HomeMy WebLinkAboutCC Reso No 2011-024 City Council ResoRESOLUTION NO. 2011 -024 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, SUPPORTING THE CITY'S CONTINUED LEAD AGENCY STATUS UNDER THE SURFACE MINING AND RECLAMATION ACT WHEREAS, surface mining, the process of removing and processing materials such as aggregate, coal and clay, has been a part of the Lake Elsinore Area since the late 1800's; WHEREAS, there are presently three active mining sites within the City limits and several mining sites that are inactive; either preparing for reclamation or operating under an interim use; WHEREAS, mining activity is regulated by the Surface Mining and Reclamation Act (SMARA) and implementing regulations administered and enforced by the City of Lake Elsinore as Lead Agency with oversight provided by the State Mining and Geology Board; . WHEREAS, the City of Lake Elsinore as Lead Agency has committed the resources necessary to ensure the proper administration of SMARA by a team of qualified and trained staff and consultants; WHEREAS, because of our geographical location, as Lead Agency, the City of Lake Elsinore is best able to efficiently and effectively monitor and respond to resident and operator needs in its administration and enforcement of SMARA; WHEREAS, City staff has developed a close working relationship with the mine operators, residents and Office of Mine Reclamation in a collaborative effort to ensure the proper, responsive and fair implementation of its responsibilities as Lead Agency under SMARA; WHEREAS, the mining operations are a transitional use in various stages of active extraction, reclamation and development and the City of Lake Elsinore, as Lead Agency, has the legislative and regulatory authority to oversee this transition toward the ultimate development of the mining areas consistent with the City's vision of the community as expressed in its General Plan and applicable Specific Plans; WHEREAS, as Lead Agency, the City is best suited to respond to community concerns and to protect and advance best interests of the community in its administration and enforcement of SMARA; and CC Resolution No. 2011 -24 Page 2 of 2 THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMIE AND ORDER AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated as a substantive part of this Resolution. SECTION 2. That the City of Lake Elsinore recognizes the importance of carrying out its duties as the SMARA Lead Agency. SECTION 3. That the City Council of the City of Lake Elsinore is committed to and supports the City's continued role as Lead Agency under SMARA. SECTION 4. This Resolution shall become effective immediately upon adoption.
