BRADY, CITY MANAGER FEBRUARY 1, 2011 GENERAL PLAN CONFORMITY DETERMINATION FOR PROPOSED STREET VACATION OF A PORTION OF RILEY STREET REDEVELOPMENT AGENCY OF THE CITY OF LAKE ELSINORE REDEVELOPMENT AGENCY OF THE CITY OF LAKE ELSINORE The Redevelopment Agency is requesting that the City vacate a portion of Riley Street in connection with the construction of the Pottery Court affordable housing project. Project Location The project site is located south of Pottery Street, east Langstaff Street, north of Sumner Avenue, and west of the flood control channel, on Assessor Parcel Nos. 374- 071 -003 thru - 014, -026, and -027; 374 - 072 -018, -020, -022, -026, -028, -030, -032, -034, and -036, within Rancho Laguna Redevelopment Project Area No. 1. A map showing the proposed area to be vacated is shown in Attachment 2. The Pottery Court project site plan is shown in Attachment 3. Background On September 4, 2007 the Redevelopment Agency of the City of Lake Elsinore ( "Agency ") issued a Request for Qualifications for a developer partner with expertise in the development and management of affordable housing. On March 25, 2008, the Agency selected BRIDGE Housing ( "BRIDGE ") as that partner. In July and August 2008, Agency staff and BRIDGE collaborated on an application for PC February 1, 2011 Item No. 2 Page 1 of 7 GENERAL PLAN CONFORMITY DETERMINATION FEBRUARY 1, 2011 PAGE 2 OF 4 funds from HUD specifically designated for the development of affordable housing in the Lake Elsinore's Historic Downtown Elsinore Overlay District. On September 23, 2008, the City was awarded a $1 Million grant from HUD through the HOPE VI Main Street program for development of the Pottery Court project. On May 26, 2009, the Agency approved a Disposition and Development Agreement (Pottery Court) which provides for sale of the project site by the Agency and development and long -term operation /management of the project by the developer. Additional Agency assistance was committed on June 22, 2010. In addition, the project was awarded an allocation of approximately $11.5 million of low income housing tax credits by the California Tax Credit Allocation Committee. The County of Riverside has also committed federal HOME funds to the project. Pottery Court's affordable units will make substantial progress toward satisfying the Agency's inclusionary housing requirements and the City's affordable housing objectives. Proiect Descriation The project consists of 113 units, with 111 affordable units and 2 resident manager units. There are eight buildings total. Five (5) of the buildings are proposed at three - stories and three (3) buildings (those facing Langstaff) providing two- stories. The Pottery Court project has received full land use approval and entitlements from the Planning Commission and City Council and is consistent with the City's General Plan and applicable zoning. The proposed street vacation is consistent with the project site plan. Environmental Determination A Notice of Exemption was filed in connection with the Pottery Court project pursuant to the California Environmental Quality Act (Ca. Pub. Res. Code sections 21000 et seq.: "CEQK) and the State Guidelines for Implementation of CEQA (14 Cal. Code Regs. Sections 15000 et seq.: "CEQA Guidelines') as a Class 32 categorical exemption for in -fill development projects. The project was also found to be consistent with MSHCP. Analysis Riley Street (between Sumner Avenue and Pottery Street) is a right -of -way within the proposed Pottery Court development Following vacation, the right of way will be used for parking and as a driveway within the Pottery Court project. Secondary access to the adjacent church parking lot will continue to be provided by way of a reciprocal easement between the church and Bridge Housing. Traffic circulation in the areas near the vacated section of Riley Street is accommodated by existing alternative roads. The vacation will not result in the loss of access to any property along the vacated segment. Recommendation It is recommended that the Planning Commission: 1. Adopt Planning Commission Resolution No. 2011 -_ determining that the vacation of a portion of the street right -of -way on Riley Street between Sumner Avenue and Pottery Street is in conformity with the City's General Plan. PC -2011- RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE ADOPT FINDINGS THAT THE VACATION OF A PORTION OF RILEY STREET CONFORMS TO THE CITY'S GENERAL PLAN WHEREAS, the Redevelopment Agency of the City of Lake Elsinore has filed an application with the City of Lake Elsinore requesting the vacation of a portion of Riley Street located between Sumner Avenue and Pottery Street; and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council regarding whether a street vacation conforms to the City's General Plan; and WHEREAS, notice of the proposed vacation has been given, and the Planning Commission has considered evidence presented by City staff and other interested parties at a public meeting held with respect to this item on February 1, 2011. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RECOMMEND AS FOLLOWS: SECTION 1. The Planning Commission hereby finds and determines that vacation of the portion of Riley Street referenced above conforms to the City's General Plan. SECTION 2. Based upon all of the evidence presented and the finding above, the Planning Commission hereby recommends that the City Council find that the vacation of that portion of Riley Street referenced above is consistent with the City's General Plan. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption. PASSED, APPROVED AND ADOPTED on this first day of February 2011.
