BRADY CITY MANAGER DATE: MARCH 9, 2010 SUBJECT: CONSIDERATION OF RESOLUTION RECITING THE FACTS OF THE SPECIAL RECALL ELECTION HELD ON FEBRUARY 23, 2010 AND DECLARING THE RESULT THEREOF BACKGROUND On October 27, 2009, the City Council adopted Resolutions No. 2009-55 calling for a special recall election to be held on February 23, 2010, seeking to recall Council member Thomas Buckley and, if recalled, to elect a successor to complete Council Member Buckley's term; Resolution No.. 2009-57 requesting specific services be rendered by the Riverside County Registrar of Voters; and Resolution No. 2009-56 adopting regulations for candidates seeking election to the office of City Council Member. The adopted resolutions also gave the Riverside County Registrar of Voters the authority to canvass the returns of the election and certify the results. DISCUSSION Pursuant thereto and in compliance with the Election Code of the State of California, the election was held on February 23, 2010. On February 24, 2010, the County Registrar completed the canvass and certified the election results. The Certification is attached as Exhibit A to the Resolution Reciting the Fact of the Special Recall Election, indicating the total number of ballots cast, the number of vote by mail ballots cast, the number of provisional ballots cast and the votes cast for and against the measure relating to the recall of Thomas Buckley, and for each person seeking to be elected, if the recall was successful. AGENDA ITEM NO.4 Page 1 of 11 Resolution Declaring the Results of the Election March 9, 2010 Page 2 As confirmed by the Certificate of Canvass, the measure relating to the recall was not successful and Thomas Buckley was not recalled from the office of City Council Member. FISCAL IMPACT There is no fiscal impact to the City in adopting this resolution. RECOMMENDATION It is recommended that the City Council: (1) Adopt Resolution No. 2010-011 Reciting the Facts of the Special Recall Election held on February 23, 2010, Declaring the Result and Such Other Matters as may be Provided by Law; and (2) Directing the City Clerk to enter on the records of the City Council, a statement declaring that as a result of the election a majority of the voters voting on the measure relating to the recall of Thomas Buckley did not vote in favor of the recall. Brady City Manager Attachment A: Resolution Reciting the Facts of the General Municipal Election Page 2 of 11 RESOLUTION NO. 2010-011 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECITING THE FACT OF THE SPECIAL RECALL ELECTION HELD ON FEBRUARY 23, 2010, DELCARING THE RESULT AND SUCH OTHER MATTERS AS MAY BE PROVIDED BY LAW. WHEREAS, a Special Recall Election was held and conducted in the City of Lake Elsinore, California, on Tuesday February 23, 2010; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California, for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution 2009-57 adopted on October 27, 2009, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results have been received, and are attached hereto and made a part hereof as Exhibit A. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The whole number of votes cast in the precincts except absent voter ballots and provisional ballots was 594. The whole number of absent voter ballots and provisional ballots cast in the City was 1,749, making a total of 2,343 ballots cast in the City. SECTION 2. The City Council does declare and determine that as a result of the election, a majority of the voters voting on the measure relating to the recall of Thomas Buckley did not vote in favor thereof, and that Thomas Buckley was not recalled from the office of the Lake Elsinore City Council. The names of persons voted for at the election for member of the City Council to succeed in the term ending November 2, 2010 are: Steve Manos, Jimmy Flores, and Phillip Mendoza. SECTION 3. The number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the office for which the persons were candidates are as listed in Exhibit "A" attached hereto. The City Clerk shall enter on the records of the city council of the city, a statement of the result of the election, showing: (1) the whole number of ballots cast in the city; (2) the names of the persons voted for; (3) the measure relating to the recall voted upon; (4) for what office each person was voted for; (5) the number of votes given at each precinct to each person, and for and against the measure relating to the recall; and (6) the total number of votes given to each person, and for and against the measure relating to the recall. SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED on this 9th day of March, 2010.
