Batey It Agreement (JPA) and the 1" Amendment to the Implementation Agreement (IA). The Amendments do the following: City ofMurrieta Gary Thomasian I I" Amendment to the JPA Vice-Chair I . Adds the City of Menifee as a Member Agency 2. Adds the City of Wildomar as Member Agency City of Ferris 3. Revises Section 3.5, Additional Members, to read "Public Agencies may be Mark Yarbrough added consistent with the terms and conditions of the Implementing Agreement after formation of the Agency. This important Amendment will allow the new Member Agencies to participate in the next scheduled RCHCA Board meeting which is now scheduled for May 21, 2009. This is necessary so that each agency will receive an Deputy County Counsel original document for their files. This Amendment does the following: City of Lake Elsinore Melissa Melendez 1. Adds the City of Menifee as a Member Agency 2. Adds the City of Wildomar as Member Agency City of Moreno valley William H. INCORPORATION OF THE AGREEMENT The Agreement and each of its provisions are intended to be, and by this reference are, incorporated I herein. III. CITY OF MENIFEE The City of Menifee agrees to the terms and conditions of the Agreement set forth in Section 11. above. IV. CITY OF WILDOMAR The City of Wildomar agrees to the terms and conditions of the Agreement set forth in Section II. Iabove. V. AGREEMENT PROVISIONS AMENDED The following provisions of the Agreement are amended as set forth below: VI. D. NOTICE Any notice permitted or required by this Agreement shall be in writing, delivered personally, by overnight mail, or by United States mail, certified and postage prepaid, return receipt requested and to the persons listed below and addressed as follows, or at such other address as any Party may from time to time specify to the other Parties in writing. Notices may be delivered by facsimile or other electronic means, provided that they are also delivered personally or by overnight or certified mail. Notices shall be transmitted so that they are received within the specified deadlines. Notice delivered via certified mail, return receipt requested, shall be deemed given five (5) days after deposit in the United States mail. Notices delivered personally shall be deemed given on the date they are delivered.
