BRADY CITY MANAGER DATE: JULY 28, 2009 PROJECT TITLE: ZONING ORDINANCE TEXT AMENDMENT NO. 2008-04; A REQUEST TO REPEAL CHAPTER 19.08 AND ADD A NEW CHAPTER 19.08 IN ORDER TO ADOPT THE STATE OF CALIFORNIA'S MODEL WATER EFFICIENT LANDSCAPING ORDINANCE APPLICANT: CITY OF LAKE ELSINORE: 130 SOUTH MAIN STREET, LAKE ELSINORE, CA 92530 BACKGROUND The Western Riverside Council of Governments (WRCOG), in conjunction with the Riverside County Water Task Force, drafted a water efficient landscape ordinance, which meets the minimum requirements of the California Department of Water Resources' (DWR) Updated Model Water Efficient Landscape Ordinance. WRCOG's ordinance was drafted to meet the State's water efficient landscaping requirements as well as to reflect the climate and landscaping requirements of Western Riverside County. On June 16, 2009 WRCOG sent out the draft ordinance to municipalities within Riverside County (with a recommendation of adoption); in order to ensure uniformity in water efficient landscaping requirements throughout the region. Subsequently and at the recommendation of WRCOG, staff agendized the item for Planning Commission and City Council review and adoption. However, it came to staff's attention that the draft Ordinance, provided by WRCOG, was not reviewed by DWR to ensure that the proposed Ordinance meets the minimum requirements of the State's CC July 28, 2009 Item No. 9 Page 1 of 2 Updated Model Water Efficient Landscaping Ordinance. Once WRCOG receives a consistency finding from DWR, they will generate a findings resolution that the proposed Ordinance is consistent with DWR's model and provide it to local jurisdictions for adoption completion. On July 21, 2009 the Planning Commission continued Zoning Ordinance Text Amendment No. 2008-04 to a date to be determined, in order to allow the California Department of Water Resources (DWR) to find that Zoning Ordinance Text Amendment No. 2008-04 is consistent and meets the minimum requirements of the California Model Water Efficient Landscape Ordinance. Staff requests that the City Council also continue Zoning Ordinance Text Amendment No. 2008-04 to a date to be determined so as to allow DWR sufficient time to find that the proposed Ordinance is consistent with the California Model Water Efficient Landscape Ordinance.
