MITIGATION FOR CONSTRUCTION OF BOAT LAUNCH FACILITY
IMPROVEMENT PROJECT
Background
The City of Lake Elsinore is proposing to rehabilitate the old Boat Launch Facility built
by the State of California in the 1960s. The facility is located at 32040 Riverside Drive.
This facility was the first and primary public boat launch providing access to Lake
Elsinore from its completion to its closure in 2005 due to flooding. This forty- year -old
Boat Launch Facility has deteriorated with time and requires rehabilitation to serve the
needs of the boating public and increase safety for shoreline users. The existing boat
launch facility becomes submerged at a lake elevation higher than 1,240' MSL (feet
above mean sea level NGVD'29). The community's goal operating elevation for Lake
Elsinore is between 1,240' to 1,249'MSL, which renders this facility unusable.
The City's proposed Boat Launch Facility Improvement Project is located below the
ordinary high water mark (OHWM) of Lake Elsinore at 1,255'MSL. Projects occurring
below the OHWM require obtaining a Federal Clean Water Act 404 Permit from the U.S.
Army Corps of Engineers (USACE) prior to construction. Part of the USACE's permit
process requires compensatory mitigation from the project proponents for any loss to
the resource resulting from the project.
The City's proposed improvements will dramatically increase the range of operating
elevations for the boat launch. The Boat Launch Facility will be constructed to function
at a wide range of lake elevations, from 1,235' MSL to 1,255' MSL. Lake Elsinore's
overflow elevation is 1,255' MSL and the 100 Year Flood Elevation is 1,263.3' MSL.
These key elevations were used as the design elevations for the improvements. For
example, the top of the boat ramp, parking lot and entrance roadway will all be raised
greater than or equal to an elevation of 1,256' MSL; whereas the restroom building will
be elevated higher than 1,263.3' MSL.

The City's plan to elevate 11.5 acres of the project site above the OHWM and out of the
existing lakebed, triggered the compensatory mitigation requirement by the USACE.
The USACE is requiring the establishment of an equivalent habitat mitigation area of
11.5 acres to obtain the permit.
Discussion
To satisfy the USACE's compensatory mitigation requirement, City Staff is proposing to
set aside and enhance 11.5 acres of the lower portion of the T- peninsula of the earthen
levee system. City Staff selected this area based on existing land ownership and
unlikely future development. The proposed mitigation site is at a low elevation (1,244'
to 1,247' MSL) and subject to frequent inundation, rendering the property unbuildable at
the current elevations. Furthermore, this site is inaccessible by public roadways, so the
majority of the public would have limited access to any future improvements. These
factors make this location a better tradeoff than any other potential mitigation site
around the Lake.
As a supplementary background note, a conceptual scheme for future development of a
"Recreation Island" was proposed for the T- peninsula in the "Lake Elsinore Master
Plan /Economic Feasibility Study (1994) ". This concept plan was to be developed in
conjunction with the Eastlake Community Builders. The outdated Lake Elsinore Master
Plan wrongly states the final "as built" elevation for the majority of the T- peninsula as
being 1,265' MSL. In fact, only a small portion of the T- peninsula was actually
constructed above the elevation of 1,265'MSL and this upper portion was built to
support three of EVMWD's wells. The majority of the T- peninsula is at or below an
elevation of 1,247' MSL.
The Corps has agreed to accept the 11.5 acres of the lower T- peninsula as mitigation
for the loss of aquatic resources and habitat as a result of the project; provided the City
prepare and implement an acceptable "Habitat Mitigation & Monitoring Plan (HMMP) ".
The City's environmental consultants, HDR, prepared an HMMP report, which has been
accepted by the Corps. Additional professional services will be required to prepare
engineered plan drawings and specifications to implement the HMMP.
Approval of the U.S. Army Corps of Engineers permit establishes the conditions that the
City will be required to implement beginning sixty (60) days after the public bid award to
construct the Boat Launch Facility Improvement Project. The two major conditions are:
The City will permanently preserve 11.5 acres of the lower portion of the T-
peninsula of the levee system as specified in the HMMP.
2. The City will provide an Implementation Program for the HMMP that shall
document the source of funding, schedule and identify the contractor. City Staff
estimates the total cost to implement the HMMP in the range of $100,000 to
$120,000.

Fiscal Impact
There is no immediate cost to the City for approving the U.S. Army Corps of Engineers
permit; however, any future City Council bid award to construct the Boat Launch Facility
Improvement Project will require the City to expend approximately $120,000 to
implement the conditions of the permit.
Recommendation
Approve U.S. Army Corps of Engineers permit and authorize the City Manager to
execute the document.

Specifically, you are authorized to conduct the following activities �iffectin- 1,vmers of

1. Pern-tanently discharge up to 196,000 cubic yards (cy) of fill material, 170,000 L y of
excavated fill material from the 100 year floodplain of Lake Elsinore and 26,000 cv vt
imported construction material, into 11.5 acres of non - wetland waters of tlrc U.S.;
2. Dredge up to 26,000 cy of fill raterial frorn a 2.2 -acre area adjacent to the BLE-- site;
3. Construct a six -lane boat launching ranrp, including launch ranip apron sand SL,iginl;
area (approximately 1.14 feet wide and 210 feet long;);
4. Install a 425 -foot floating breakti.vater /dock system with guide piles;
5. Build two 100 -foot boarding floats; and
6. Create the following attendant features: a vehicle /trailer surface parking lot, a four -lane
guttered boat wash with catch basins and drainage lines, a four -stall restroom facility
with barrier -free access, a fish cleaning station, and a landscaped picnic area with
lighting.
Project Location The proposed project site is located at 32040 Riverside Drive within'+eaion .3
of Township 6 South, Range 5 West, of the U.S. Geological Survey Lake V1sinow, Califorioa7 7_ i
minute topographic quadrangle map within the City of Lake Elsinore, Riverside County, CA
(see Figures 1 through 3, and 6)(latitude:: 33:676553° W, longitude: A17.373774° N).

Permit Conditions:
General Conditions:
1. The time limit for completing the authorized activity ends on September 10, 2013. If you find
that you need more time to complete . the authorized activity, submit your request for a time
extension to this office for consideration at least one month before the above date is reached.
?. You must maintain. the activity authorized by this perm
in good condition and in
conformance with the terms and conditions of this permit. You are not relieved of this
requirement if you abandon the permitted activity, although you may make a good faith transfer
to a third party in compliance with General Condition 4 below. Should you wish to cea;e to
maintain the authorized activity or should you desire to abandon it without a stood faith transfer,
you must obtain a modification from this permit from this office, w'hic:h may require rest()ration
of the area.
3. If you discover any previously unknown historic or archeological remains while
accomplishing the activity authorized by this permit, you Hurst immediately notify this office of
vvrhat you have found. We will initiate the Federal and state coordination required to determine d
the remains warrant a recovery effort or if the site is eligible for listing; in the National Register of
Historic Places.
4. If you sell the property associated with this permit, you must obtain the signature of the nei v
owner in the space provided and forward a copy of the permit to this office to validate the
transfer of this authorization.
5. If a conditioned water.' quality certification h.as been issued for your project, you must comply
with the conditions specified in the certification as special conditions to this permit. For your
convenit.race, a copy of the certification is attached if it contains such conditions.
6. You must allow representatives from this office to inspect the authorized activity at any three
deemed necessary to ensure that it is being or has been accomplished with the terms and
conditions of your permit.
Special. Conditions:
I . The Permittee shall mitigate for permanent impacts to 11.5 acre(s) of waters of the U. S.,
thrOUgh restoration and erdiancement of 11.5 acre(s) of waters of the U.S. as described in the
final mitigation plan.: "Boat Lau:n.ch. Facility Habitat Mitigation and Monitoring flan" (dat(d
April 2009, revised August 2009, and prepared by HDR Engineering, Inc.). The Permittee .shall
fully implement this final. mitigation plan within 1.20 days of initiation of work in water� of the
U.S. According to the final mitigation plan, responsible parties would be as follows: a)
Implementation: City Manager, City of Lake Elsinore; b) Performance: City Manager, City of
Lake Elsinore; c) Long -term management: City Manager, City of Lake Elsinore. The Permittee
retains ultimate legal responsibility for meeting the requirements of the final mitigation plan.
Detailed mitigation objectives, performance standards, and .mon.itoring requirements are

L) One copy of as built drawings for the entire project, including all mitigation
(all sheets must be signed, dated, to- scale, and no larger than 11 x 17 inches).

at the dredging site, excavation of dredged material within the project boundaric��; end

2. For this permit, the maximum dredging design depth (also known as the project depth or
grade) shall be at 1,228 MSL, with a m :aximuna allowable overdredge depth of minus two (?)
feet below 1,228 MSL. No dredging shall occur deeper than 1,226 :MSL (dredging design (.4q)th
plus overdredge depth) or outside the project bou..ndaries.
3. Upon request, the Perrnittee and its contractor(s) shall allow inspectors from the Corps
and(or) EPA to inspect all phrases of the dredging; and disposal operations.
4. The perrnitted. activity shall not interfere with the public's right to free navigation on all
navigable waters of the United `_hates.
5. If a violation of any permit condition occurs, the violation shall be reported by the Permittee
to the Corps within twenty -four (24) hours. if the Perrnittee retains any contractors to perform
any activity authorized by this permit, the Permittee shall instruct all such contractors that
notice. of any violations must be reported to the Perrnittee immediately.

1.0 DESCRIPTION OF THE PROJECT / IMPACT SITE
This Habitat Mitigation and Monitoring Plan (HMMP) describes mitigation for impacts resulting
from the rehabilitation of the non - functional Lake Elsinore Boat Launch Facility (BLF). The
mitigation will occur at a 1:1 ratio off -site on a portion of the T- peninsula, located at the eastern side
of Lake Elsinore. Currently, the Lake Elsinore BLF site is not accessible when lake levels exceed
1,240 feet above mean sea level (AMSL), as it does under existing conditions. As a result of
frequent water inundation, the Lake Elsinore BLF has become degraded and non- functional.
To ensure that the BLF site is functional at a wide range of elevations, rehabilitation activities also
include raising the BLF site above Lake Elsinore's spill elevation of 1,255 feet AMSL. To
accomplish this, approximately 194,000 cubic yards (cy) of native fill material would be deposited
on the BLF site, within waters of the U.S., for a final solid fill volume of 154,000 cy after shrinkage

1.2 LOCATION OF PROJECT / IMPACT SITE
The BLF site is located along the northern shore of Lake Elsinore at 32040 Riverside Drive
(APN 379 -120 -008) within the City of Lake Elsinore, Riverside County, California (Figure 1). The
site can be found within Section 3 of Township 6 South, Range 5 West, of the U.S. Geological
Survey Lake Elsinore, California, 7.5 minute topographic quadrangle map. The geographic
coordinates near the middle of the site are 33.676553 °W latitude and - 117.373774 °N longitude.
1.3 PROJECT SUMMARY
The proposed project will include the demolition and removal of the existing boat ramp and
construction of the following improvements:
• Six -lane boat launching ramp, including launch ramp apron and staging area (approximately
114 feet wide and 210 feet long);
• 425 -foot floating breakwater /dock system with guide piles;
• Vehicle /trailer surface parking lot (260 spaces with an additional 10 handicap accessible);
• Four -lane guttered boat wash with catch basins and drainage lines;
• Four -stall restroom facility with barrier -free access;
• Fish cleaning station;
• Landscaped picnic area with lighting; and
• Two 100 -foot boarding floats (movable for varying lake levels).
Figure 2 shows the site plan and jurisdictional limits as it relates to the proposed project. As
identified above, development of these improvements will require elevating the existing BLF site to
1,255 feet above mean sea level (AMSL). Approximately 196,000 cy of material will be used to fill
waters of the U.S. After factoring in shrinkage and settlement there would be a final fill volume of
154,000 cy. Approximately 144,000 cy of this fill material will be excavated from the back basin
area of Lake Elsinore. Another 26,000 cy of fill material will be dredged from a 2.2 -acre site
adjacent to the existing BLF. The remaining 26,000 cy of fill material will be imported in the form
of asphalt pavement, pavement base material, and rock riprap.
1.4 JURISDICTIONAL AREAS TO BE IMPACTED AND HABITAT TYPE
Impacts to approximately 11.5 acres of non - wetland jurisdictional waters of the U.S. will occur with
rehabilitation of the BLF site. Specifically, approximately 196,000 cy of material will be used to fill
waters of the U.S. The current vegetation community is characterized by disturbed /developed land.
Remnants of asphalt from the previous boat ramp are located within the development footprint. The
vegetation is of a disturbed nature with large areas of bare ground. There is a low diversity of native
and non - native plant species within the development footprint due to previous and on -going
disturbance(s).

1.5 TYPE(S), FUNCTIONS, AND VALUES OF THE JURISDICTIONAL AREAS TO BE
DIRECTLY AND INDIRECTLY IMPACTED
Direct impacts will occur to 11.5 acres of disturbed waters of the U.S. The impacted area has
relatively low resource value due to the degree of d] isturbance from historic boating - related activities
and current lack of vegetation. The vegetation on ste is a mixture of native and non - native species
which include cheeseweed (Malva parviora), salt grass (Distichlis spicatu), heliotrope
(Heliotropium curvassavicum) red -stem stork's -bill (Erodium cicutarium) and tamarisk (Tamarisk
sp.). The low stature of the plants onsite is attributed to regular mowing. The limited and disturbed
nature of the on -site vegetation does not provide high quality nesting habitat for birds or other
wildlife species. However it does provide limited foraging habitat for various bird species that use
the lake.
1.6 CRAM ANALYSIS OF MITIGATION SITE
A California Rapid Assessment Method (CRAM) Analysis was prepared for the off -site mitigation
area at the T- peninsula. The results of the CRAM Analysis are included as Appendix A of this
document. The T- peninsula has been graded; therefore, there is little topographic relief beyond the
30 percent slope located at the eastern portion of the site. The total vegetation cover of the T-
peninsula ranges from 60 to 70 percent with a mixture of native and non - native species including
Indian sweet clover (Melilotus indicus), heliotrope and tamarisk. Additionally, signs of ponding
were observed which explains the low vegetation cover associated with portions of the site. The site
floods on an annual basis.
The overall buffer score of the T- peninsula is relatively low because the site is surrounded on three
sides by Lake Elsinore. Although the surrounding water is considered a neutral buffer in the CRAM
assessment, the water results in limiting pedestrian access to the T- peninsula. However, the site is
publically accessible by the lake's levee system trails and experiences moderate pedestrian traffic. In
addition, unleashed domestic dogs were identified using the site during the assessment. Higher
pedestrian traffic contributes to a lower buffer score.
Table 1 summarizes the individual attribute and total CRAM scores for the T- peninsula.

2.0 GOALS OF THE COMPENSATORY MITIGATION PROJECT
The goal of this HMMP is to enhance the biological functions and values of the mitigation site. This
goal will be achieved by restoring portions of the T- peninsula with areas of alkali marsh (AM)
interspersed with patches of southern willow scrub (SWS) vegetation between the elevations of
1,244 and 1,247 feet AMSL. There is the potential that prolonged periods of high lake levels andioi
flooding would cause mortality among SWS vegetation. However, the USACE has requested that
willows (Salix spp.) and other SWS species be included in the mitigation efforts. In addition, by
enhancing the plant community, habitat, and increasing species diversity (botanical and zoological)
within the mitigation site it is anticipated that biogeochemical /water quality functions and values
would also be enhanced. The increased functional values in the mitigation area will mitigate for the
functional values lost during rehabilitation of the existing BLF site at the northern shoreline of Lake
Elsinore.
2.1 TYPE OF MITIGATION PROPOSED AND RATIONALE
The type of mitigation proposed involves creation of AM with areas of SWS habitat within waters of
the U.S. and at similar elevation levels as where impacts would occur as a result of the BLF.
Creation of these habitats will reduce adverse impacts incurred during rehabilitation of the BLF site
by replacing non - native vegetation at the T- peninsula with native AM and SWS vegetation. By
creating native wetland habitats, any biological functions and values lost at the BLF site would be
gained at the T- peninsula. It should be noted that the BLF site provides minimal biological functions
and values since it has been historically disturbed from boating activities.
2.2 TYPE OF HABITAT TO BE CREATED /ENHANCED
This HMMP proposes to create AM and SWS habitat by revegetating the T- peninsula with a
hydroseed mix of AM vegetation and cuttings. Additionally, a hydroseed mix of upland coastal sage
scrub (CSS) species will be utilized to create a buffer between the mitigation site and the upper
portions of the T- peninsula (Figure 3). The CSS buffer would occupy an approximately 25 -foot wide
by 2,300 -foot long area along the slope of the berm. The elevation of the CSS buffer would start at
approximately 1,250 feet AMSL. Within the 11.5 -acre mitigation site, irregularly shaped raised
areas will be created and constitute approximately 40 percent of the area (Figure 4). The increase in
topographic complexity would create a more natural system at the site. The resulting vegetation
communities will provide a higher quality habitat than what was impacted by the BLF within waters
of the U.S. The proposed plant communities would increase botanical diversity of the site and
provide habitat for a greater diversity of wildlife. In addition, by incorporating varying plant layers
(short-very tall) the topographic complexity of the site should be improved.
2.3 FUNCTIONS AND VALUES OF HABITAT TO BE CREATED /ENHANCED
The habitat functions and values to be created will be of a greater value to the value lost at the BLF
site. Currently, the BLF site provides minimal biological functions and values due to the disturbed
nature of the site. The BLF site is predominately utilized by common bird species that occur at
Lake Elsinore and use the area for foraging habitat. The impacted habitat functions and values wi 11 be
mitigated through creation of AM and SWS that would provide similar foraging habitat for bird
species at Lake Elsinore. Additionally, the presence of the AM and SWS vegetation at the
