.34 (Required Improvements) of the Lake Elsinore Municipal Code
(LEMC) which states in Section 16.34.040 (D): .
The parcels shall be deemed served by City water and sewer if the distance in feet
from the closest property line to the facility to be extended shall be two hundred
times the number of lots to be developed.
Based on the information presented above the proposed project would not be required to
tie into the public sewer system since the closest existing sewer line is located at the U
intersection of Dryden Street and Lakeshore Drive which is approximately 1800 feet away.
The applicant has submitted a Septic System Feasibility Study for each unit which will be
included as part of the conditions of approval. (See Attachment)

The proposed vacant lots are generally located at the intersection of Dryden Street and
Arnold Avenue. The subject property has a Zoning designation of R-1 (Single Family
Residential) and a General Plan designation of Future Specific Plan "J" (Country Club
Heights #1).

Proiect Description
The applicant is -requesting' minor. design review for the development of three (3) ,
conventionally built two (2) story single-family dwelling units located on Arnold Avenue. The
applicant is proposing two (2) models varying from 2,570 to 2,825 square feet with an ..
attached two (2) car garage. Each unit will have a living room, dining room, kitchen on the
first floor, and each model will either have a den, a library or a bedroom on the first floor.
The second floor will have a full bathroom for the two (2) or three (3) bedrooms depending
on the model, and a masterbedroomwithmaster bathroom and walk-in-c1oset. .

It should be noted that the lot coverage for the proposed dwellings will vary from thirty
(30%) to thirty-three (33%) percent, which is in conformance with the fifty-percent (50%)
maximum allowed for single-family dwelling units as outlined in Chapter 17.23.090 of the
Lake Elsinore Municipal Code (LEMC).

The proposed development of the three single-family dwelling units will be located on
relatively steep slopes; therefore the applicant is' proposing a number of retaining walls up
to six feet (6') high, along the sides and block wall!along the rear of the lots. The proposed
development that will occur on lot 105, which is also referenced as (APN's 378-211-002
and 003), will be subject to a lot merger with the City of Lake Elsinore's Engineering
Division which shall be processed and approved I:!rior to the issuance of a building permit,
which is referenced as conditions of approval number 38 under the Planning Division and.
number 54 under the Engineering Division.

The applicant is proposing to include elements of 'JMonterey" architecture for one (1) of the
proposed dwellings and the other two (2) units will represent "Spanish/Mediterranean"

finally one of the most predominant features which is the Grand Entry porch element with
elaborate columns that connects with the roof on the second floor.
Gradinq
Due to the steep topography of the lot, the applicant will have to include retaining walls
along the interior property lines and block walls along the rear. Staff has added a condition
of approval requiring the applicant to submit revised grading plans indicating that any rear
retaining walls be setback from the main dwelling units a minimum of fifteen-feet (15'), in
order to comply with Section 17.23.0BO(C) (3); of the Lake Elsinore Municipal Code, which
does not allow finished slopes in excess of five percent (5%) within fifteen feet (15') of the
main dwelling unit.
It should be further noted that staff has added a condition of approval indicating that all
retaining walls that will be visible from a public right-of-way either have a stucco finish or
utilize a "split-face" block material. This will assist in providing interest and detail to any
walls that can be seen. from the public right-of-way.

The applicant is proposing to landscape and irrigate the front yards of the proposed
development with trees such as "Indian Laurel and Pine" with a minimum of twenty-four
(24") inch box and a variety of shrubs and turf for the remaining of the front yard area. The
proposed landscape areaswill be automatically irrigated and will include a rain sensor,
which will assist in the conservation of water. The total landscape area for each of the units
will vary from 2,828 square feet to 2,956 square feet which is approximately fifty-seven
(57%) percent to sixty (60%) percent of the lot.

SECTION 1. The Planning Commission has considered the proposed design for
the Project and has. found it acceptable. 1;he Planning Commission finds and
determines that the Project is consistent with thellLake Elsinore Muni.cipal Code.
..SECTION 2. The Planning Commission finds and determines 'that the Project is
categorically exempt from the California Environmental Quality Act (Cal. Pub. Res.
Code SS 21000 et seq.: "CEQA") and the CEOA Guidelines (14 C.C.R. SS 15000 et
seq.) pursuant to a class 3 exemption for "New Construction or Conversion of Small
Structures (14 C.CR S 15303) (a); because the Project involve ttie construction of
three (3) two-story single-family dwelling units Vl(ithin City limits on lots of no more than
five (5) acres, which are surround~d by urban ,uses and have no value as habitat for
endangered, rare or threatened sp~cies. The project will not result in any significant
effects relating.to traffic, noise, air quality, or water quality and the homes can be served
by all required utilities and public services.

The proposed Minor Design Review for the development of three (3) single-family
residential dwelling units to be located on Arnold Avenue complies with the goals
and objectives of the General Plan, in that the approval of this single-family
residence will assist in achieving the development of a well-balanced and functional
mix of residential, commercial, industrial, open space, recreational and institutional
land uses as well as encouraging the development and maintenance of a broad
range of housing types for all income groups and age categories.
2. The project complies with the desigri directives contained in Section 17.82.060 and
all other applicable provisions of the Municipal Code.
The proposed Minor Design. Review for the development of three (3)" single-family
residential dwelling units to be located on Arnold Avenue are appropriate to the site
and surrounding developments in that the single family home has been designed in
consideration of the size and shape of the property, thereby creating interest and
varying vistas as a person moves along the street. Further the project as proposed
will complement the quality of existing development and will create a visually
pleasing, non-detractive relationship between the proposed and existing projects in
that the architectural design, color and materials proposed exceeds the size and
design of the homes in the surrounding area.
3. Subject to the attached conditions of approval, the Project is not anticipated"to result
in any significant adverse environmental impacts.
. A. Class 3 CEQA exemption may be invoked when the development proposal
involves construction of one single family residence. Pursuant to CEQA" Guidelines
15303(a), the Project is exempt from environmental review because it involves the
construction of three single family dwelling units. Therefore, no. further environmental
analysis is required. Notwithstanding the foregoing, however,. the attached
conditions of approval incorporate design features into the ProjeCt which suggest
that the Project will not have a significant effect on trye environm~nt. .
Section 7.3.2 of the MSHCP states that: "[djevelopment of individual single-family
homes on existing parcels, in accordance with existing land use regulations is a
Covered Activity within the Criteria Area," subject to an expedited review process.
Impacts of development of single-family residences on sensitive habitat and covered
species were accounted for in the MSHCP and the MSHCP EIR. The Planning'
Commission hereby finds that the single-family residential development on Arnold
Avenue (APN: 378-211-002 thru 005) was sited on the least sensitive portion ofthe
lot. . Consideration was given "to access, topography/terrain, zoning standards
including setbacks, soil types, presence of earthquake fault lines, leach fields,
" presence of oak trees and high fire hazard areas. The building foot print area is
appropriate and complies with the MSHCP Criteria Area.

Moreover, the Project has been reviewedqy all City divisions and departments,'
which have imposed certain conditions of approval on the Project to ensure that no
adverse impacts occur. In light d,f those conditions of approval, as well as the design
features of the Project itself, the Project will not have a significant effect on the
environment.
4. 'Conditions and safeguards pursl!ant to Sectiqn 17.~2,070, including guarantees and
evidence of compliance with conditions, have'~ been incorporated into the approval of
the subject project to insure development of the property' in accordance with the
objectives of this Chapter and the planning district in which the site is located.
Pursuant to Section 17.82.100 (Minor Design ;Review) of the Lake Elsinore Municipal
Code (LEMC), the proposed Minor Design Review for the development of three (3)
single-family residential dwelling units to be. located on Arnold Avenue has been
scheduled and considered. for approval by the, Planning Commission.
SECTION 4. Based upon the evidence presented, the above findings, and the
Conditions of Approval attached,' the Planning Commission hereby. recommends

required setbacks, and development standards pursuant to the R-1. (Single-Family
Residential), development standards. Any revisions to the Minor Design Review
attached hereto shall be processed in a similar manner as the original Minor
Design Review. All plans submitted for Building Division plan check shall conform
to the submitted plans as modified by the Conditions of Approval.
9. The applicant shall comply with all requirements of the Riverside County Fire
Department.
10. All necessary exterior/ancillary equipment shall be effectively screened from public
view. All proposed screening methods shall be reviewed and approved the
Community Developer Director or designee.

shall be limited to the hours of 7:00 AM to 5:00 PM, Monday through Friday, and

Construction generated dust and erosion shall be mitigated in accordance with the

29. The applicant shall provide assurance that all required fees to the Lake Elsinore
Unified School District have been paid prior to issuance of building permits.
30. The applicant shall pay park-in-Iieu fees in effect at the time prior to issuance of
building permits.
31. The applicant shall provide assurances to the Planning Division that all
requirements and fees of the Riverside County Flood Control and Water
Conservation District .have been met.
32. The applicant shall pay the Multiple Species Habitat Conservation Plan Fee
(MSHCP) Local Development Mitigation Fee (fee for density less than eight (8)
dwelling units/acre) prior to obtaining building permits.

enter into an agreement with the City and the Redevelopment Agency of the City of
Lake Elsinore to provide (a) 15% of the units constructed in the Project as
affordable housing units in accordance with the requirements of Section
33413(b)(2) of the California Community Redevelopment Law (Health & Safety
Code Sections 33000 et seq.), or (b) an alternative equivalent action as
determined by the City which may include (without limitation) dedication of vacant U
land, construction of affordable units on another site, or payment of an in-lieu fee at
the rate of $2.00 per square-foot of assessable space for each dwelling unit in the
Project. For purposes of this condition, "assessable space" means all of the
square-footage within the perimeter of a structure, not including any carport,
walkway, garage, overhang, patio, enclosed patio, detached accessory structure,
or similar area... The amount ,of the square-footage within the perimeter of a
residential structure shall be calculated by the building department of the City in
accordance with the standard practice of the City in calculating structural ..

34. Prior to the issuance of a building permit the Applicant shall obtained and submit a
"Will Serve" letter from Elsinore Water District to the satisfaction of the Director of
Community Development. The "Will Serve~ letter shall specifically indicate the

applicant shall contribute to protection of storm water quality and meet the goals of
the BMP in Supplement "A" in the Riverside County NPDES Drainage Area

70. All grading shall be done under the supervision of a geotechnical engineer and he
shall certify all slopes steeper than 2 to 1 for stability and proper erosion control.
The geotechnical engineer shall make recommendation for the minimum distance
of building foundation to the top and toe of slopes.
DRAINAGE:
71. On-site drainage shall be conveyed to a public facility, accepted by adjacent
property owners by a notarized letter of drainage acceptance, or conveyed to a
drainage easement.
72. All natural drainage traversing the site shall be conveyed through the site, or shall
be collected and conveyed by a method approved by the City Engineer.
73. Roof drains shall not be allowed to outlet directly through coring in the street curb. U
Roofs shall drain to a landscaped area. Driveways shall be sloped to drain into
landscaping prior to entering street facilities.
74. Submit, along with grading plans, Hydrology and Hydraulic Reports for review' and
approval by City Engineer. Developer shall mitigate any flooding and/or erosion
downstream caused by development of the site and/or diversion of drainage. '
FEES:
75. Pay all Capital Improvement and Plan Check fees (LEMC 16.34). The current
traffic mitigation fee; the current drainage fee applied by the (Northwest Lake
Management Dist.) and the current TUMF; the amount of fees shall be adiusted
accordino to the fee schedule current at the time of pavment.
76. ,Provide in-lieu payment for future off-site public improvements prior to building
permit. (Res. 86-35) In-lieu payment shall be calculated by developers' engineer
or architect and submitted for City Engineer's approval. The estimate shall' be

construction administration. The street improvements shall include 6' wide
concrete sidewalk and curb and gutter, and 3" AC over 5" AB pavement section to

STORMWATERI CLEANWATER PROTECTION PROGRAM
City of Lake Elsinore has adopted ordinances for storm water management and
discharge control. In accordance with state and federal law, these local storm water
ordinances prohibit the discharge of waste into storm drain system or local surface
waters. This includes non-storm water discharges containing oil, grease, detergents,
trash, or other waste remains. Brochures of "Storm water Pollution, What You
Should Know" describing preventing measures are available at City Hall.

BACKGROUND
Royal Street Communications is proposing to co-locate wireless antenna panels on ann
existing seventy five foot (75') telecommunication pole so as to provide cellular
telephone coverage along the Interstate 15 corridor as well as the residential and
commercial communities in the surrounding area. It should be noted that the existing
pole is visible from Collier Avenue and the 1-15 Freeway.
The project site has a zoning designation of M-1 Limited Manufacturing. The Limited
Manufacturing District, Lake Elsinore Municipal Code (LEMC) Section 17.56.030.A,
states that uses located within one hundred feet (100') of a residential district may have
outdoor operational characteristics and/or have the potential to impact those
surrounding properties and shall therefore require additional approval and
consideration. In addition, the Limited Manufacturing District (Section 17.56.030.J)
further identifies structures proposed to exceed the height of the district (a height of forty
feet) shall require additional approval and consideration. Such uses shall require a
Conditional Use Permit pursuant to Lake. Elsinore Municipal Code (LEMC) Section
17.74 (Conditional Use Permits).
Since project submittal, staff has worked with the applicant regarding the design and
location of the tower. An agreeable solution has not been achieved regarding
"stealthing" the existing wireless facility, which consists of a seventy five foot (75') tall
steel utility pole and antenna panels
PROJECT DESCRIPTION
The proposed wireless antenna panels will be co-located on the existing utility pole and
the equipment will be housed within a 220 square foot lease area and will consist of the
following improvements:

The lease area containing the facility equipment will be screened and secured with an
8'0" tall masonry stucco finish wall.l Two (2) acc~ss gates will be located along the north
side of the lease area. Staff has tonditioned the project to stucco and plant climbing
vines against the CMU walls so as to grow on and soften the appearance of the walls.
To further enhance the aesthetic;slof the proje9t, the applicant has agreed to plant six
(6) live twenty four inch (24") box eucalyptus trees outside the walls of the facility which
will create a more natural appearahce of a group of trees rather than just the one stealth
tower.

ANALYSIS

1. Facility Site: The. proposed site plan meets all applicable development standards
and criteria outlined in the Limited Manufacturing Zoning District including setbacks.
2. Transmission/Callin~ covera~le: After extensive research regarding potential site
placement, Royal Street Communications has concluded that due to the height
requirements and the coverage I objective of,the selected search ring, there are no
other practical locations for the telecommunications facility within the immediate area.
3. Tower Heiaht: The apPlicant~as indicat~d: that .in' ~r'der toProVid~' the desirable
. service, the height of the antenn~s must be aminimum of sixty-five feet (65'). Section
17.56.030.J of the Lake Elsinor~ Municipal Gode allows for a project to exceed the
maximum building height of the IZoning District subject to a Conditional Use Permit.
Staff believes the proposed cotlocation and tower height meets the intent of the
Limited Manufacturing Zoning District and will not result in incompatibility issues with
surrounding properties and plahned land uses given the location of the proposed
facility and that sufficient setbacks have been,achieved from surrounding properties.

4. StealthinQ Improvements: Staff has conditioned the project to be stealthed subject
to the review and approval of the Director of Community Development. Staff is
encouraging the existing tower to be stealthed as a "mono-pine" facility. It is staff's
opinion that mono-pine facilities are satisfactory at concealing antennae panels,
especially for co-location purposes. The aesthetics of the facility will be further
enhanced with the planting of six (6) live twenty four inch (24") box eucalyptus trees
outside the walls of the facility creating a more natural grouping of trees in the
immediate area.
It should be noted that the applicant is objecting to the stealthing of the facility. It is
the applicant's position that the facility is an existing wireless antennae pole and the
proposed project is requesting only to co-locate to the existing facility, not construct a
new tower. Staff understands the applicant's position, however, feels that co-location
on existing facility subjects that facility to additional review, conditions and stealthing
criteria.
5. Decorative LandscapinQ & Fencinq: Staff believes the conditioning of the project
for stucco finish masonry screen walls, wall vines and foundation plantings will all
serve to screen the ground mounted equipment from view. In addition, the
camouflaged cellular tower and six (6) new live eucalyptus trees will all serve to give
the facility a more natural appearance that will blend with the surrounding natural U
landscape.".
6. Operation and Maintenance: There will be virtually no increase in traffic in the
area as a result of this project. After construction, Royal Street Communications
technicians visit the facility approximately once every four (4) weeks. Additionally,
no increase in ambient noise level is anticipated as there are no external air
conditioning units needed or proposed for this facility.
ENVIRONMENTAL DETERMINATION
Pursuant to the California Environmental Quality Act (CEQA), Section 15303 (New
Construction or Conversion of Small Structures), staff has determined that the proposed
project will not have a significant effect on the environment and shall therefore. be
exempt from the provisions of CEQA. Therefore no 'additional environmental clearance
is necessary.
RECOMMENDATION
a. Waive further reading and adopt a resolution approving Conditional Use Permit
No. 2008-17, and

Assessor Parcel Number 363-020-039 (the "Facilities"); and

WHEREAS, the project site has a zoning designation of M-1 (Limited
Manufacturing). Section 17.56.030.A of the Lake Elsinore Municipal Code states that

impact adjoining properties, businesses or residents and therefore are permitted subject
to the issuance of a conditional us1e permit, which allows the City to comprehensively
review and approve the use; and ! '

WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of icons ide ring and approving, conditionally approving,
or denying conditional use permits; and, .

WHEREAS, on November ;18, 2008, at a duly noticed public hearing, the
Planning Commission considered evidence presented by the Community Development
Department and other interested parties with respect to the Facilities. .

NOW, THEREFORE, THE~LANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. The Planning Commission has considered Conditional Use Permit
No. 2008-17 prior to rendering its d,ecision and finds that the requirements of Chapters
17.56 and 17,74 of the Lake Elsinore Municipal Code (where applicable) have been

projects do not have a significant ~ffect.on the 'environment and are therefore exempt

seq.: the "CEOA Guidelines"). A Class 3 exemption exists for: U
"Construction and location of limited numbers of new, small facilities or
structures; installation of small new equipment and facilities in small
structures; and the conversion of existing small structures from one use to
another where only minor modifications are made "in the exterior of the
structure." '
The co-located antenna tower, equipment shelter, screen walls and associated
landscaping improvements qualify for a Class 3 exemption because they involve the
construction of limited numbers of new, small facilities or structures and the installation
of small new equipment and facilities.
None of the exceptions to the categorical exemptions set forth in CEOA
Guidelines section 15300.2 applies here. The Facilities will not result in damage to
scenic resources, including trees (except those dead or dying), and is not located on
any site compiled pursuant to Government Code section 65962.5 (hazardous and toxic
waste sites).
Therefore, the Planning Commission hereby -finds and determines that the
Project is exempt from CEOA and the CEOA Guidelines.
SECTION 3. That in accordance with the State Planning and Zoning Law, and
the Lake Elsinore Municipal Code (where applicable), the Planning Commission makes U
the following findings for approval of CUP 2008-17:

1. The proposed use, on its own merits and within the context of its setting, is in
accord with the objectives of the General Plan and the purpose of the planning
district in which the site is located.

'Issuance of this Conditional Use Permit will facilitate, and improve wireless
communication coverage for the general public and City of Lake Elsinore
residents in the general area. Furthermore, the proposed land use and
conditioned design conforms to the objectives of the General Plan and the
purpose of/he planning district in which the site is located.
2. The proposed use will not be detrimental to the general health, safety, comfort, or
welfare of persons residing or working within the neighborhood of the proposed
use or the City, or injurious to property or improvements in the neighborhood or
the City.
All applicable City departments and agencies have been afforded the opportunity
to review the Conditional Use Permit and their comments have been addressed
in the conditions of approval attached to the staff report for this Project.
Conditions have been applied relating to the installation, design and maintenance
of landscaping, walls, regulations of points of vehicular ingress and egress and
control of potential nuisances; so as to eliminate any negative impacts to the

1. The Project, as approved, will comply with the goals and objectives of the
General Plan, Specific Plan and the Zoning District in which the Project is

The Minor Design Review complies with the goals and objectives of the General
Plan in that the approval of this cellular telecommunications facility project will
assist in achieving the development of a well balanced and functional mix of
residential, commercial, industrial, open space, recreational, and institutional land
uses as well as improve wireless communication coverage for the general public
and City of Lake Elsinore residents in the general area.
2. The Project complies with the design directives contained in the General Plan
Urban Design Element and all other applicable provisions of the lake Elsinore U
Municipal Code.
The Minor Design Review is appropriate to the site and surrounding
developments in that the cellular telecommunications facility has been designed
in consideration of the size and shape of the property. Sufficient setbacks and
enhanced onsite landscaping have been provided thereby creating interest and
varying vistas as a person moves along abutting streets. Further, the project, as
conditioned, will compliment the quality of existing development and will create a
visually pleasing, non-detractive relationship between the proposed development
and existing projects in that the cellular tower will be and other additional
landscape improvements have been added including six (6) live eucalyptus trees
and perimeter plantings which serve to enhance the aesthetics of the proposed
facility.
3. Subject to the attached conditions of approval, the Project is not anticipated to
result in any significant adverse environmental impacts.
Notwithstanding the fact that the Project is exempt from CEQA pursuant to a
Class 3 categorical exemption, the Project was reviewed and conditioned by all
applicable City departments to ensure that the telecommunications facility blends
into the existing natural landscape and creates the least amount of disturbance,
and does not negatively impact the residents or businesses of Lake Elsinore.

RE: CUP 2008-17 Project Description I Letter of Intent
To Whom It May Concern:
This is a formal letter of intent to the City of lake Elsinore, which specifically details the proposed operation
of a Royal Street Communications (MetroPCS) wireless telecommunications facility.
Efforts are currently underway in Riverside County to establish the required infrastructure to have an
operational wireless communication system as required by the FCC. MetroPCS is currently seeking approval
of a Conditional Use Permit to allow our co-location on an existing 75' Crown Castle pole. MetroPCS would
like to attach eight (8) antennas on the existing tower and four (4) equipment cabinets on the ground near
the existing compound. Therefore, MetroPCS is seeking a permit to co-locate on an existing vertical element
rather than constructing a new site along Interstate 15 in the City of lake Elsinore.
MetroPCS propOses to install a total of eight (8) antennae being six (6) panel antennas, one (1) microwave
antenna and one (1) gps antenna. The antenna will. be mounted on an existing tower that is 75-feet in
height. The center of MetroPCS' panel antennas will be at 63-feet and microwave dish at 57'. MetroPCS will
also attach one (1) GPS antenna to the equipment cabinet. All antennas, cable and connecting hardware will
be painted to match the existing tower color. This project will also consist of the installation of four (4)
equipment cabinets that will house the associated electronic equipment. The cabinets will be located inside a
new CMU walled compound attached to the existing compound. The installation of the antennas and shelter
will have no impacts to the surrounding environment in that it MetroPCS will use existing access roads and
not disturb any vegetation. MetroPCS also proposed planting six (6) 24" box Eucalyptus trees at staggered
heights around the facility.

In identifying the proposed location, MetroPCS' network deployment personnel have selected a site that not
only meets the technical objectives of RF engineering, but concurrently provides the best siting option with
regard to other key criteria that include, but are not limited to: accessibility, utility connections, zoning
compatibility, liability and risk assessment, site acquisition, maintenance and construction costs.
At present, MetroPCS has no service in lake Elsinore. The proposed site will provide wireless
telecommunications services to MetroPCS customers who live, work, and travel throughout this part of lake

WHEREAS, an application has been filed with the City of Lake Elsinore by
Walter Clendenon, R.MA ("the developer") to request approval of Negative Declaration
No. 2008-13 for Tentative Tract Map No. 32013 for Finance and Conveyance Purposes;
and
WHEREAS, Tentative Tract Map No. 32013 is defined as a "project" by Section
21065 of the California Environmental Quality Act (CEQA), Cal. Public Resources Code
Section 21000 et seq., which is defined as an activity which may cause either a direct
physical change in the environment, or a reasonably foreseeable indirect physical
change in the environment and which includes the issuance to a person of a lease,
permit, license, certificate, or other entitlement for use by one or more public agencies;
and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of making recommendations to the City Council
regarding environmental documetnts; and

WHEREAS, public notice of said application has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on November 18, 2008.' "
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed Negative"
Declaration No. 2008-13, prior to making a decision to recommend approval to the City
Council. The Planning Commission finds and determines that Negative Declaration No.
2008-13 is adequate and prepared in accordance with the requirements of the California
Environmental Quality Act (CEQA).
SECTION 2. That in accordance with State Planning and Zoning law and the
City of Lake Elsinore the following findings for the approval of Negative Declaration No.
2008-13 has been made as follows:
1. Revision in the project plans or proposal made by or agreed to by the applicant
before a proposed mitigated negative declaration and initial study are released for
public review would a"void the effects or mitigated the effects to a point where clearly

GENERAL CONDITIONS
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City: its Officials, Officers, Employees, and Agents from any claim; action,
or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set
aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or
legislative body concerning the Tentative Tract Map No. 32013 for Finance and
Conveyance Purposes project attached hereto.
2. The applicant shall submit a money order, cashier's check or check, made payable to
the County Recorder, for filing of a Notice of Determination and No Effect Form in the
amount of $64.00 to the Planning Division within 48 hours of the City Council approval
date meeting the required Environmental Filing.
PLANNING DIVISION
3. The Tentative Tract Map No. 32013 will expire two (2) years from date of approval
unless within that period of time an appropriate instrument has been filed and recorded
with the County Recorder, or an extension of time is granted by the City of Lake
Elsinore City Council in accordance with the Subdivision Map Act.

4. The Tentative Tract Map No. 32013 shall comply with the State of California Subdivision
Map Act and shall comply with all applicable requirements of the Lake Elsinore
Municipal Code, Title 16 unless modified by approved Conditions'of Approval.
5. All future development with the Tract Map area shall conform to all standards set forth in
the Lake Elsinore Municipal Code (LEMC) and General Plan. Current landowner shall
disclose to all potential. buyers the requirements to conform to all standards and
provisions of the LEMC and General Plan.
ENGINEERING DIVISION
6. This single parcel tentative map is for financing and conveyance purposes only. A
subsequent tract map or parcel map shall be required to subdivide this property.
Specific conditions of approval related to traffic circulation, grading, drainage, right-of-
way dedications, mitigation fees, and other related engineering requirements and/or
mitigations shall be required when the property is subdivided or at time of development. .
