SUBJECT: RECALL PETITION CERTIFICATE OF REGISTRAR OF VOTERS
Background
The "Notice of Intention to Circulate a Recall Petition" against Councilmember
Thomas Buckley was received by the City on March 10 2009.
Since then, the recall process has been proceeding forward. The recall process is
governed by the California Elections Code and guided by the Secretary of State's
publication "Procedure for Recalling State and Local Officials" (Revised 2007). As
the City's elections official, the City Clerk is charged with oversight of the recall
process.
Once the form and wording of the petition was approved, the proponents were given
120 days in accordance with Elections Code Section 11220 to obtain signatures
from 20 percent of Lake Elsinore's 15,985 registered voters. The proponents' first
day to collect signatures started May 5, 2009 and continued through
September 1, 2009.
The completed petition was delivered to the City Clerk on August 22, 2009 and a
prima facie examination was made by the City Clerk to determine if enough
signatures had been submitted to accept the petition for filing as required by
Elections Code Section 11222(b).
The preliminary count revealed that the petition contained the required number of
signatures. Accordingly, the petition was accepted and thereafter delivered to the
Riverside County Registrar of Voters to conduct the examination necessary to verify
whether a sufficient number of signatures were those of qualified registered voters.

Discussion
Per Elections Code Section 11227, "if the elections official finds the signatures on
the petition to be sufficient, he or she shall submit his or her certificate as to the
sufficiency of the petition to the governing body at its next regular meeting. The
certificate shall contain:
(1) The name of the officer whose recall is sought.
(2) The title of his or her office.
(3) The number of signatures required by law.
(4) The total number of signatures on the petition.
(5) The number of valid signatures on the petition.
(6) The number of signatures which were disqualified.
Based on its examination, the Registrar determined that the petition was signed by
the requisite number of voters and provided the attached Certificate to the City Clerk
on September 22, 2009. The purpose of this agenda item is for the City Clerk to
submit the Registrar's Certificate in accordance with Elections Code Section 11227.
No City Council action is required.
Elections Code Section 11240 provides that within 14 days of receiving the
Certificate, the City Council must issue an order setting a special election. The
election must be held not less than 88 and not more than 125 days from the date of
the order. If the City Council elects not to issue such an order, a special election will
be ordered by the County Registrar of Voters.
Fiscal Impact
None at this time. The fiscal impact of an election is not known at this time, but is
estimated to be between $30,000 and $50,000.
Recommendation
No City Council action is required at this time.

hereby certify that on August 24, 2009 the Petition to Recall Councilman Thomas Buckley of the City
of Lake Elsinore was delivered to my office for the purpose of verifying that the signatures thereon
were registered within the defined area.
I further certify that the signatures on said petition were counted and examined by means of a 100%
verification process, and that the results of said examination are as follows:
That the total number of signatures submitted for said petition was.... 3,575
- The total number of signatures checked was 3,575
The total number of sufficient signatures on said petition is 3,256
The total number of insufficient signatures on said petition is 319
I further certify that the number of valid signatures required to qualify said petition is 3,197 and that,
because the number of valid signatures on said petition was 3,256 the petition is hereby declared
sufficient.
