SUBJECT: THIRD AMENDMENT TO PARKS LANDSCAPE MAINTENANCE
SERVICES CONTRACT
Background
On February 12, 2008, the City Council approved a three year contract with CTAI
Pacific Greenscape for park landscape maintenance of all City parks in the amount of
$221,820 annually.
On October 14, 2008, the City Council approved a second amendment to the contract to
eliminate landscape services at three City parks to allow City Staff to perform the work
in-house. Shortly after the amendment was approved, the Parks Division Staff
assumed maintenance responsibilities and the City realized a cost savings in the
amount of $45,528. The annual contract amount decreased to $176,292.
Discussion
The current Parks Landscape Services Contract is set to expire on February 12, 2011.
Per Section 4 of the services agreement (February 12, 2008); "This Agreement shall be
for a term of three (3) years as commencing from the date of execution by the City. The
term of this Agreement may be extended for two (2) one (1) year extensions." City Staff
is satisfied with CTAI's performance and desires to extend the agreement by one year
and amend the scope of services to include the new Rosetta Canyon Community Park.
Under the proposed "Third Amendment to Services Contract," the scope of services is
being expanded to include landscape services at the Rosetta Canyon Community Park.
CTAI has submitted a proposal of $1,700 per month.
Concurrently, City Staff is reviewing a proposal from a local soccer league to perform a
portion of the landscape maintenance at Rosetta Canyon Park in exchange for use of
the office/concession building. If an agreement is reached with the soccer league, then
the scope of services with CTAI will be decreased, along with the price. Given the
pending expiration of CTAI's Landscape Service Contract, City Staff requests Council
approve the Third Amendment, subject to minor modifications tAfffi11Wd 5 VMd"X4s

Fiscal Impact
CTAI's proposed rate of $1,700 per month for Rosetta Canyon Community Park will
annually cost $20,400. The total cost of landscape maintenance services budgeted for
the Parks will increase to $196,692 annually. This cost is budgeted for the current fiscal
year 2010-2011 for the Parks Division.
Recommendation
Authorize the City Manager to make modifications to the scope of services and execute
the "Third Amendment to Services Contract", subject to minor modifications to the
contract approved by the City Attorney.

THIRD AMENDMENT TO SERVICES CONTRACT
(Park Landscape Maintenance)
This Third Amendment to Services Contract (this "Third Amendment") is made
and entered into as of the day of _,201 1, by and between the City of
Lake Elsinore, a municipal corporation (the "City") and CTAI Pacific Greenscape, a
California corporation ("Contractor").
RECITALS
A. City and Contractor have previously entered into that certain Services
Agreement, dated as of February 12, 2008 and amended on May 27, 2008 and October
20, 2008 (as amended, the "Contract').
B. The parties desire to extend the term of the Contract and amend the
Contract to provide for an additional park facility to be serviced under the Contract.
NOW, THEREFORE, the parties amend the Contract as follows:
1. As provided in Section 4 of the Contract, the parties elect to extend the
Term of Agreement for one year.
2. Specification: The Parties hereby amend the Specifications for City of
Lake Elsinore Park Maintenance Contract Work as set forth in Exhibit-A of the "Second
Amended and Restated Specifications for City of Lake Elsinore Park Maintenance
Contract Work" for the addition of Rosetta Canyon Community Park to the "LIST OF
LOCATIONS TO BE MAINTAINED UNDER THIS CONTRACT".
3. Compensation: The Parties hereby amend and restate the Bid Schedule,
Base Bid Part 1 as set forth in Exhibit-B of the "Second Amended and Restated
Specifications for City of Lake Elsinore Park Maintenance Contract Work" for the
addition of Rosetta Canyon Community Park at an annual cost of $20,400, changing the
Total Bid, Part 1 to $196,692 .
4. Except as provided herein, the terms and conditions set forth in the
Contract shall remain in full force and effect.
5. Each individual signing below represents and warrants that he/she has the
authority to execute this Third Amendment on behalf of and bind the party he/she
purports to represent.
