HomeMy WebLinkAbout06-14-2011 City Council MinutesMINUTES REGULAR CITY COUNCIL MEETING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CALIFORNIA TUESDAY, JUNE 14, 2011 CALL TO ORDER Mayor Bhutta called the City Council Meeting to order at 7:00 p.m. ROLL CALL PRESENT: Mayor Bhutta Mayor Pro Tern Magee Council Member Hickman Council Member Melendez ABSENT: Council Member Tisdale Also present: City Manager Brady, City Attorney Leibold, Director of Administrative Services Riley, Public Works Director/City Engineer Seumalo, Director of Lake, Parks and Recreation Kilroy, Police Chief Fontneau, Fire Chief Lawson, Planning Manager Morelion, and City Clerk Bloom. PLEDGE OF ALLEGIANCE Rocco Melendez led the pledge of allegiance. PRESENTATIONS / CEREMONIALS Andrea De Leon of MFI Recovery Center made a presentation of the program to the Council. Mayor Bhutta presented a Certificate of Recognition to Richard Leverson, Pole Vaulter from Elsinore High School. Mayor Bhutta presented a Certificate of Recognition to Pete Dawson for his community services and participation. PUBLIC COMMENTS - NOWAGENDIZED ITEMS - 1 MINUTE Chris Hyland, resident, spoke of the upcoming Juneteenth event at McVicker Park. PUBLIC COMMENTS - AGENDIZED ITEMS - 3 MINUTES None. Regular City Council Minutes Meeting of June 14, 2011 Page 2 of 6 CONSENT CALENDAR (1) Approval of Minutes Recommendation: It is recommended the City Council approve the minutes of: A) Joint Study Session of May 24, 2011 B) Regular City Council Meeting of May 24, 2011 C) Special Study Session of May 26, 2011 (2) Warrant List Dated May 26 2011 Recommendation: Authorize payment of Warrant List dated May 26, 2011. (3) Amendment to Extend the Term of the Agreement for the Operations and Maintenance of the Phase-II Aeration System Recommendation: It is recommended that the City Council approve the amendment to extend the Agreement for the Lake Elsinore Phase-II Aeration System and authorize the City Manager to execute the Agreement. (4) Purchase Order Adjustment for Contract Mine Compliance Firm -Enviromine Recommendation: It is recommended that the City Council: (A) Approve the purchase order in the amount of $40,000; and (B) Authorize staff to process the purchase order. (5) Construction Contract Award Diamond Drive Street Rehabilitation from Auto Center Drive to Mission Trail Proiect No. 4347 Recommendation: It is recommended that the City Council: (A) Award Diamond Drive Street Improvements between Southbound 1-15 Off Ramps and Mission Trail to All American Asphalt, Inc. for the amount of $195,676.00 with a 15% contingency; and (B) Authorize the City Manager to execute the contract with All American Asphalt. (6) Assignment and Assumption of Professional Services Agreement with SC Engineering Recommendation: It is recommended that the City Council authorize the City Manager to execute Agreement. Regular City Council Minutes Meeting of June 14, 2011 Page 3 of 6 (7) A Resolution of the City Council of the City of Lake Elsinore, California Authorizing Issuance of a Letter of Credit by Bank of America in Connection with the Lake Elsinore Boat Launch Project Recommendation: It is recommended that the City Council adopt Resolution No. 2011-036 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA AUTHORIZING ISSUANCE OF A LETTER OF CREDIT BY BANK OF AMERICA IN CONNECTION WITH THE LAKE ELSINORE BOAT LAUNCH PROJECT. Council Member Melendez pulled Consent Item No. 7 for discussion and Mayor Bhutta pulled Consent Item No. 2. Upon a motion by Mayor Pro Tern Magee, seconded by Council Member Melendez Consent Item Nos. 1, 3, 4, 5, and 6 were unanimously approved. CONSENT ITEMS PULLED FOR DISCUSSION (2) Warrant List Dated May 26, 2011 Recommendation: Authorize payment of Warrant List dated May 26, 2011. Council Member Melendez, Council Member Hickman and Mayor Bhutta questioned various items on the warrant list and staff provided responses thereto. Motion by Council Member Melendez, seconded by Mayor Pro Tern Magee to approve Consent Item No. 2 passed by unanimous vote. (7) A Resolution of the City Council of the City of Lake Elsinore, California Authorizinq Issuance of a Letter of Credit by Bank of America in Connection with the Lake Elsinore Boat Launch Project Recommendation: It is recommended that the City Council adopt Resolution No. 2011-036 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA AUTHORIZING ISSUANCE OF A LETTER OF CREDIT BY BANK OF AMERICA IN CONNECTION WITH THE LAKE ELSINORE BOAT LAUNCH PROJECT. Council Member Melendez asked why the City needed this line of credit and was this cost factored into the project. Administrative Services Director Riley answered that it is required by the Department of Fish & Game. Public Works Director Seumalo offered that the project has been budgeted and a letter of credit essentially serves as a bond for the project. Lake Director Kilroy offered that it was also a condition of approval for the project. Regular City Council Minutes Meeting of June 14, 2011 Page 4 of 6 Mayor Pro Tem Magee questioned the cost of obtaining the letter of credit. Administrative Services Director Riley answered that Bank of America would charge the City $5,000 for the letter. Council Member Hickman stated that he had received a telephone call regarding the City's boat launch project specifications and asked if the dredging and asphalt/cement work could be separated in order to allow for local contractors to do some of the work. Public Works Director Seumalo answered that the work could not be separated as it has to be done in the water and contractors must have experience working in the water to be qualified. Motion by Council Member Melendez, seconded by Mayor Pro Tem Magee to approve Item No. 7 passed by unanimous vote. PUBLIC HEARINGS No public hearings scheduled. APPEAL(S) No appeals scheduled. BUSINESS ITEM(S) (8) Waive Further Reading and Adopt Ordinance No. 2011-1290 by Title Only - ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE CALIFORNIA ACTING AS THE LEGISLATIVE BODY OF CITY OF LAKE ELSINORE COMMUNITY FACILITIES DISTRICT NO. 2007-1 (LAW ENFORCEMENT, FIRE AND PARAMEDIC SERVICES) AUTHORIZING THE LEVY OF A SPECIAL TAX WITHIN ANNEXATION AREA NO. 2 (POTTERY COURT) TO SAID DISTRICT Recommendation: Waive further reading and adopt Ordinance No. 2011-1290 by title only - ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF CITY OF LAKE ELSINORE COMMUNITY FACILITIES DISTRICT NO. 2007-1 (LAW ENFORCEMENT, FIRE AND PARAMEDIC SERVICES) AUTHORIZING THE LEVY OF A SPECIAL TAX WITHIN ANNEXATION AREA NO. 2 (POTTERY COURT) TO SAID DISTRICT by a roll-call vote. Administrative Services Director Riley presented the staff report to Council. Motion by Mayor Pro Tern Magee, seconded by Council Member Melendez and upon a unanimous roll-call vote, Ordinance No. 2011-1290 was adopted. COMMITTEE REPORTS None. CITY COUNCIL COMMENTS Council Member Hickman commented on the homeless camp site and the need to direct Code Enforcement personnel. Council Member Melendez commented on the Memorial Day ceremony and thanked all of those involved; reminded that Sunday is Father's Day. Mayor Pro Tern Magee commented on the Hwy 74 and Gunnerson intersection road work; commented on the road improvements on Railroad Canyon and Diamond Drive; stated that the recognition of Pete Dawson was long overdue; acknowledged Pastor Fred Rodriguez for his prayers for his family and asked to keep his son, Richard, in prayers until he returns from Afghanistan. Mayor Bhutta welcomed the new Planning Manager; she thanked Code Enforcement, City staff and Law Enforcement for addressing the panhandling within the City, and wished all a Happy Father's Day. ADJOURNMENT The Lake Elsinore City Council adjourned the meeting at 7:45 p.m. to a regular meeting to be held on Tuesday, June 28th, 2011, in the Cultural Center located at 183 N.
