SUBJECT: ASSESSMENT AND IMPLEMENTATION PLAN FOR
ESTABLISHMENT OF PERMANENT OFF -LEASH DOG AREA
Background
The City Council was recently petitioned by over 200 citizens to establish a Dog
Play Area within an enclosed baseball field at McVicker Canyon Park. A 90 -day
trial period was approved by the Council on September 22 2009. The 90 -day
trial period began on October 14 and will conclude on January 12, 2009.
The City Council acknowledged the public's request for the establishment of a
permanent off -leash dog area and directed City Staff to conduct an assessment
and implementation plan.
Discussion
City Staff's assessment consisted of an internet search and field surveys of
established off -leash dog areas to determine development standards and site
selection criteria. Nine potential sites within the City were evaluated based on
the selected standards and site criteria. The results of the assessment are
contained in the attached report entitled "Guide for Establishing Off -Leash Dog
Areas ".
The outcome of the assessment is an implementation plan for establishing an
Off -Leash Dog Play Area at Rosetta Canyon Park. This park is currently under
construction, so this is an opportune time to incorporate this feature.
Fiscal Impact
Staff estimates the cost to construct the Off -Leash Dog Play Area at Rosetta
Canyon Park in an amount not to exceed $55,000. The fenced enclosure would
encompass approximately 1.5 acres. The estimate includes two fenced pens,
self - latching gates, double entry gates, water supply, dog water dispensers, drip

irrigation, planting of interior trees, wood chip ground cover, pet waste stations,
benches, and regulatory signage.
During the initial stages of the Rosetta Canyon Fire Station and Park project, the
City Council approved a phasing of the park improvements to maximize
construction with the available funds. This phasing process resulted in a
reduction of fees for water services from EVMWD in the amount of $68,985.
Staff is proposing to use $55,000 of this refund to finance a change order for the
construction of the Off -Leash Dog Play Area.
Recommendation
1. Direct Staff to incorporate Off -Leash Dog Play Areas into future park
development based upon the principles contained in the "Guide to
Establishing Off -Leash Dog Play Areas ".
2. Approve the conceptual design and location of a 1.5 -acre dog park located
at Rosetta Canyon Park.
3. Approve a change order to the Rosetta Canyon Fire Station and Park —
Phase 1 project in an amount not to exceed $55,000 from the reimbursed
EVMWD fees.
4. Direct staff to construct the dog park in a configuration consistent with
conceptual design.

GUIDE FOR ESTABLISHING OFF -LEASH DOG AREAS
STATEMENT OF PURPOSE
The City Council recognizes the increasing necessity for Dog Parks in the City of Lake
Elsinore. Local Dog Parks provide a place for exercising, playing and socializing dogs
and dog owners alike. The City desires to provide off -leash Dog Parks for its citizens
and their dogs to the benefit of the Community. To ensure compatibility with other
Community and Park goals, the City Council requested an assessment of the various
issues posed by establishing a Dog Park, as well as the development of standards and
the selection of suitable sites for placement within the City.
PEOPLE, PETS, PARKS AND PLANNING
The Parks & Recreation Master Plan (2008 -2030) describes the long term aspirations of
the City to provide parks to satisfy a wide variety of recreational activities in a functional
and aesthetically pleasing environment to meet the needs of its citizens. One of the
overall goals of the Master Plan is highlighted below.

The City's current "Recreational Facility Standards" provides for the following
recreational amenities:
• baseball fields, multi - purpose fields, picnic areas, tot lots /children playground,
swimming pools, tennis courts, basketball courts, volleyball courts, exercise
course, horseshoe pits and handball courts.
The Recreational Facility Standards did not include the establishment of dog parks or
dog play areas.

This guidance document offers a starting point to begin the public process of
establishing Off -Leash Dog Parks within the City to ensure compatibility with other park
and community goals by developing site selection and design standards. Conversion of
existing park sites into Off -Leash Dog Areas may be controversial. The public process
necessitates extensive community outreach and public meetings to reach a consensus
prior to proceeding with an implementation plan for existing park sites.
COMMUNITY NEEDS
Pet ownership is growing in leaps and bounds across the US and dog owners are
increasingly including their pet into their activities. Dogs have become an integral part
of society. Locally, the City of Lake Elsinore is estimated to have a dog population of
approximately 9,600 dogs.
Dog Demographics for City of Lake Elsinore:
• Citizen Population = 50,267
• Number of Households in City = 14,478
• *Dog Population Estimate = 9,600
•
*Dog Population Estimate extrapolated based upon the following statistics compiled from the
American Pet Products Manufacturers Association (APPMA) 2007 -2008 National Pet Owners
Survey.
Dog Demographics for U.S.:
• There are approximately 74.8 million owned dogs in the United States
• Thirty -nine percent of U.S. households own at least one dog
• Most owners (63 percent) own one dog
• Twenty -five percent of owners own two dogs
• Twelve percent of owners own three or more dogs
• On average, owners have almost two dogs (1.7)
• Seventy -five percent of owned dogs are spayed or neutered
On May 7, 2008 a Community Workshop was held by the Parks & Recreation
Department to gauge the public's opinion of the top issues concerning future park
development. The creation of "Off -Leash Dog Parks" was rated in the top five (5) of
twenty -four (24) different categories.
The City Council was recently petitioned by over 200 citizens to establish a Dog Play

was approved by the Council on September 22 2009. The 90 -day trial period began
on October 14 2009. At this time, there is not sufficient information to judge the

outcome of the trial period. However, the City Council acknowledged the public's
request for the establishment of a permanent dog park and directed City Staff to
conduct an assessment and implementation plan.
RESEARCH
City Staff conducted an extensive internet search and performed field surveys of four
dog parks in three different counties to assist in developing the recommended
standards for a Dog Park. The results of the field survey are provided in the reference
section of this document. The four Dog Parks surveyed were:
1. Redhawk Community Park — 44747 Redhawk Parkway, Temecula, CA 92592
2. Pooch Park — 31461 Golden Lantern, Laguna Niguel, CA 92677
3. Bob Burkhardt Dog Park — 13094 Civic Center Dr., Poway, CA 92064
4. Mayflower Dog Park — 3450 Valley Parkway, Escondido, CA 92027
DEFINITIONS
"Dog Park" means a park dedicated for the primary purpose of providing an off -leash
dog area and supporting amenities.
"Dog Play Area" means a designated off -leash area inside a multi -use park.
DESCRIPTION OF GENERAL DESIGN ELEMENTS
Below is a general list and description of elements provided at Dog Parks.
1. Restrooms:
a. Typical Park Restroom Facility with flushing toilets, sinks and separate
men and women's bathrooms.
b. Portable Restrooms with hand sanitizer dispensers.
2. Parking:
a. Asphalt paved parking with a minimum twenty (20) parking stalls.
b. Parking on native base (dirt).

a. Close proximity of ADA parking places.
b. ADA complaint accessible route.
c. Available only at paved parking Tots.
4. Fenced Dog Enclosure:
a. The minimum total area for a fenced dog enclosure is about one acre
(43,500 sq -ft).
b. It is preferable to have two acres (87,000 sq -ft).
c. Fence heights are in the range of 4 to 6 feet.
5. Dog Separation by Size:
a. Dogs should be separated by size to reduce the chance of severe injury or
death to smaller dogs involved in fights or mauling by substantially larger
dogs. Most of the Dog Parks provide two or three separate areas.
b. If two (2) fenced dog enclosures are preferred, then dogs should be
separated approximately based upon the following weight classes.
i. Less than 30 pounds.
ii. Greater than 30 pounds.
c. If three (3) fenced dog enclosures are preferred, then dogs should be
separated approximately based upon the following weight classes.
i. Less than 20 pounds.
ii. 20 to 50 pounds.
iii. Greater than 50 pounds.
d. The separately fenced dog enclosures may be sized to provide additional
space for large dogs or more dogs of a certain size class.
6. Pens for Fenced Dog Enclosure:
a. A one acre fenced dog enclosure should have two equally divided pens
with approximately 22,500 square feet (150'x150') per pen.
b. Sites with at least 1.7 acres frequently have three pens with the following
approximate area per pen:

i. 40,000 square feet (200'x200')
ii. 22,500 square feet (150'x150')
iii. 10,000 square feet (100'x100')
c. Pen dimensions will vary based on the best fit with the specific site.
7. Fence Material:
a. Chain -link is the most common, least expensive and most durable fencing
material; however, the aesthetics are poor.
b. Split rail fencing made of wood, vinyl or pre -cast concrete with 2 "x4" wire
mesh attached to the interior side to prevent escape of small dogs is an
option. It has better aesthetics, but isn't as durable as chain -link. The
wood material splinters and requires annual painting.
c. Decorative rod iron or tubular aluminum with wire mesh attached to the
interior to prevent escape of small dogs is an option. This is the most
expensive option. The metal rod iron requires substantial maintenance,
whereas as tubular aluminum is rust free (ex: Elm Grove Beach).
8. Entry Gate(s):
a. Self- latching entry gate(s).
b. Double entry gates that open into a small pen are preferred to prevent
dogs from escaping. The outside entry gate separates the small pen from
the exterior of the dog enclosure. Whereas, the inner gate separates the
small pen from the interior dog enclosure.
9. Ground Cover:
a. Turf:
i. The most common material used for ground cover. It also appears
most dog owners would prefer turf; however the turf is expensive to
maintain and keep in good condition under heavy use. It may be
appropriate in existing park areas for conversion into Dog Play
Areas.
b. Tree Bark:
i. Aesthetically pleasing, with low maintenance costs.

ii. Conserves water, no mowing and deters weeds.
iii. Difficult for small dogs to walk on, it hides droppings and floats in
heavy rains.
iv. Sanitary, as it can be replaced.
c. Wood Chips:
i. Aesthetically pleasing, with low maintenance costs.
ii. Free from City's tree trimming service.
iii. Conserves water, no mowing and deters weeds.
iv. Sanitary, as it can be replaced.
d. Native (dirt):
i. Least expensive
ii. Poor aesthetics.
iii. Low maintenance costs, primarily weed abatement.
iv. Muddy in rain and in areas adjacent to pet watering stations.
10. Pet Waste Stations:
a. Provide pet waste stations equipped with disposable bags and trashcan.
11. Pet Watering Station:
a. Dogs easily overheat in the summer months. A source of water would
need to be provided. There are an assortment of low cost methods to
provide water for the dogs.
12. Drinking Fountain for People.
13. Trees:
a. Provide shade trees within the interior of the fenced dog enclosure.
b. Large trees often utilized along the outside fenced dog enclosure to
obscure view of Dog Park.

15. Signage (Regulatory):
a. Post Rules & Regulations.

a. Water spray misters provide cool -down areas for dogs and owners.
Usually associated with shade structures.
19. Lighting:
a. Field lighting provided for nighttime use.
RECOMMENDED STANDARD DESIGN ELEMENTS
There are three general classes for developing an Off -Leash Dog Park/Play Area, which
are primitive, basic and exceptional.
Based on the results of the research and evaluation, City Staff recommends the
following "basic" design elements as a City standard for a Permanent Off -Leash Area.
1. Restrooms - Typical Park Restroom Facility.
2. Parking - Asphalt paved parking with a minimum twenty (20) parking stalls.
3. ADA Parking and Accessible Route.
4. Fenced Dog Enclosure:
a. It is preferable to have two acres (87,000 sq -ft). The minimum total area
for a fenced dog enclosure is about one acre (43,500 sq -ft).
b. Fence height at 5 -feet.
5. Dog Separation by Size:
a. Two fenced dog pens are preferred to separate dogs based upon the
following weight classes.
i. Less than 30 pounds.
ii. Greater than 30 pounds.

b. Alternatively, Split Rail and wire mesh to conform to surrounding area.

b. Alternatively, existing turf for conversion to Dog Play Area.
10. Pet Waste Stations.
11. Pet Watering Station.
12. Drinking Fountain for People.
13. Trees:
a. Provide shade trees within the interior of the fenced dog enclosure.
14. Benches.
15. Signage (Regulatory).
SITE SELECTION CRITERIA
The City shall evaluate potential establishment of standard Off -Leash Dog Park or Play
Areas using the following site selection criteria to consider available space, topography,
impact on existing facilities and adjacent property, as well as compatibility with the
overall park plans.
1. Total Area required for Off -Leash Area:
a. A Dog Park with standard elements requires a total of about four (4) acres.
b. A standard Dog Play Area requires about two (2) acres.

2. The distance between the proposed Off -Leash Area and adjacent homes and
businesses shall be evaluated for potential impacts caused by noise, aesthetics,
odor and public safety. The preferred minimum distance of a Dog Enclosure from
homes and businesses is two hundred feet (200').
3. The establishment of an Off -Leash Dog Play Area within an existing multiuse park
shall be evaluated for potential impacts caused by noise, aesthetics, odor, sanitation
and public safety. Areas of potential conflict include:
a. Children's playgrounds and Tot Tots.
b. Athletic Fields and courts.
c. Jogging or bicycle paths.
d. Sensitive habitats or wildlife areas.
4. A Dog Play Area shall not be placed in a multiuse park if it will negatively impact the
primary use of the park, unless the impact can be mitigated, such as regulating
hours of operation.
5. To reduce stormwater pollution and encourage percolation, the Off -Leash Area
should be located on substantially level ground or sloped away from natural water
courses and stormwater channels.
6. A series of Off -Leash Dog Areas should be established in the City and located to
facilitate public access by being within a 15 minute drive of most residence. The
City will require a north, south and east site location master plan to cover the major
park service areas.
7. An Off -Leash Dog Area shall comply with all codes and regulations of the American
with Disabilities Act. ADA Access shall be considered when selecting a site for the
Off -Leash Area to provide adjacent parking and an ADA compliant accessible route.
8. A potable water connection shall be available at the selected site.
RULES & REGULATIONS
The rules and regulations shall be prominently posted at the entrance of Off -Leash Dog
Areas. The sign posting shall include operating hours, warnings, dog requirements,
owner requirements and enforcement information. Below are recommended rules and
regulations.
Operating Hours:
The hours of operation will be set specifically for each location based on adjacent land
use and other park activities.

Warninq(s):
• Enter at your own risk. Visitors entering the fenced "Dog (off - leash) Play Area"
during operating hours are at risk of being bitten, knocked down or tripped by
unleashed dogs.
• Dog owners are responsible and liable for the behavior of their dog at all times,
including injury to persons and damage to the Park's landscape and infrastructure.
• Adults accompanied by children under the age of five (5) years are discouraged from
entering.
• Strollers, carriages, bicycles and children's toys are prohibited.
• Children under the age of fifteen (15) years must be accompanied by an adult.
• Smoking, alcoholic beverages, food and dog treats are prohibited.
Doq Requirements:
• Dogs are permitted to be "off leash" within the fenced area only.
• Dogs must be leashed when entering or leaving this area.
• Dogs must have a current license and vaccinations.
• Dogs must wear a properly fitted collar, with the dog license tag attached. Choke,
prong, spiked or shock collars are prohibited.
• Dogs that are sick or in heat are prohibited.
• Dogs exhibiting aggressive behavior, such as biting or growling, are prohibited and
shall immediately vacate the area.
• Dogs that bark excessively and become a public nuisance shall vacate the area.
• Puppies under four (4) months of age are prohibited.
• Digging by dogs is prohibited.
• A dog that has been formally classified as "dangerous or vicious" per California State
Law are prohibited.
Owner Requirements:
• Owners must remain with dogs inside the fenced area at all times.
• Owners must immediately remove and properly dispose of their dog's droppings.

• Owners must possess a leash at all times.
• Owners are limited to a maximum of two (2) dogs at one time in this area.
• Owners must retain proper identification in their possession.

Guide for Establishing a Dog Park (DRAFT)
IMPLEMENTATION ACTION PLAN
The outcome of the assessment is an implementation plan for establishing an Off -Leash
Dog Play Area at Rosetta Canyon Park. This park is currently under construction, so
this is an opportune time to incorporate this feature.
BUDGET
Capital Costs:
Staff estimates the capital cost to construct the Off -Leash Dog Play Area at Rosetta
Canyon Park in an amount not to exceed $55,000. The fenced enclosure would
encompass approximately 1.5 acres. The estimate includes two fenced pens, self -
latching gates, double entry gates, water supply, dog water dispensers, drip irrigation,
planting of interior trees, wood chip ground cover, pet waste stations, benches, and
regulatory signage.
Operation & Maintenance Costs:
The annual operating and maintenance costs are estimated at $7,500. This figure is
considerably less expensive than maintaining a greenbelt or turf field. This cost is
already incorporated into the Rosetta Canyon Park operation and maintenance budget.
CAPITAL COST FUNDING
During the initial stages of the Rosetta Canyon Fire Station and Park project, the City
Council approved a phasing of the park improvements to maximize construction with the
available funds. This phasing process resulted in a reduction of fees for water services
from EVMWD in the amount of $68,985. Staff is proposing to use $55,000 of this refund
to finance a change order for the construction of the Off-Leash Dog Play Area.

• Multi -use park, small playground, ball field and a lot of open turf area surround it

Pooch Park — Laguna Niguel
• Dog park only — located next to fire station
• Two areas, no signs or verbiage stating dogs must be separated by size
• Bark ground cover — one complaint was that feces can blend in with bark making
it hard to locate
• Double entry gate
• 6' high chain link fence around majority of park, on the side next to the fire
station there was black rod iron bars; 2' high section of netting around the base of
the entire park
• 1 porta potty located immediately outside the gate to the trail entrance
• 1 bench in the park with dedication names and bulletin board areas
• 4 picnic tables in the large pen, 2 of which were covered with shade structures
• 2 trees located in the large pen, liquid amber trees
• Pet waste stations were a mixture of 4 bag dispensers and 5 trash cans periodically
placed along the perimeter of the fencing; 2 bag dispensers and 1 can was placed
along the trail, and 2 bag dispensers and 2 cans were located in the parking lot
• 2 pet watering stations, one single for dogs only and another one connected to the
drinking fountain, area around stations seems very soaked; several water pales
and bowls were located throughout the park for residents to fill up
• 1 drinking fountain
• 30 parking stalls — 28 located in the parking lot at the end of the trail, 2 handicap
stalls were located next to the fire station
• No lighting — Park open Mon.— Sat lam to dusk, Sundays 8am to dusk; closed
Mon and Fri 8am to 12pm for maintenance
• ADA accessible — best handicap access out of the four -parks inspected, had a
paved walkway from the entrance alI the way to a shade covered picnic table
• Park has locking entry gates to close the parking lot completely at night
• Dog Park maintenance was contracted out
• Near unreadable sign on each entry gate into park reads: Please: - Absolutely no
food allowed, - Maximum three (3) dogs per person, - No aggressive dogs, -
closely supervise small children
• No chains on the entry gates to secure the pens at night
• Concrete picnic pads were 16 x 19 ft in dimension
• Parking lot is 775 ft from the entrance to the dog park; residents have to walk
along a winding trail and slope to get to park
• Residents interviewed stated they really enjoyed the park thoroughly as is, one
resident would like to see a pool/splash area for dogs to play in during the hotter
summer months

Bob Buckhardt Dog Park — Poway
• Multiuse Park — One of Poway's biggest, park includes 2 baseball fields, 2 tennis
courts, bocce ball court, boys & girls club, senior center, swimming pool, two
playgrounds, auditorium and a soccer field
• Three areas, one area for small dogs, one for medium dogs, and one for large dogs
all labeled
• Turf ground cover
• Double entry gates
• 5' high chain link fence
• Restrooms available in the park, but none in close proximity to the dog park,
closest restrooms are approximately 800 feet away
• Benches and picnic tables in each pen: small pen has 1 bench and 4 picnic tables;
medium pen has 1 bench and 4 picnic tables; large pen has 2 benches and 3 picnic
tables
• No shade structures located in dog park
• Many well established trees provide shade for residents: small pen has 4 trees,
medium.pen has 9 trees, and large pen has 8 trees
• Pet waste stations are a mixture of bag dispensers and trash cans: small pen had 1
bag dispenser and 3 trashcans, medium pen had 1 bag dispenser and 2 trashcans,
and large pen had 4 bag dispensers and 3 trashcans
• Pet water stations: each pen contained one hose bib with a specialized drip spout
attached to the end, a French drain was positioned around each water source
• Drinking fountains available in the park, but none in close proximity to the dog
park, closest drinking fountains are located by restrooms

Dog Park Survey Notes
Mayflower Dog Park — Escondido
• Dog park only — located by the Escondido Humane Society and Hidden Valley
Obedience Club
• Three areas, no signs or verbiage stating dogs must be separated by size
• Turf ground cover
• Double entry gates
•. 6' high chain link fence around perimeter, and in between pen 2 & 3; 4' high
chain link fence in between pen 1 & 2 and also between walkway and pens
• No restroom facility on site
• Benches and picnic tables in each pen: pen #1 has 2 bench and 2 picnic tables;
pen #2 has 3 bench and 2 picnic tables; pen #3 has 2 benches and 2 picnic tables
• No shade structures located in dog park
• Newer planted trees throughout the pens: pen #1 has 3 trees, pen #2 has 6 trees,
and pen #3 has 7 trees
• Pet waste stations are a mixture of bag dispensers and trash cans: pen #1 had 3
bag dispenser and 3 trashcans, pen #2 had 4 bag dispenser and 4 trashcans, and
pen #3 had 4 bag dispensers and 2 trashcans
• Pet water stations: each pen contained one hose bib with a regular spout, a French
drain was positioned around each water source
• No drinking fountains were located in the park
• 21 total parking stalls —19 regular stalls and 2 handicap stalls
• Lighting available to cover all 3 pens, lights remain on everyday until 9pm; park
is closed for maintenance Mon, Wed, Fri from l lam to 1pm
• ADA accessible entry to all 3 pens
• An old fire hydrant was installed in pen #1

• Large shrub line is planted in between the dog park and Valley Parkway road
• Resident complaint about park was that there is no designation for pens based on
dog size. Other people had protested over assigning pens by size due to the fact
that they owned both a large and small dog. I observed for the most part that
residents separated by dog size on their own, smaller dogs in pen #1 and larger
dogs in pen #3. Some residents still complained that it was a major issue.
• Total Area 528 ft x 195 ft = 93984 ft
• Pen #1 100 ft x 200 ft = 20000 ft
• Pen #2 148 ft x 196 ft = 29008 ft
• Pen #3 280 ft x 158.ft = 44240 ft

Banning of "Dangerous or Vicious" Dogs
Counties and Cities may adopt ordinances controlling potentially dangerous and vicious
dogs; however, California Laws prohibits enacting ordinances that specifically ban
certain breeds of dog.
CALIFORNIA CODES
FOOD AND AGRICULTURAL CODE
SECTION 31681 -31683
31683. Nothing in this chapter shall be construed to prevent a city
or county from adopting or enforcing its own program for the control
of potentially dangerous or vicious dogs that may incorporate all,
part, or none of this chapter, or that may punish a violation of this
chapter as a misdemeanor or may impose a more restrictive program to
control potentially dangerous or vicious dogs. Except as provided in
Section 122331 of the Health and Safety Code, no program regulating
any dog shall be specific as to breed.
Animal Friends of the Valley Policy — Potentially Dangerous Dog Listing
AFV takes very seriously our obligation and duty to investigate incidents that involve the
possession of potentially dangerous dogs. The decisions made by Animal Control on behalf
of the citizens ensure the health, safety and welfare of the public.
Food & Agriculture Code 31601.
The Legislature finds and declares all of the following:
(a) Potentially dangerous and vicious dogs have become a serious and widespread threat to
the safety and welfare of citizens of this state. In recent years they have assaulted without
provocation and seriously injured numerous individuals, particularly children, and have
killed numerous dogs. Many of these attacks have occurred in public places.
(b) The number and severity of these attacks are attributable to the failure of owners to
register, confine, and properly control vicious and potentially dangerous dogs.
Please be aware that Food & Agriculture Code 31602 defines a "Potentially Dangerous Dog"
as:
(a) Any dog which, when unprovoked, on two separate occasions within the prior 36 -month
period, engages in any behavior that requires a defensive action by any person to prevent
bodily injury when the person and the dog are off the property of the owner or keeper of
the dog.
(b) Any dog which, when unprovoked, bites a person causing a less severe injury than as
defined in Section 31604.

(c) Any dog which, when unprovoked, on two separate occasions within the prior 36 -month
period, has killed, seriously bitten, inflicted injury, or otherwise caused injury attacking a
domestic animal off the property of the owner or keeper of the dog.
Food & Agriculture Code 31603 defines a vicious dog as:
(a) Any dog seized under Section 599aa of the Penal Code and upon the sustaining of a
conviction of the owner or keeper under subdivision (a) of Section 597.5 of the Penal Code.
(b) Any dog which, when unprovoked, in an aggressive manner, inflicts severe injury on or
kills a human being.
(c) Any dog previously determined to be and currently listed as a potentially dangerous dog
which, after its owner or keeper has been notified of this determination, continues the
behavior described in Section 31602 or is maintained in violation of Section 31641, 31642
or 31643.
