HomeMy WebLinkAbout09-28-2010 City Council MinutesMINUTES REGULAR CITY COUNCIL MEETING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CALIFORNIA TUESDAY, SEPTEMBER 28, 2010 CALL TO ORDER Mayor Melendez called the Regular City Council Meeting to order at 7:00 p.m. ROLL CALL PRESENT: MAYOR MELENDEZ MAYOR PRO TEM BHUTTA COUNCIL MEMBER BUCKLEY COUNCIL MEMBER HICKMAN COUNCIL MEMBER MAGEE ABSENT: NONE Also present: City Manager Brady, City Attorney Leibold, Director of Administrative Services Riley, Public Works Director/City Engineer Seumalo, Director of Lake and Aquatics Kilroy, Police Chief Fontneau, Redevelopment Agency Analyst Carlson and Interim City Clerk Cowley. PLEDGE OF ALLEGIANCE Mayor Melendez invited Pastor Rodriguez to lead the audience in the Pledge of Allegiance. CLOSED SESSION REPORT (1a) CONFERENCE WITH LEGAL COUNSEL-EXISTING LITIGATION (Subdivision (a) of Gov't Code § 54956.9) In Re the Darwin Rogers Booster Trust Dated 7/27/2005 (Riverside Superior Court Case No. RIP 095857 (1b) CONFERENCE WITH LEGAL COUNSEL--ANTICIPATED LITIGATION Significant exposure to litigation pursuant to subdivision (b) of Gov't Code Section 54956.9: 1 potential case City Attorney Leibold announced that items (1a) and (1 b) as listed on the agenda were discussed during closed session and indicated there was no reportable action on either case. Regular City Council Meeting September 28, 2010 PRESENTATIONS / CEREMONIALS Page 2 of 8 PRESENTATION OF VERIZON LITERACY GRANT TO ELSINORE FIRST ASSISTANCE CENTER - PROJECT ELSINORE READ Mr. Doug McAllister, Director of Government External Affairs with Verizon spoke of the Verizon Foundation. He presented a $9,000 Grant to the project known as Elsinore Read which stands for Reading Early Achieving Dreams, which is a program that helps children read at a young age. Mr. McAllister introduced a representative (name not entered into the record) from the Elsinore Assistance Center who provided a synopsis of the READ project and the kick off event that would take place on October 13, 2010 at the Elsinore First Assembly Church from 4:30 p.m. to 6:00 p.m that would explain the program in greater detail. WESTERN RIVERSIDE COUNTY OF GOVERNMENTS AND SOUTHERN CALIFORNIA EDISON PRESENTATION ON WESTERN RIVERSIDE ENERGY LEADER PARTNERSHIP UPDATE Barbara Spoonhour, Environmental Program Manager for Western Riverside County of Governments (WRCOG) provided City Council with an update of the Energy Leader Partnership and discussed the Direct Install Program which would be coming to the City in October 2010. She indicated that the program was designed to assist small business owners with low energy efficient lighting to help lower their cost with electricity. She stated that the program is free to the businesses that qualify. She specified that in order for a business to qualify for this free program their business must use less than 100 kilowatts per month. The total amount of kilowatts used can be found on the bottom of their monthly statement. Council Member Magee asked if the residents who live in the un-incorporated area of Lake Elsinore were eligible. Ms. Spoonhour replied by saying the program was for western Riverside County. Mayor Pro Tern Bhutta asked if the 820 businesses that were available for this program were all within the City's jurisdiction. Ms. Spoonhour confirmed they were. Council Member Buckley asked where should the business owners call. Ms. Spoonhour replied that the business owner could contact either Southern California Edison or they can contact her at WRCOG. Mayor Melendez asked for clarification of when the auditor would come to the business. Ms. Spoonhour replied by saying if the business owner calls in October, the auditor would be there in October and would only take a few days for the program to be completed. Council Member Hickman asked if this program would include non-profit businesses such as churches. Paul Yea with Southern California Edison confirmed that churches are included as long as they are customers of Southern California Edison. Regular City Council Meeting Page 3 of 8 September 28, 2010 RIVERSIDE COUNTY REGISTRAR OF VOTERS PRESENTATION ON VOTING OPTIONS FOR ELECTION Mr. Ralph Rivers representing the Riverside County Registrar of Voters spoke of the upcoming Consolidated General Municipal Election which is on November 2, 2010. He provided important dates for the public and how to become a registered voter. Mayor Melendez reminded the public that October 18th is the last day to rester to vote. She asked Mr. Rivers if the Registrar of Voters would be mailing out absentee ballots early to the members in the military who are currently serving overseas. Mr. Rivers replied by saying he will need to research that information and get back to her. Council Member Hickman asked if the registered voters would have the opportunity to vote in some of the shopping centers. Mr. River's responded by saying that they have abolished voting abilities in the shopping centers. He advised the public that there are opportunities for those who are interested to serve as poll workers and earn up to $110 for the day of their assistance. PUBLIC COMMENTS - NON-AG_ENDIZED ITEMS -1 MINUTE John Larson representing the Lake Elsinore Citizen Corps addressed Council regarding the Lake Elsinore "Shake Out Expo" which would be held on October 16th, 2010 from 12:00 p.m. to 5:00 p.m. at the Lake Point Park. Donna Franson representing the Lake Elsinore Citizen's Committee announced the upcoming Candidate's Forum which would take place on Wednesday, October 6th at 7:00 p.m at the Tuscany Hills Recreation Center. Raymond Roberson, resident of Lake Elsinore addressed his concerns with a car dealership in the City that is currently conducting unfair business to their customers and wanted the public to be forewarned. Council Member Magee suggested giving the City Clerk copies of his letters so she could forward the information on to the City's Business License Department and Code Enforcement Department to verify that the business is up to date with all their codes. Police Chief Fontneau also requested copies of Mr. Roberson's letter in order to conduct some research on the business. PUBLIC COMMENTS - AGENDIZED ITEMS - 3 MINUTES There were none. Regular City Council Meeting Page 4 of 8 September 28, 2010 CONSENT CALENDAR (2) Approval of Minutes Recommendation: It is recommended the City Council approve the following minutes: a) Regular City Council Meetings - August 24, 2010 and September 14, 2010. b) Joint City Council /Redevelopment Agency Meeting - August 24, 2010. (4) Investment Report for August 2010 Recommendation: It is recommended the City Council receive and file. (5) Custody Agreement with Union Bank for CFD No. 2006-1 Recommendation: It is recommended the City Council authorize the City Manager to execute the Custody Agreement between the City and Union Bank of California for CFD No. 2006-1 (Summerly). (6) Notice of Cessation of Special Tax - 31776 Indian Springs Road Recommendation: It is recommended the City Council direct the City Clerk to execute the Notice of Cessation of Special Tax for 31776 Indian Spring Road and submit the executed document to the Riverside County Recorder's Office for recordation. (7) Resolution of the City Council to vacate a Portion of Right-Of-Way Known as Lake Street (Formally Known as Robb Road Recommendation: It is recommended that the City Council adopt Resolution No. 2010-061 approving the Summary Vacation of a Portion of Lake Street. (9) Rosetta Canyon Fire Station and Park Project Notice of Completion Recommendation: It is recommended the City Council: (1) File the Notice of Completion with the County Recorder; (2) Accept the improvement within the City Right of Way into the City maintained system; and (3) Release all retention monies 35-days after the filing of the Notice of Completion. Council Member Magee pulled Items No. 3 and 8 from the Consent Calendar for discussion. Regular City Council Meeting Page 5 of 8 September 28, 2010 It was moved by Council Member Hickman and seconded by Council Member Buckley to approve Items 2 through 9 excluding Item 3 and 8 on the Consent Calendar. The motion unanimously carried by the following vote: AYES: Council Members: Buckley, Hickman, Magee, Mayor Pro Tern Bhutta and Mayor Melendez; NOES: None. ITEMS PULLED FROM THE CONSENT CALENDAR (3) Warrant List Dated September 152010 _ Recommendation: Authorize payment of Warrant List dated September 15, 2010. Council Member Magee explained to the audience that Item No. 3 pertains to the City's Warrant List which includes the checks and amounts that the City is to disburse. He stated he is no longer willing to support check number 104075 payable to SC Engineers. He has requested staff to provide the City Council an invoice from the firm and have it brought before Council as a Business Item for further discussion. It was moved by Council Member Magee, and seconded by Council Member Hickman to approve the balance of the Warrant List and to deny check number 104075 payable to SC Engineers. The motion unanimously carried by the following vote: AYES: Council Members: Buckley, Hickman, Magee, Mayor Pro Tern Bhutta and Mayor Melendez; NOES: None. (8) Resolution of the City Council Establishing the Speed Limit on McVicker Canyon Park Road Recommendation: It is recommended the City Council adopt Resolution No. 2010-062 establishing the prima facie speed limit for McVicker Canyon Park Road. Council Member Magee advised that all of the Council Members received an email from Mr. & Mrs. Almeria who reside on Star Ridge Drive who wrote in opposition to increasing the speed limit on McVicker Canyon Drive. Council Member Magee stated he concurs with their concerns and therefore does not support the increase of the speed limit on McVicker or Palomar. Any requests to speak on this project: Brian Shomo spoke in opposition to the increase of the speed limit on McVicker Road especially since there is a school, public park and fire station within the vicinity. Regular City Council Meeting Page 6 of 8 September 28, 2010 It was moved by Council Member Magee and seconded by Council Member Hickman to continue this item off calendar and, direct Law Enforcement and Engineering Staff to discuss the issues with the neighbors in community and come back to Council with a better alternative. The motion unanimously carried by the following vote: AYES: Council Members: Buckley, Hickman, Magee, Mayor Pro Tern Bhutta and Mayor Melendez; NOES: None PUBLIC HEARING(S) _ There are none. APPEAL(S) There are none. BUSINESS ITEM(S) (10) Consideration of Approval of CDBG Supplemental Agreement 2010-2011 Recommendation: It is recommended the City Council authorize the Mayor to execute the supplemental agreement with the County of Riverside for the use of Community Development Block Grant funds. Redevelopment Analyst Carlson provided an overview of the project with the City Council. Any requests to speak on this project: There were none Any written correspondence received on this project: There were none. It was moved by Mayor Pro Tern Bhutta and seconded by Council Member Hickman to authorize the Mayor to execute the supplemental agreement with the County of Riverside for the use of Community Development Block Grant funds. The motion unanimously carried by the following vote: AYES: Council Members: Buckley, Hickman, Magee, Mayor Pro Tern Bhutta and Mayor Melendez; NOES: None The City Council recessed and convened to the Redevelopment Agency at 7:43 p.m. The City Council reconvened at 7:54 p.m. PUBLIC COMMENTS - NON-AGENDIZED ITEMS - 3 MINUTES There were none. Regular City Council Meeting Page 7 of 8 September 28, 2010 CITY MANAGER COMMENTS City Manager Brady commented on the following: • Thursday, September 30th is the Mayor's State of the City Address for Lake Elsinore. The event will take place at the Diamond Stadium from 8:00 a.m. to 10:00 a.m. and the cost is $25. • Friday, October 1st is the Murder Mystery Dinner to be held at the Links at Summerly from 7:00 p.m to 9:30 p.m. The cost is $50 per person. • Saturday, October 2nd is the Household Hazardous Waste Collection Event. The event is free for city and county residents. It is from 9:00 a.m. to 2:00 p.m. at the City's Public Works Yard. • Saturday, October 2nd & 3rd is the Lake Elsinore Rotary and Storm Oktoberfest. The event will take place at the Storm Stadium from 11:00 a.m. to 6:00 p.m. and it is free of charge. • Monday, October 4th is the Career Expo at the Storm Stadium. The event will take place from 9:00 a.m. to 12:00 p.m and it is free of charge. • Tuesday, October 5th will be the Students of the Month Awards Program. The selected students will be presented a certificate at the Sizzler's Restaurant in Lake Elsinore at 12:00 p.m. - 2:00 p.m. • Wednesday, October 6th will be Principal for a Day. The event will be from 7:30 a.m. to 1:30 p.m. For further information please call Lorie Reitz at (951) 253-7000 • Thursday, October 7th will be the Heroes in Education Awards & Dr. Passarella's Report to the Community. The event will be from 6:00 p.m. to 9:00 p.m. and the fee is $49 per person. CITY COUNCIL COMMENTS Regular City Council Meeting Page 8 of 8 September 28, 2010 Council Member Magee commented on the following: • He addressed his concerns with SC Engineering who has been working on the street improvements at the intersection of the 1-15 and Railroad Canyon Road. • He recommended the community show support to the City by attending the Mayor's State of the City Address to be held on September 30th at the Diamond Club at 8:00 a. m. Council Member Hickman commented on the following: • He thanked Police Chief Fontneau for his hard work. • He stated that he is looking forward to attending the Mayor's State of the City Address on September 30tH Council Member Buckley commented on the following: • He congratulated the Storm Stadium for the outstanding success of the Mud Run which was held over the weekend. Mayor Pro Tem Bhutta commented on the following: • She had no comments. Mayor Melendez commented on the following: • She reminded the public that October 18th is the last day to register to vote. • She stated she looked forward to seeing everyone at the State of the City Address on September 30th at the Diamond Stadium. ADJOURNMENT The Lake Elsinore City Council adjourned the meeting at 8:00 p.m. to a regular meeting to be held on Tuesday, October 12, 2010, at 7:00 p.m. to be held in the Cultural Center located at 183 N.
