The City of Lake Elsinore appreciates your attendance. Citizens' interest provides the
Planning Commission with valuable information regarding issues of the community.
Meetings are held on the 1 st and 3rd Tuesday of every month. If you are attending this
Planning Commission meeting, please park in the Parking Lot across the street from the
Cultural Center. This will assist us in limiting the impact of meetings on the Downtown

4. Minor Design Review of a single-family dwelling unit
located at 16517 Arnold Avenue (APN's: 378-221-

Director of Community Development Preisendanz stated that staff is
recommending denial of the project due to the design.
Applicant, Vass Hymas, 15070 Alvarado Street, Lake Elsinore, stated that he
doesn't understand why staff is recommending denial of his project because they
have done everything that staff has requested.
PLANNING COMMISSION COMMENTS
Commissioner Zanelli stated that the Commission would like to see architectural
renderings instead of hand drawn and he also had concerns about the retaining
wall on the property and the fact that there were no permits pulled or inspections
done in addition to a required compaction report.
The applicant stated that the Building Technician told him that he could build a
thirty six (36) inch retaining wall around his property so that there would not be
erosion onto the neighbor's property, and a permit would not be required.

Director of Community Development Preisendanz stated that if there is a slope
that is retaining a surcharge, a permit is required. He indicated that he would
confirm with the Building Technician that this was done correctly. He also said
that the only time a permit is not needed is for a planter wall which has a level
backfill and is two (2) feet or under.
Commissioner Zanelli said unfortunately there was a lack of communication
between the Building Technician and the applicant. He referred the applicant to
the Engineering Division regarding structural guidelines for the retaining wall.
Commissioner Flores said he viewed the property and questioned whether or not
the retaining wall was inspected and certified by Building and Safety. He also
had a question about the existing four (4) inch fire hydrant and recommended
approval of a standard six (6) inch fire hydrant for safety reasons prior to
approval of the project.
The applicant indicated that Riverside County Fire indicated that the wart head is
within the 500 foot requirement.
Commissioner Mendoza asked that the applicant be more specific on the
Architectural drawings and to bring it back to the Commission at that time.
Vice Chair Gonzales asked what type of roof would be on the proposed project.
The applicant indicated that the roof was synthetic straw and met the code.
Chairman O'Neal stated that he had a problem with the design of the project and
said it did not look like a Tutor home, and the drafting was incomplete. He
specified to the applicant that he has fifteen (15) days to appeal the decision of
denial to the City Council.
The applicant requested to meet with staff to discuss design review.
Director of Community Development Preisendanz stated that staff would be
happy to work with the applicant regarding architectural standards for this type of
design.
Chairman O'Neal suggested a continuance.

5. Residential Design Review No. 2005-04 for a proposed 8-
unit multi-family development located on Riley Street in the
Historic Elsinore Overlay District (APN: 374-071-011 & 012)
Chairman O'Neal opened the Public Hearing at 6:28 pm.
Director of Community Development Preisendanz provided a brief overview of
the proposed project and requested Planning Consultant Miller to review it with
the Commission and answer questions.
Planning Consultant Miller provided an overview of the project and stated that
she had corrections to Condition Numbers 1, 47, 55, 63, and added Condition
Number 72 to the Conditions of Approval.
Applicant, Deleo Hagan, 280 Walnut Hills Drive, San Marcos, California, read
and agreed with the Conditions of Approval, including the corrections to the
Conditions.
Chairman O'Neal closed the Public Hearing at 6:35 pm.

Commissioner Flores thanked staff for looking into the matter regarding
Condition No. 47 regarding gutter installation requirements.
Commissioner Mendoza stated that this project would be a nice addition to the
City.
Vice Chair Gonzales said the project looks good.

gorgeous and the businesses in the area will benefit from this project.

Chairman O'Neal opened the Public Hearing at 6:42 pm.
Director of Community Development Preisendanz provided an overview of the
project and requested Planning Consultant Donahoe to review it with the
Commission and answer questions.
Planning Consultant Donahoe provided an overview of the project. She stated
that the City Attorney's office asked that staff add two (2) conditions to both maps
which are Condition No's. 15E and 15F of the CC&R HOA Conditions.
Applicant, Christine Zortman, The Shopoff Group, 8951 Research Drive, Irvine,
read and agreed with the Conditions of Approval including the new Conditions.
She thanked Carole Donahoe, Planning Division, Ken Seumalo and Ed Basubas,
Engineering Division, and staff for being diligent in processing the project.
REQUESTS TO SPEAK
Mike Mathews, 29026 Allan Street, Lake Elsinore, stated that he had complaints
about excessive water runoff to the properties near the project and indicated
health risks due to the contamination of water run off on the streets. Their homes
and properties are being damaged by the increased saturation of soil and their
foundations and patios are cracking and septic systems are failing. Mr. Mathews
contacted County and City officials with his concerns and they told him that there
was no budget to resolve the problems. He asked for help in resolving this
situation and requested postponement of any further development.
Public Works Director Seumalo stated that he will be meeting with Centex
Homes regarding the drainage problem and will resolve this situation. He
indicated that the Engineering Division is working with Riverside County to
advance a Master Plan Drainage project and they are working on resolving
funding issues.
Community Development Director Preisendanz stated that the project still needs
to go through the design review and prior to the issuance of the Building Permit,
the City hopes to have this resolved.

Ms. Zortman stated that the project will not start for another year.
Mr. Rockwood, 18840 Welch Drive, Lake Elsinore, stated that his concern is the
drainage along the property lines on Welch because of all of the development.
Public Works Director Seumalo addressed this issue regarding drainage.
Ms. Zortman indicated that there will be a future bio swale and detention basin
which will pick up all of the water that is going through there historically and will
then pull all of the water into a storm drain that they are going to build in the
street. At that point, the residents along Welch Drive can decide if they want to
abandon the storm drain in place and take back the other twenty (20) feet of their
front yard.
Mary Fenrable, resident on 3rd Street, Lake Elsinore, stated she is concerned
about eminent domain regarding her property. Her other concern is that if a
storm drain is built, she asked if it could flood into her property because it has
happened in the past. Additionally, she has concerns about the speed of traffic
at the entrance and exits of this area and the annexation issue that still exists on
3rd Street.
Ms. Zortman stated that the project is taking its own annexation and LAFCO
requested the City to pull the rest of the area into the City jurisdiction. She stated
that the Engineering Division has reviewed their hydrology reports and they are
not "out letting" anywhere off site that would exceed current existing conditions,
they are also fixing the drainage on Welch Drive. Ms. Zortman indicated that the
Traffic Study for the project provided Mitigation measures.
Chairman O'Neal closed the Public Hearing at 7:20 pm.
PLANNING COMMISSION COMMENTS
Commissioner Mendoza stated he had concerns about the drainage problem and
requested a Condition to be added to resolve this issue before construction
starts.
Vice Chair Gonzales asked if the City would work with the County to get the
drainage problems cleared up.
Public Works Director Seumalo indicated that the City is proactive with the
County regarding this situation.
Commissioner Zanelli asked Deputy City Attorney Santana to address Ms.
Fenrables concerns about eminent domain.
Deputy City Attorney Santana addressed the eminent domain question regarding
Ms. Fenrable's property.

Commissioner Zanelli requested Public Works Director Seumalo to inform the
residents of the results of the drainage assessment. He indicated that he liked
the project and is confident that it will be a good development.
Commissioner Flores recommended adding a Condition stating that prior to any
construction being completed, the drainage problems must be fixed. His main
concern is the health hazards to the residents and their families.
Commissioner Mendoza stated he is also concerned about the health problems
to the residents.
Commissioner Zanelli stated that he understands the health concerns and the
drainage problem but doesn't think it is fair to the Shopoff Group to hold up their
project based on problems created by someone else.
Chairman O'Neal stated that he agrees with Commissioner Zanelli not to hold the
project up and indicated that these issues need to be addressed at the design
review. He also stated that Mr. Seumalo has represented that this is a priority.

8. Uniform Sign Program No. 2007-06
Director of Community Development Preisendanz provided an overview of the
project and requested Associate Planner Carlson to review it with the
Commission and answer questions.
Associate Planner Carlson provided an overview of the project and
recommended denial of the project.
Applicant, Megan Locke, 183 Collier Avenue, Suite A, Lake Elsinore, addressed
the issues regarding the architecture of the sign and the number of panels placed
in the sign.
Owner, Les Young, Alesco Development Company, stated that the reason why
they chose that design was that it reflected the architecture of the rest of the
buildings.
Chairman O'Neal asked why the California Environmental Quality Act (CEQA)
requirements pertain to a sign.
Community Development Director Preisendanz explained the CEQA
requirements regarding signs.
PLANNING COMMISSION COMMENTS
Vice Chair Gonzales stated that there were too many panels on the sign.
Commissioner Zanelli also indicated that there were too many panels on the sign
and suggested the sign to say "Skypark Automotive Center" with the address.
Commissioner Flores asked if there was any other additional signage that
identified the independent units within the Industrial Complexes located on
Corydon?
Planning Manager Weiner stated that they didn't take an inventory of the signs
that are located on Corydon but from his recollection, there was not a
proliferation of movement signs. New developments didn't have any other signs
other than on the building.
Commissioner Mendoza agreed with staff to deny the project.
Chairman O'Neal stated that he agreed with staff's recommendation for denial.

STAFF COMMENTS
Public Works Director Seumalo gave the Capital Improvement Plan update. He
also thanked staff for their assistance.
Planning Manager Weiner stated that Mark Dennis, Information/Communication
Manager asked if the Commission would be interested in establishing a City e-
mail account.

Planning Manager Weiner thanked Vice Chair Gonzales for his patience
regarding the Gunder and McPherson Circle grading issues and said that he
would keep him abreast of the situation.
Director of Community Development Preisendanz stated that the City
appreciates Alesco Development Company's business but the City tried to work
with Mr. Young but Mr. Young wanted to bring this issue to the Commission.
Director of Community Development Preisendanz indicated that there would be a
Joint Study Session on July 31, 2007 at 5:00 pm with the City Council regarding
design review and a Staff Report would be prepared for the Commission.
Deputy City Attorney had no comments.
PLANNING COMMISSION COMMENTS
Commissioner Zanelli thanked Planning Consultant Donahoe for all of
her work on the project and thanked staff for answering all of his
questions.
Commissioner Flores stated he was concerned about the safety issues
at night on Corydon Road located where the light is on Palomar and
the extension for drainage where the sidewalk is.
Public Works Director Seumalo addressed his concerns and said he would
contact the City or County Inspector regarding this.
Commissioner Mendoza stated that regarding the Uniform Sign Program project,
the City should stay consistent with the number of signs that go into Business
Parks. He also indicated that he has gone by various construction sites on
Saturday and Sunday and there has been construction activity on those days and
requested signs to be posted with the City's contact information if any complaints
need to be made.
Vice Chair Gonzales thanked Planning Manager Weiner for his assistance
regarding Mrs. Alonzo.

WATER AVAILABILITY/FIRE FLOW
The applicant provided staff with a "Fire Flow Test Report" dated September 25, 2007 from
the Elsinore Valley Municipal Water District (EVMWD). In the letter, EVMWD indicates that
there are two (2) fire hydrants within the immediate vicinity of the subject lot. The "Fire Flow
Test Report" identifies that the hydrants have a total discharge of 1 ,705 gallons-per-minute
(GPM) (see attachment 5). It should be noted that staff conducted a field inspection and
verified that the two (2) fire hydrants were in close proximity to the dwelling unit. Staff
estimates that, one (1) fire hydrant is located approximately 100 linear-feet from the site
and the other fire hydrant is 330 linear-feet from the subject site.

Sitinq
The proposed 1.25 acre vacant lot located at 15038 Le Gaye Street will be located on a
relatively flat, previously graded lot located within the R-E (Estate Single-Family
Residential) Zoning district. In order to create a flat buildable pad for development, the
applicant is proposing to cut and fill approximately 500 cubic-yards of earth.
Architecture
The applicant is proposing to include elements of "Mediterranean" architecture for the
proposed single-story single-family dwelling unit located at 15038 Le Gaye Street. The
front elevation will include decorative window surrounds with divided "lites", coach lights,
decorative garage doors, exposed rafter-tails, a "Santa Barbara Cat face" stucco finish, a
decorative front-entry patio, and a lightweight concrete tile roof. The north elevation will
included a chimney with decorative cap, side entry door with divided "lites", decorative
window surrounds with divided "lites", coach lights, exposed rafter tails, a "Santa Barbara
Cat Face" stucco finish, and a lightweight concrete tile roof. The east elevation includes a
chimney with cap, decorative window surrounds with divided "lites", exposed rafter tails, a
"Santa Barbara Cat Face" stucco finish, and a lightweight concrete tile roof. The west
elevation will include decorative window surrounds with divided "lites", exposed rafter tails,
a "Santa Barbara Cat Face" stucco finish, and a lightweight concrete tile roof.
The applicant is proposing a six-foot (6') high block wall along the eastern and rear
property lines and a six-foot (6') high wood fence along the west property line. The
applicant is proposing decorative return wall fencing from the interior property line fencing
to the main dwelling unit. The decorative return fencing will include six-foot (6') high
wrought-iron fencing with stucco pilasters.
Landscapinq
The applicant is proposing to landscape and irrigate the front-yard of the subject property.
Front-yard landscaping will include two (2) twenty-four inch (24") "Canary Island" pine trees,
four (4) twenty-four inch (24") box "Evergreen Pear" trees, "Longifolia" shrubs, "New
Guinea Hybrid" flowers, and turf. To further enhance the front-yard landscaping, the
applicant is also proposing to include a decorative stamped concrete driveway and
meandering sidewalks that lead to the side-yards of the subject lot. Staff will continue to
work with the applicant in the field in order to reduce the area of turf proposed; thereby
assisting in the preservation of water.

Staff has reviewed the proposed conventionally built single-story single-family dwelling unit
located at 15038 Le Gaye Street and found that the project will meet all minimum
requirements of Chapter 17.82 (Design Review), Chapter 17.14 (Residential Development
Standards), Chapter 17.20 (Estate Single-Family Residential) Zoning District, and Chapter
17.66 (Parking Requirements) of the Lake Elsinore Municipal Code (LEMC) including but
not limited to; density, setbacks, landscaping, parking, and lot coverage.
Sitinq
The total building footprint forthe proposed dwelling unit located at 15038 Le Gaye Street,
which includes the proposed dwelling unit, the three (3) car garage, and covered front-
patio, will be approximately eight percent (8%). It should be noted that the eight percent
(8%) net lot coverage is below the maximum lot coverage of twenty-five percent (25%) as
outlined in Chapter 17.20.090 of the LEMC. In addition, the site plan meets all applicable
development standards and criteria outlined in the R-E (Estate Single-Family Residential)
Zoning District and the Residential Development Standards outlined in the LEMC.
Architecture
The proposed architecture of the conventionally built single-story single-family dwelling unit
is consistent with the style and design of existing single-family dwelling units within the
vicinity. Furthermore, the proposed colors and materials to be incorporated are consistent
with the goals and intent of the architectural design guidelines of the General Plan's
Community Design Element, in that the proposed dwelling unit, which incorporates
elements of "Mediterranean" architecture, provides an aesthetic quality that lends to the
overall achievement of a well balanced R-E (Estate Single-Family Residential) Zoning
district.
Landscaoina
The minimum landscape coverage requirements for in-fill single-family dwelling units states
that the applicant landscape the front-yard with an automatic irrigation system as outlined

ENVIRONMENTAL DETERMINATION
Staff determined that the Project is categorically exempt from the California Environmental
Quality Act (Cal. Pub. Res. Code 9921000 et seq.: "CEQA") and the CEQA Guidelines (14
C.C.R. 99 15000 et seq.) pursuant to a class 3(a) exemption for new construction or
conversion of small structures because the Project involves construction of one single-
family dwelling unit. (14 C.C.R. 9 15303(a)).
RECOMMENDATION
Staff recommends that the Planning Commission adopt Resolution No. 2007-_ approving
the proposed the single-story single-family dwelling unit based on the Findings, Exhibits,
and the proposed Conditions of Approval.

WHEREAS, M. Celina Martinez/Draftech Design Company, filed an application
with the City of Lake Elsinore requesting approval of a Minor Design Review for a
conventionally built single-story single-family dwelling unit with an attached three (3) car
garage (the "Project") on property located at 15038 Le Gaye Street (APN: 379-140-
083); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of considering and approving, conditionally approving,
or denying Minor Design Review requests for residential projects; and
WHEREAS, public notice of the Project has been given and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public meeting held with respect to this
item on November 20,2007.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed design for
the Project and has found it acceptable. The Planning Commission finds and
determines that the Project is consistent with the Lake Elsinore Municipal Code.
SECTION 2. The Planning Commission finds and determines that the Project is
categorically exempt from the California Environmental Quality Act (Cal. Pub. Res.
Code SS 21000 et seq.: "CEQA") and the State Guidelines for Implementation of CEQA
(14 C.C.R. SS 15000 et seq.: the "CEQA Guidelines") pursuant to a class 3(a)
exemption for new construction or conversion of small structures because the Project
involves construction of one single-family residence. (CEQA Guidelines S 15303(a)).
SECTION 3. That in accordance with Lake Elsinore Municipal Code Chapter
17.82, the Planning Commission makes the following findings for the approval of the
Project:
1. The Project, as approved, will comply with the goals and objectives of the
intended General Plan and the Zoning District in which the Project will be
located.
The Project complies with the goals and objectives of General Plan designation
Low Density (LD) as well as the R-E (Estate Single-Family Residential) Zoning
District. General Plan designation Low Density is intended for residential
development characterized by quality single-family homes on large lots at least

one-third of an acre in size. Furthermore, Table 11/-5 (General Plan/Zoning
Compatibility Matrix) within the General Plan identifies that the General Plan
designation Low Density is compatible with the R-E (Estate Single-Family
Residential) Zoning District. In addition, the Low Density General Plan
designation mandates that the maximum density shall be three (3) dwelling units
to the net acre. The proposed single-family dwelling unit will cover approximately
eight percent (8%) of the net lot area, which complies with the goals and
objectives of the Low Density designation of the General Plan, R-E (Estate
Single-Family Residential) Zoning District, and the General Plan/Zoning
Compatibility Matrix.
Approval of this Project will assist in achieving the development of a well
balanced and functional mix of residential, limited commercial, limited industrial,
open space, recreational and institutional land uses by providing additional
affordable housing within the R-E (Estate Single-Family Residential) Zoning
District. The Project also encourages the development and maintenance of a
broad range of housing types for all income groups and age categories. Finally,
the Project, which incorporates elements of "Mediterranean" style architecture,
will provide a well rounded design while maintaining the desirable rural
characteristics and base framework to achieve quality and compatibility in the
physical design of the developing portions of the City. Overall, the Project will
enhance the existing developed areas within General Plan designation Low
Density and Zoning Designation R-E (Estate Single-Family Residential) Zoning
district of the Lake Elsinore Municipal Code.
2. The Project complies with the design directives contained in Section 17.82.060
and all other applicable provisions of the Municipal Code.
The Project is appropriate to the site and surrounding developments in that the
proposed single-family dwelling unit will have: an approximate fifty-two foot (52?
front-yard setback; sufficient front-yard landscaping; and, safe and sufficient on-
site vehicular circulation.
In addition, the Project will comply with all setback, height, and lot coverage
requirements as outlined in the R-E (Estate Single-Family Residential) Zoning
District of the Lake Elsinore Municipal Code.
The Project will complement the quality of existing projects in that the applicant is
providing elements of "Mediterranean" style architecture, which includes: 360-
degree architecture articulation pursuant to the "General Plan, Community
Design Element Design Guidelines'; decorative window surrounds with divided
"lites':' a decorative front-entry patio; coach lights, a "Santa Barbara Cat Face"
stucco finish; and a lightweight concrete tile roof.

3. Subject to the attached conditions of approval, the Project is not anticipated to
result in any significant adverse environmental impacts.
A Class 3 CEQA exemption may be invoked when the development proposal
involves construction of one single family residence. Pursuant to CEQA
Guidelines 15303(a), the Project is exempt from environmental review because it
involves the construction of one single family residence.
Section 7.3.2 of the MSHCP states that: 'Tdjevelopment of individual single-family
homes on existing parcels, in accordance with existing land use regulations is a
"Covered Activity within the Criteria Area," subject to an expedited review
process. Impacts of development of single-family residences on sensitive habitat
and covered species were accounted for in the MSHCP and the MSHCP EIR.
The Planning Commission hereby finds that the single-family residence at 15038
Le Gaye Street (APN: 379-140-083) was sited on the least sensitive portion of
the lot. Consideration was given to access, topography/terrain, zoning standards
including setbacks, soil types, presence of earthquake fault lines, leach fields,
presence of oak trees and high fire hazard areas. The building foot print area is
appropriate and complies with the MSHCP Criteria Area.
Moreover, the Project has been reviewed by all City divisions and departments,
which have imposed certain conditions of approval on the Project to ensure that
no adverse impacts occur. In light of those conditions of approval, as well as the
design features of the Project itself, the Project will not have a significant effect
on the environment.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the Project to ensure development of the
property in accordance with the objectives of Chapter 17.82.
Pursuant to Lake Elsinore Municipal Code Section 17.82.070, the Project has
been scheduled for consideration and action of the Planning Commission. The
Project has also been conditioned to comply with all aspects of the Lake Elsinore
Municipal Code. The Applicant shall meet all required setbacks and development
standards pursuant to the R-E (Estate Single-Family Residential) zoning
designation.
SECTION 4. Based upon the evidence presented, the above findings, and the
conditions of approval, the Planning Commission hereby approves the Minor Design
Review application.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

GENERAL CONDITIONS
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and
hold harmless the City, its Officials, Officers, Employees, and Agents from any
claim, action, or proceeding against the City, its Officials, Officers, Employees or
Agents to attach, set aside, void, or annul an approval of the City, its advisory
agencies, appeal boards, or legislative body concerning the Minor Design Review
of a conventionally built single-story single-family dwelling unit located at 15038 Le

2. The decision of the Planning Commission shall be final fifteen (15) days from the
date of the decision, unless an appeal has been filed with the City Council
pursuant to the provisions of Chapter 17.80 of the Lake Elsinore Municipal Code.
3. If the project proposes an outdoor storage tank, the applicant shall locate the unit
within the side or rear yards. If the location must be within the front yard, the
applicant shall provide a method of screening subject to the review and approval of
the Director of Community Development or his designee.
4. Minor Design Review approval of the conventionally built single-story single-family
dwelling unit located 15038 Le Gaye Street (APN: 379-140-083) will lapse and
become void one (1) year of the approval date unless a building permit is issued
and construction commenced and the project is diligently being pursued toward
completion.
5. All Conditions of Approval shall be reproduced upon page one of building plans
submitted to the Building and Safety Division for Plan Check.
6. Prior to issuance of any grading or building permits, the applicant shall sign and
complete an "Acknowledgement of Conditions," and shall return the executed
original to the Community Development Department for inclusion in the case
records.
7. All materials and colors depicted on the plans and materials board shall be used
unless modified by the Applicant and approved by the Director of Community

8. All site improvements shall be constructed as indicated on the approved site plan
and elevations, with revisions as noted herein. The applicant shall meet all
required setbacks, and development standards pursuant to the R-E (Estate Single-

Minor Design Review attached hereto shall be processed in a similar manner as
the original Minor Design Review. All plans submitted for Building Division plan
check shall conform to the submitted plans as modified by the Conditions of

9. The applicant shall comply with any/all requirements of the Riverside County Fire
Department.
10. All windows shall use foam surrounds and/or other architectural-type features
approved by the Director of Community Development or designee.
11. All necessary exterior/ancillary equipment shall be effectively screened from public
view. All proposed screening methods shall be reviewed and approved by the
Director of Community Development or designee.
12. All roofing materials shall have a minimum Class "AU Fire rating, and so noted on
the construction plans.
13. The Applicant is to meet all applicable City Codes and Ordinances.
14. A cash bond of $1,000.00 shall be required for any construction trailers placed on
the site and used during construction. Bonds will be released after removal of
trailers and restoration of the site to an acceptable state, subject to the approval of
the Director of Community Development or designee.
15. The Applicant shall comply with the City's Noise Ordinance. All construction activity
shall be limited to the hours of 7:00 AM to 5:00 PM, Monday through Friday, and
no construction activity shall occur on Saturdays, Sundays or legal holidays.
16. The Applicant shall comply with all requirements of the City's Grading Ordinance.
Construction generated dust and erosion shall be mitigated in accordance with the
provisions of Municipal Code, Chapter 15.72 and using accepted control
techniques. Interim erosion control measures shall be provided thirty (30) days
after the site's rough grading, as approved by the City Engineer.
17. Any exterior air conditioning or other mechanical equipment shall be ground
mounted and screened so that they are not visible from neighboring property or
public streets. Air conditioning units and related equipment may not encroach more
than two-feet (2') into the required minimum side yard setback.

18. Garages shall be constructed to provide a minimum interior clear space of twenty
feet (20') x twenty feet (20') for two cars.
19. The Applicant shall provide shrubs and plant materials as shown on the landscape

plantings shall be fully installed prior to issuance of a Certificate of Occupancy.

24. The applicant shall provide a flat concrete pad a minimum of 3'- 0" by 7'- 0"
adjacent to each dwelling unit. The storage pad for trash barrels shall be
concealed from public view.
25. The applicant shall submit a check in the amount of $64.00 made payable to the
County of Riverside for a Notice of Exemption. The check shall be submitted to the
Planning Division for processing within 48 hours of the projects approval.
26. The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project
site identifying the approved days and hours of construction activity and a
statement that complaints regarding the operation can be lodged with the City of
Lake Elsinore Code Enforcement Division (951) 674-3124. The sign shall be

27. All exposed retaining walls visible from any public right-of-way shall utilize "split-

PRIOR TO THE ISSUANCE OF BUILDING PERMITS
42. The applicant shall pay the Multiple Species Habitat Conservation Plan Fee
(MSHCP) Local Development Mitigation Fee (fee for density less than 8 du/ac),
prior to obtaining building permits.
43. The applicant shall pay all applicable Library Capital Improvement Fund fees, prior
to the issuance of a building permit.
44. Prior to the issuance of any building permit for the Project, the Developer shall
enter into an agreement with the City and the Redevelopment Agency of the City of
Lake Elsinore to provide (a) 15% of the units constructed in the Project as
affordable housing units in accordance with the requirements of Section
33413(b )(2) of the California Community Redevelopment Law (Health & Safety
Code Sections 33000 et seq.), or (b) an alternative equivalent action as
determined by the City which may include (without limitation) dedication of vacant
land, construction of affordable units on another site, or payment of an in-lieu fee at
the rate of $2.00 per square-foot of assessable space for each dwelling unit in the
Project. For purposes of this condition, "assessable space" means all of the
square-footage within the perimeter of a structure, not including any carport,
walkway, garage, overhang, patio, enclosed patio, detached accessory structure,
or similar area. The amount of the square-footage within the perimeter of a
residential structure shall be calculated by the building department of the City in
accordance with the standard practice of the City in calculating structural
perimeters.
45. Prior to the issuance of a building permit, the applicant shall provide assurances to
the Planning Division that all sewer arrangements have been met.
46. Prior to the issuance of a building permit, the applicant shall provide a detailed
sewer will serve letter from the Elsinore Valley Municipal Water District. The sewer
will serve letter submitted to the Community Development Department shall have
been generated no longer than thirty (30) days prior to submittal.
PRIOR TO THE ISSUANCE OF A CERTIFICA TE OF OCCUPANCY
47. The applicant shall provide an irrigation system for landscaped areas onsite as
shown on the landscape plans. The irrigation system shall be fully installed and
operational prior to the issuance of a Certificate of Occupancy.

49. All exposed slopes in excess of three feet (3') in height shall have permanent
irrigation system and erosion control vegetation installed, as approved by the City's
Landscape Architect. A Planting and Irrigation Plan shall be submitted, approved

for review of plans and inspections.
50. The building address shall be a minimum of four inches (4") high and shall be

ENGINEERING DIVISION
GENERAL
52. All Public Works requirements shall be complied with as a condition of
development as specified in the Lake Elsinore Municipal Code (LEMC), prior to
issuance of a building permit.
53. The applicant shall submit a "Will Serve" letter to the City Engineering Division
from the applicable water agency stating that water and sewer arrangements have
been made for this project and specify the technical data for the water service at
the location, such as water pressure and volume etc; and whether sewer lines are
available in proximity of the property for sewer connection or septic tanks have to
be used. The applicant shall submit this letter, prior to applying for a building
permit.
54. The applicant shall submit a "Non Interference Letter" from Southern California
Edison, prior to the issuance of a Grading Permit. Southern California Edison's

55. All arrangements for relocation of utility company facilities (power poles, vaults,
etc.) out of the roadway or alley shall be the responsibility of the property owner or

56. The applicant shall provide fire protection access and facilities as required in
writing by the Riverside County Fire Department.
57. In accordance with the City's Franchise Agreement for waste disposal & recycling,
the applicant shall be required to contract with CR&R Incorporated for removal and
disposal of all waste material, debris, vegetation and other rubbish generated during
cleaning, demolition, clear and grubbing or all other phases of construction.

58. All grading and street improvement plans submitted to engineering shall be drawn
on 24" x 36" Mylar and be set into City's specific border and title block and include
city specific general notes for grading or street improvements respectively. All

STREET IMPROVEMENTS
59. All work done under an encroachment permit for off-site improvements of utility
lines shall be delineated on the street improvement plans and approved and
signed by the City Engineer, prior to the issuance of a building permit.
60. The applicant shall pay all fees and meet requirements of an encroachment permit
issued by the Engineering Division for construction of off-site public works
improvements (LEMC12.08, Res.83-78). All fees and requirements for an
encroachment permit shall be fulfilled before the issuance of a Certificate of
Occupancy.
GRADING
61. The developer shall obtain all necessary off-site easements for off-site grading
from the adjacent property owners, prior to the issuance of a grading permit.
62. The applicant shall apply and obtain a grading permit with appropriate security,
prior to any grading activity.
63. A grading plan stamped/signed by a California Registered Civil Engineer is
required if the sum of the cut and fill for grading exceeds 50 cubic yards and the
existing drainage flow pattern is substantially modified as determined by the City
Engineer. The grading plan shall show volumes of cut and fill, adequate contours
and/or spot elevations of the existing ground as surveyed by a licensed surveyor or
civil engineer. All contours shall extend to minimum of 15 feet beyond property
lines to indicate existing drainage pattern. The applicant shall apply and obtain a
grading permit with appropriate security, prior to grading permit issuance.
64. The applicant shall provide soils; geology and seismic report, as part of this report
address the requirement of the Alquist-Priolo Earthquake Fault Zoning Act. The
applicant shal provide a final soils report showing compliance with
recommendations.
65. The applicant is to provide erosion control measures as part of their grading plan.
The applicant shall contribute to protection of storm water quality and meet the
goals of the BMP in Supplement "A" in the Riverside County NPDES Drainage
Area Management Plan.

66. All grading shall be done under the supervision of a geotechnical engineer and he
shall certify all slopes steeper than 2-to-1 for stability and proper erosion control.

67. All on-site drainage shall be conveyed to a public facility, accepted by adjacent
property owners by a notarized letter of drainage acceptance, or conveyed to a
drainage easement.
68. All natural drainage traversing the site shall be conveyed through the site, or shall
be collected and conveyed by a method approved by the City Engineer.
69. All roof drains shall not be allowed to outlet directly through coring in the street
curb. Roofs shall drain to a landscaped area. All driveways shall be sloped to drain
into landscaping, prior to entering street facilities.
70. The applicant shall submit, along with grading plans, Hydrology and Hydraulic
Reports for review and approval by City Engineer. The developer shall mitigate any
flooding and/or erosion downstream caused by development of the site and/or
diversion of drainage.
71. If sump pumps are used to divert run off into street, provide a notarized letter
stating that it will be maintained in good operating condition by the owner of the
property.
FEES
72. The applicant shall pay all Capital Improvement and Plan Check fees (LEMC
16.34). The current traffic mitigation fee is $1,369.00; the current drainage fee is
$6,384.00 (Northwest Lake Management) and the current TUMF amount is
$9,693.00; the amount of fees shall be adiusted accordinq to the fee schedule
current at the time of payment.
STORMWA TER/ CLEANWA TER PROTECTION PROGRAM
73. The City of Lake Elsinore has adopted ordinances for storm water management
and discharge control. In accordance with state and federal law, these local storm
water ordinances prohibit the discharge of waste into storm drain system or local
surface waters. This includes non-storm water discharges containing oil, grease,

A water and/or sewer service application must accompany the payment of fees to the Meter Department, attention
of Stella Butler at ext 8222. A $10 service origination charge per new account will be billed on your first
water/sewer bill.
District Standards allow for a 30 day installation period upon payment for meter connection fees. Generally,
meters are installed within 14-21 working days. The District requires seven days notification before intention to
deliver payment in order to coordinate the most efficient placement and/or connection to facilities.
Meters must be installed and connection to sewer facilitities must occur within six months of purchase date or any
subsequent fee increases are applicable.
If water service is being requested, a water meter location stake will be provided for placement on your parcel at
time of payment. It is the responsibility of the customer to place the stake on the parcel. The District will not set

Backaround
This item is for the purpose of presenting a summary of the subcommittee's goals and
objectives and milestone activities. The Lakeshore Overlay District subcommittee was
established earlier this year to study and prepare recommendations for updating City of
Lake Elsinore Zoning Code, Chapter 17.05, Lakeshore Overlay District. A map and
copy of the current zoning ordinance are attached.
Discussion
Since May 30th of this year, the subcommittee has held nine (9) meetings. Members
include: Commissioners Flores, Zanelli, Norkin, and Bhutta, Deputy City Attorney
Santana, Planning Manager Weiner, Information./Communication Manager Dennis,
Department Directors Kilroy and Seumalo and Building and Safety Manager Chipman.
The subcommittee's primary goal is to develop recommendations to update the City's
current Lakeshore Overlay District ordinance for improved clarity, consistency and
enforceability.
The subcommittee's objectives include:
. Use of a "workshop" process to develop a framework and draft ordinance.
. Include public involvement and outreach to stakeholders (City and County) as
part of developing draft language and final recommendations.
. Obtain input from the County of Riverside on actual draft ordinance and final
recommendations.

. Hold public hearings at respective meetings of the Planning Commission and
Public Safety Advisory Commission prior to finalizing recommendations.
. Develop joint consensus recommendations for consideration by the City Council
in first quarter 2008.
The subcommittee's scope of work is to study the current Lakeshore Overlay District
ordinance and make findings and recommendations for each the following:
. Evaluate the appropriateness of new dock & ramp standards
. Evaluate camping and RV storage guidelines and enforcement needs
. Evaluate building standards for pads, slabs & structures
. Assess conditions and constraints affecting new fencing safety standards
. Assess conditions and constraints on new dwelling construction
. Assess constraints on public access with regard to property owner rights
. Assess constraints posed by floodplain & floodway issues and regulations
The above comprises the Needs Assessment Phase of the Subcommittee's work plan.
The next phase consists of Public Outreach, which will include a survey and
informational meeting that will provide feedback to be used in the third phase, which is
Development of the revised ordinance. After public hearings and Council consideration
and adoption, the fourth stage is implementation of the new ordinance. A final stage is
Evaluation, after which the Lakeshore Overlay District ordinance would be modified by
amendment, if necessary.

Section 17.05.010 Put:pose. The pwpose of the Lakeshore OverlayZone is to insure that retention of certain
water areas and shoreline areas in water-oriented activities are in conformance with the Lake Elsinore General Plan
Any parcel in the Lakeshore Overlay District may be occupied by a principal use listed in Section 17.05.040 or,
when authorized by the GtyCouncil, bya Conditional Use listed in Section 17.05.050. An additional pwpose of
the Lakeshore Overlay District is to implement the relevant General Plan Programs and give enforcement of
violators thereof as herein defined.
Section 17.05.020 Lake Shoreline Area Defmed. The Lakeshore Overlay District shall apply to the lake shoreline
area defined as extending from Lakeshore Drive right-of-way southwesterly to the State Patk ownership boundary
or elevation 1240' MSL and from Main Street northwesterly to Iowa Street, a distance of approximate1y3.45 miles.
In any base district where the district symbol is followed by, as a part of such symbol, parenthetically enclosed
1etter(s), "L", thus (L), the additional requirements, limitations and standards contained in this section shall apply.
The district symbol shall constitute the "base district" and "L" suffix shall constitute the "overlay district". In the
event of conflicting provisions of such a combined district, the requirements of the "L" district shall take
precedence over the requirements of the base district. Uses permitted by the "L" district, must in each instance be
in compliance with those uses permitted by the applicable base district regulations and any other overlay district
regulations.
Section 17.05.030 Definitions. For the pwpose of this title, certain words and tenns are defined as set out in this
chapter.
A Litterin~ - Litter shall include, but not limited to, willful or negligent throwing, dropping, placing,
depositing, or sweeping, or causing anysuch acts, of anywaste matter or materials on any land or
water in other than specified approved storage/waste containers, as so designated.

B. Private Encroachment - Private Encroachment shall include, but not limited to, any and every
person who willfully or negligently commits a trespass by any of the following acts:
1. Enters upon any private land, owned by any other person;
2. Any person entering upon any private land, not owned by that person;
3. Entering upon any land, owned by another or not by that person, whether posted or not
by any person; and
4. Entering upon any land, owned by another or not by that person, posted or not,
whether unenclosed or enclosed by prohibitive/ restrictive entrance, by any person.
\
C Illegal Parking of Vehicle - "Vehicle" shall be defined as outlined within the State of California
Vehicle Code. Illegal parking shall include, but not limited to, anyperson(s) in control of a
vehicle, who willfully or negligently commits a parking violation by any of the following acts:
1. A vehicle which has entered upon/in or onto any private land, owned by another or not
owned by that person, posted or not, whether unenclosed or enclosed by
prohibitive/ restricted entrance;
2. A vehicle, which has entered upon/in! along or onto any public lands, streets or
right-of-way, that is posted in verbiage, stating, "No Parking, Stopping or Standing -
Tow Away Zone," or as prescribed by law, including State Highways.
Section 17.05.040 Permitted Uses. Uses permitted in the Lakeshore Overlay District shall be as follows:
A Floats and dolphins for private pleasure craft; boating marinas and fishing facilities; boat rentals.
B. Boating, at designated locations.
C Swimming, at designated locations.
D. Fishing, at designated locations.
E. Publicly owned park, when in conformance with the Lake Elsinore General Plan.
F. Existing occupied single-family residences and existing operated businesses.
G. Jet ski rentals.
H Piers and docks for private pleasure craft.
1. Restaurant, but excluding:
1. Establishments serving customers within their automobiles on the premises or preparing
food! drink for conswnption off of, or drive-away/through the premises; and
2. Establishments primarily preparing foodl drinks intended for conswnption off the
prenuses.

J. Overnight camping is limited to authorized! established State/private facility, per Title 15,
O1apter 44 of this Code and Section 17.03.050; and registered private owners, by approved
Special Camping Permit, issued by the Gty. All other camping, day or night, shall be prohibited
and shall been forced as provided herein.
Section 17.05.050 Conditional Uses. The following uses are allowed in the Lakeshore Overlay District provided a
Conditional Use Permit has been granted by the GtyCouncil, after notice and public hearing before the Planning
Commission and Gty Council:
A Campgrounds and picnic grounds (also requiring additional compliance with California State
Code, Title 25).
B. Tennis courts.
C Athletic fields.

H Other retail uses as deemed similar to the above mentioned uses.
Section 17.05.060 Prohibited Uses. Anyuses not specifically listed as allowed, either as ownership right within
Permitted! Conditional Use or Special Permit, are prohibited, but not limited to, new residential dwellings, off-site
advertising structures, storage of any kind unless connected with existing occupied residential dwellings but will be
applicable to all other Gty Codes, parking lots and unauthorized vending! peddling and selling.
Section 17.05.070 Violations. It shall be unlawful to litter, commit private encroachment, i1legallypark a vehicle,.
all as defmed herein, orto utilize property in a manner prohibited by Section 17.05.060. Violations of this Chapter
shall be treated as an infraction offense for the ftrst two (2) of any such violations and any subsequent violation
may be treated and charged as either an infraction or a misdemeanor as determined by the Court.
Section 17.05.080 Development Standards.
A Ten thousand (10,000) square feet minimum lot area.
B. One hundred (100) feet minimum lot width.
C Minimum yanl setback requirements shall be as follows:
1. All uses shall maintain a minimum setback of thirty (30)feet from Lakeshore Drive;
2. Side yanl setback shall be five (5) feet; and
3. Rear yanl setback shall be established by the Gty Council on a case by case basis.

D. Fences may be erected within the Lakeshore Overlay District, subject to approval of architectural
theme determined by Planning Cmnmission. No fees required to review.
E. Stumps and dead trees to conform with existing Municipal Codes.
F. Access for any use must be approved by the Planning Division based upon:
1. Safety of approach;
2. Adequate facilities; and
3. Conformance to requirements as listed in the Lake Elsinore Municipal Code.
G. Anyuse approved as a Conditional Use must conform to the Lake Elsinore General Plan and
requirements for Scenic Conidors.
Section 17.05.090 Parking. Parking shall be allowed in conjunction or maintained in accordance with Sections
17.05.040,17.05.050 and 17.05.080, in addition to meeting all other Gty Codes. No other parking shall be
permitted and is prohibited as defined within Section 17.05.030.C Violations shall be enforced as herein
provided.
Section 17.05.100 Materials to be Submitted. In addition to all materials and procedures required by the Gty's
subdivision, zoning, building and grading regulations, and environmental review procedures applicable to lake
shoreline development projects falling within the scope of this Chapter, the following application materials shall be
required to be submitted for lake shoreline development projects:
A A plot plan reflecting the proposed project including representations of property lines , all records
and proposed property lines, all recorded and proposed easements, and public right-of-way.
B. A topographical map of the project site and adjacent terrain located within 150 feet of the
project boundaries.
C A complete grading plan for the project.
D. A landscaping plan which shall accurately show the final disposition of all existing trees on the
project site and the type and extent of proposed vegetation.
E. If the development project is within an area of special flood hazard, developer shall also submit a
properly executed flood hazard deed notification document, which shall be recorded by the Gty
to provide constructive notice to all future purchasers and encumbrances concerning the flood
hazard.
Section 17.05.110 Nonconforming Uses. Anystructure or use within the Lakeshore Overlay District which does
not comply with the provisions of this Chapter, but which is legally in existence, shall upon such date acquire the
status of a lawfully nonconforming structure or use, subject to all Municipal Codes and Ordinances.
A Unoccupied structures and buildings subject to Section 15.08.020,
B. Campgrounds, unless a Conditional Use Permit is granted - one (1) year is given to bring into
conformance with all GtyCodes and State of California, TIde 25.

C Foundations, walls and other concrete structures, not used for retaining purposes, not in
conjunction or necessatywith existing or developed property, shall be removed within six (6)
months.
D. Open storage, storage structures, storage of materials, trailers, vehicles and boats not related to
existing residential structures are prohibited unless stored in a legal manner to Gty Codes.
E. Stumps and dead trees, if not under water, shall be removed immediately.
F. Refuse materials shall be removed immediately.
Section 17.05.120 Enforcement Authority. The Oty's Law Enforcement Agency and Code Enforcement Officers
are appointed inspectors to assure compliance with all provisions herein and have the right to enter frye of charge,
at any time, upon an}place or parcel of land, to investigate and determine compliance and! or to enforce and
perform all the regulat01yprovisions of Chapter 17.05.010 through 17.05.140.
In addition, the Code Enforcement Officers are hereby empowered to issue written citations! tickets to
trespassers, persons who litter and illegally parked vehicle-violators, as defined in Section 17.05.030.A, B, and C,
whether the violator is physically present or not, found within the areas as defined within Section 17.05.020; these
violations shall constitute a prima facia presumption that the trespasser, person who litters, and last registered
owner of record of vehicle, not having complied with the provisions of Section 17.05.030.A, B, and C, is
responsible for such and is thereby liable for the cost of a fine as imposed and established hereafter.
Section 17.05.130 Imposition of Fines. Anyperson or registered owner in control of a vehicle found in violation
of any provisions herein defined and described, shall be fined with the following schedule:
A Litte~ - Any person found in violation of littering shall be fined fifty dollars ($50.00) for the
first offense, one hundred dollars ($100.00) for the second offense, and each additional offense
may be treated and charged as either an infraction or a misdemeanor by the Court.
B. Private Encroachment - Any person found in violation of private encroachment shall be fined
fiftydollars ($50.00) forthe first offense, one hundred dollars ($100.00) for the second offense,
and each additional offense may be treated and charged as either an infraction or a misdemeanor
as determined by the Court.
C Illegal Parked Vehicle - A minimum frne of fifteen dollars ($15.00) shall be set for vehicle(s)
found in violation.
Section 17.05.140 - Administrative ApJJeal
A Any person aggrieved by or dissatisfied with the provisions of this Gapter may file a written
appeal to the Oty Council as per Oty Codes and Ordinances.
B. Anyperson aggrieved by or dissatisfied with the enforcement of this Chapter may appeal to the
Municipal Court as structured within due process of California law.
Section 17.05.150 Liberal Construction - O>nflict. The provisions of this Gapter shall be liberally construed to
effectuate their pwposes. If there is a conflict between this Olapter and any other provisions of the Municipal
Code, the provisions of this Olapter shall prevail.
