BRADY CITY MANAGER DATE: MARCH 8, 2011 SUBJECT: ADOPTION OF RESOLUTION NO. 2011-_ ESTABLISHING FINES AND PENALTIES FOR PARKING VIOLATIONS Background Last year, the California Senate passed State Bill 857 which added Government Code Section 76000.3 to provide an additional $3.00 "Trial Court Trust Fund - Parking Fee" on each parking ticket written by cities and counties. Section 76000.3 subdivision (c) provides in pertinent part as follows: (c) In those cities, districts, or other issuing agencies which elect to accept parking penalties, and otherwise process parking violations pursuant to Article 3 (commencing with Section 40200) of Chapter 1 of Division 17 of the Vehicle Code, that city, district, or issuing agency shall collect the added penalty imposed by this section. Each agency that elects to process parking violations shall pay to the Treasurer for deposit in the Trial Court Trust Fund three dollars ($3) for each civil parking penalty collected on each violation. Those payments to the Treasurer shall be made monthly. Discussion City staff was notified last month by the City's parking ticket administrator that they would be withholding the $3.00 Trial Court Trust Fund Parking starting with the first billing cycle in January and recommended that the City amend its parking citation bail schedule to account for the fee. The attached resolution amends the City's bail schedule for parking violation by increasing those penalties by $3.00 over current levels. Fiscal Impact The proposed increase will have no fiscal impact to the City but simply keep pace with current fee schedules charged by the state. Brady City Manager Attachment: Resolution establishing fines and penalties Page 2 of 7 RESOLUTION NO. 2011- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ESTABLISHING FINES AND PENALTIES FOR PARKING VIOLATIONS WHEREAS, the City Council may impose fines and penalties for violations of City ordinances and State laws relating to parking. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMIE AND ORDER AS FOLLOWS: SECTION 1. The above recitals are true and correct. SECTION 2. The parking fines and penalties set forth in the "Penalties and Delinquent Fee Schedule for Parking Violations" attached hereto as Exhibit "A" are hereby adopted and incorporated herein by reference. SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution and the same shall thereupon take effect and be in force.
