SUBJECT: RECREATION PROGRAM SERVICES AGREEMENT
WITH THE CITY OF WILDOMAR
Background
The City of Wildomar recently celebrated their first year anniversary as an incorporated
city. As a new city, Wildomar is beginning to transition from County provided services to
providing their own services by contracting with local agencies, contractors, and non-
profit organizations.
The City of Wildomar sent a proposal to solicit bids for summer recreation programs
services to the City of Lake Elsinore Parks and Recreation Department. After reviewing
the proposal, staff submitted a bid to provide summer recreation programs to Wildomar.
Discussion
The Parks and Recreation Department proposal included summer programs similar to
the current programs offered in Lake Elsinore. The proposal includes a Summer
Concert Series, Movies in the Park, and Family Fun Days. Wildomar contacted the
Parks and Recreation Director and offered to contract with the City of Lake Elsinore to
provide summer recreation programs.
Upon Council's approval, the City of Lake Elsinore Parks and Recreation staff will
provide programs on Friday and Saturday nights based on the attached program
schedule. The City of Wildomar will reimburse the City of Lake Elsinore for all staff,
supplies, equipment, and city overhead associated with providing services to Wildomar.
The agreement is specific to providing recreation programs for a six month period and
may be extended for one additional year by the City Manager. Compensation to the City
of Lake Elsinore will not exceed $24,780 unless prior approval is obtained. The Parks
and Recreation Director discussed the program proposal with department staff, and
staff is ready and available to begin providing quality recreation programs to the City of

Based on the short implementation period, staff is requesting City Council approve the
recreation services agreement with the City of Wildomar, and to authorize the City
Manager to sign the agreement with modifications.
Fiscal Impact
No fiscal impact to the City of Lake Elsinore. The City of Lake Elsinore will receive
reimbursement from the City of Wildomar for costs associated with the summer
program.
Recommendation
Approve the recreation services agreement with the City of Wildomar, and to authorize
the City Manager to sign the form of the agreement provided herein with such
modifications as may be approved the City Attorney.

SERVICES AGREEMENT
(Recreation Programs)
THE CITY OF LAKE ELSINORE, hereinafter referred to as CITY OF LAKE
ELSINORE, AND CITY OF WILDOMAR, hereinafter referred to as the CITY OF
WILDOMAR, hereby agree as follows:
1. PROJECT: The CITY OF LAKE ELSINORE shall perform certain recreation
services in the City of WILDOMAR.
2. SCOPE OF SERVICES: The CITY OF LAKE ELSINORE shall furnish own
tools, equipment, and vehicle, and labor at its own expense to provide Recreation program
services as listed in Exhibit A.
3. TIME FOR PERFORMANCE: The CITY OF LAKE ELSINORE shall
commence performance of service forthwith upon the execution of this Services
Agreement and upon written direction to commence from the CITY OF LAKE ELSINORE
and from the City of WILDOMAR.
4. TERM OF AGREEMENT: This Agreement shall be for a term six months
and shall commence from the date of execution by the CITY OF LAKE ELSINORE. The
term of this Agreement may be extended one (1) year extension with the approval of each
party's City Manager.
5. COMPENSATION: Compensation shall be as set forth in the attached
Compensation Schedule Exhibit B and shall be promptly paid upon receipt of the monthly
invoice.
6. LICENSES: The CITY OF LAKE ELSINORE, its employees, agents,
contractors, and subcontractors shall maintain professional licenses required by the laws

of the State of California, at all times while performing services under the Agreement.
7. PERMITS AND RIGHTS OF ENTRY: CITY OF WILDOMAR will provide
any and all necessary permit and rights of entry as required to perform the proposed
services. The CITY OF LAKE ELSINORE will provide the work in a manner to minimize
inconvenience to the CITY OF WILDOMAR during setup and removal of program
equipment.
8. WORKER'S COMPENSATION INSURANCE: The CITY OF LAKE
ELSINORE shall follow the State of California provisions requiring employers to be insured
against liability for Worker's Compensation and shall comply with such laws during the
term of this Agreement.
9. CONTRACTOR'S LIABILITY: The CITY OF WILDOMAR shall indemnify
and hold the CITY OF LAKE ELSINORE, its officers, employees, and agents free and
harmless from any liability whatsoever, including wrongful death, based or asserted upon
act or omission of the CITY OF LAKE ELSINORE, its employees, subcontractors, and
agents relating to or in any way connected with the accomplishment of the work or
performance of service under this Agreement. As part of the foregoing indemnity, the
CITY OF WILDOMAR agrees to protect and defend at their own expense, including
attorney fees, the CITY OF LAKE ELSINORE, its offices, agents, and employees in any
legal action based upon any such alleged acts or omission.
10. PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE: CITY OF
WILDOMAR shall furnish to the CITY OF LAKE ELSINORE and maintain during the life of
the contract a public liability policy in which the CITY OF LAKE ELSINORE is named as an
additional insured.

The policy shall also hold harmless the CITY OF LAKE ELSINORE, its officers, and
employees while acting within the scope of their duties, against all claims arising out of or
in connection with the work to be performed. The policy shall provide for not less than the
following amounts:

Insurance policies carried by the CITY OF WILDOMAR shall bear an endorsement
or shall have attached a rider providing that in the event of cancellation or proposed
cancellation of such policies for any reason whatsoever, the CITY OF LAKE ELSINORE
shall be notified by registered mail.
11. WORK PRODUCT: Work shall be considered complete upon inspection and
approval of the CITY OF WILDOMAR.
12. TERMINATION: This Agreement may be terminated by either the CITY OF
WILDOMAR or the CITY OF LAKE ELSINORE upon thirty (30) day written notice to other
party in the event of substantial failure of performance by the other party, or in the event
the CITY OF WILDOMAR shall elect to abandon or indefinitely postpone the project and
gives notice of termination.
The CITY OF WILDOMAR shall make payment for all services having been
performed as of the date of written notice pursuant to the Compensation Schedule.
13. INDEPENDENT CONTRACTOR: CITY OF LAKE ELSINORE agents,
servants, and employees shall act at all times in an independent capacity during the term

of this Agreement and in the performance of the services to be rendered hereunder, and
shall not act as, and shall not be, and shall not in any manner be considered to be agents,
officers, or employees of the CITY OF WILDOMAR.
14. PERSONNEL ATTIRE AND EQUIPMENT: The CITY OF LAKE ELSINORE
shall require each of their employees to adhere to basic Parks and Recreation standards
of working attire. These are basically uniforms, proper shoes and other gear required by
State Safety Regulations, and proper wearing of the clothing.
15. ASSIGNMENT: Neither this Agreement nor any part thereof shall be
assigned by the CITY OF LAKE ELSINORE without the prior written consent of the CITY
OF WILDOMAR.
IN WITNESS WHEREOF the parties have caused this Agreement to be
executed on July 14, 2009.

SUBJECT: PARKS AND RECREATION MASTER PLAN
Background
The City's twenty year Recreation Park Master Plan is due to expire next year in 2010.
In March 11, 2008, the City Council approved an agreement with Baxter Miller
Landscape Architecture, to update the City Parks and Recreation Master Plan.
At the August 12, 2008, City Council meeting, a draft copy of the Parks and Recreation
Master Plan was presented to Council, and at the August 26 study session staff formally
presented the Plan to Council. During the Council study session staff received Council's
input and those changes have been incorporated in the plan. To provide the new
Council members an opportunity to review the draft Parks and Recreation Master Plan,
copies were distributed to all council members on April 8, 2009 by the City Manager's
office.
Discussion
The purpose of the Parks and Recreation Master Plan is to create a clear set of goals,
policies and objectives that will provide direction to City staff, Planning Commission, and
the City Council for development and enhancement of the City's parks and recreation
system for the next 20 years. This Plan will also provide a basis for improved
coordination between the City, school district, and other jurisdictions for joint -use of
facilities such as open space and facility use.
The Parks and Recreation Master Plan is comprised of ten (10) sections. The first
portion of the plan provides an overview to the City's current programs and provides an
inventory of existing facilities, park improvements, and city demographic information.
The second portion of the plan projects the amount of park acreage needed, the cost to
enhance the park system, project facility standards, and estimates the cost to maintain
the park system for the next 22 years.

Based on Council's direction, staff has incorporated the Council's ideas and comments
into a final Master Plan which is being presented to the City Council tonight. Staff is
recommending Council approve and formally adopt the Parks and Recreation Master
Plan.
