BRADY CITY MANAGER DATE: JANUARY 27, 2009 SUBJECT: LOCAL GOVERNMENT WASTE TIRE CLEANUP & AMNESTY EVENT GRANT PROGRAM BACKGROUND The City of Lake Elsinore experiences a large amount of illegal dumping throughout the year. Tires are a particular problem because they are considered a hazardous waste and there is a cost involved with their disposal. Currently, City Staff is seeking grant funds to raise public awareness and provide opportunities to properly dispose of tires. As part of the County of Riverside's waste tire collection program a tire collection event was held in Lake Elsinore on July 12, 2003. At that event the County collected 738 tires. Since that date there have been no waste tire collection events held in the City. Over the past 5 %2 years city maintenance crews have collected hundreds of tires that were illegally dumped in the City. As the population of the City has grown so has the number of improperly disposed tires in the community. DISCUSSION Between August and December of 2008, the City of Lake Elsinore has paid $800 for transportation and disposal /recycling of illegally dumped tires. The proposed grant funding, allows the City of Lake Elsinore to schedule four (4) Amnesty Day tire collection events during the course of the grant period between Fall of 2009 and Summer of 2010. These events will be open to all City residents. Two of the Amnesty Day events will be held in conjunction with the City's twice - yearly cleanup events and the other two will be held as stand -alone tire collections. The Amnesty Day events are tentatively scheduled for October 2009, January 2010, April 2010, and June 2010. The proposed program estimates an average of 1,000 tires collected per event. The events will be staffed by young adults from local job training programs, and /or volunteer staff from local community service organizations or high schools as well as City staff to oversee the program. Data collected from the Amnesty Day events will be gathered to develop a projection of scrap tire recycling needs among the community, and these Agenda Item No. 8 Page 1 of 6 GOVERNMENT WASTE TIRE CLEANUP & AMNESTY GRANT January 27, 2009 Page 2 projections will help to develop an ongoing program to accept scrap tires as part of our twice -a -year Citywide Cleanup Events. A supplemental requirement of the grant application is that the City adopt an "Environmentally Preferable Purchase Policy ". The policy requires that special emphasis be placed on the purchase of recycled materials whenever practicable. This policy will be coordinated through the Director of Public Works. FISCAL IMPACT There is no net cost to the City. The cost per event is estimated to be $4,150, which includes staff time, transportation, handling and processing /recycling. The program requires up front payment for the events and the costs are reimbursed by the grant through the California Integrated Waste Management Board. The grant funding request totals $16,600, however staff will not commit any City forces /funds until a notice to proceed has been received from the State. RECOMMENDATIONS 1. The City Council adopt Resolution No. 2009-_ 2. Adopt the purchasing policy as required by the grant application. 3. Direct City Manager to execute the grant application. Brady ,lai City Manager " Attachments: Grant Resolution Purchasing Policy Agenda Item No. 8 Page 2 of 6 RESOLUTION NO. 2009 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR GRANT FUNDS FOR WASTE TIRE CLEANUP AND AMNESTY EVENTS WHEREAS, the California Integrated Waste Management Board (CIWMB) administers the State of California's Waste Tire Cleanup and Amnesty Event Grants which provides funding to local governments for the cost of cleanup, abatement, or other remedial actions related to the disposal of waste tires collected at cleanup projects and amnesty events; and WHEREAS, the California Integrated Waste Management Board (CIWMB) has allocated two million dollars ($2,000,000) for the Local Government Waste Tire Cleanup and Amnesty Event Grant Programs in fiscal year (FY) 2008/09; and WHEREAS, California Public Resources Code section 42889 authorizes the CIWMB to expend funds from the California Tire Recycling Management Fund to pay for the cost of cleanup, abatement, or other remedial actions related to the disposal of waste tires; and WHEREAS, the notice of funding availability published by CIWMB for the Waste Tire Cleanup and Amnesty Event Grant requires that the City of Lake Elsinore adopt a resolution approving submission of a grant application and delegating a staff member to administer the grant funds; and WHEREAS, the City of Lake Elsinore desires to apply for a grant of funds available through the Waste Tire Cleanup and Amnesty Event Grants for the purposes of hosting four (4) Tire Amnesty Day events at which the City will collect waste tires and properly dispose of them. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Manager is authorized to execute and submit an applications for grant funds to the CIWMB for all tire - related grants for the period of 2009 to 2011. SECTION 2. That the City Manager or his /her designee is hereby authorized and empowered to execute in the name of the City of Lake Elsinore all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption. This policy is enacted to demonstrate compliance with the Waste Management Reduction Act and foster market development for recycled products. Policy: A. All City of Lake Elsinore departments shall use recycled products whenever practicable. Special emphasis shall be placed on the purchase of products manufactured with post - consumer recycled materials. B. All City of Lake Elsinore departments may, at their option and with purchasing concurrence, require procurement of designated recycled products or recycled products above the levels required by this policy. C. The City of Lake Elsinore shall promote the use of recycled products by publicizing its procurement policy whenever practicable. Purchase Responsibilities of Recycled Products and Materials Coordinator The Director of Public Works or his /her designee shall coordinate the implementation of this policy. He /she will establish a list of recycled products that shall be purchased by all City of Lake Elsinore departments whenever practicable and will develop the mechanism for maintenance, additions, and deletions to the list of recycled products available for procurement. Maintenance of the list will include addition of new products containing recycled material as they become available. Specifications of these new products and their suggested uses will be made available to all City of Lake Elsinore departments. The Director of Public Works or his /her designee will also work with all departments to establish minimum recycled content standards for designated recycled products to maximize recycled product availability, recycled content, and competition. The Director of Public Works or his /her designee will also be responsible for annual policy review. Environmentally Preferable Practices The City of Lake Elsinore will act to make resource conservation an integral part of its waste reduction and recycling programs. The practice of discarding materials used in the City of Lake Elsinore facilities is wasteful of natural resources, energy, and money. Practice Policies A. The City of Lake Elsinore will cooperate with, and participate in, recycling efforts being made by the City and County as systems for recovering waste and recycling products. B.
