BRADY CITY MANAGER DATE: DECEMBER 22, 2009 SUBJECT: TENTATIVE PARCEL MAP NO. 36123, AND INDUSTRIAL DESIGN REVIEW NO. 2009 -02, FOR PASADENA BUSINESS PARK Background The project was presented to the City of Lake Elsinore Planning Commission on December 1, 2009 for review and consideration. Items for discussion at this meeting included site design, location, access and road improvements associated with the project. Ultimately, the Planning Commission expressed satisfaction with the proposed project and voted unanimously to recommend that the City Council approve Tentative Parcel Map No. 36123 and Industrial Design Review No. 2009 -02. Discussion The applicant is requesting approval of Tentative Parcel Map 36123, pursuant to Title 16 "Subdivisions" of the Lake Elsinore Municipal Code (LEMC), Chapter 17.136 (M -1, Limited Manufacturing) of the LEMC and Section(s) 66424 and 66426 of the California Subdivision Map Act. In addition, the applicant is proposing to construct five (5) concrete (tilt -up) buildings totaling 39,445 square feet. The total land area is 2.62 acres. Fiscal Impact Ultimately, the proposed project will have a positive fiscal impact to the existing industrial area and to the City, in that the project will generate increased sales tax revenue and will expand the availability of job opportunities within the City. Draft Planning Commission minutes dated December 1, 2009 CC December 22, 2009 Item No. 8 Page 2 of 58 VICINITY MAP TENTATIVE PARCEL MAP NO. 36123 AND INDUSTRIAL DESIGN REVIEW NO. 2009 -02 LOCATED AT APN: 377 - 120 -059 \ # 4 C k 4)p � sc PROJECT LOCATION G� 4 ■ A Aill16 ,tA CITY COUNCIL CC December 22, 2009 Item No. 8 Page 3 of 58 RESOLUTION NO. 2009 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADOPTING FINDINGS THAT THE PROJECT KNOWN AS INDUSTRIAL DESIGN REVIEW NO. 2009 -02 IS CONSISTENT WITH THE WESTERN RIVERSIDE MULTIPLE SPECIES HABITAT CONSERVATION PLAN WHEREAS, Carl Johnson, Lake Elsinore 1 L.P., filed an application with the City of Lake Elsinore requesting approval of the subdivision, design, construction and establishment of five (5) industrial /warehouse buildings totaling 39,445 square feet on 2.62 acres of vacant land ( "the Project "), which will be located at the northwest corner of Pasadena Street and Central Avenue at APN 377 - 120 -059 (the "Site "); and WHEREAS, the City Council, of the City of Lake Elsinore, California, has been delegated with the responsibility of reviewing and making findings of consistency with the Western Riverside Multiple Species Habitat Conservation Plan; and WHEREAS, the Western Riverside Multiple Species Habitat Conservation Plan (the "MSHCP ") requires that the City of Lake Elsinore adopt consistency findings demonstrating that the proposed development is consistent with the MSHCP criteria and the MSHCP goals and objectives; and WHEREAS, action taken by the Planning Commission and City Council with regard to the industrial design review is a discretionary action subject to the MSHCP; and WHEREAS, the City Council has considered the recommendation of the Planning Commission following its consideration on December 1, 2009, as well as evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on December 22, 2009. NOW, THEREFORE, the City Council of the City of Lake Elsinore, California, does hereby resolve as follows: Section 1. The City Council has considered the Project's consistency with the Multiple Species Habitat Conservation Plan prior to adopting Findings of Consistency with the MSHCP. Section 2. That in accordance with the MSHCP, the Planning City Council makes the following MSHCP Consistency Findings: 1. The Project is a project under the City's MSHCP Implementing Resolution, and the City must make an MSHCP Consistency finding before approving the Project. CC December 22, 2009 Item No. 8 Page 4 of 58 CITY COUNCIL RESOLUTION NO. 2009 - PAGE 2 OF 5 Pursuant to the City's MSHCP Implementing Resolution, prior to approving any discretionary entitlement, the City is required to review the Project to ensure consistency with the MSHCP criteria and other "Plan Wide Requirements." The Project, as proposed, is not located within an MSHCP criteria cell. The Project was reviewed and found consistent with the following "Plan Wide Requirements ": Protection of Species Associated with Riparian /Riverine Areas and Vernal Pool Guidelines (MSHCP § 6.1.2), Protection of Narrow Endemic Species (MSHCP § 6.1.3), Urban/Wildlands Interface Guidelines (MSHCP § 6.1.4), Vegetation Mapping (MSHCP § 6.3.1), Additional Survey Needs and Procedures (MSHCP § 6.3.2), Fuels Management (MSHCP § 6.4), and payment of the MSHCP Local Development Mitigation Fee (MSHCP Ordinance § 4.0). 2. The Project is subject to the City's Lake Elsinore Acquisition Process (LEAP) and the County's Joint Project Review processes. The Project Site is within the Elsinore Area Plan, but is not located within a Criteria Cell. As such, the Joint Project Review process was not required. 3. The Project is consistent with the Riparian /Riverine Areas and Vernal Pools Guidelines. Section 6.1.2 of the MSHCP focuses on protection of riparian /riverine areas and vernal pool habitat types based upon their value in the conservation of a number of MSHCP covered species. Surface vegetation no longer exists on this Site. The entire Site is bare ground without natural or remnant inclusions of native vegetation. Natural watercourses are not present at the Site. And, no other kinds of aquatic features are present (i.e. wetlands, vernal pools and swales, vernal pool -like ephemeral ponds, stock ponds, etc.). As such, there are no impacts to riparian /riverine areas, vernal pools or fairy shrimp. The Project is therefore consistent with Section 6.1.2 of the MSHCP. 4. The Project is consistent with the Protection of Narrow Endemic Plant Species Guidelines. The Project is located in a Narrow Endemic Plant Species Survey Area as mapped in Section 6.1.3 of the MSHCP. According to a Narrow Endemic Plant Species and Burrowing Owl Habitat Assessment report prepared by Principe and Associates, the Site is highly disturbed and denuded of all vegetation. There is no suitable habitat present on the project Site for Narrow Endemic Plant Species. As such, the Project is therefore consistent with Section 6.1.3 of the MSHCP. CC December 22, 2009 Item No. 8 Page 5 of 58 CITY COUNCIL RESOLUTION NO. 2009- PAGE 3 OF 5 5. The Project is consistent with the Additional Survey Needs and Procedures. The Project is located within the Burrowing Owl survey area as identified in Section 6.3.2 Additional Survey Needs and Procedures of the MSHCP. The Site is highly disturbed and denuded of all vegetation. A Burrowing Owl and Habitat Suitability Survey was conducted on the Site. The results of the Burrowing Owl and Habitat Suitability Survey are contained in the Narrow Endemic Plant Species and Burrowing Owl Habitat Assessment Report (the "Report) prepared by Principe and Associates and the findings contained in the Report are incorporated herein by this reference. During the field surveys, Burrowing Owls were not observed. Neither critical habitat features (i.e. functional rodent or other burrows for roosting or nesting) nor diagnostic signs (i.e. molted feathers, cast pellets, prey remains, eggshell fragments, or excrement) were discovered at or near a burrow entrance. It was determined that there is no suitable habitat present on the Project Site for Burrowing Owl. As such, the Project is consistent with Section 6.3.2 of the MSHCP. 6. The Project is consistent with the Urban/Wildlands Interface Guidelines. The Site is substantially surrounded by development and is not located directly adjacent to any conservation areas, existing or proposed. As such, the Urban Wildlands Interface Guidelines are not applicable to the proposed Project. 7. The Project is consistent with the Vegetation Mapping requirements. The Project Site is not within an MSHCP Criteria Cell and is not located within areas that require mapping of vegetation. As such, the Project is consistent with the MSHCP Section 6.3.1 Vegetation Mapping requirements. 8. The Project is consistent with the Fuels Management Guidelines. The Fuels Management Guidelines presented in Section 6.4 of the MSHCP are intended to address brush management activities around new development within or adjacent to the MSHCP Conservation Area. The Project Site is not in a Criteria Cell and does not abut any areas proposed for conservation. As such, the Project is consistent with the Fuels Management Guidelines. 9. The Project will be conditioned to pay the City's MSHCP Local Development Mitigation Fee. As a condition of approval, the Project will be required to pay the City's MSHCP Local Development Mitigation Fee at the time of issuance of building permits. 10. The Project is consistent with the MSHCP. For the foregoing reasons, the Project is consistent with the MSHCP. Based upon all of the evidence presented, and the above findings, the City Council of the City of Lake Elsinore hereby adopts findings that the Project is consistent with the MSHCP Section 4. This Resolution shall take effect from and after the date of its passage and adoption. (the "Developer "), filed an application with the City of Lake Elsinore requesting approval of Tentative Parcel Map No. 36123 for the subdivision, design, construction and establishment of five (5) industrial /warehouse buildings totaling 39,445 square feet on 2.62 acres of vacant land ( "the Project "); and WHEREAS, the property that Developer proposes to subdivide is located at the northwest corner of Pasadena Street and Central Avenue at APN 377 - 120 -059 (the "Site "); and WHEREAS, the City of Lake Elsinore General Plan and Zoning Maps designate the Site for limited industrial uses; and WHEREAS, the Site has approved access from Pasadena Street and Central Avenue, which streets' alignments and widths have been approved by the City Council as part of the General Plan Circulation Element; and WHEREAS, pursuant to California Government Code sections 66426(c) and 66426(0 it is appropriate for the proposed subdivision to be effectuated by way of a parcel map in lieu of a tract map; and WHEREAS, The California Legislature has determined that certain classes of projects are exempt from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA ") and the State Guidelines for Implementation of CEQA (14 C.C.R. §§ 15000 et seq.: the "CEQA Guidelines "). A Class 32 exemption exists for: "[P]rojects characterized as in -fill development meeting the following conditions: (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses. (c) The project site has no value as habitat for endangered, rare or threatened species. The City Council hereby finds and determines that the Project is exempt from the requirements of the California Environmental Quality Act pursuant to a Class 32 exemption. Specifically, the City Council finds that the Project: 1. The Site is designated as M -1, limited manufacturing, on the City's Zoning Map and LI, limited industrial, on the City's General Plan. The proposed Project is an industrial project and is therefore consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations as set forth herein below. 2. The Project Site 2.62 acres, which is less than (5) acres. The Site is substantially surrounded by urban uses with the Target shopping center to the north, and industrial buildings to the east and south. 3. The Project Site currently vacant. However, according to the Narrow Endemic Plant Species and Burrowing Owl Habitat Assessment report prepared by Principe and Associates, the Site has no value as habitat for endangered, rare or threatened species. 4. Approval of the Project will not result in any significant effects relating to traffic, noise, air quality or water quality. 5. The Project Site can be adequately served by all required utilities and public services. WHEREAS, the City Council, of the City of Lake Elsinore, California, has been delegated with the responsibility of reviewing and making decisions relating to the subdivision of land; and WHEREAS, the City Council has considered the recommendation of the Planning Commission following its consideration on December 1, 2009, as well as evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on December 22, 2009. NOW, THEREFORE, the City Council of the City of Lake Elsinore, California, does hereby resolve as follows: SECTION 1. The City Council has considered the proposed request for Tentative Parcel Map No. 36123 prior to making a decision. The City Council finds and determines that the Tentative Parcel Map request is consistent with Title 16 of the Lake Elsinore Municipal Code SECTION 2. The City Council hereby finds and determines that the Project is exempt from the requirements of the California Environmental Quality Act pursuant to a Class 32 exemption and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.). That in accordance with the Subdivision Map Act and the City of Lake Elsinore Municipal Code, the City Council makes the following findings to approve Tentative Parcel Map 36123: 1. The proposed subdivision, together with the provisions for the design and improvement, are consistent with the General Plan; Zoning Code; Title 16 of the Municipal Code relating to Subdivisions; and the State Subdivision Map Act. The Lake Elsinore General Plan designates the Site as LI (Limited Industrial) and the Zoning Map designates the Site as M -1 (Limited Manufacturing). Tentative Parcel Map 36123 appropriately subdivides the Site into five (5) parcels. The project is consistent with the designated land use planning area, development and design standards, and all other appropriate requirements contained in the General Plan, Zoning Code, City Municipal Code, and Subdivision Map Act. 2. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The project is consistent with the land use plan, development and design standards and programs, and all other appropriate requirements contained in the General Plan. 3. The effects this proposed subdivision is likely to have upon the housing needs of the region, the public service requirements of its residents, and the available fiscal and environmental resources have been considered and balanced. The project is consistent with the City's General Plan and Zoning Code, will provide necessary public services and facilities, will pay all appropriate fees, and will not result in any adverse environmental impacts. SECTION 4. Based upon all of the evidence presented, the above findings, and the conditions of approval imposed upon the Tentative Parcel Map, the City Council hereby approves Tentative Parcel Map No. 36123. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption. The City Council has considered the proposed request for Industrial Design Review No. 2009 -02 prior to making a decision. The City Council finds and determines that the Industrial Design Review request is consistent with the Lake Elsinore Municipal Code. Section 2. The City Council hereby finds and determines that the Project is exempt from the requirements of the California Environmental Quality Act pursuant to a Class 32 exemption and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.). Section 3. That in accordance with Section 17.82 (Design Review) of the Lake Elsinore Municipal Code, the City Council makes the following findings for the approval of Industrial Design Review No. 2009 -02. 1. The project, as approved, will comply with the goals and objectives of the General Plan, and the Zoning District in which the project is located. The proposed Project complies with the goals and objectives of the General Plan, and the Zoning District in which the project is located in that the approval of this industrial warehouse buildings will assist in achieving the development of a well - CC December 22, 2009 Item No. 8 Page 14 of 58 CITY COUNCIL RESOLUTION NO. 2009 - PAGE3OF5 balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses as well as encouraging industrial land uses to diversify Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Project is appropriate to the site and surrounding developments in that the proposed industrial warehouse buildings have been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further, the Project as proposed will complement the quality of existing development and will create a visually pleasing, non - detractive relationship between the proposed and existing projects in that the architectural design, color and material and site designs proposed evidence a concern for quality and originality. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. The proposed Project, as reviewed and conditioned by all applicable City Divisions and Departments and Agencies, will not have a significant effect on the environment. As explained above, the Project is categorically exempt from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.) pursuant to a Class 32 categorical exemption. 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Pursuant to Section 17.184.070 of the Lake Elsinore Municipal Code, the proposed Industrial Design Review located at the northwest corner of Pasadena Street and Central Avenue, has been scheduled for review and consideration by the Planning Commission. Section 4. Based upon all of the evidence presented, the above findings, and the conditions of approval imposed upon the Industrial Design Review, the City Council hereby approves Industrial Design Review No. 2009 -02. Section 5. This Resolution shall take effect from and after the date of its passage and adoption. The sign shall be installed prior to the issuance of a grading permit. ENGINEERING DIVISION 36. Buildings shall be located on their own parcels. No parcel line shall cross the buildings on site. 37.Applicant shall allow for truck turning movements on site as well as onto the site. 38. Provide a truck turning template on the site plan showing adequate room for truck to turn and back into all loading bays. 39. Dedicate full half width of Pasadena Street creating a 45 -foot half width right -of -way dedication. A 35 -foot of roadway improvements shall be constructed between the centerline of Pasadena Street and the curb -face adjacent to the project. This requirement shall be for the project frontage with transitions to the existing pavement where applicable. 40. Dedicate full half width street of 50 -feet on Central Avenue. Construct full half width of Central Avenue measuring 40 -feet from the centerline to the curb face adjacent to the project. Sight distance shall be maintained to CALTRANS standards for ingress, egress and for all onsite drive isles. 42. Applicant shall enter into an agreement with the City for the construction of public works improvements and shall post the appropriate bonds prior to certificate of occupancy. 54.AII compaction reports, grade certifications, monument certifications (with tie notes delineated on 8 'A" x 11" Mylar) shall be submitted to the Engineering Division before final inspection of public works improvements will be scheduled and approved. 55. Provide street lighting and show lighting improvements as part of street improvement plans as required by the City Engineer. 60. Developer shall install blue reflective pavement markers in the street at all fire hydrant locations. 61. If applicable, all traffic control devices shall be installed prior to final inspection of public improvements. This includes No Parking and Street Sweeping Signs for streets within the development. 62.AII improvement plans and tract maps shall be digitized. At Certificate of Occupancy applicant shall submit tapes and /or disks which are compatible with City's ARC Info /GIS or developer to pay $300 per sheet for City digitizing. 63.AII utilities except electrical over 12 kv shall be placed underground, as approved by the serving utility. 64.Apply and obtain a grading permit with appropriate security prior to building permit issuance. A grading plan signed and stamped by a California Registered Civil Engineer shall be required if the grading exceeds 50 cubic yards or the existing flow pattern is substantially modified as determined by the City Engineer. If the grading is Tess than 50 cubic yards and a grading plan is not required, a grading permit shall still be obtained so that a cursory drainage and flow pattern inspection can be conducted before grading begins. 65. Provide soils, geology and seismic report including street design recommendations for plan checking purposes at the time of street improvement or grading permit application, which ever occurs first. At the completion of construction, provide final soils report showing compliance with recommendations. 66.An Alquis - Priolo study shall be performed on the site to identify any hidden earthquake faults and /or liquefaction zones present on -site. 67.AII grading shall be done under the supervision of a geotechnical engineer and he shall certify all slopes steeper than 2 to 1 for stability and proper erosion control. All manufactured slopes greater than 30 ft. in height shall be contoured. 68. Prior to commencement of grading operations, applicant to provide to the City with a map of all proposed haul routes to be used for movement of export material. Individual lot drainage shall be conveyed to a public facility or accepted by adjacent property owners by a letter of drainage acceptance or conveyed to a drainage easement. 71.AII natural drainage traversing site shall be conveyed through the site, or shall be collected and conveyed by a method approved by the City Engineer. 72. Meet all requirements of LEMC 15.64 regarding flood hazard regulations. 73. Meet all requirements of LEMC 15.68 regarding flood plain management. 74. Submit Hydrology and Hydraulic Reports for review and approval by City Engineer and the Riverside County Flood Control District prior to issuance of building permit. Developer shall mitigate any flooding and /or erosion caused by development of site and diversion of drainage. 75.AIi drainage facilities on this site shall be constructed to Riverside County Flood Control District Standards. 76. Storm drain inlet facilities shall be appropriately stenciled to prevent illegal dumping in the drain system, the wording and stencil shall be approved by the City Engineer. 77. 10-year storm runoff should be contained within the curb and the 100 -year storm runoff should be contained with the street right -of -way. When either of these criteria is exceeded, drainage facilities should be installed. 78.A drainage acceptance letter will be necessary from the downstream property owners for discharging the proposed storm water run -off on private property. 79. Applicant will be required to install BMP's using the best available technology to mitigate any urban pollutants from entering the watershed. 80.Applicant shall obtain approval from Santa Ana Regional Water Quality Control Board for their storm water pollution prevention plan including approval of erosion control for the grading plan prior to issuance of grading permits. Intersection site distance shall meet the design criteria of the CALTRANS Design Manual (particular attention should be taken for intersections on the inside of curves). The Tentative Parcel Map proposes to create a five (5) lot parcel map for the industrial complex, known as the "Pasadena Business Park ". Generally, a tract map is required for all subdivisions creating five or more parcels. However, the Section 66426(c) of the Subdivision Map Act provides an exception for a subdivision of land that consists of a parcel of land having approved access to a public street or highway, which comprises part of a tract of land zoned for industrial development, and which has the approval of the governing body as to street alignments and widths. When an exception to the tract map rule applies, the Subdivision Map Act permits the subdivider to instead follow the parcel map procedures. Here, because the subdivider proposes to divide the Site into five (5) parcels, a tract map would ordinarily be required. However, because the Site is designated for industrial uses pursuant to the Lake Elsinore General Plan and Zoning map, because the Site has approved access, and because the Site affronts streets with approved alignments and widths, the project qualifies for the exception to the tract map rule. Consequently, this subdivision can be effectuated by way of the parcel map process. Landscaping The applicant is proposing to provide landscaping on twenty five percent (25 %) of the project Site. This exceeds the minimum landscaping coverage requirement of twelve percent (12 %) per the Lake Elsinore Municipal Code. A minimum of five percent (5 %) of the landscaping will be located within the parking and driveway areas per Section 17.148.100.D of the LEMC. Architecture /Colors and Materials The applicant is proposing to construct five (5) pre -cast concrete (tilt -up) buildings ranging in size from 4,180 square feet to 15,000 square feet, for a total building area of 39,445 square feet. Each building will have a standard entrance door, and a twelve foot (12') roll -up door. Standard sized loading spaces (Type A — 12' x 20' and Type B — 12' x 40') designated for loading purposes only will be provided for each unit. The applicant is proposing to construct rectangular shaped buildings, typical of the neighboring industrial complexes. Each building will incorporate a pop -out tower element for visual relief and shadowing. The pop -out tower element will be a darker color to contrast against the background of the remaining building. The Project is a project under the City's MSHCP Implementing Resolution, and the City must make an MSHCP Consistency finding before approving the Project. Pursuant to the City's MSHCP Implementing Resolution, prior to approving any discretionary entitlement, the City is required to review the Project to ensure consistency with the MSHCP criteria and other "Plan Wide Requirements." The Project, as proposed, is not located within an MSHCP criteria cell. The Project was reviewed and found consistent with the following "Plan Wide Requirements ": Protection of Species Associated with Riparian /Riverine Areas and Vemal Pool Guidelines (MSHCP § 6.1.2), Protection of Narrow Endemic Species (MSHCP § 6.1.3), Urban/Wildlands Interface Guidelines (MSHCP § 6.1.4), Vegetation Mapping (MSHCP § 6.3.1), Additional Survey Needs and Procedures (MSHCP § 6.3.2), Fuels Management (MSHCP § 6.4), and payment of the MSHCP Local Development Mitigation Fee (MSHCP Ordinance § 4.0). 2. The Project is subject to the City's Lake Elsinore Acquisition Process (LEAP) and the County's Joint Project Review processes. The Project Site is within the Elsinore Area Plan, but is not located within a Criteria Cell. As such, the Joint Project Review process was not required. 3. The Project is consistent with the Riparian /Riverine Areas and Vernal Pools Guidelines. Section 6.1.2 of the MSHCP focuses on protection of riparian /riverine areas and vernal pool habitat types based upon their value in the conservation of a number of MSHCP covered species. Surface vegetation no longer exists on this Site. The entire Site is bare ground without natural or remnant inclusions of native vegetation. Natural watercourses are not present at the Site. And, no other kinds of aquatic features are present (i.e. wetlands, vernal pools and swales, vernal pool -like ephemeral ponds, stock ponds, etc.). As such, there are no impacts to riparian / riverine areas, vernal pools or fairy shrimp. The Project is therefore consistent with Section 6.1.2 of the MSHCP. 4. The Project is consistent with the Protection of Narrow Endemic Plant Species Guidelines. The Project is located in a Narrow Endemic Plant Species Survey Area as mapped in Section 6.1.3 of the MSHCP. According to a Narrow Endemic Plant Species and Burrowing Owl Habitat Assessment report prepared by Principe and Associates, the Site is highly disturbed and denuded of all vegetation. There is no suitable habitat present on the project Site for Narrow Endemic Plant Species. As such, the Project is therefore consistent with Section 6.1.3 of the MSHCP. The Project is located within the Burrowing Owl survey area as identified in Section 6.3.2 Additional Survey Needs and Procedures of the MSHCP. The Site is highly disturbed and denuded of all vegetation. A Burrowing Owl and Habitat Suitability Survey was conducted on the Site. The results of the Burrowing Owl and Habitat Suitability Survey are contained in the Narrow Endemic Plant Species and Burrowing Owl Habitat Assessment Report (the "Report") prepared by Principe and Associates and the findings contained in the Report are incorporated herein by this reference. During the field surveys, Burrowing Owls were not observed. Neither critical habitat features (i.e. functional rodent or other burrows for roosting or nesting) nor diagnostic signs (i.e. molted feathers, cast pellets, prey remains, eggshell fragments, or excrement) were discovered at or near a burrow entrance. It was determined that there is no suitable habitat present on the Project Site for Burrowing Owl. As such, the Project is consistent with Section 6.3.2 of the MSHCP. 6. The Project is consistent with the Urban/Wildlands Interface Guidelines. The Site is substantially surrounded by development and is not located directly adjacent to any conservation areas, existing or proposed. As such, the Urban Wildlands Interface Guidelines are not applicable to the proposed Project. 7. The Project is consistent with the Vegetation Mapping requirements. The Project Site is not within an MSHCP Criteria Cell and is not located within areas that require mapping of vegetation. As such, the Project is consistent with the MSHCP Section 6.3.1 Vegetation Mapping requirements. 8. The Project is consistent with the Fuels Management Guidelines. The Fuels Management Guidelines presented in Section 6.4 of the MSHCP are intended to address brush management activities around new development within or adjacent to the MSHCP Conservation Area. The Project Site is not in a Criteria Cell and does not abut any areas proposed for conservation. As such, the Project is consistent with the Fuels Management Guidelines. 9. The Project will be conditioned to pay the City's MSHCP Local Development Mitigation Fee. As a condition of approval, the Project will be required to pay the City's MSHCP Local Development Mitigation Fee at the time of issuance of building permits. 10. The Project is consistent with the MSHCP. For the foregoing reasons, the Project is consistent with the MSHCP. The Site is substantially surrounded by urban uses with the Target shopping center to the north, and industrial buildings to the east and south. 3. The Project Site currently vacant. However, according to the Narrow Endemic Plant Species and Burrowing Owl Habitat Assessment report prepared by Principe and Associates, the Site has no value as habitat for endangered, rare or threatened species. That in accordance with Section 17.82 (Design Review) of the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for the approval of Industrial Design Review No. 2009 -02: 1. The project, as approved, will comply with the goals and objectives of the General Plan, and the Zoning District in which the project is located. The proposed Project complies with the goals and objectives of the General Plan, and the Zoning District in which the project is located in that the approval of this industrial warehouse buildings will assist in achieving the development of a well - balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses as well as encouraging industrial land uses to diversify Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. Further, the Project as proposed will complement the quality of existing development and will create a visually pleasing, non - detractive relationship between the proposed and existing projects in that the architectural design, color and material and site designs proposed evidence a concern for quality and originality. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. The proposed Project, as reviewed and conditioned by all applicable City Divisions and Departments and Agencies, will not have a significant effect on the environment. As explained above, the Project is categorically exempt from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.) pursuant to a Class 32 categorical exemption. 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.82. Vice-Chair Gonzales asked the }applicant when he anticipates starting construction. Dwight Jo ; son responded by saying construction would begin once the economy gets better. Commissioner Mendoza stated his only concern was whether vehicle access was from Pasadena Street and not from Central Avenue. Commissioner O'Neal asked staff when the applicant submitted their application. Planning Consultant Coury replied the original application was submitted approximately two years ago, however because of complications on both sides the project is now coming before the Commission.
