City of Lake Elsinore; Claim filed 7-6-11) 1(b) CONFERENCE WITH LEGAL CONSEL - ANTICPATED LITIGATION Initiation of litigation pursuant to subdivision (c) of Gov't Code Section 54956.9: 1 potential case PRESENTATIONS / CEREMONIALS Western Riverside Council of Governments (WRCOG) Presentation of Assembly Bill 811 on renewable generation and energy efficiency improvements PUBLIC COMMENTS - NON-AGENDIZED ITEMS - 1 MINUTE PUBLIC COMMENTS - AGENDIZED ITEMS - 3 MINUTES Joint City Council/RDA Study Session August 9, 2011 Page 2 of 8 CONSENT CALENDAR (2) Approval of Minutes Recommendation: It is recommended the City Council approve the minutes of: (A) Joint Study Session Meeting of July 12, 2011 (B) Regular City Council Meeting of July 12, 2011 (C) Joint Study Session Meeting of July 26, 2011 (D) Regular City Council Meeting of July 26, 2011 (3) Warrant Lists Dated July 14 and July 28, 2011 Recommendation: Authorize payment of Warrant Lists dated July 14, and July 28, 2011. Council Member Tisdale, Council Member Hickman and Council Member Melendez questioned various items on the warrant list and staff provided responses thereto. (4) Investment Report for June 2011 Recommendation: It is recommended the City Council receive and file. (5) Resolution to Approve Placing Delinquent Weed Abatement Invoices on Tax Roll Recommendation: It is recommended that the City Council adopt RESOLUTION NO. 2011-047 A RESOLUTION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, CONFIRMING AN ITEMIZED WRITTEN REPORT SHOWING COST OF WEED ABATEMENT, CONFIRMING THE ITEMIZED WRITTEN REPORT FOR EACH SEPARATE PARCEL OF LAND REQUIRED BY SECTION 39574 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA, AND PROVIDING THAT THE COSTS THEREOF ON EACH PARCEL OF LAND SHALL CONSTITUTE A SPECIAL ASSESSMENT LIEN AGAINST SAID PARCELS OF LAND PURSUANT TO SECTION 39574 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA, AND PROVIDING FOR THE FILING OF SAID ASSESSMENTS AS PROVIDED IN SAID GOVERNMENT CODE; and direct staff to place special assessments against the properties listed in the itemized report. (6) Resolution to Approve Placing Delinquent Refuse Bills on FY 2010-2011 Tax Roll Recommendation: It is recommended that the City Council approve RESOLUTION NO. 2011-048 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AFFIRMING THE REPORT OF Joint City Council/RDA Study Session August 9, 2011 Page 3 of 8 DELINQUENT RESIDENTIAL REFUSE FEES AND DIRECTING THEIR COLLECTION ON THE PROPERTY TAX ROLLS; and instruct staff to file with the Riverside County Auditor a certified copy of said Resolution along with the 120-days past due accounts report. (7) Designation of City's Agent to Process FEMA and Cal-EMA Grant Applications Recommendation: It is recommended that the City Council approve Cal-EMA Form 130 designating James Riley, Administrative Services Director as the Authorized Agent to process Federal and California Emergency Management Agency Grant Applications. Support staff is identified to be Ken Seumalo, Director of Public Works and Rick DeSantiago, Public Works Superintendent. (8) Professional Engineering Services: Peter Ramey - Construction Management Contract, Rusty Beardsley - Traffic Engineer Contract Recommendation: It is recommended that the City Council approve the contract with Peter Ramey to perform duties as the City's CIP Project Manager and approve the contract with Rusty Beardsley to perform duties as the City's Traffic Engineer. PUBLIC HEARING(S) No Public Hearings scheduled. APPEAL(S) No appeals scheduled. BUSINESS ITEM(S) (9) Memorandum of Understanding with United Public Employees of California LIUNA Local 777 for July 1, 2011 to June 30, 2013 Recommendation: It is recommended that the City Council approve the attached Memorandum of Understanding for the period of July 1, 2011 to June 30, 2013. (10) Resolution Changing Benefits for Non-Union Represented Employees and Newly Elected City Council Members of the City of Lake Elsinore for the Period July 1, 2011 to June 30, 2013. Recommendation: It is recommended that the City Council adopt RESOLUTION NO. 2011-049 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING THE CHANGE OF BENEFITS FOR NON-UNION REPRESENTED EMPLOYEES AND NEWLY ELECTED CITY COUNCIL MEMBERS FOR THE PERIOD OF JULY 1, 2011 TO JUNE 30, 2013. Joint City Council/RDA Study Session August 9, 2011 Page 4 of 8 (11) Interim Urgency Ordinance of the City of Lake Elsinore Establishing a 45-Day Moratorium on the Permitting of Boat Docks within Recreation Districts Recommendation: It is recommended that the City Council: (A) Waive further reading and adopt by a four-fifths vote ORDINANCE NO. 2011-1291 by title only AN INTERIM URGENCY ORDINANCE OF THE CITY OF LAKE ELSINORE ESTABLISHING A 45-DAY MORATORIUM ON THE PERMITTING OF BOAT DOCKS WITHIN AREAS ZONED AS RECREATION DISTRICTS PURSUANT TO GOVERNMENT CODE SECTION 65858 (B) Direct staff to begin studying the establishment of boat dock construction standards and present the City Council with additional information at a future date. Council Member Melendez asked for the current standards of the County. Director Kilroy stated he is not aware that the County has any standards for docks, however he would work with the County on any adopted dock standards. Council Member Hickman suggested to Director Kilroy to check with other cities that have lakes in this jurisdiction to see what their regulations and specifications were. Council Member Tisdale noted that Lake Elsinore and Canyon Lake are the only cities with lakes that allow docks. He added that this topic may be added to the agenda for discussion with Supervisor Buster. (12) Ordinance Correcting and Restating NUNC PRO TUNC Certain Time Limits Specified in Ordinance No. 987 and Affirming Certain Time Limits Specified in Ordinance No. 1249 as to the Redevelopment Plans for the Lake Elsinore Rancho Laguna Redevelopment Protect Areas No. I No. II and No. III Recommendation: Waive further reading and introduce by title only ORDINANCE NO. 2011-1292 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, CORRECTING AND RESTATING NUNC PRO TUNC CERTAIN TIME LIMITS SPECIFIED IN ORDINANCE NO. 987 AND AFFIRMING CERTAIN TIME LIMITS SPECIFIED IN ORDINANCE NO. 1249 AS TO THE REDEVELOPMENT PLANS FOR THE LAKE ELSINORE RANCHO LAGUNA REDEVELOPMENT PROJECT AREAS NO. I, NO. II and NO. III (13) Resolution No. 2011-050 declaring the City's intention to enact an Ordinance whereby the City shall elect to comply with and participate in the alternative voluntary redevelopment program contained in Part 1.9 of Division 24 of the California Health and Safety Code: and Waive further reading and introduce bV title only Ordinance No. 2011-1293 electing to comply with and participate in the Joint City Council/RDA Study Session August 9, 2011 Page 5 of 8 alternative voluntary redevelopment program contained in Part 1.9 of Division 24 of the California Health and Safety Code. Recommendation: It is recommended that the City Council: (A) Adopt RESOLUTION NO. 2011-050 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA DECLARING ITS INTENTION TO ENACT AN ORDINANCE WHEREBY THE CITY SHALL ELECT TO COMPLY WITH AND PARTICIPATE IN THE ALTERNATIVE VOLUNTARY REDEVELOPMENT PROGRAM CONTAINED IN PART 1.9 OF DIVISON 24 OF THE CALIFORNIA HEALTH AND SAFETY CODE; and (B) Waive further reading and introduce by title only ORDINANCE NO. 2011- 1293 AN ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA ELECTING TO COMPLY WITH AND PARTICIPATE IN THE ALTERNATIVE VOLUNTARY REDEVELOPMENT PROGRAM CONTAINED IN PART 1.9 OF DIVISION 24 OF THE CALIFORNIA HEALTH AND SAFETY CODE (14) Appointments to the Public Safety Advisory Commissions Recommendation: The sub-committee will make a recommendation to the City Council for consideration and shall nominate its selected applicants at the meeting. A vote will be called for each nomination, and the applicants receiving the highest number of affirmative votes from the majority of the Council present shall be appointed. (15) Policy Regarding the Use of Badges Recommendation: It is recommended that the City Council review and discuss this policy and direct staff accordingly. (16) City Council Vacancy Recommendation: In accordance with the requirements of Policy No. 200-11, it is recommended to the City Council that it select two City Council Members to serve as the Appointment Committee to review applications and nominate an eligible candidate to fill the vacancy at the August 23`d City Council meeting. Alternatively, the City Council could elect to revise Policy No. 200-11 to allow 60 days to fill the vacancy or modify the selection procedures. (17) City Attorney Services Recommendation: It is recommended that the City Council and Agency Board discuss the City Attorney's services and Legal Services Agreement and provide direction as appropriate. Joint City Council/RDA Study Session August 9, 2011 Page 7 of 8 (4) Investment Report for June 2011 Recommendation: It is recommended the Redevelopment Agency receive and file. (5) Habitat for Humanity Support Letter Recommendation: It is recommended the Redevelopment Agency authorize the Executive Director to execute the "REO Properties, Lake Elsinore" support letter. Redevelopment Agency Analyst Carlson presented the staff report. Agency Member Magee hoped that the City could get more than one house for a million dollars. Agency Member Hickman spoke of a person (Larry Hawthorn) that was willing to help out by building six to eight homes for less than one million dollars. City Treasurer Baldwin stated that he works with the Neighborhood Stabilization Program (NSP) and the costs are high because of the government's demands. Vice-Chair Tisdale questioned as to how the City could send a support letter acknowledging a house for one million dollars. Agency Counsel Leibold noted that the Habitat was awarded $1.7 million which was within the City's region and that they only completed one house last year and that one to two houses are anticipated this year. The funds are distributed by the County and could be expended anywhere outside the City of Lake Elsinore. Chairwoman Melendez noted that the City of Menifee is also listed in the report and asked how many homes are being rehabbed in the City of Menifee. Redevelopment Agency Analyst Carlson responded that he did not know. Agency Member Magee suggested getting a better understanding of the goal. Redevelopment Agency Analyst Carlson stated that he would give the agency a call and have the information available for the 7:00 p.m. meeting. (6) Lake Elsinore Technology Center Status Update Recommendation: It is recommended the Redevelopment Agency receive and file this status report. Chairwoman Melendez asked Redevelopment Agency Analyst Carlson the status of the extension? Redevelopment Agency Analyst Carlson stated a representative from EDA should have the status by the end of the week. BUSINESS ITEM(S) (7) Agency Attorney Services Recommendation: It is recommended the City Council and Agency Board discuss the City Attorney's services and Legal Services Agreement and provide direction as appropriate. The City Council reconvened at 4:23 p.m. CLOSED SESSION REPORT City Attorney Leibold announced that the City Council would adjourn to Closed Session at 5:00 p.m to discuss Items 1(a) and 1(b).
