PC- 2010 -34 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING UNIFORM SIGN PROGRAM NO. 2010 -02 TO AMEND A PREVIOUSLY APPROVED UNIFORM SIGN PROGRAM FOR THE EXISTING PLAZA AT LAKEVIEW PROFESSIONAL OFFICE DEVELOPMENT LOCATED AT 31569 & 31571 CANYON ESTATES DRIVE WHEREAS, Jack Tine, Sign Methods Inc., has initiated proceedings for Uniform Sign Program No. 2010 -02 for The Plaza at Lakeview Professional Offices (the "Uniform Sign Program ") in order to amend a previously approved sign program (USP 2007 -10) located at 31569 & 31571 Canyon States Drive (APN: 363- 910 -001, 002 & 003) (the "Project'); and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of considering and approving or denying Uniform Sign Programs; and WHEREAS, on July 6, 2010, at a duly noticed public hearing, the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has considered the proposed Uniform Sign Program Amendment prior to rendering its decision and finds that the requirements of Chapter 17.94 of the Lake Elsinore Municipal Code have been satisfied. SECTION 2. The Planning Commission hereby finds and determines that Uniform Sign Program No. 2010 -02 is categorically exempt from the California Environmental Quality Act (Public Resources Code §§ 21000 et seq.: "CEQA ") and the Guidelines for Implementation of CEQA (14 California Code of Regulations §§ 15000 et seq.: "CEQA Guidelines ") pursuant to a Class 11 categorical exemption. A Class 11 exemption exists for: "Construction or replacement of minor structures accessory to (appurtenant to) existing commercial, industrial or institutional facilities, including but not limited to: (a) On- premise signs ;" The Uniform Sign Program amendment qualifies for a Class 11 exemption because it involves the construction of additional on- premise signs that are appurtenant to an existing commercial facility; the Plaza at Lakeview Professional Offices. Therefore the PLANNING COMMISSION RESOLUTION NO. 2010-34 PAGE 2OF4 Planning Commission hereby finds and determines that the Uniform Sign Program Amendment is exempt from CEQA Guidelines. SECTION 3. That in accordance with State Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for approval of Uniform Sign Program No. 2010 -02: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The Uniform Sign Program amendment complies with the goals and objectives of the General Plan, Canyon Creek `Summerhill" Specific Plan and the C -1 1SP Neighborhood Commercial Zoning District in which the Plaza at Lakeview Professional Offices are located. The amendment will assist in achieving the development of a well balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses, thereby diversifying Lake Elsinore's economic base. Moreover, the sign program amendment will facilitate the efficient and orderly use of signs for the purpose of attracting new and returning customers to participating businesses. 2. The project complies with the design directives contained in Section 17.196.180 and all other applicable provisions of the Municipal Code. The Uniform Sign Program amendment for the Plaza at Lakeview Professional Office development is appropriate to the site and surrounding developments in that the additional signage has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further, the additional signage will complement the quality of existing development and will create a visually pleasing, non - detractive relationship between the proposed and existing projects in that the sign designs, colors and materials evidence a concern for quality and originality and compliment the building architecture and existing signage. 3. Subject to the attached conditions of approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. The Uniform Sign Program amendment was reviewed and conditioned by all applicable City departments to ensure that the amendment provisions blend into existing development, create the least amount of disturbance, and do not negatively impact the residents or businesses of Lake Elsinore. The amendment will not result in any significant adverse environmental impacts. 4. Adequate conditions and safeguards pursuant to Lake Elsinore Municipal Code Section 17.196.180.D have been incorporated into the approval of the Conditional Use Permit to insure that the use continues in a manner envisioned by these findings for the term of the use. PLANNING COMMISSION RESOLUTION NO. 2010-34 PAGE 3OF4 Pursuant to Lake Elsinore Municipal Code Section 17.196.180.D, the uniform sign program amendment has been scheduled for consideration and approval of the Planning Commission at the regularly scheduled meeting on July 6, 2010. SECTION 4. Based upon the evidence presented, the above findings, and the attached conditions of approval, the Planning Commission hereby approves Uniform Sign Program No. 2010 -02. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption. Brady City Manager CONDITIONS OF APPROVAL UNIFORM SIGN PROGRAM NO. 2010 -02 PLAZA AT LAKEVIEW AMENDMENT TO ALLOW ADDITIONAL WALL MOUNTED SIGNAGE GENERAL 1. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the environmental documentation, or Uniform Sign Program No. 2010 -02. UNIFORM SIGN PROGRAM NO. 2010 -01 2. The decision of the Commission shall be final fifteen (15) days from the date of the decision unless an appeal has been filed with the City Council pursuant to the provisions of Chapter 17.180. 3. Prior to issuance of any sign permit the applicant shall sign and complete an "Acknowledgement of Conditions" form and shall return the executed original to the Planning Division for inclusion in the case records. 4. The applicant shall apply for a sign permit and pay appropriate fees for all signs installed at the project site. 5. The location, size, style, and color for all signs shall comply with the Sign Program (Approved herein). Any additions or revisions to the approved Sign Program shall require Planning Commission review and approval. 6. The approval for Uniform Sign Program No 2010 -02 will lapse and be void unless sign permits are issued within two (2) years. 7. Any alteration or expansion of this Sign Program approval shall be reviewed according to the provisions of Chapter 17.94 (Signs- Advertising Structures) of the Lake Elsinore Municipal Code and the Canyon Creek "Summerhill" Specific Plan. 8. Prior to issuance of sign permits, the applicant shall provide materials indicating appropriate referencing between the Uniform Sign Program and the existing Covenants Conditions and Restrictions (CC &R's) for the subject condominium complex.
