SUBJECT: ADOPTION OF RESOLUTION NO. 2010- ESTABLISHING
FINES AND PENALTIES FOR PARKING VIOLATIONS
Background
Last year, the California Legislature amended Government Code Section 70372 to
provide a State imposed $4.50 "court construction" fee on each parking ticket written by
cities and counties.
Section 70372, subdivision (b) provides in pertinent part as follows:
In addition to the penalty provided by subdivision (a), for every parking
offense where a parking penalty, fine, or forfeiture is imposed, an added
state court construction penalty of four dollars and fifty cents ($4.50) shall
be included in the total penalty, fine, or forfeiture. These moneys shall be
taken from fines and forfeitures deposited with the county treasurer prior
to any division pursuant to Section 1462.3 or 1463.009 of the Penal Code.
In those cities, districts, or other issuing agencies which elect to accept
parking penalties, and otherwise process parking violations pursuant to
Article 3 (commencing with Section 40200) of Chapter 1 of Division 17 of
the Vehicle Code, that city, district, or issuing agency shall observe the
increased bail amounts as established by the court reflecting the added
penalty provided for by this subdivision. Each agency that elects to
process parking violations shall pay to the county treasurer four dollars
and fifty cents ($4.50) for the parking penalty imposed by this subdivision
for each violation that is not filed in court.
Discussion
City staff was notified last month by the City's parking ticket administrator that they
would be withholding the $4.50 court construction fee in the near future and
recommended that the City amend its parking citation bail schedule to account for the
fee. We were also informed that parking fees were typically imposed in whole dollars
for processing purposes and that an increase of $5.00 per ticket was recommended.

The attached resolution amends the City's bail schedule for parking violation by
increasing those penalties by $5.00 over current levels.
Fiscal Impact
The proposed increase will have a minimal positive impact to the City due to the whole
dollar increase of $5.00 versus the actual court construction fee of $4.50. Based on
calendar year 2009 this would amount to an additional $2,869.00 in fines.
Recommendation
That the City Council adopt Resolution No. 2010-_ establishing fines and penalties
for parking violations.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, ESTABLISHING FINES AND PENALTIES
FOR PARKING VIOLATIONS
WHEREAS, the City Council may impose fines and penalties for violations of City
ordinances and State laws relating to parking.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA,
DOES HEREBY RESOLVE, DECLARE, DETERMIE AND ORDER AS FOLLOWS:
SECTION 1. The above recitals are true and correct.
SECTION 2. The parking fines and penalties set forth in the "Penalties and
Delinquent Fee Schedule for Parking Violations" attached hereto as Exhibit "A" are
hereby adopted and incorporated herein by reference.
SECTION 2. The City Clerk shall certify to the passage and adoption of this
resolution and the same shall thereupon take effect and be in force.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Lake Elsinore, California, this 9th day of February 2010.
