A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, MAKING AN
ELECTION TO RECEIVE PAYMENTS PURSUANT TO
HEALTH & SAFETY CODE SECTIONS 33607.5 AND
33607.7 FOR THE RANCHO LAGUNA REDEVELOPMENT
PROJECT AREA NO. 1
WHEREAS, the City Council of the City of Lake Elsinore (the "City Council'), by
Ordinance No. 607 approved and adopted the Redevelopment Plan ('Redevelopment
Plan ") for the Lake Elsinore Rancho Laguna Redevelopment Project Area No. I ('Project
Area ") and subsequently amended the Redevelopment Plan by Ordinance No. 624,
Ordinance No. 987, Ordinance No. 1249 and Ordinance No. 1260; and
WHEREAS, as provided by Senate Bill 211 (SB211) and pursuant to Health &
Safety Code Section 33333.6(e)(2)(B), the City Council, by Ordinance No. 1249 adopted
on February 26, 2008, eliminated the time limit to incur debt for the Project Area; and
WHEREAS, Health & Safety Code Section 33607.7 provides that if a
redevelopment plan is amended to eliminate the time limit on incurring indebtedness
and no pass- through agreement exists, the amounts required pursuant to subdivisions
(b), (c), (d), and (e) of Health & Safety Code Section 33607.5 must be paid to each
affected taxing entity, including the City, if the City elects to receive such tax increment
payments; and
WHEREAS, the City of Lake Elsinore is an affected taxing entity under Health &
Safety Code Section 33607.5 and may elect to receive the amount authorized by
Section 33607.5(b) in any fiscal year in which the Agency receives tax increments from
the Project Area.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby elects for the City to receive the maximum
amounts authorized by Sections 33607.5(b) and 33607.7 from the Project Area,
including such amounts as may be retroactively due and owing to the City from prior
years and continuing through the last fiscal year in which the Agency receives tax
increments from the Project Area.
SECTION 2. This Resolution shall take effect from and after the date of its
passage and adoption.
