BRADY CITY MANAGER DATE: DECEMBER 14, 2010 SUBJECT: CONSIDERATION OF RESOLUTION RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 2, 2010 AND DECLARING THE RESULT THEREOF BACKGROUND On June 8, 2010, the City Council adopted three Resolutions pertaining to the General Municipal Election of November 2, 2010. Resolution No. 20 10-024 calling for an election to be held on November 2, 2010 to elect two people to the City Council; Resolution No. 2010-025 requesting specific services be rendered by the Riverside County Registrar of Voters; and Resolution No. 2010-026 adopting regulations for candidates seeking elective office. Resolution 2010-024 also gave the Riverside County Registrar of Voters the authority to consolidate the General Municipal Election with the Statewide Election, to canvass the returns of the election and certify the results. The City Council also adopted Resolution No. 2010-046 on July 13, 2010 ordering a measure, entitled "Measure T" related to increasing the Transient Occupancy Tax also be submitted to the voters at the November 2, 2010 election. DISCUSSION Pursuant thereto and in compliance with the Election Code of the State of California, the election was held on November 2, 2010. On November 26, 2010, the County Registrar completed the canvass and certified the election results. The Certification is attached as Exhibit A to the Resolution Reciting the Fact of the General Municipal Election held on November 2, 2010, indicating the total number of ballots cast, the number of vote by mail and provisional ballots cast, and the votes cast for each person running for the respective office and for and against Measure T. AGENDA ITEM NO.. 2 Pagel of 11 Resolution Declaring the Results of the Election December 14, 2010 Page 2 On December 1, 2010, a Request for Recount was filed with the County Registrar of Voters. The recount commenced on December 8, 2010 and as of the writing of this report has not concluded. In discussions with the Acting Registrar of Voters, the City Clerk's office was informed that the election will not be re-certified unless the results of the election change. In that regard, the resolution indicates the number of votes received by each candidate as reported by the Registrar's November 26, 2010 certification and the number of votes received after the recount. Council will be provided with a revised resolution prior to the beginning of the meeting on Tuesday, December 14th, with the final votes. As confirmed by the Certificate of Canvass, the following persons were elected to office: Brian Tisdale, City Council for a full term of four years Daryl Hickman, City Council for a full term of four years As also confirmed by the Certificate of Canvass, Measure T did not pass by the voters. FISCAL IMPACT There is no fiscal impact to the City. RECOMMENDATION It is recommended that the City Council: (1) Adopt in such final form as provided to the City Council Resolution No. 2010-068 Reciting the Facts of the General Municipal Election held on November 2, 2010, Declaring the Result and Such Other Matters as may be Provided by Law; (2) Direct the City Clerk to deliver Certificates of Election to each of the persons elected to office; and (3) Direct the City Clerk to administer the Oath of Office as prescribed in the Constitution of the State of California. Brady City Manager Attachment A: Proposed Resolution Reciting the Facts of the General Municipal Election Page 2 of 11 RESOLUTION NO. 2010-068 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 2, 2010, DECLARING THE RESULT AND SUCH OTHER MATTERS AS MAY BE PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Lake Elsinore, California, on Tuesday, November 2, 2010, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Election Code of the State of California, for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution 2010-024 adopted on June 8, 2010, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results have been received, and are attached hereto and made a part hereof as Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF. LAKE ELSINORE, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The whole number of votes cast in the precincts except absent voter ballots and provisional ballots was 4,882. The whole number of absent voter ballots and provisional ballots cast in the City was 3,958, making a total of 8,840 ballots cast in the City. Section 2. The names of persons voted for at the election for Member of the City Council and the number of votes received by each person are as follows: Election Results Recount Results Brian Tisdale 2555 votes Thomas Buckley 2268 votes Joyce Smith 2230 votes Patrick Masterson 834 votes Steve Manos 2235 votes Daryl Hickman 2285 votes Page 3 of 11 Resolution No. 2010-068 Page 2 of 3 Section 3. That as a result of the election, a majority of the voters voting on Measure "T" relating to an increase in the Transient Occupancy Tax did not vote in favor of it and the measure failed and shall not be deemed adopted and ratified. Section 4. The number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates and for and against Measure "T are as listed in Exhibit "A" attached hereto. Section 5. The City Council does declare and determine that: Brian Tisdale was elected as Member of the City Council for the full term of four years. Daryl Hickman was elected as Member of the City Council for the full term of four years. Section 6. The City Clerk shall enter on the records of the City Council of the City of Lake Elsinore, a statement of the result of the election showing: (1) the whole number of votes cast in the City; (2) the names of the persons voted for; (3) for what office each person was voted for: (4) the number of votes given at each precinct to each person and for and against Measure T, and (5) the total number of votes given to each person and for and against Measure T. Section 7. The City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall cause to be administered to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. Section 8. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED on this 14th day of December, 2010.
