BRADY, CITY MANAGER DATE: JULY 27, 2010 SUBJECT: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING SECTIONS 6.04.020, 6.04.030, 6.04.060, 6.04.070, 6.04.140, 6.04.150, 6.04.245 AND EXHIBIT A TO CHAPTER 6.04 OF THE LAKE ELSINORE MUNICIPAL CODE REGARDING ANIMAL CONTROL Background The new animal shelter is scheduled to open later this year and the City's agreement for animal control field services expired on June 30t"; however, it has been extended on a month-to-month basis until a new agreement has been approved. The City's overall cost for Animal Control services is projected to rise substantially during the current fiscal year. To help offset a portion of the increased cost of Animal Control services, City Staff desires to increase animal license and impound fees. Currently the City's Animal Control Fee Schedule is embedded as part of the ordinance in Chapter 6.04 of the Lake Elsinore Municipal Code (LEMC). City Staff desires to amend the ordinance so that all fees, penalties and other charges related to animal control are established by resolution. In general, setting fees by ordinance is not desirable, because the ordinance process takes additional time to become law and the City shouldn't have to amend an ordinance every time it desires to change fees. In a separate housekeeping measure, City Staff recommends deletion of Exhibit-A from Chapter 6.04 of the LEMC. Exhibit-A is an outdated listing of exotic animals. City Staff believes the listing is irrelevant and redundant, because section 6.04.260 (Keeping of exotic animals) already provides regulation of all "exotic" animals. Amending the Animal Control ordinance and establishing the Animal Control Fee Schedule by resolution will be a two step process. The first step is for the City Council to consider amending the ordinance. In addition, City Council should AGENDA ITEM NO. 12 Page 1 of 15 JULY 27, 2010 ANIMAL CONTROL ORD. provide direction to City Staff on a DRAFT Animal Control Fee Schedule. During the second reading of the ordinance, the City Council will have the opportunity to adopt the revised Animal Control Fee Schedule by resolution. Discussion The estimated annual cost for Animal Control Services during a full fiscal year for the City of Lake Elsinore equals: $712,912 (Field & Shelter Services) minus $135,800 (license revenue) _ $577,112 However, this estimate will be prorated based upon the actual opening date of the new shelter. Per the City's current agreement with Animal Friends of the Valley (AFV), all license and impound fees are retained by AFV. For the Fiscal Year ending 2010, AFV collected the following revenue. License Fees = $127,900 Impound Fees = $ 10,628 Boarding Fees = $ 4,679 Citations = $ 16,000 Total = $159,207 Attached is an Animal Control Fee Schedule Comparison for regional cities and the County of Riverside. Included in the Fee Schedule are City Staff's proposed increases and changes in fees. The changes are summarized below. • Incrementally increase license fees over a three year period. • Eliminate multi-year license fee discount. • Increase Impound Fees equivalent to the County. • Increase Boarding Fees ($/day) on par with actual cost. City Staff request direction from the City Council on the Animal Control Fee Schedule in order to prepare a resolution to adopt the Fee Schedule during the second reading of the amended ordinance. Fiscal Impact There is no fiscal impact for amending the ordinance. Recommendation Waive further reading and introduce by title only an ordinance amending certain sections of Chapter 6.04 of the Lake Elsinore Municipal Code regarding Animal Control. That Section 6.04.020 of the Lake Elsinore Municipal Code is hereby amended and restated in its entirety as follows: 6.04.020 Animal Control Fees Fees, penalties and charges related to animal control shall be established by resolution of the City Council. SECTION 2. That the title and Subparts A and B of Section 6.04.030 of the Lake Elsinore Municipal Code are hereby amended as follows: 6.04.030 Dog and Cat Licensing A. It is unlawful for any person to own, harbor or keep any dog or cat four months of age or older within the City for a period longer than 30 days, unless there is attached to such dog or cat a valid license tag obtained from the City of Lake Elsinore. A license will be issued for each dog or cat upon payment of a license fee established pursuant to, •..h;^h °°4 fnrFh LEMC 6.04.020. Said license shall be valid for a period of one year following issuance and shall be renewed within 30 days after such period termination. B. If an application for a license is made more than 30 days after the date such license is required, the applicant shall pay a penalty established pursuant tomet4GFt; iR LEMC 6.04.020. If a valid license tag is lost or destroyed, a duplicate thereof may be procured from the Animal Control Department upon submission of proof of loss and payment of the fee established pursuant iR-LEMC 6.04.020. SECTION 3. That Subpart B of Section 6.04.060 of the Lake Elsinore Municipal Code is hereby amended as follows: B. If an application for a license is made more than 30 days after the date such license/permit is required, the applicant shall pay a penalty established pursuant to as set foF*h OR LEMC 6.04.020. Page 5 of 15 Ordinance No. 1283 Page 2 of 11 SECTION 4. That Subpart D of Section 6.04.070 of the Lake Elsinore Municipal Code is hereby amended as follows: D. The Animal Control Agency may deny an application for a permit/license required by this chapter, whether original pr renewal, or suspend or revoke such a permit/license if it finds that any kennel, cattery or pet shop fails to meet any of the conditions set forth in this chapter, or the premises within which dogs or cats are kept or maintained as provided in this chapter fail to meet any of the conditions set forth herein. The Animal Control Agency shall prepare a notice of denial of an application, or suspension or revocation of a permit/license, setting forth the reasons for such a denial, suspension or revocation. Such notice shall be served personally on the applicant or licensee. Such notice of denial, suspension or revocation by filing with the City, within 15 days after notice of such denial, suspension or revocation, a written notice of appeal briefly setting forth the reasons why such denial, suspension or revocation is not proper and by paying the fee for appeal established pursuant to by LEMC 6.04.020. The City Clerk shall give notice to the appellant by regular mail of the time and place of the hearing. Such appeal shall be heard by the City Council which may affirm, amend or reverse the decisions. In conducting the hearing, the Council shall not be limited by the technical rules of evidence. SECTION 5. That Subpart A of Section 6.04.140 of the Lake Elsinore Municipal Code is hereby amended as follows: A. No impounded animal shall be redeemed except on payment of all appropriate fees established pursuant to as stated in LEMC 6.04.020. No dog or cat which is to be kept or harbored within the corporate limits of the City of Lake Elsinore shall be released from the shelter unless or until it is duly licensed in accordance with the provisions of this chapter. No unredeemed dog or cat shall be sold if or while the same is suffering from any infectious or communicable disease. SECTION 6. That Section 6.04.150 of the Lake Elsinore Municipal Code is hereby deleted in its entirety. The fees, penalties, and Gharge° a set in i EMG 6.04.020. SECTION 7. That paragraph 7 of Subpart F of Section 6.04.245 of the Lake Elsinore Municipal Code is hereby amended as follows: 7. Require that the animal be impounded at the expense of the owner or person in charge, custody, or control of the animal in accordance with the fee schedule established pursuant to set fei4h in LEMC 6.04.020. SECTION 8. That Exhibit A to Chapter 6.04 of the Lake Elsinore Municipal Code is hereby deleted in its entirety. If any provision, clause, sentence or paragraph of this Ordinance or the application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions of this Ordinance and are hereby declared to be severable. SECTION 10. This Ordinance shall take effect thirty (30) days after the date of its final passage or such later date as may be designated by the City Council. The City Clerk shall certify as to adoption of this Ordinance and cause this Ordinance to be published and posted in the manner required by law.
