The City of Lake Elsinore appreciates your attendance. Citizens' interest provides the
Council and Agency with valuable information regarding issues of the community.
Meetings are held on the 2nd and 4th Tuesday of every month. In addition, meetings are
televised live on Time Warner Cable Station Channel 29 and Verizon Subscribers can
view the meetings on Channel 31.
If you are attending this City Council Meeting, please park in the parking lot across the
street from the Cultural Center. This will assist us in limiting the impact of meetings on
the Downtown Business District. Thank you for your cooperation.

(9) Amendment To Resolution Callino And Givino Notice Of Hold Of A General
Municipal Election
Recommendation: Waive further reading and adopt a resolution amending and
restating Resolution No. 2008-52, calling and giving notice of the holding of a
General Municipal Election to be held on Tuesday, November 4, 2008, for the
election of certain officers as required by the provisions of the laws of the State of
California relating to General Law cities and requesting the Registrar of Voters of
the County of Riverside to conduct said election.
(10) Resolution to Approve PlacinQ Delinquent Refuse Bills on FY 2008-2009 Tax Roll
Recommendations:
a. Waive further reading and adopt a resolution affirming the report of
delinquent residential reuse fees and directing their collection on the
property tax roll.
b. Direct the City Clerk to file with the Riverside County Auditor a certified
copy of the resolution along with the 120-days past due accounts report.

Mayor Hickman called the Joint Study Session to order at 4:01 p.m.

Mayor Hickman gave an overview of the presentations and confirmed that the

Councilman Magee inquired if the City Clerk received the phone message related
to the corrections of the June 10, 2008, City Council meeting minutes.
Clerk Munson responded she did receive the message and the corrections were
made to the final set of minutes.

Administrative Services Director Pressey responded to his inquiry.

(6) Notice of Completion for Median Modification on Malaqa Road
Mayor Hickman thanked Mr. Solomon.
(7) Summary Street Vacation for the Riqht-Of-Wav Known as Silver Street
Mayor Hickman inquired if there was still access to the outflow channel.
Director of Public Works/City Engineer Seumalo responded the vacation request
is only for northerly half of the length of the street, so there is still a 30 ft. foot
right-of-way on the south side.
(8) Resolution of the Fees for the Transportation Uniform Mitiqation Fee (TUMF)

(9) Professional Enqineerinq Services - Chuck Mackev
City Treasurer Weber inquired how much Mr. Mackey will make an hour.
Director of Public Works/City Engineer Seumalo responded $75 per hour.
(10) Professional Enqineerinq Services - Dave Solomon
Councilman Magee stated Mr. Solomon is a real asset to the City.
(11) Professional Enqineerinq Services - Peter Ramev
Councilman Magee required clarification on when the Rosetta Fire Station would
be completed.
Director of Public Works/City Engineer Seumalo responded construction will be
completed by September 2009.

(12) Alberhill Ranch Sports Park Turf Renovation
Mayor Pro Tem Kelley inquired why one of the City's newest park is being closed
for renovation as opposed to the older parks in the City.
Parks and Recreation Director Gonzales responded this particular park, though
new, when the park opened, the turf area was not quite mature enough to sustain
the type of use that it has been sustaining over the last ten months. He noted
because of the type of use, that being soccer for children and adults is the
primary reason why the City must returf the area. He also noted staff plans to
meet with the League organizations in order to regulate the amount of use that
these fields get. Staff is planning to meet and have discussions on having a field
use maintenance use procedure and a calendar to provide a rest time for the
fields so that the fields, throughout certain times of the year, will have the time to
recover from the high use. He noted the Alberhill Field will be open in mid-
October.
(13) Railroad Canyon Road Slope Stabilization Proiect - Construction Contract Award
City Treasurer Weber inquired if the City was able to get any Federal funding or
grants.
Councilman Magee responded staff applied to FEMA for Federal Funds and
were denied.
(14) Contract with Lilburn Corporation to Prepare CEQA Compliance Documents for
the Proiect Known as "Alberhill Southwest Shale Mine Reclamation Plan"
Mayor Hickman inquired about the identity of the applicant.
Director of Community Development Preisendanz responded the applicant is
MCA.
(15) Contract with HDR. Inc. to Prepare CEQA Compliance Documents for the Proiect
Known as "Lake Elsinore Association II"
City Manager Brady indicated this item will be pulled from the Consent Calendar
and recommended the item be tabled.
(16) Contract with David HOQan to Prepare CEQA Compliance Documents for the
Proiect Known as "Collier Avenue Auto Center"
Mayor Pro Tem Kelley inquired if a conditional use permit was required for this
application.
Director of Community Development Preisendanz confirmed that a conditional
use permit is required.

Councilman Magee. suggested getting some contributions to landscape the
median on Collier.
(17) Contract with David Hoaan to Prepare CEQA Compliance Documents for the
Proiect Known as "Lake Street Marketplace"
Mayor Pro Tem Kelley informed staff that there may be some problem with the
residents in the area approving this type of use and indicated that they are
sensitive to type of use, especially the sale of alcohol.
(18) Annual Adoption of Investment Policy
Mayor Hickman complemented Administrative Services Director Pressey.
(19) Lake Elsinore Valley Chamber of Commerce 2008-09 Services Aareement
Mayor Pro Tem Kelley inquired about the accountability of the Chamber.
Administrative Services Director Pressey responded Mr. Cousins has been
working on an update for the last quarter; however, it was not ready prior to the
distribution of the agenda.
Mayor Pro Tem Kelley inquired if Mr. Brady had received any relocation
requests.
City Manager Brady responded that he had not.
Kim Cousins provided a status report on the Chambers goals and objectives for
2008-09.
(20) General Plan Update
Director of Community Development Preisendanz reported staff is anticipating
returning to the Planning Commission on July 15th with the General Plan and
recommending taking the Plan to the City Council.
(21) Plannina Division Professional Service Contracts 2008-2009 Fiscal Year
Councilman Magee noted the staff report shows every City has population
greater than Lake Elsinore and noted it would appear our staffing is in-line or
even larger.
(22) Purchase Authorization For a Web Based Streamina Media Solution
Mayor Hickman inquired about the status of the new web site.

Information/Communications Manager Dennis presented a proposed schedule
and indicated staff is still looking at 6-8 weeks of work remaining, with a target
date around the early part of August.
(23) Aareement with Riverside County to Provide Road Maintenance on Portions of
Lost Road and Navaio Sprinas Road
Councilman Magee inquired if this would occur after the facilities are fully
improved and not taking care of the dirt roads
City Manager Brady responded that was correct.
PUBLIC HEARINGS
(24) Continued Public Hearina - Tentative Tract Map No. 34346 for Condominium
Purposes and Residential Desian Review No. 2005-27, for "The Colony"
Leonard Leichnitz, President of Lumos Communities, expressed his concerns
related to the project one being the designation of R-3, which he noted as a
typographical error, and the importance of the density caps under Appendix A.
Mayor Hickman inquired of Mr. Leichnitz if he was ok with the density.
Leonard Leichnitz, President of Lumos Communities, indicated, if this project is
setting a precedent, that Appendix A will not govern this plan or future projects up
Mission Trail, and if a seniors' project was not built, then this density would go
away.
Mayor Hickman inquired if there is a condition that states this project is for senior
55 years and older.
Peter Bauchman, representative of the applicant, responded there is a condition
that addresses the age; however, the City Attorney drafted an amendment to this
condition that makes this condition stronger and he indicated they were fine with
the amendment.
City Attorney Leibold responded the project is conditioned on being a project for
occupancy by persons 55 years and older consistent with applicable State and
Federal law. She noted Condition No. 12 already imposes that requirement, but
indicated the City Attorney's Office redrafted the condition to make it extremely
clear. She also noted in addition, CC&R's will be prepared which will also require
and restrict occupancy to person 55 years or older.
Peter Bauchman noted the golf carts are an amenity to get around the
residential facility itself and to be able for residents to utilize the golf course.

City Attorney Leibold indicated she can add a new condition saying "in the event
that Olive Street is constructed, the applicant shall upon the City's request; make
gated pedestrian golf cart and/or vehicular access available from the project's
southern boundary to Olive Street.
City Attorney Leibold also noted she will add another new condition saying "shall
work with staff and shall consult with Northwest Mosquito Vector Control District
to create an appropriate landscaping plan for the retention basin."
Mayor Pro Tem Kelley stated her concern with this development is that the City is
treating each parcel in that area equally, and that the same standards have
applied for each applicant.
City Attorney Leibold responded one issue is what is the appropriate land use
designation for the Colony property which includes Planning Areas 50, 51 and 59.
She indicated they encompass R-2 with a sliver of a R-3 designation that has
been retained. She also indicated Planning Area No. 59 on the map was
designated R-3 and what she recently learned, and had not the opportunity to
convey, is that looking to Appendix A, Planning Area No. 59 on the governing
land use designation was mislabeled R-2. She also noted the Land Use Map
from the 1993 plan forward, the map itself has always identified Planning Area
No. 59 as R-3 and has never been changed by subsequent amendments.
City Attorney Leibold explained how future development along Mission Trail will
be addressed.
City Attorney Leibold also stated State law and the City's density bonus
ordinance would allow for a density bonus for this type of project because of the
senior restriction; however, there is an application process associated with the
density bonus including an agreement that the City and the property owner must
enter into to ensure those long term convents on the occupancy.
Councilman Magee inquired if the project was circulated to the County, with
respect to the traffic impacts, and asked if any comments were received.
Community Development Director Preisendanz responded it was circulated to the
County and no comments were received.
Councilman Magee inquired if there will be any cars parked on Mission Trail
Community Development Director Preisendanz responded there will be "no
parking" signs posted on Mission Trail.
Councilman Schiffner stated he does not want to see a precedent for high density
in the future.

Community Development Director Preisendanz talked about how staff calculated
density and why the open space was included.
COUNCILMAN BUCKLEY LEFT TO THE COUNCIL CHAMBER AT 5:22 P.M.
(25) Capital Improvement Proaram (CIP) for FY 2008-09 Throuah 2012-13
Councilman Magee indicated he was very disappointed Dexter Street would not
be completed until next winter.
Councilman Magee complemented Public Works Manager Payne and Public
Works Director/City Engineer Seumalo and thanked them for keeping the project
under budget.
Councilman Magee inquired about pavement condition on Diamond Drive.
Public Works Director/City Engineer Seumalo Seumalo responded staff is
currently looking for funding for both Diamond Drive between 1-15 and Lakeshore
Drive as well as Riverside Drive between Illinois and Stater Bros. shopping center
driveway.
(26) Zonina Ordinance Text Amendment No. 2008-03: a Request to Amend Lake
Elsinore Municipal Code Chapter 17.82 (Desian Review) in Order to Modify
Existina Guidelines For Time Extension Related to Desiqn Review Approvals

(27) Sub-Committee Recommendations for Planninq Commission Expired Terms
Councilman Magee indicated he and Councilman Buckley would like to comment
on the applicants during the regular City Council meeting.

(1) Mayor Hickman presented a proclamation to Deputy Joseph Narciso who was
recently recognized by MADD for being one of the top performers in the State of

update on Chamber activities.

Lorraine Watts, thanked Administrative Services Director Pressey, Supervisor Buster,
Mary Venerable and Mayor Hickman for attending and assisting with the Home
Preservation Conference sponsored by the NAACP and the City of lake Elsinore.
Lewis Davis, Regional Public Affairs Manager of Edison, introduced the new
Regional Manager for lake Elsinore and surrounding area Viet Tran as his
replacement.
Viet Tran, stated it was good to be back and announced Edison will be building a new
service center on Clinton Keith which will serve the communities of lake Elsinore,
Murrieta, Wildomar, Canyon lake and Temecula.

Recommendation: Authorize the City Manager to enter into a contract with HDR,

Recommendation: Waive the informal bidding process and authorize the City
Manager to sign and issue a purchase order to Granicus, Inc., to acquire and

(23) Aoreement with Riverside County to Provide Road Maintenance on Portions of
Lost Road and Navaio Sprinqs Road
Recommendation: Approve the Road Maintenance Agreement between the City
of Lake Elsinore and Riverside County in substantially the form provided and
authorize the Mayor to execute the Agreement in such final form as approved by
the Director of Public Works and the City Attorney.

PUBLIC HEARINGS
(24) COUNCIL ADOPTS RESOLUTIONS APPROVING TENTATIVE TRACT MAP
NO. 34346 FOR CONDOMINIUM PURPOSES AND RESIDENTIAL DESIGN
REVIEW NO. 2005-27. FOR "THE COLONY"
Mayor Hickman opened the public hearing at 7:21 p.m.
Community Development Director Preisendanz presented the staff report. He
indicated this project was a 211 multi-family condominium community for active
seniors and is located in the East Lake Specific Plan. He stated the Planning
Commission unanimously recommended approval of the various entitlements.

Leonard Leichnitz, President of Lumos Communities, stated he was opposed to
the project. He indicated there were three problems with project in the way it is
presented: 1) it eliminates the density cap for the property imposed by the
Specific Plan; 2) the current Land Use Map for the Specific Plan, approved in
2005, clearly shows this area as R-2 density where the applicant has described
this project within a R-3 planning area and staff agrees with applicant. He stated
if the latest approved map says this project is medium density, then it should be
processed as medium density; and 3) staff allows the developer to use the flood
storage area in its density calculations and pointed out with prior projects such as
his and others, density calculations to exclude not include flood storage space.
He requested City Council reverse the decision and vote "no".
Peter Buchanan, Project Manager, thanked staff for their assistance with the
project, spoke in favor of the project and indicated the process has really been a
collaborative effort with a goal of providing a unique and wonderful development
with high quality housing and very fine amenities that fulfills a very specific need
in the community that is not in the City. He proceeded to outline some of the
benefits their project will have for the City.
Dan Uhlry, resident, stated he liked the project. He indicated he had the same
density concerns as Mr. Leichnitz.
City Attorney Leibold stated the East Lake Specific Plan is being implemented
and should be implemented in accordance with its definitions, land use map and
other provisions and does not feel this project is any variance from the
implementation of East Lake SpecifiC Plan and is not receiving any special
treatment. She also stated the Land Use Map in the East Lake Specific Plan
establishes land use designations throughout the 3,000 acres of the East Lake
Specific Plan. She also stated each land use designation in the narrative of the
plan articulate a maximum number of dwelling units per acre, calculated as a net
density. She indicated the proposed project is well within, in fact, quite a bit
below maximum allowable density based on the text of the East Lake Specific
Plan.
Councilman Buckley inquired if the applicant was getting extra density because it
is a seniors' project.
City Attorney Leibold responded they were not; however, because of the design
review and parking requirements, there may be a lesser parking standard
because of the senior restriction which would not be available to an unrestricted
project, which would require a higher level of parking, and therefore reduce the
overall density.
Community Development Director Preisendanz stated it was important for him to
mention, when the applicant arrived in the City two years ago, staff had given the
applicant density direction, based on what was directed with other applicants,

which was based on the Land Use Plan which was R-2 and R-3 with 14 dwelling
units as the goal. He also stated along Mission Trail there is a lot of R-1 zon~ng
along with Commercial zoning which many landowners want to change to hl~h
density. He also indicated staff has explained to these owners that the City
wants a commercial project in the area. He noted this project was presented
much different than it is being presented now and per staffs' request, the
applicant has changed many items. He stated he would also like to see some
continuity with the golf course.
Councilman Schiffner stated he felt this project adds value to the City of Lake
Elsinore.
Mayor Hickman closed the public hearing at 7:47 p.m.
Mayor Pro Tem Kelley stated it was a wonderful and beautifully designed needed
project. She indicated the area of concern with her is whether or not all of the
procedures been applied equitably to the developments in East Lake Specific
Plan.
Peter Buchanan, Project Manager, indicated Lumos and Laing were their own
Specific Plans where they worked with the City to come up with the rules, density,
etc. He noted what they are processing is a project under the East Lake Specific
Plan.
City Attorney Leibold responded it was not technically correct to say they were
new Specific Plans, they were amendments to planning areas within the East
Lake Specific Plan that established new land use designations, new circulation,
etc. and because they're their own amendment with a whole new set of
regulations and not the implementation of the existing East Lake Specific Plan,
there could be some distinction and that is a distinction worthy of notice.
Councilman Magee indicated the applicants have been very good neighbors and
stewards of the property and stated he explained to the applicant that he was
opposed to high density projects. He also stated the City should establish
residential estate zoning in this particular area. He noted the Council set the bar
with Laing and Lumos, reduced density, increased public recreational
opportunities and this application does none of this.
Mayor Hickman indicated this was an excellent project and it must remain a
senior project.
It was moved by Mayor Pro Tem Kelley, and seconded by Councilman Magee to
continue this item off calendar.

Federal Housing Act or other applicable State and Federal law."
3) Add a new condition saying "in the event that Olive Street is constructed,
the applicant shall upon the City's request; make gated pedestrian golf
cart and/or vehicular access available from the project's southern

SUBJECT: APPROV AL TO PARTICIPATE IN THE RIVERSIDE COUNTY
MORTGAGE CERTIFICATE (MCC) PROGRAM
Summary
The Riverside County Board of Supervisors has authorized the County Economic
Development Agency (EDA) to apply to the California Debt Limit Allocation Committee
for an allocation of Mortgage Credit Certificates on or about July 28, 2008. The City of
Lake Elsinore is able to participate in the County MCC Program for mortgage loans
available for first-time homebuyers in Lake Elsinore. Adoption of a resolution is
necessary for the City to participate in the County's MCC Program.
Backaround
A Mortgage Credit Certificate (MCC) entitles qualified home buyers to reduce the amount
of federal tax liability on a home mortgage. This tax credit allows the buyer to qualify
more easily for a loan by effectively increasing the stated income of the buyer.
The Riverside County MCC Program allows a 15% rate, which can be applied against
the interest paid on the mortgage loan. The borrower can then claim a credit on their taxes
equal to 15% of the interest paid during the year. Since the taxes paid by the borrower
are being reduced, the annual take-home pay is effectively increased. The borrower can
still deduct the remaining part of the interest paid as a standard deduction. When underwriting
a loan, a lender takes this potential increase in income into consideration and the borrower
is able to qualify for a larger loan than would otherwise be possible.
This program can be used with all types of homes, including foreclosures, new and
resale single-family and/or manufactured homes, and may be the "extra cushion" future
homebuyers will need to purchase in Lake Elsinore.

The EDA will be submitting an application for approximately $12 million on or about July
28, 2008 for applicants acquiring homes within the County. Program guidelines include
income restrictions, as well as limits to the purchase price of the home. Future Lake
Elsinore homebuyers can qualify for the MCC on their own through their lender, even if
the City is not providing any down payment assistance.
The City of Lake Elsinore has participated in the MCC Program in past years. Staff
recommends approval of the attached updated resolution, which will provide another
tool for qualified homebuyers to purchase a home in Lake Elsinore.
Fiscal Impact
No impact to the City or the Redevelopment Agency budget. Potential buyers can
qualify through a lender to receive the MCC from the County.
Recommendation
Waive further reading and adopt a resolution approving participation with the County of
Riverside Mortgage Credit Certificate (MCC) Program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, APPROVING
PARTICIPATION WITH THE COUNTY OF RIVERSIDE
MORTGAGE CREDIT CERTIFICATE (MCC) PROGRAM
WHEREAS, the Tax Reform Act of 1986 established the Mortgage Credit
Certificate Program ("MCC Program") as a means of assisting qualified individuals with
the acquisition of new and existing single family housing; and
WHEREAS, pursuant to Division 31, Part 1, Chapter 3.5, Article 3.4 of the
California Health and Safety Code Sections 50197 et seq, local issuers are authorized
to issue Mortgage Credit Certificates ("Certificates") and administer MCC Program; and
WHEREAS, the Board of Supervisors of the County of Riverside adopted
Resolution No. 87-564 on December 22, 1987, establishing a Mortgage Credit
Certificate Program; and
WHEREAS, the Board of Supervisors of the County of Riverside has
authorized the Riverside County Economic Development Agency ("EDA") to administer
the MCC Program pursuant to the applicable federal, state and local policies and
procedures, and to enter into those agreements necessary for efficient administration of
the MCC Program; and
WHEREAS, the County of Riverside ("County") will be applying to the
California Debt Limit Allocation Committee ("CDLAC") for a mortgage credit certificate
allocation in July 28, 2008, or thereabouts; and
WHEREAS, the City of Lake Elsinore ("City") wishes to participate in the
MCC Program administered by the EDA in connection with mortgage loans it will make
available for the acquisition of new and existing single-family housing in Riverside
County; and
WHEREAS, the adoption of this resolution is necessary to include the City
a participating unit of general government under County's MCC Program; and
WHEREAS, the City agrees to cooperate with the County of Riverside to
undertake the MCC Program within City jurisdiction to assist persons or households of
limited income to purchase new and existing single family residences located in the
City; and
WHEREAS, the City by adopting this resolution, hereby gives notice of its
election to participate in the Riverside County MCC Program.

NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Lake Elsinore, California, as follows:
The City of Lake Elsinore, California, agrees;
1. To participate in the MCC Program administered by the EDA in
connection with mortgage loans it will make available for the acquisition of new and
existing single-family housing in Riverside County; and
2. To assist the County of Riverside to market the MCC Program
within the city's jurisdictional boundary by publishing a general public notice in the local
newspaper at least twice a year.
PASSED, APPROVED, and ADOPTED by the City Council of the City of
Lake Elsinore, California, on the 8th day of July, 2008.

Castle & Cooke Alberhill Ranch, LLC owner of the Alberhill Ranch Specific Plan area
located at the northeast end of the City adjacent to Lake Street, has formally requested
that Alderwood Circle be changed to Welsh Circle. This new community contains two
roadways with the name Alderwood, one with the suffix "Circle" and one with suffix
"Place". By changing the name of the street it will reduce confusion and facilitate the
response of emergency services.
Discussion
Staff has notified all appropriate Utility Services and Emergency Services Providers of
the request for name change. Their where no objections by the utility companies or
emergency service providers, nor were there conflicts with existing street names located
within the City.
Fiscal Impact
None, the applicant is responsible for ordering and installing the new street signs.
Recommendations
1 . Approve the street name change request.
2. Direct the City Clerk notify the County Board of Supervisors of the street
name change.

Backaround
The City will be conducting a General Municipal Election on November 4, 2008, for the
purpose of electing three members of the City Council and the City Treasurer for four-
year terms.
Resolutions were presented and adopted by the City Council on June 10, 2008, as part
of the General Municipal Election process. The resolution pertaining to "Calling and
Giving Notice" which list the electeds that will be on the November ballot which
inadvertently did not include the City Treasurer and therefore the attached resolution is
needed to amend and restated the prior resolution to include the City Treasurer.
Discussion
Prior to conducting a General Municipal Election, resolutions must be adopted which
call and give notice of holding the election and request that the Riverside County Board
of Supervisors render specific services.
Fiscal Impact
No fiscal impact.
Recommendation
Waive further reading and adopt a resolution amending and restating Resolution No.
2008-52 calling and giving notice of the holding of a General Municipal Election to be
held on Tuesday, November 4, 2008, for the election of certain officers as required by
the provisions of the laws of the State of California relating to General Law cities and
requesting the Registrar of Voters of the County of Riverside to conduct said election.

CERTAIN OFFICERS OF THE CITY AS REQUIRED BY THE

CALIFORNIA RELATING TO GENARAL LAW CITIES AND
REQUESTING THE REGISTRAR OF VOTERS OF THE
COUNTY OF RIVERSIDE TO CONDUCT SAID ELECTION
WHEREAS, under the provisions of the laws relating to General Law cities in
the State of California, a General Municipal Election shall be held on November 4, 2008,
for the election of Municipal Officers.
WHEREAS, on June 10,2008, the City Council adopted Resolution 2008-52
pertaining to "Calling and Giving Notice" which inadvertently did not include the City
Treasurer.
WHEREAS, the City Council desires to amend and restate Resolution No.
2008-52.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. That pursuant to the requirements of the laws of the State of
California relating to General Law Cities within the State, there is called ordered held in the
City of Lake Elsinore, California, on Tuesday, November 4, 2008, a General Municipal
Election of the qualified electors of the City for the purpose of electing three (3) members
of the City Council and a (1) City Treasurer for terms continuing to November 2012. The
three (3) incumbent members of the City Council of the City are Genie Kelley, Robert
Magee, and Robert Schiffner and the one (1) incumbent for the City Treasurer is Peter
Weber.
Section 2. That pursuant to the provisions of Section 10002 ofthe Elections
Code of the State of California, this City Council hereby requests the Registrar of Voters of
the County of Riverside to conduct the General Municipal Election for the City of Lake
Elsinore.
Section 3. That the ballots to be used at the Election shall be, in form and
content, such as may be required by law to be used in the Election.

Section 4. That the City Clerk is hereby authorized, instructed and directed
to procure and furnish any and all official ballots, notices, printed matter and all supplies,
equipment and paraphernalia that may be necessary in order to properly and lawfully
conduct the Election.
Section 5. That the polls for the Election shall be open at seven o'clock a.m.
on the day of the Election and shall remain open continuously from that time until eight
o'clock p.m. of the same day when the polls shall be closed, except as provided in Section
14401 of the Elections Code of the State of California.
Section 6. That in all particulars not recited in this Resolution, the Election
shall be held and conducted as provided by law for holding municipal elections in the City.
Section 7. That notice of the time and place of holding the Election is given
and the City Clerk is authorized, instructed and directed to give such further or additional
notice of the Election, in time, form and manner as required by law.
Section 8. That the City Council of the said City desires the canvass of said
Election to be made by the Riverside County Registrar of Voters.
Section 9. That the Riverside County Registrar of Voters shall, on the 4th day
of November 2008, commence the canvass of the General Municipal Election to be held in
said City on the 4th day of November, and shall certify the results to this City Council.
Section 10. That said City shall reimburse the County of Riverside, Registrar
of Voters for the cost of services performed relative to the conduct of the General Municipal
Election, after completion of all work and upon presentation to the City of a properly
detailed bill.
Section 11. That the City Clerk is hereby directed to forward a certified copy
of this Resolution to said Riverside County Registrar of Voters.
Section 12. That the City Clerk shall certify to the passage and adoption of
this Resolution and enter it into the book of original Resolutions of the City of Lake
Elsinore.

SUBJECT: RESOLUTION TO APPROVE PLACING DELINQUENT REFUSE BILLS
ON FY 2008-2009 TAX ROLL
Backaround
On June 9,1992, CR&R, Inc. was awarded an exclusive franchise agreement to provide
solid waste collection and recycling services. Due to uncollectible accounts resulting
from non-payment from property owners and renters, City Council approved collections
via the tax rolls. These collections are for those accounts whose payments are
delinquent a minimum of 120-days. These costs are to include the delinquent charges,
the appropriate late payments, processing fees and the trash collection and recycling
fees for the following year.
Discussion
As of July 1, 2008, there are 547 new accounts on delinquent tax rolls totaling
$119,045.91. Due to these delinquent accounts and CR&R's past actions to collect for
services rendered, CR&R submits a list of accounts for City Council's consideration to
be placed on the tax roll.
Fiscal Impact
Payment from delinquent accounts placed on the tax rolls can take as long as 24-
months to collect. In addition, CR&R continues to pay the City the franchise fee from the
gross revenues.
Recommendations
1. Waive further reading and adopt a Resolution affirming the report of delinquent
residential refuse fees and directing their collection on the property tax roll.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, AFFIRMING THE
REPORT OF DELINQUENT RESIDENTIAL REFUSE FEES
AND DIRECTING THEIR COLLECTION ON THE
PROPERTY TAX ROLLS
WHEREAS, according to Lake Elsinore Municipal Code Section 8.16.206,
any refuse collection rate or charge shall become delinquent if not paid within thirty days
of the time payment is due; and
WHEREAS, in that same section, the City Council has established that each
delinquent account shall be charged a penalty of ten percent (10%) of the monthly rate for
each month the account is delinquent; and
WHEREAS, on July 23, 1996, the City Council approved collection of
delinquent accounts by way of listing the amount due on the account holder's property tax
rolls; and
WHEREAS, this collection method was restricted to those accounts which
were delinquent for a minimum of one hundred twenty (120) days; and
WHEREAS, a written report of residential refuse collection fees delinquent
as of July 1, 2008, has been prepared and filed with the City Clerk; and
WHEREAS, the City Council has considered evidence presented by the
Public Works Department, the City Clerk, and other interested parties at a public meeting
held with respect to this item on July 8, 2008.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. The report of residential refuse collection fees delinquent as of
July 1, 2008, attached hereto and incorporated into this resolution is hereby confirmed.
The City Clerk is directed to file a certified copy of this resolution and of the report with the
County Auditor. The County Auditor is designated and empowered to perform its duties as
is customary in its practice.
Section 2. The fees set forth in the report shall constitute a special
assessment against the respective parcels on which they are levied and are a lien against
such property. The assessment shall be collected at the same time and subject to the
same procedures that taxes are collected. All laws applicable to the levy, collection and
enforcement of ad valorem property taxes shall be applicable to such assessments,
except that if any real property to which such fees or changes relate has been transferred

or conveyed to a bona fide purchaser, prior to the date on which the first installment of
such taxes would become delinquent, then a lien which would otherwise be imposed shall
not attach to such real property and the fees or charges or interest shall be transferred to
the unsecured roll for collection.
Section 3. The City shall remit the fees collected to the franchised solid
waste collector within fifteen (15) days after receipt thereof.
Section 4. That portion of the principal, interest and other costs related to the
delinquent trash accounts to be placed on the County Tax Rolls and be collected by the
Riverside County Tax Collector.
Section 5. That the properties to be assessed and the related amounts are
submitted on magnetic tape as requested by the Riverside County Tax Collector, further
identified as County Fund No. 68-2370.
Section 6. The City Council of the City of Lake Elsinore hereby authorizes
the collection of delinquent refuse service fees of customers with unpaid balances of more
than one hundred and twenty (120) days to be collected permanently on the annual
property tax roll.
Section 7. This Resolution shall take effect from and after the date of its
passage and adoption.

Background

Discussion
Attached are two Resolutions for Fiscal Year 2008-09 providing for an Annual Levy and
Collection of Assessments in both Districts.
Fiscal Impact
The total assessment for FY 2008-09 Citywide LLMD IS $1,275,730. The total
assessment for LLMD No.1 is $209,042.
Recommendations
1. Waive further reading and adopt a resolution confirming a diagram and
assessment and providing for annual assessment levy after formation of a district
Fiscal Year 2008-09 for the Citywide LLMD.
2. Waive further reading and adopt a resolution confirming a diagram and

(hereinafter referred to as the "District"); and
WHEREAS, the City Council has ordered the preparation of a report and

Resolution of Intention to levy and collect assessments for the next ensuing Fiscal Year

CITYWIDE LANDSCAPE & STREET LIGHTING DISTRICT
Fiscal Year 2008-09
The City Council of the City of Lake Elsinore approved the formation of an Assessment District
with Resolution No. 88-27 on June 28, 1988. The District was formed pursuant to the
requirements of the Landscaping and Lighting Act of 1972.
The District was formed to provide a source of funds for the installation, servicing, maintenance,
repair and operation of landscaping, lighting and appurtenant facilities within the District. Prior
to the fiscal year 1997-98, the boundaries of the District were coincidental with the boundaries of
the City. The Engineer's Report, which was approved by the City Council when the District was
formed and as amended, sets forth the methodology to be used in apportioning the assessment to
the different land use types and benefit zones within the City based upon the benefit they receive.
Based on the proceedings in Fiscal Year 1997-98 and the provisions of Proposition 218, the
District is exempt from the requirements of Proposition 218, unless there is an increase in the
assessment rates.
At the time the District was formed, several benefit zones were established. Citywide benefit
zones were established to insure a source of funds for the ongoing maintenance of landscaping
and lighting improvements which are of benefit to all parcels or lots within the City. This
includes landscaping and street lighting along major thoroughfares, and a portion of the
secondary arterials as defined in the Circulation Element of the City's General Plan and on other
City owned properties. Several special benefit zones were established to provide a source of
funding for the maintenance of improvements that are of local benefit. Currently there are
twenty-one (21) special benefit zones, lettered A through U (see Appendix A, Figure 1 - Zone
Map).
In response to Proposition 218, passed November 5, 1996 and as now provided by California
Constitution Article XIIID Section 5(a), this Assessment District will only finance the capital
costs, maintenance and operation expenses for sidewalks, streets, flood control and drainage. All
other maintenance that is not exempt from Proposition 218 has been removed from this District.
The City has determined that by removing the non-exempt costs that the remaining
improvements may continue to be paid for through the assessment district without being
subjected to the procedures and requirements of Proposition 218. The City has determined that
all of the remaining improvements and maintenance are exempt from requirements of
Proposition 218.

The City will not increase the assessment district rates for Fiscal Year 2008-09. To the extent
any parcel changes its land use, thereby placing the parcel in a different rate category is not
deemed to be an increase in rates.
Parcels or lots within these special benefit zones are assessed for the maintenance of local
improvements including but not limited to tree maintenance, site specific street lighting and site
specific landscaping. These improvements provide a special benefit to those parcels due to their
nature and location. In addition to their proportionate share of the cost for the maintenance of
these local improvements, those parcels within a special benefit zone are also assessed for those
improvements designated as of Citywide benefit.
As required by the Landscaping and Lighting Act of 1972, this Engineer's Report describes the
improvements to be maintained by the District for FY 2008-09, provides an estimated budget by
benefit zone, and lists the assessments to be levied upon each assessable lot or parcel within the
District.

The facilities to be maintained and serviced are more generally described as follows:

Improvements to be performed are: installation, construction, operation and/or maintenance of
street lights and landscaping, including but not limited to personnel, electrical energy, utilities
such as water, materials, contracting services and other items necessary for the satisfactory
operation of these services. No detailed plans and specifications are provided herein.
STREET LIGHTING
Street lighting improvements include but are not limited to: the current payments to Southern
California Edison Company (SCE) for electrical energy, installation, maintenance, and operation
of approximately 2,422 total lights and 17 traffic signals.
LANDSCAPING
Landscaping improvements include but are not limited to: irrigation, cultivation, installation and
replacement of plant material, tree trimming, and other necessary supplies; personnel, utility, and
equipment costs; contract services where applicable; care and maintenance of approximately
fifteen (15) acres oflake beaches, and approximately thirty-four (34) acres of streetscapes.

ESTIMATE OF COST
The 2008-09 fiscal year expenditures (or costs) for the proposed district are estimated as follows:
STREET LIGHTING
The City is currently paying for the operation of approximately 2,422 street lights; 185 are City-
owned lights and 2,237 are utility-owned lights. Street lighting also includes costs for
maintaining 17 traffic signal lights and traffic signal maintenance within the City.
It has been determined that all properties within the City benefit from lighting and signalization
on major streets; therefore, a proportional share of the cost are spread to all parcels in the City. It
has further been determined that street lights on secondary streets benefit all properties within the
City and adjacent local benefit areas. Therefore, these costs are split evenly, half going to major
street lighting and the other half to local lighting benefit areas.
Therefore, the total amounts to be spread for the Major Street direct benefit of street lighting and
for each of the level of services are as follows:

LANDSCAPING
It has been determined that wetlands, landscaping and erosion protection for a levee, major street
landscaping, beaches and beach water testing, benefits all properties within the City; therefore, a
proportional share of the cost are spread to all parcels in the City whether or not there is local
street landscaping. The cost of local site-specific street landscaping not on a major street is
spread to those areas that have a local benefit from the site-specific street landscaping.

PART IV
METHOD OF APPORTIONMENT OF ASSESSMENT
A. GENERAL
Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting
Act of 1972, permits the establishment of assessment districts by cities for the purpose of
providing certain public improvements which includes installation, construction, and
maintenance and operation of street lights and street landscaping.
The 1972 Act requires that the assessments be levied according to benefit rather than
according to assessed value. Section 22573 provides that:
"The net amount to be assessed upon lands within an assessment district
may be apportioned by any formula or method which fairly distributes the
net amount among all assessable lots or parcels in proportion to the
estimated benefit to be received by each such lot or parcel from the
improvements. "
The Act also permits the designation of zones of benefit within any individual assessment
district if "by reasons or variations in the nature, location, and extent of the
improvements, the various areas will receive different degrees of benefit from the
improvement" (S&H 22574). Thus, the 1972 Act requires the levy of a true "assessment"
rather than a "special tax."
Excepted from the assessment would be the areas of all public streets, public avenues,
public lanes, public roads, public drives, public courts, public alleys, all public easements
and rights of way, all public parks, greenbelts and parkways and all public school
property, other public property, mineral rights, and designated open space.
Public utility owned properties would be included in the assessment district and assessed
in accordance with benefits received.
B. PARCEL CLASSIFICATION
Since the assessment will be levied on the owners of properties as shown on the tax rolls,
the final charges must be assigned by Assessor's Parcel Number. If assessments were to
be spread by parcel in various zones, not considering land use, this would not be
equitable, because a single family parcel would be paying the same as a 50-unit apartment
parcel or a large commercial establishment in a similar zone.

It has been determined that the residential parcels will be assessed by the number of
dwelling units on each parcel; commercial and industrial property by the area of the
parcel. The single family parcel has been selected as the basic unit for calculation of the
assessments. Parcels of other land uses are reduced to Equivalent Dwelling Units
(EDU), in the manner described below:
1. Multiple Residential parcels, including mobile homes, are adjusted in accordance
with a multiple residential factor, determined by statistical proportion of relative
trip generation from various types of residential uses, in combination with
population density per unit. Studies have found that in multiple residential areas,
the primary beneficiaries of street lighting are the tenants rather than the property
owners because of increased safety and security. It was concluded that it is proper
to "pass through" such an assessment to renters. Therefore, although benefit
assessments are normally property related, it is deemed valid to equate a portion
of the assessment methodology to the population density of the dwelling units.
Based on data from representative cities in Southern California, the multiple
residential factor is 80 percent. For example, a 100 unit apartment parcel would
be assessed 80 times a single family unit parcel; rather than 100 times.
2. Condominium parcels are adjusted in accordance with the multiple residential
factor of 80 percent because of the high population density of dwelling units.
3. Commercial and Industrial parcels are assessed on the basis of the area of the
parcel. Seven thousand two hundred (7,200) square feet of land has been equated
to one EDU based on the minimum lot size for single family parcels. Therefore,
one acre is equivalent to 6 EDU.
4. Nonprofit or Property Tax Exempt parcels such as churches, private schools,
private hospitals, boys' clubs, women's clubs, YMCA, etc., receive equal benefits
from this type of district and are assessed.
5. Public Utility Owned parcels such as office buildings, plants and yards will be
assessed the same as other similar land uses.
6. Vacant parcel assessments are adjusted by a factor of 20 percent. All vacant
parcels will receive 0.2 EDUs for the first acre and 1.2 EDUs (6 * 0.2) for each
additional acre.

Therefore, as previously stated, it is proposed to spread assessments by the number of
dwelling units on a parcel in residential areas, and by the area of the parcel in commercial
and industrial areas.
C. CATEGORIES OF BENEFIT
Street Lighting
A portion of the benefits for certain improvements may be spread over all parcels of the
City on an equitable basis. This applies to street lighting and traffic signals on major
streets, since vehicles emanating from all parcels throughout the City use these streets and
receive a benefit from the additional safety and security provided by the lights. The cost
of street lights on secondary streets are split evenly, half going to Major streets and the
other half going to local lighting benefit areas based upon levels of service. The balance
of the street lighting costs, which are spread as a benefit assessment to parcels, depend
upon levels of service. The levels of service, relative to local lighting benefits, are broken
down into six separate categories:

Landscaping
Maintaining the street trees and street medians protects the street from erosion, depth and
from tree limbs from falling into or blocking the roadway. The costs of landscaping on
major streets, wetlands, levee beaches and beach water testing are spread as a direct
benefit assessment to all parcels. Costs associated with landscaping on secondary streets
are spread both Citywide and to the parcels that receive local benefits. Those costs are
split evenly, half going to Citywide and the other half to the site-specific street landscape
area. The street landscaping costs on the remaining streets are spread to all parcels in the
neighborhoods with local benefits.
Major streets are defined as Arterial (110') and Major Streets (100') per City of Lake
Elsinore General Plan, they are: Highway 74, Lakeshore Drive, Main Street, Riverside
Drive, Robb Road, Grand Avenue, Mission Trail, Railroad Canyon Road, Diamond
Drive, Corydon Street, Summerhill Drive from Railroad Canyon Road to Riverside
Street, Tuscany Hills Parkways, and Grape Street. Per the "City of Lake Elsinore General
Plan 1992 Land Use Map", the following existing streets are classified as secondary (88'):
Machado Street from Grand Avenue to Lakeshore Drive, Dexter Avenue, Sixth Avenue
from Casino Drive to Lakeshore Drive, Terra Cotta Road from Lakeshore Drive to
Nichols Road, Lincoln Street from Lakeshore Drive to Nichols Road, Lincoln Street from
Grand A venue to Riverside Drive, Lincoln from Machado Street to Shore Cliff Drive,
Chaney Street from Lakeshore Drive to Dexter Avenue, Graham Avenue from Lakeshore
Drive to Main Street, and Pottery Street from Main Street to Franklin A venue. The
remaining City streets are classified below the secondary street level.

The costs of the Assessment District's incidental expenses are spread as a Citywide direct
benefit assessment.
The costs for the maintenance of trees in designated areas are spread to the parcels that
receive local benefit. See Appendix A, Figure 4 - Tree Maintenance Areas, for the
delineation of the five tree maintenance zones.
D. BENEFIT ZONES
A system of zones, encompassing both street lighting and street landscaping levels of
service, has been developed. These zones, combined with an assigned land use based on
the County-assigned use code for each parcel, have been used as the methodology for
spreading the assessments to each parcel within the City. The County-assigned use codes
and a brief description of them are shown in Appendix B.

It is recognized that using the information on the County Assessor's tapes as the primary
source for the assessment formula may lead to circumstances and errors that do not fit the
intent of this program when dealing with specific parcels.
Where such circumstances are discovered, either by the persons administrating this
program or by the owners of the properties affected, such circumstances shall be reported
to the Director of Administrative Services, who may make such final corrections or
adjustments as are consistent with the concept, intent and parameters of the programs set

Lighting Act of 1972 (California Streets and Highways Code
Section 22500 through 22679), Article XIIID of The California
Constitution, and The Proposition 218 Omnibus Implementation
Act (California Government Code Section 53750 Et Seq.)

XmD of the California Constitution, the Proposition 218 Omnibus Implementation Act and in
accordance with the Resolution of Initiation adopted by the Council of the City of Lake Elsinore,

PLANS AN 0 SPECIFICATIONS
The facilities will be operated, serviced and maintained as generally described as follows:
DESCRIPTION OF IMPROVEMENTS, FY 2008-09
The facilities to be maintained and serviced include landscaping for the specific Maintenance District
as described herein. Facilities include but are not limited to: landscaping, planting, shrubbery, trees,
turf, irrigation systems, hardscapes, fixtures, and appurtenant facilities, in public rights-of-way,
parkways, slopes and dedicated easements within the boundaries of said Maintenance District.
Zone 1 (original District) - Encompasses the Water Ridge Development and funds landscape and
street lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include approximately 10,039 square feet of landscaping and 49 street lights.
Zone 2 (Annexation No.1) - Encompasses the Elsinore Homes Development and funds landscape and
street lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include approximately 5,850 square feet of landscaping and 16 street lights.
Zone 3 (Annexation No.2) - Encompasses the Pepper Grove Development and funds landscape and
street lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include approximately 22,560 square feet of landscaping and 4 street lights.
Zone 4 (Annexation No.3) - Encompasses the Serenity Development and funds landscape and street
lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include approximately 630 square feet of landscaping and 63 street lights.
The amount of landscaping has been increased to include approximately 9.52 acres of neighborhood
park landscaping.
Zone 5 (Annexation No.4) - Encompasses the Rosetta Canyon Development and funds street
lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include 263. street lights.
Zone 6 (Annexation No.5) - Encompasses the La Laguna Phase 3 Development and funds street
lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include 28 street lights.
Zone 7 (Annexation No.6) - Encompasses Tract 28214 of the Alberhill Ranch Development and
funds street lighting maintenance and operations. The facilities within the public right-of-way that are
to be maintained and serviced include 244 street lights.
Zone 8 (Annexation No.7) - Encompasses Tract 32670 of the Belcaro Development and funds
landscape maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include approximately 1,080 square feet of landscaping.

street lighting maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include 36 street lights.
Zone 10 (Annexation No.9) - Encompasses Tracts 30698 and 32129 of the Clurman-owned
development and funds street lighting maintenance and operations. The facilities within the public
right-of-way that are to be maintained and serviced include 38 street lights.
Zone 11 (Annexation No. 10) - Encompasses Tract 31920-1 of the Summerly Development and
funds park landscaping and street lighting maintenance and operations. The facilities within the
public right-of-way that are to be maintained and serviced include approximately 4.77 acres of
landscaping and 464 street lights.
Zone 12 (Annexation No. 11) - Encompasses Tract 31957 of the Running Deer Estates development
and funds landscaping and street lighting maintenance and operations. The facilities within the public
right-of-way that are to be maintained and serviced include approximately 116,531 square feet of
landscaping and 24 street lights.
Zone 13 (Annexation No. 12) - Encompasses Tract 33370 of the Tessera Development and funds
landscaping and street lighting maintenance and operations. The facilities within the public right-of-
way that are to be maintained and serviced include approximately 13,100 square feet of landscaping
and 7 street lights.
Zone 14 (Annexation No. 13) - Encompasses Tract 31792 of the Wasson Canyon Development and
funds street lighting maintenance and operations. The facilities within the public right-of-way that are
to be maintained and serviced include 46 street lights.
Zone 15 (Annexation No. 14) - Encompasses Tract 34231 of the Trieste Development and funds
landscaping and street lighting maintenance and operations. The facilities within the public right-of-
way that are to be maintained and serviced include approximately 25,079 square feet of landscaping
(along Ardenwood Way) and 9 street lights.
Zone 16 (Annexation No. 15) - Encompasses the Ridgestone Apartments Development and funds
landscape maintenance and operations. The facilities within the public right-of-way that are to be
maintained and serviced include approximately 1,100 square feet of landscaping (along Ardenwood
Way), and future maintenance of 10,850 square feet of landscaping along Highway 74 (if
maintenance is taken over by the City).
Zone 17 (Annexation No. 16) - Encompasses Tract 32503 of the Rosetta Canyon Development and
funds street lighting maintenance and operations. The facilities within the public right-of-way that are
to be maintained and serviced include 15 street lights.
Zone 18 (Annexation No. 17) - Encompasses Tract 32337-1 of the La Laguna Phases 4 & 5
Development and funds street lighting maintenance and operations. The facilities within the public
right-of-way that are to be maintained and serviced include 36 street lights.
Zone 19 (Annexation No. 17) - Encompasses Tract 32337-2 of the La Laguna Phases 4 & 5
Development and funds street lighting maintenance and operations. The facilities within the public
right-of-way that are to be maintained and serviced include 16 street lights.

Zone 20 (Annexation No. 18) - Encompasses Tract 17413-4 of the Tuscany Hills Estates
Development and funds landscape maintenance and operations. The facilities within the public right-
of-way (Via De La Valle, Via Del Lago and Via De La Luna) that are to be maintained and serviced
include landscaping and a decomposed granite trail.
Zone 21 (Annexation No. 19) - Encompasses Tract 33486 of the Makenna Court Development and
funds landscaping and street lighting maintenance and operations. The facilities within the public
right-of-way that are to be maintained and serviced include approximately 9,800 square feet of
landscaping and 22 street lights.
Zone 22 (Annexation No. 20) - Encompasses the California Business Condos Development and
funds landscape maintenance and operations. The facilities within the public right-of-way that are to
be maintained and serviced include approximately 4,150 square feet of landscaping (along Minthorn
Street), and future maintenance 00,900 square feet of landscaping along Silver Street.
Zone 23 (Annexation No. 21) - Encompasses the Diamond Professional Plaza Development and
funds landscape maintenance and operations. The facilities within the public right-of-way that are to
be maintained and serviced include approximately 7,500 square feet of landscaping along Diamond
Drive.
Maintenance for landscaping means the furnishing of services and materials for the ordinary and usual
maintenance, operation and servicing of the landscaping and appurtenant facilities, including repair,
removal or replacement of all or part of any of the landscaping or appurtenant facilities; providing for
the life, growth, health and beauty of the landscaping, including cultivation, irrigation, trimming,
spraying, fertilizing and treating for disease or injury; the removal of trimmings, rubbish, debris and
other solid waste; and the cleaning, sandblasting, and painting of walls and other improvements to
remove or cover graffiti. Maintenance for street lights means the furnishing of services and materials
for the ordinary and usual maintenance, operation and servicing of the street lights and appurtenant
facilities, including repair, removal or replacement of all or part of any of the street lights or
appurtenant facilities.
Servicing means the furnishing of water for the irrigation of the landscaping and the maintenance of
any of the lighting facilities or appurtenant facilities and the furnishing of electric current or energy,
gas or other illuminating agent for the lighting facilities, or for the lighting or operation of the
landscaping or appurtenant facilities.
The plans and specifications for the improvements, showing and describing the general nature,
location, and the extent of the improvements, are on file in the office of the Director of Public Works
and are incorporated herein by reference.

PART D
METHOD OF APPORTIONMENT OF ASSESSMENT
GENERAL
Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting Act of 1972,
permits the establishment of assessment district by cities for the purpose of providing certain public
improvements which include construction, operation, maintenance and servicing of street lights,
traffic signals and landscaping.
Section 22573 of the Landscaping and Lighting Act of 1972 (the 1972 Act) requires that maintenance
assessments be levied according to benefit rather than according to assessed value. This section states:
"The net amount to be assessed upon lands within an assessment district may be apportioned
by any formula or method which fairly distributes the net amount among all assessable lots
or parcels in proportion to the estimated benefits to be received by each such lot or parcel
from the improvements."
The 1972 Act permits the designation of zones of benefit within any individual assessment district if
"by reason of variations in the nature, location, and extent of the improvements, the various areas will
receive different degrees of benefit from the improvements." (Sec. 22574). Thus, the 1972 Act
requires the levy of a true "assessment" based on the actual benefit rather than a "special tax."
In addition, Proposition 218, the "Right to Vote on Taxes Act" which was approved on the November
1996 Statewide ballot and added Article XmD to the California Constitution, requires that a parcel's
assessment may not exceed the reasonable cost of the proportional special benefit conferred on that
parcel. Article xmD provides that only special benefits are assessable and the City must separate the
general benefits from the special benefits. Article xmD also requires that publicly owned property
which benefit from the improvements be assessed.
REASON FOR THE ASSESSMENT
The assessment is proposed to be levied to pay for the costs of the construction, servIcmg and
maintenance of landscaping, street lighting and appurtenant improvements within the District.
SPECIAL BENEFIT ANALYSIS
Street Landscaping, Slopes and Greenbelts. Trees, landscaping, hardscaping and appurtenant
facilities, if well maintained, provide beautification, shade and enhancement of the desirability of the
surroundings, and therefore increase property value.
In Parkwavs and Land Values, written by John Nolan and Henry V. Hubbard in 1937, it is stated:
"... there is no lack of opinion, based on general principals and experience and common sense,
that parkways do in fact add value to property, even though the amount cannot be determined
exactly.... Indeed, in most cases where public money has been spent for parkways the
assumption has been definitely made that the proposed parkway will show a provable
financial profit to the City. It has been believed that the establishment of parkways causes a
rise in real estate values throughout the City, or in parts ofthe City,..."

It should be noted that the definition of "parkways" above may include the roadway as well as the
landscaping along side the roadway.
The ongoing operation and maintenance of the street landscaping, slopes and green ways within the
individual district, as identified in Part A of this Report, provide beautification to the areas that result
in a special benefit to the parcels within the tracts adjacent to the improvements. If these landscaped
areas were not properly maintained, the tract would be blighted.
The City of Lake Elsinore considers the maintenance and upkeep of parkways and adjacent slopes to
be the responsibility of the adjacent development due to the added beautification of the local
community which extends to the perimeter of the development.
Street Lighting. Proper maintenance and operation of the streetlights benefit all properties within the
District by providing security, safety and community character and vitality as outlined below.
Streetlights provide only incidental benefits to motorists traveling to, from or through the area.
BENEFITS OF STREET LIGHTING

Improvements that provide a special benefit to an isolated group of parcels of land located within the
District are considered to be a localized benefit, and the costs associated with these improvements are
assessed to all assessable parcels receiving the localized benefit. Localized benefits include the
construction, operation, servicing and maintenance of the improvements that only benefit the parcels
located within the localized areas.
Localized Improvements - Parcels that have localized landscaping such as entryway landscaping,
parkway landscaping, etc., and street lighting adjacent to or near their parcels directly benefit from the
improvements and are assessed for the costs of the localized improvements.
ASSESSMENT METHODOLOGY
The maximum annual maintenance assessments shall be increased each year by 2%. The actual
assessments levied in any fiscal year will be as approved by the City Council and may not exceed the
maximum assessment rate without receiving property owner approval for the increase.
To establish the special benefit to the individual parcels within the District, an Equivalent Dwelling
Unit system is used. Each parcel of land is assigned Equivalent Dwelling Units ("EDU's") in
proportion to the estimated special benefit the parcel receives relative to the other parcels within the
District from landscaping and/or streetlights.
The single-family detached (SFD) residential parcel has been selected as the basic unit for calculation
of assessments; therefore, the SFD residential parcel is defined as one Equivalent Dwelling Unit
(EDU). A methodology has been developed to relate all other land uses within each zone to the SFD
residential land use as described below.

The single-family detached (SFD) residential parcel has been selected as the basic unit for calculation
of assessments; therefore, the SFD residential parcel is defined as one Equivalent Dwelling Unit
(EDU). A methodology has been developed to relate all other land uses to the SFD residential land
use as described below.
Developed Non-Residential (Non-Res). Developed non-residential properties are defined as
improved commercial, industrial and institutional properties (such as school property or churches). In
converting these properties to EDU's, the size of the parcels are compared to the average size of a
single-family residential lot, which is 7,200 square feet. This equals approximately 6 SFR lots per
acre of land. Therefore, developed non-residential parcels are assigned EDU's at a rate of 6 EDU's
per acre.
Vacant. Based upon the opinions of professional appraisers, appraising current market property
values for real estate in Southern California, the land value portion of a property typically ranges from
20 to 30 percent of the property's total value. Additionally, the utilization of vacant property is
significantly less than improved property and vacant property has a traffic generation rate of O.
Therefore, vacant parcels will be assessed at the rate of 25% of Non-Res properties, or 1.5 EDU per
acre or any portion thereof.
Types of Benefit
Within the Serenity development (Zone 4) boundary is a 9.52-acre neighborhood park. As a
condition of development, the developer must provide for the on-going operation and maintenance of
the landscaping improvements for said park.
Development Benefit
All 233 parcels within the development were classified as having a development benefit, since the
creation of this funding mechanism satisfies a condition of approval for the development.
Service Benefit
A neighborhood park, by definition, is a park of typically 5 to 20 acres in size and serving an area
from 1;4 mile up to Yz mile distance, which is generally within walking distance of the park. The park
within the Zone 4 boundary is small in size (less than 10 acres); therefore a service area radius of 1;4
mile is used for calculating assessments. All parcels within Zone 4 that are in the 1;4 mile radius will
be assessed for service benefit, in addition to the development benefit, due to their proximity to the
park.
General Benefit
Parcels that are within the 1;4 mile radius but not within the District boundaries are considered to
receive general, rather than special, benefit and are therefore not assessed.
The table below provides the FY 2008-09 assessment apportionment for Zone 4.

On April 8, 2008, the Lake Elsinore City Council adopted Ordinance No. 1252 to protect
residential neighborhoods in our community from becoming blighted through the lack of
adequate maintenance and security of abandoned properties.
Discussion
When the City Council adopted Ordinance No. 1252, Lake Elsinore, as well as many
other jurisdictions in California, were just realizing the severe impact the economy was
having on the local housing market. The number of properties going into default, and
being foreclosed on was something that local jurisdictions had not encountered in the
past. The magnitude of the problems associated with abandoned and foreclosed
properties had not been anticipated.
The adoption of Ordinance NO.1252 was a starting point to provide a measure of
enforcement and the vehicle to ensure that these properties are being maintained in an
acceptable condition, consistent with the surrounding neighborhood. As the effort to
register, document, and maintain these properties continues, staff faces many new
circumstances. Through mutual efforts and communication with surrounding
jurisdictions, local Realtors, and local Homeowner's Associations, staff is learning new
methods of identifying the responsible parties, and how to better enforce the regulations
outlined in the Ordinance.
Though the "Abandoned/Foreclosed Properties Ordinance" has only been enforceable
since May 8, 2008, this report is intended to inform the City Council of the current status
and for staff to receive any further direction and comments.

Fiscal Impact
The budget for operating and maintaining the "Abandoned/Foreclosed Properties"
Program was adopted as part of the FY 2008/2009 Code Enforcement budget. Staffing
for this program was accomplished by re-assigning these duties to Building Inspector
Scott Burns, with assistance provided by other Code Enforcement and Building & Safety
Division staff.

ORDINANCE NO. 1255
AN ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING CHAPTER 17.82 OF THE
LAKE ELSINORE MUNICIPAL CODE REGARDING TIME
EXTENSIONS FOR DESIGN REVIEW APPROVALS
WHEREAS, the Planning and Zoning Law authorizes the legislative body
of a city to adopt ordinances that, among other things, regulate the use of buildings,
structures, and land as between industry, business, residences, and open space; and
WHEREAS, the City of Lake Elsinore wishes to provide clear standards
for the establishment and implementation of time extensions and expirations for Design
Review approvals which can be applied throughout the City of Lake Elsinore; and
WHEREAS, based on evidence presented by the Community
Development Department and other interested parties at a duly noticed public hearing
on May 20, 2008, the Planning Commission recommended that the City Council
approve the ordinance adopting modifications to Chapter 17.82 of the Lake Elsinore
Municipal Code regarding time extensions for design review approvals; and
WHEREAS, at a duly noticed public hearing, held on June 24, 2008, the
City Council considered the Planning Commission's recommendation and evidence
presented by the Community Development Department and other interested parties
regarding the proposed Text Amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, ORDAINS AS FOLLOWS:
Section 1. That Section 17.82.110 of the Lake Elsinore Municipal Code
be amended as follows (additions in underline; deletions in strikethrough):
Section 17.82.110. Lapse of Design Review approval and Time Extensions.
A. A Design Review approval shall lapse and become void one (1) two (2) year~
following the date on which the Design Review became effective, unless one of the
followinq: (1) prior to the expiration of two (2) year~, a building permit related to the
Design Review is issued and construction commenced and diligently pursued toward
completion, or (2) prior to the expiration of two (2) years. the applicant has applied for
and has been qranted an extension of the Desiqn Review approval pursuant to
subsections Band C. Notwithstanding conditions to the contrary, a Design Review
granted pursuant to this Chapter shall run with the land for this two (2) year period,
subiect to any approved extensions. and shall continue to be valid upon a change of
ownership of the site which was the subject of the Design Review application.

B. The expiration date of an approved Desian Review may be extended for no more
than two (2) years. The first extension may be aranted for one (1) year subiect to
the approval of the Community Development Director after consultation with
other city departments if such Desian Review complies with current law.

C. Application for extensions of time shall be filed prior to the expiration of the initial
Desian Review approval and accompanied by a fee in an amount as established
by resolution of the City Council.
D. Any Desian Review approval aranted on or after July 1. 2007. up to the effective
date of this ordinance. shall lapse and become void two (2) years followina the
date on which the Desian Review became effective. unless one of the exceptions
set forth in subparaaraph A is satisfied. then. in which case. the life of the Desian
Review shall be extended in accordance with subparaaraphs Band C.
SECTION 2. Severability. If any provision, clause, sentence or paragraph
of this Ordinance or the application thereof to any person or circumstance shall be held
invalid, such invalidity shall not affect the other provisions of this Ordinance and are
hereby declared to be severable.
SECTION 3. This Ordinance shall take effect thirty (30) days after the date
of its final passage. The City Clerk shall certify as to adoption of this Ordinance and
cause this Ordinance to be published and posted in the manner required by law.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City
Council of the City of Lake Elsinore, California, on this 8th day of July
2008.
