REGULATION OF CANDIDATE MATERIALS AND COSTS;
ESTABLISHING RUNOFF ELECTION FOR TIES; AND
REQUESTING REGISTRAR OF VOTERS TO RENDER ELECTION
SERVICES
Background
A "Notice of Intention to Circulate a Recall Petition" against Councilmember Thomas
Buckley was received by the City on March 10, 2009. The recall proponents started
collecting signatures May 5, 2009 and submitted the completed petition to the City
Clerk's office on August 22, 2009. Per Elections Code Section 11220, signatures
from 20 percent of Lake Elsinore's 15,985 registered voters were required.
The completed petition was then submitted to the Riverside County Registrar of
Voters for verification and certification. The petition was determined to be "sufficient"
and a Certification noting all requirements was issued. The Certification was
submitted to the City Council as required per Election Code Section 11227 on
October 13, 2009. Council requested specific information be provided on for the
October 27 regular meeting
1) Recommendation of potential Special Election dates; and
2) Recommendation of financial availability for funding a Special Election.
Discussion
Elections Code Section 11240 states within 14 days after receiving the Certificate,
the City Council must issue an order setting a Special Election. The election must
be held not less than 88 and not more than 125 days from the date of the order. If

the City Council elects not to issue such an order, a special election will be ordered
by the County Registrar of Voters.
1 a) ROV recommendation and resolution setting Special Election date:
As noted above, Section 11240 states the special election must be held not
less than 88 and not more than 125 days from the date of the order.
Elections Code Section 1100 requires that all elections be held on a Tuesday
and that no election shall be held on the day before, the day of, or the day
after a state holiday. The applicable 2010 state holidays are February 12
(President Lincoln's Birthday) and February 15 (President's Day).
If the election is ordered by the City Council on October 27, 2009, the
potential dates for an election are:
• January 26, 2010
• February 2, 2010
• February 9, 2010, or
• February 23, 2010.
Sample schedules of events detailing the various deadlines associated with
the election are attached for the first and the last potential dates (January 26
and February 23
Potential Consolidation with State Senate Election:
There is currently a vacant seat on the Riverside County Board of
Supervisors. The Board has recommended that the Governor appoint State
Senator John Benoit, currently serving Senate District 37 which includes Lake
Elsinore. Such appointment would necessitate a special election within
Senate District 37 to fill Senator Benoit's vacated seat.
The ROV has stated that, depending on the Governor's action, an opportunity
for a consolidation with the Senate District special election may exist on either
January 26 or February 23, 2010.
The City Clerk will advise the Council prior to the meeting if the Governor has
taken action and, accordingly, if the date of a special election for District 37 is
available for consolidation.

Recommendation of the Riverside County Registrar of Voters (ROV):
The ROV has recommended that the election be held on February 23, 2010.
This recommendation is based on the following:
• Possible consolidation (see above).
• Longest campaign time allotted for all candidates.
• Mailing of campaign literature, absentee and sample ballots, set
for December 17, 2009 through January 5, 2010 would be
greatly be impacted by holiday mail if an earlier date is chosen.
• The ROV has an election scheduled in December 2009 and,
therefore, the February 23 date would greatly assist her staff
with meeting the mailing deadlines (late January).
1 b) Resolution establishing regulation of candidate materials and costs:
Elections Code Section 13307 allows the City Council to adopt regulations
pertaining to materials prepared by any candidate, including the cost of the
candidate's statement. The attached resolution has been prepared for
consideration by the City Council establishing the estimated candidate's costs
for this Recall Special Municipal Election. A $25.00 fee will be paid to the City
when nomination papers are pulled. If the candidate chooses to prepare and
print an optional Candidate's Statement of 200 words, the estimated charge is
$850.00 to cover the cost established by the Riverside County Registrars of
Voters. If applicable, excess funds received will be reimbursed or insufficient
funds will be requested when the final cost have been determined after the
election.
The attached resolution is applicable only to this specific Recall Special
Municipal Election and automatically terminates once the election has taken
place.
1 c) Resolution establishing runoff election for ties:
Elections Code Section 15651 provides that tie elections will be determined
"by lot" conducted by the City Council unless the Council adopts a resolution
calling for a runoff election. If the City Council prefers that a runoff election be
conducted in the event of a tie, the Council must adopt the attached
resolution establishing that procedure.
Due to the cost of a run -off election and the short time remaining in
Councilman Buckley's term, City staff does not recommend adoption of the
attached resolution.

1d) Resolution requesting ROV to render election services:
Elections Code Section 10002 allows the City Council to request the Board of
Supervisors allow the "County Election Department" to render election
services to the City related to the Recall Special Municipal Election. The
attached resolution, if adopted by the Council, requests the Board of
Supervisors to authorize the Riverside County Registrar of Voters to provide
the necessary election services. Expenses in performing these election
services must be paid by the City of Lake Elsinore. The estimated cost for
the Recall Special Municipal Election is $30,000 to $50,000.
2) Budget Allocation:
Per the criteria specified by the California Secretary of State's office and the
California Elections Code, which specifies the required process, a recall
election is not a planned event. Accordingly, the funds to cover such an
election have not been set aside in the 2009/10 budget.
City staff recommends that the Council authorize the transfer of $50,000 from
the Unallocated Fund Balance to the General Fund for payment of election
expenses.
Fiscal Impact
The Riverside County Registrar of Voters has estimated the costs of the Special
Recall Election at $30,000 to $50,000.
Recommendations
1) Choose one of the proposed dates and adopt a Resolution to Order a date for
a Recall Special Municipal Election.
2) Adopt a Resolution to establish Candidate Rules and Regulations specific
only to this Recall Special Municipal Election and automatically rescind this
adopted Resolution once the election has taken place.
3) Decline to adopt a Resolution to hold a Special Runoff Election if the election
results are tied
4) Adopt a Resolution requesting the Riverside County Board of Supervisors to
authorize the Registrar of Voter's office to render services for this Recall
Special Municipal Election and automatically rescind this adopted Resolution
once the election has taken place

5) Direct the City Manager which financial funds to use from the Fiscal Year
2009/10 budget to cover the Recall Special Municipal Election's expenses.
City management recommends transferring funds from the Unallocated Fund
Balance to the General Fund to cover all costs associated with the Recall
Special Municipal Election.

ELECTIVE OFFICES IN THE EVENT OF A TIE VOTE AT
ANY MUNICIPAL ELECTION HELD BY THE CITY
WHEREAS, California Elections Code Section 15651(b) authorizes the
City Council, by majority vote, to adopt provisions to require the conduct of a Runoff
Election to resolve a tie vote involving those candidates who received an equal
number of votes and the highest number of votes for an elective office;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. Pursuant to California Elections Code
Section 15651(b), if any two or more persons receive an equal and the highest
number of votes for an office to be voted for within the City, there shall be held within
the City a Special Runoff Election to resolve the tie vote. A Special Runoff Election
shall be called and held on a Tuesday not less than 40 days nor more than 125 days
after the administrative or judicial certification of the election which resulted in a tie
vote.
SECTION 2. The City Clerk shall certify to the passage and

WHEREAS, a Recall Special Municipal Election is to be held in the
City of Lake Elsinore, California, on ; and
WHEREAS, in the course of conducting this election, it is necessary

be paid by the City of Lake Elsinore, California.

attached to self - mailer sample ballot pamphlets; and will also furnish to the City

and will make available to the City additional election equipment and assistance

SECTION 2. The City of Lake Elsinore shall reimburse the
County for services performed when the work is completed and upon presentation to
the City of a properly approved bill.
SECTION 3. The City Clerk of the City of Lake Elsinore,
California is directed to forward without delay to the Riverside County Board of
Supervisors and to the Riverside County Election Department, each a certified copy
of this resolution.

WHEREAS, California Elections Code Section 13307 provides the
governing body of any local agency adopt regulations pertaining to materials
prepared by any candidate for a municipal election, including costs of the
OPTIONAL candidate's statement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMIE
AND ORDER AS FOLLOWS:
SECTION 1. APPLICABILITY. This Resolution shall apply only
to the Special Runoff Municipal Election to be held on Tuesday,
. All previous resolutions establishing Council Policy on
payment for Candidate Statements are repealed.
SECTION 2. GENERAL PROVISIONS. Pursuant to California
Elections Code Section 11307, each candidate for elective office to be voted on in
the Recall Special Municipal Election scheduled to take place on Tuesday,
may prepare a candidate's statement for submission to the
City Clerk. The statement may include the name, age and occupation of the
candidate and a brief description of no more than 200 words of the candidate's
education and qualifications as expressed by the candidate. The statement shall not
include party affiliation of the candidate, nor membership or activity in partisan
political organizations. The statement shall be filed in the Office of the City Clerk at
the time the candidate's nomination papers are filed. The statement may be
withdrawn, but not changed, during the period for filing nomination papers and until
5:00 p.m. of the next working day after the closing of the nomination period.
SECTION 3. FOREIGN LANGUAGE POLICY.
(a) Pursuant to the Voting Rights Act, the City may be required to
translate candidates' statements into the following language: Spanish

(b) The City Clerk shall cause all candidates' statements translated
into Spanish at no charge to the candidates.
SECTION 4. PAYMENT.
(a) The candidate shall be required to pay a filing fee of $25.00
when nomination papers are pulled.
(b) If the candidate chooses to prepare an optional Candidate's
Statement of 200 words, the estimated charge is $850.00. This cost has been
established by the Riverside County Registrars of Voters and includes printing the
candidate's statement in the voter's pamphlet along with related handling and
mailing charges. Excess funds received will be reimbursed or insufficient funds will
be requested when the final cost have been determined after the election.
SECTION 5. No candidate will be permitted to include
additional materials in the sample ballot package.
SECTION 6. The City Clerk will provide each candidate with a
copy of this Resolution at the time nomination papers are pulled.
SECTION 7. It is agreed by the City Council this Resolution
shall apply ONLY to the Recall Special Municipal Election of Thomas Buckley and
shall automatically be rescinded 60 days after the completion of this election
process.
SECTION 8. The City Clerk shall certify to the passage and
adoption of this Resolution and enter it into the book of original Resolutions.

WHEREAS, the City of Lake Elsinore, California is a General Law
City; and
WHEREAS, the City Clerk received a Certification of Sufficiency for a
recall petition regarding elected official Councilmember Thomas Buckley; and
WHEREAS, California Elections Code Section 11240 mandates the
City Elections Official to submit such Certification of Sufficiency to the governing
body at the next scheduled regular or adjourned regular meeting; and
WHEREAS, the City Elections Official presented to the City Council
the Certification of Sufficiency on October 13, 2009; and
WHEREAS, the City of Lake Elsinore Governing Body refers to the
City Council and the City Elections Official refers to the City Clerk; and
WHEREAS, California Elections Code Section 11241 authorizes the
City Council, to order and set the date for a Special Election within 14 days after the
presentation of the Certification of Sufficiency submitted to the City Council; and
WHEREAS, California Elections Code Section 11241 authorizes the
Riverside County Registrar of Voters to order and set the date for a Special Election
within 5 days after 14 day of the presentation of the Certification of Sufficiency
submitted to the City Council should they fail to set the election date; and
WHEREAS, the City Council and / or the Riverside County Registrar of
Voters are authorized and directed by the Elections Code Sections referenced
above to submit the proposed recall decision to the voters of the City of Lake
Elsinore; and
WHEREAS, candidates shall be elected to fill the vacancy if the recall
prevails; and

A. The referenced election shall be held on Tuesday,
for the purpose of submitting the question if
Councilmember Buckley shall be recalled, yes or no.
B. If the voter states "no" then the voter shall not vote for another
candidate listed on the recall ballot; and
C. If the majority of votes received state "no" then Councilmember
Buckley shall not be recalled and shall serve out the rest of his current elected term
which ends November 2010; and
D. If the voter states "yes" then the voter shall also vote to
determine which candidate listed on the recall ballot shall fill the vacancy; and
E. If the majority of votes received state "yes" then Councilmember
Buckley shall be recalled and shall not serve out the rest of his current elected term

SECTION 3. The ballots to be used at the election shall be in form and
content as required by law.

SECTION 4. The City Clerk is authorized, instructed and directed to
procure and furnish any and all official ballots, notices, printed matter and all
supplies, equipment and paraphernalia that may be necessary in order to properly
and lawfully conduct the election.
SECTION 5. The polls shall be open at seven o'clock a.m. of the day
of the election and shall remain open continuously from that time until eight o'clock
p.m. of the same day when the polls shall be closed, except as provided in California
Elections Code Section 14401.
SECTION 6. In all particulars not recited in this resolution, the election
shall be held and conducted as provided by law for holding municipal elections.
SECTION 7. The notice of the time and place of holding the election is
given and the City Clerk is authorized, instructed and directed to give further or
additional notice of the election, in time, form and manner as required by law.
SECTION 8. This Resolution shall apply ONLY to the Recall Special
Municipal Election of Thomas Buckley and shall automatically be rescinded 60 days
after the completion of this election process.
SECTION 8. The City Clerk shall certify to the passage and adoption
of this resolution and enter it into the book of original Resolutions.
