A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, APPROVING
COMMERCIAL DESIGN REVIEW NO. 2011-01, FOR THE
PROPOSED LAKESHORE MEDICAL CENTER
WHEREAS, Pablo Paredes AIA, has filed an application with the City of
Lake Elsinore requesting approval of Commercial Design Review 2011-01; to construct
a 5,065 square-foot pharmacy and medical complex. The vacant project site is
generally located on Lakeshore Drive, and commonly identified as APN 378-290-005
(the 'Project'); and
WHEREAS, the City Council of the City of Lake Elsinore has been
delegated with the responsibility of considering and approving Commercial Design
Review applications; and
WHEREAS, on July 12, 2008, at a duly noticed public hearing, the City
Council considered evidence presented by the Community Development Department
and other interested parties with respect to this item; and
WHEREAS, public notice of said application has been given, and the
Planning Commission has considered evidence presented by the Community
Development Department and other interested parties at a public hearing held with
respect to this item on June 7, 2011.
NOW, THEREFORE, the City Council of the City of Lake Elsinore,
California, does hereby resolve as follows:
SECTION 1. The City Council has considered the proposed Commercial
Design Review No. 2011-01 prior to approving the application. The City Council finds
that the Commercial Design Review satisfies all requirements set forth on Chapter
17.184 of the Lake Elsinore Municipal Code.
SECTION 2. The City Council hereby finds and determines that this
project is consistent with the Lake Elsinore Municipal Code and that no further
environmental review is necessary pursuant to the California Environmental Quality Act
(CEQA), Section 15332 (In-Fill Development Projects).
SECTION 3. That in accordance with State Planning and Zoning law and
the City of Lake Elsinore Municipal Code, the City Council makes the following findings
for the approval of Commercial Design Review No. 2011-01:

I . The project, as approved, will comply with the goals and objectives of the
General Plan and the Zoning District in which the project is located.
The proposed Commercial Design Review located within Assessor Parcel
Number 378-290-005 complies with the goals and objectives of the General Plan,
in that the approval of this commercial office complex will assist in achieving the
development of a well-balanced and functional mix of residential, commercial,
industrial, open space, recreational and institutional land uses, diversifying Lake
Elsinore's economic base.
2. The project complies with the design directives contained in Section 17.184 and
all other applicable provisions of the Municipal Code.
The proposed Commercial Design Review located at Assessor Parcel Number
378-290-005 is appropriate to the site and surrounding developments in that the
commercial office complex known as the "Lakeshore Medical Center" has been
designed in consideration of the size and shape of the property, thereby creating
interest and varying vistas as a person moves along the street. Further the
project as proposed will complement the quality of existing development and will
create a visually pleasing, non-detractive relationship between the proposed and
existing projects in that the architectural design, color and materials and site
design proposed evidence a concern for quality and originality.
3. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Pursuant to the California Environmental Quality Act (CEQA), the proposed
Commercial Design Review located at Assessor Parcel Number 378-290-005 as
reviewed and conditioned by all applicable City Divisions and Departments and
Agencies, will not have a significant effect on the environment pursuant to
attached Conditions of Approval.
4. Conditions and safeguards pursuant to Chapter 17.184 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of the
property in accordance with the objectives of Chapter 17.184
Pursuant to Section 17.184.090 (Action of the City Council) of the Lake Elsinore
Municipal Code (LEMC), the proposed Commercial Design Review located at
Assessor Parcel Number 378-290-005, has been scheduled for consideration
and approval of the City Council.
SECTION 4. Based upon the evidence presented, the above findings,
and the conditions of approval imposed upon the proposed project, the City Council
hereby approves the Commercial Design Review No. 2011-01.
SECTION 5. This Resolution shall take effect from and after the date of
its passage and adoption.
