City Tree Ordinance Be it ordained by the City Council of the City of Lake Elsinore, California. Section: 1 Definitions Street trees: "Street trees" are herein defined as trees, shrubs bushes, and all other woody vegetation on land lying within the City "Right of Way" between property lines on either side of all streets, avenues or ways within the City. Park Trees: "Park trees" are herein defined as trees, shrubs bushes and all other woody vegetation in public parks having individual names, and all areas owned by the City, or to which the public has free access as a park. Section: 2 Creation and Establishment of City Tree Board There is hereby created and established a City Tree Board for the City of Lake Elsinore, California which shall consist of the following employees or an employee assigned to the board by any one of the following employees: Public Works Director, Community Services Director, Park Supervisor, and Public Works Manager. Section: 3 Duties and Responsibilities It shall be the responsibility of the Board to study, investigate, council and develop and /or update annually, and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs in parks and in the public right -of -way. Section: 4 Street Tree Species to be Planted The official Street Tree species list for the City of Lake Elsinore shall be the list identified in the City Council adopted Landscape Guidelines on file in the City's Community Development Department. No species other than those included in this list may be planted as Street Trees without written permission of the City Tree Board. Section: 5 Spacing The Spacing of Street Trees will be in accordance with the City Council adopted Landscape Guidelines on file in the City's Community Development Department. Section: 6 Distance from the Curb and Sidewalk The distance trees may be planted from curbs or curb lines and sidewalks will be in accordance with City Council adopted Landscape Guidelines on file in the City's Community Development Department. Section: 7 Distance from Street Corners The distance trees may be planted from street corners will be in accordance with City Council adopted Landscape Guidelines on file in the City's Community Development Department. Section: 8 Utilities No Street Trees may be planted under or within 10 lateral feet of any overhead utility wire, or over or within 5 lateral feet of any underground water line, sewer line, transmission line or other utility. Section: 9 Public Tree Care The City shall have the right to plant, prune, maintain and remove trees, plants and shrubs in City Parks and within the City Right -of Way as may be necessary to insure public safety or to preserve or enhance the symmetry and beauty of such public grounds. The City Tree Board may remove or cause or order to be removed, any tree or part thereof which is in an unsafe condition or which by reason of its nature is injurious to sewers, electric power lines, gas lines, water lines, or other public improvements, or is affected with any injurious fungus, insect or other pest. Section: 10 Tree Topping It shall be unlawful as a normal practice for any person, firm, or city department to top any Street Tree, Park Tree, or other tree on public property. Topping is defined as the severe cutting back of limbs to stubs larger than three inches in diameter within the tree's crown to such a degree so as to remove the normal canopy and disfigure the tree. Trees severely damaged by storms or other causes, or certain trees under utility wires or other obstructions where other pruning practices are impractical may be exempted from this ordinance at the determination of the City Tree Board. Section: 11 Pruning, Corner Clearance Every owner of any tree overhanging any street or right -of -way within the City shall prune the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be a clear space of eight feet (8') above the surface of the street or sidewalk. Said owners shall remove all dead, diseased or dangerous trees, or broken or decayed limbs which constitute a menace to the safety of the public. The City shall have the right to prune any tree or shrub on private property when it interferes with the proper spread of Tight along the street from a street light or interferes with visibility of any traffic control device or sign. Section: 12 Dead or Diseased Tree Removal on Private Property The City shall have the right to cause the removal of any dead or diseased trees on private property within the city, when such trees constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the city. The City Tree Board will notify in writing the owners of such trees. Removal shall be done by said owners at their own expense within fourteen days after the date of service of notice. In the event of failure of owners to comply with such provisions, the City shall have the authority to remove such trees and charge the cost of removal on the owner's property tax notice. Section: 13 Removal of Stumps All stumps of street and park trees shall be removed below the surface of the ground so that the top of the stump shall not project above the surface of the ground. Section: 14 Arborist License and Bond It shall be unlawful for any person or firm to engage in the business or occupation of pruning, treating, or removing street or park trees within the City without first applying for and procuring a City Business License. That's how an unsigned letter to dozens and maybe thousands of Lake Elsinore property owners begins. The letter, one of several that arrived in the mailboxes of property owners, urged them to protest the city's proposed revision of its general plan. And protest they did. Dozens of them called the only listed telephone numbers on one of the letters, numbers for reporters from The Californian and the Press - Enterprise. Others e- mailed their concerns to the newspapers and some called or e- mailed Lake Elsinore City Hall in an attempt to find out who to talk to and complain about the proposed rezoning, part of a years -long process that involves changing the city's zoning to reflect current housing conditions and the business environment. The hubbub sparked by the letters carried over into Tuesday's regularly scheduled Planning Commission meeting, which included an item on the general plan revision. 5/22/2008 Page 2 of 3 A general plan is a state - mandated document that is supposed to guide how a city processes and approves development projects. The city has been working since 2002 to update its plan, a process complicated by the city's unique history - - -- which includes severe flooding, decades when the lake was dry or poisoned by fish dieoffs, land scams and failed country dub projects that date to the 1910s. While the letters have ginned up a firestorm of protest, it looks to have been largely for naught, as the commission and city administrators had already addressed many of the complaints before the meeting. The commission and staff announced Tuesday that they are proposing a change in the zoning for and situated along the northeastern edge of the lake. The new zoning would allow the construction of custom homes, a departure from the area's current zoning that doesn't allow any development. The existing zoning, a decades -long thorn in the sides of the owners of those parcels, was created after a flood in the early 1980s destroyed existing homes along the lake and turned the area into a camp for the homeless. The proposed change sucked the righteous anger from the sails of Dennis Fahey, a property owner who has complained for years about the restrictive zoning. "I've been mad for 10 years. You took all my fun away," he said, smiling. The letters, politically- charged pieces that point to the possibility of a three - member slate running for council seats in the upcoming November election, argued the city was attempting to rezone particular areas from medium - density residential to low- density residential. This change, according to the letters, would devalue the rezoned land because it would allow for the construction of only one home per acre instead of six to eight homes. While the city's land use consultants had recommended such a change, the Planning Commission has fielded dozens of complaints to date and the city's planning staff has said, repeatedly, that many of the complaints would be addressed in a future version of the plan, which hasn't been adopted or even discussed in public by the City Council. During Tuesday's meeting the commission and city staff unveiled some of the "finetuning" measures already crafted. For instance, a large property owned by Joseph Huband of Yucaipa in the Country Club Heights section will be zoned medium density residential instead of hillside residential, a change the owner of more than 100 small parcels of land had requested at a previous meeting. Huband is working with a housing developer to turn those parcels into a housing development. Other bits of finetuning changed some land that had been zoned for residential into commercial, a change requested by landowners looking to open businesses on their land instead of building homes. Wrapping up Tuesday's meeting, the commission postponed discussion of the general plan to an unscheduled date at a future meeting. Main St Lake Elsinore, Calif 92530 RE: Proposed zone change APN #'s 377 - 080 -049, 377 - 080 -048, 377 - 080 -051, 377 - 080 -061, 377 - 080 -062, 377 - 080 -063 & 377 - 080 -060 As the owners of the properties located along Dexter Ave, and also on Third St., here in Lake Elsinore, we have become very concerned after viewing a copy of the proposed general plan map. In the early 1990's we applied for, complied with, and paid all the requisite fees to put the parcels into commercial zoning. We are opposed to your intentions to what we consider a "downzone" to " office professional" It has always been the family's intention to develop these parcels commercially, and we consider your change proposal to be of negative financial consequences to us. There is currently commercial development along Dexter Ave. from Central Ave south and there is a "Lonestar Steak House" under construction directly behind and next to our parcel on Third St., so it is not like there is no precedent. Once again, we are requesting very strongly, that our properties remain under the commercial zone, and if there is anything that we have to do , please advise us.
