The City of Lake Elsinore appreciates your attendance. Citizens' interest provides the
Planning Commission with valuable information regarding issues of the community.
Meetings are held on the 1 st and 3rd Tuesday of every month. If you are attending this
Planning Commission meeting, please park in the Parking Lot across the street from the
Cultural Center. This will assist us in limiting the impact of meetings on the Downtown
Business District. Thank you for your cooperation.
The agenda is posted 72 hours prior to each meeting outside of City Hall and is available at
each meeting. The agenda and related reports are also available in the Community
Development Department on the Friday prior to the Planning Commission meeting.

Chairman O'Neal called the regular Planning Commission meeting to order at
6:15pm.

2. Conditional Use Permit No. 2007.17/Riverside Recovery
Resources
Planning Manager Weiner provided a brief overview of the proposed project and
requested Associate Planner Carlson to review it with the Commission and
answer questions.
Associate Planner Carlson provided an overview of the project, and stated that
staff recommended denial of the project to the Planning Commission because
the applicant did not provide to staff a professionally condUcted Parking Study
which would justify acceptable levels of off-street parking in spite of providing
less than the required number of parking spaces.
The applicant, Derrick Bruce Harvey, Executive Director of Riverside Recovery
Resources provided a presentation to the Planning Commission; Mr. Harvey
stated that Riverside Recovery Resources w?s founded in 1986. The facility
provides alcohol and other drug prevention, interv.ention, education, and
rehabilitation services to members of the community on an out-patient basis.
Although he indicated that the fagility is in a good location, the parking issues
need to be addressed.
Hugh Mosbacher, property owner, stated thafRiX~.rsideRecovery Resources is a
good program. He indicc;it~p that it is ine9ideallOQ(:ition with the exception of the
parking availability but the.yare working on options for parking. Mr. Mosbacher
requested a continuation of the ProJl;lct until they can get the proper
documentation for the parking.
Ann who did notstate her lasfhameindicated that she started the program
approximately twenty (20) years ago and also stated that they have a very good
reputation.
Chairman O'Neal closed the Public Hearing at 6:19 pm.
PLANNING COMMISSION COMMENTS
Commissioner Zanelli thanked the applicant and the owner for their presentations
and suggested to the applicant to continue the project so that he could provide
the appropriate Parking Study.
Commissioner Flores thanked the applicant and the owner for their presentation
and stated that he knows some individuals that have the completed the program
and they said they were very satisfied with the services that Riverside Recovery
Resources provided to them. Commissioner Flores stated that the facility is in an
excellent location and suggested a continuance of the project if staff and the
applicant are able to work out the parking conditions.

Commissioner Mendoza thanked the applicant and the owner for their
presentations. He stated that programs such as this are needed, and knows
individuals that have participated in the program and have completed it
successfully. He asked Associate Planner Carlson if the Parking Study was the
only incomplete item.
Associate Planner Carlson stated yes.
Commissioner Mendoza asked Planning Manager Weiner if the City is able to get
a prorated Parking Study for the project since it is a non-profit organization.
Planning Manager Weiner deferred the question to ..Public Works Director
Seumalo.
Public Works Director Seumalo stated that the City has resources available to
assist the applicant with a Parking Study.
Commissioner Mendoza stated that he agrees with his fellow Commissioners
regarding a continuance of the project until the parking Study issue isresolved.
Vice Chair Gonzales indicated that. he went by the prOject and stated that it is not
possible for additional parking at th~>rfacility but agreed with the applicant and
owner regarding coordinating withtheirn~ighboring businesses for additional
parking for the facility. Commissioner Gon~~les(:lIso asked the applicant if they
were going to be removing the two (2) storage binsfrom the location.
The applicant statedyes.
Commissioner Gonzales C3~ked theC3Pplicant if he was going to be moving out of
the Administrative Offices at the School District located at 600 3rd Street.
The applicant stated that they are transferring the classes to the new location in
Lake Elsinore.
Commissioner Gonzalesistated that the facility is located in a good location.
Chairman O'Neal asked the applicant if there were other Riverside Recovery
Resource Facilities in other Cities in Riverside County.
The applicant stated that they are serving approximately 800 people in various
facilities throughout Western Riverside County.
Chairman O'Neal asked why Riverside Recovery Resources, if it is such a large
Corporation, can't pay for a Traffic Study.
The applicant stated that they are a non-profit organization and the services that
they provide are to folks that don't have the ability to pay. The funding comes
primarily from the County and the State, who have recently cut funding by 10%.

He indicated that they are struggling to keep their doors open because the
funding for this program is very limited and the Parking Studies that he looked
into were unaffordable.
Chairman O'Neal asked Public Works Director Seumalo if there were any
programs available for their organization.
Public Works Director Seumalo stated that the staff would research reasonable
rates for the applicant and forward to them to him.
Chairman O'Neal wanted to clarify with the applicant that he does understand
their mission and the service that they do provide for the. community and he does
share the applicant's desire to serve the community/but he is following the
guidance of City Council in terms of meeting Municipal Code guidelines.

PlanningConsultantponahoe provided an overview of the project and stated that
staff..is recommending/denial of the project. Ms. Donahoe indicated that staff
finds thatthe applicant'$proposed changes to the project drastically reduces the
quality and attractivenes~of the original project which was previously presented
to and approved by the Planning Commission and City Council.
Deputy City Attorney Santana referred to page 5 of 9 of the Staff Report
regarding staff's recommendation and stated that the paragraph should read
"staff recommends that the Planning Commission recommend that City Council
deny the Residential Design Review."
The applicant, Brian Phelps, Senior Project Manager of MBK Homes, Irvine,
California, stated that they started the project in early 2006 and by the middle of
2007 the prices and values had dropped between $80,000 to $90,000 per unit
and they are continuing to drop. He indicated that they would like to move
forward with the project but in order to do so, they have to make cuts and
changes and they directed those changes to the exterior elevations to make the
product more affordable.

concerns but he is concerned with the long term future of the City and what it will
develop into.
Chairman O'Neal stated that the applicant did make significant revisions to the
project and suggested that the applicant work with staff again regarding the
design of the project.
The applicant stated that he met with staff three (3) times regarding the design of
the project and indicated that they were at a loss when it was denied because
correspondence from staff suggested that it was moving forward.
Chairman O'Neal stated again to the applicant that he would like to see the
project move forward and suggested working with. ..staff but indicated to the
applicant that it is up to him.
The applicant said he couldn't comment at thattime and would have to take it
back to Tim Kane who is the President of MBK Homes to see what direction to
go.
Chairman O'Neal stated to the applicant that has fifteen (15) days to appeal
any action of the Planning Commission recommends.
Commissioner Zanelli asked the applicantifan extension to the project would
help him.
The applicant stated thallhey already had one (1) extension.
Commissioner ZanellFaskedPlanning Manager Weiner if the applicant could get
another one (1) year extension.
Planning ManagerVVeiner stated that staff would have to present an extension
request to the City Council and if they find it acceptable then they can grant an
extension.
CommissionerZanel1i asked the applicant if this would be acceptable to him.
The applicant stated yes.
Commissioner Mendoza asked the applicant if he was the decision maker on the
project.
The applicant stated that he is the Senior Project Manager and their company
works as a "Committee" with the President of the company.
Commissioner Mendoza stated to the applicant that if the President of the
Company chooses not to attend the meeting and explain his desires, then it must
not be important enough for him to be present for any decisions made, and
recommended denial of the project.

Commissioner Zanelli suggested extending the original design approval for
another year.
Planning Manager Weiner said if this is the direction that the applicant would like
to take then the applicant needs to turn in a formal application to the City Council
to get the extension approved.
Chairman O'Neal asked Planning Manager Weiner if it is possible to recommend
denial of the project and if the applicant wishes to extend the project, would the
City Council entertain this notion?
Planning Manager Weiner said that this would be acceptable.
Commissioner's Mendoza, Zanelli, Flores and Vice Chair Gonzales stated that
this would be acceptable to them.

4. Zoning Ordinance Text Amendment No. 2007-01; A request to amend
the Lake Elsinore Mgnicipal Code relative to the establishment of a
Planned Unit Develppment (PUD)<Overlay District within various
Zoning Districts < Citywide as outlined in Chapter 17.37 (Planned
Unit .Developmentc>yerlayDistrict).

requested Associate Planner Carlson to review it with the Commission and
answer qoestions.
Associate Planner Carlson provided an overview of the project.

PLANNING COMMISSION COMMENTS
Planning Commissioner Mendoza stated that he approves the adoption of a
Planned Unit Development (PUD).
Vice Chair Gonzales is in favor of the PUD.
Commissioner Zanelli had no comments.

Commissioner Flores asked Planning Manager Weiner if the Draft Ordinance is
for existing residences.
Planning Manager Weiner stated that it won't affect any existing projects, it is for
new projects coming in. He indicated that the PUD gives the City flexibility to
streamline various developments and there has to be a 500 acre site or above to
implement a Specific Plan so if it is less than 500 acres a Specific Plan can't be
done, the PUD is a good alternative to get the project through if it is a good
project.
Commissioner Flores asked Planning Manager Weiner if the PUD provides
assistance to the new community.
Planning Manager Weiner said it is possible and stated that if they are in the City,
they can benefit from the PUD but the General PI.c:mstill dictates and this is just a
mechanism to facilitate certain developments.
Chairman O'Neal noted that the City of Murri~ta doespot have a PUD.
Associate Planner Carlson stated that they do nothave a traditional PUD.

PROJECT TITLE: MINOR DESIGN REVIEW OF A SINGLE-FAMILY RESIDENCE
LOCATED AT 29880 REID STREET (APN: 375-022-002)
PROJECT LOCATION
The approximately 4000 square foot vacant site is located on the south side of Reid Street,
approximately 415 linear feet west of Strickland Avenue. More specifically, the property is
located within the R-3 (High Density Residential District) area and has a General Plan
designation of Future Specific Plan J (Country Club Heights), Assessor Parcel Number
(APN) 375-022-002.
PROJECT DESCRIPTION
The applicant is requesting design review consideration for the design and construction of
a conventionally built 2,820 square-foot two-story single-family residence with an attached
440 square-foot two (2) car garage. The proposed residence will be placed on a relatively
flat rectangular lot that is fifty feet (50') wide and eighty feet (80') deep.
The total building footprint including the residence and garage will occupy approximately
1,600 square-feet. The proposed project will require a dedication of a ten (10) foot slope
easement along the property frontage on Reid Street. The property has a net lot area of
4,000 square-feet. Accordingly, the proposed dwelling unit will have a net lot coverage of
approximately forty percent (40%), which is in compliance with Section 17.23.090 (Lot
Coverage) of the LEMC, which limits the maximum lot coverage of all structures to fifty-
percent (50%).
Architecture
The applicant has chosen to construct the proposed single-family residence using
elements of Spanish style architecture. The applicant has provided the same architectural
details to all four (4) elevations to further enhance the project. The front elevation has
been conditioned to include decorative return walls.
Landscapina
Front yard landscaping will be installed and will include an automatic irrigation system and
a rain sensor, which will assist in the conservation of water. The proposed landscaping will
include two (2) 24" box Magnolia Grandiflora "Majestic Beauty". Tall Fescue Blend Grass
and numerous five (5) gallon accent shrubs complete the front yard landscaping.
Utilities
The project is proposing to be connected to sewer which will be serviced by Elsinore Valley
Municipal Water District (EVMWD). Water is available to this project from an 8" water line
located in Reid Street and will be serviced by Elsinore Water District. A "will serve" letter

BACKGROUND
On November 8, 2007 the Design Review Committee (DRC) reviewed the proposed plans
and discussed the architectural design of the house. The DRC recommended that the
applicant use more Spanish style architectural details, enhancing all four (4) elevations.
Once revised, the applicant re-submitted plans along with building elevations. The
applicant has complied with all recommendations by the DRC. A copy of the initial
submittal has been included as an attachment to this report to illustrate compliance.
ANALYSIS
Staff has reviewed the project and found that with the attached Conditions of Approval, the
project, including, but not limited to; density, setbacks, landscaping, parking, private open
space, and lot coverage, meets all of the requirements of Chapter 17.82 (Design Review),
Chapter 17.14 (Residential Development Standards), 17.23 (R-1 , Single-Family Residential

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, APPROVING A MINOR DESIGN

WHEREAS, Jose Gonzales filed an application with the City of Lake Elsinore
requesting approval of a Minor Design Review for a single-family residence (the
"Project") on property located at 29880 Reid Street (APN: 375-022-002) (the "Project
Site"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of approving Minor Design Review requests for
residential projects; and
WHEREAS, public notice of the Project has been given and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public meeting held with respect to this
item on March 18, 2008.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed design for
the single-family residence and has found it acceptable. The Planning Commission finds
and determines that this project is consistent with Chapter 17.82 (Design Review),
Chapter 17.14 (Residential Development Standards), Chapter 17.23 (Single-Family
Residential), and Chapter 17.66 (Parking Requirements) of the Lake Elsinore Municipal
Code.
SECTION 2. The Planning Commission finds and determines that the Project is
categorically exempt from the California Environmental Quality Act (Cal. Pub. Res.
Code SS 21000 et seq.: "CEQA") and the State Guidelines for Implementation of CEQA
(14 C.C.R. SS 15000 et seq.: the "CEQA Guidelines") pursuant to a class 3(a)
exemption for new construction or conversion of small structures because the Project
involves construction of one single-family residence. (CEQA Guidelines S 15303(a)).
SECTION 2. That in accordance with Chapter 17.82 of the Lake Elsinore
Municipal Code, the Planning Commission hereby makes the following findings for the
approval of the Project:
1. The project, as approved, will comply with the goals and objectives of the
intended General Plan and the Zoning District in which the project will be located.
The proposed Minor Design Review for a proposed single-family residence
located at 29880 Reid Street (APN: 375-022-002) complies with the goals and
objectives of the General Plan designation Specific Plan J. Specific Plan J is
designed to maintain a range of housing densities and encourage lot
consolidation to provide more viable building sites. The approval of this single-

and functional mix of residential densities. Further, the development will
consolidate two existing lots into a viable building site which will encourage the
development and maintenance of a broad range of housing types for all income
groups and age categories.
2. The project complies with the design directives contained in Section 17.82.060
and all other applicable provisions of the Municipal Code.
The proposed Minor Design Review located 29880 Reid Street (APN: 375-022-
002) is appropriate to the site and surrounding developments in that the applicant
will incorporate: twenty-foot (20) front yard and rear yard setbacks; sufficient
front yard landscaping and safe and sufficient on-site vehicular circulation.
Further, the project as proposed will complement the quality of existing
development and will create a visually pleasing, non-detractive relationship
between the proposed and existing projects.
3. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
A Class 3 CEQA exemption may be invoked when the development proposal
involves construction of one single family residence. Pursuant to CEQA
Guidelines 15303(a), the Project is categorically exempt from environmental
review because it involves the construction of one single family residence.
Section 7.3.2 of the MSHCP states that: '1d]evelopment of individual single-family
homes on existing parcels, in accordance with existing land use regulations is a
Covered Activity within the Criteria Area," subject to an expedited review
process. Impacts of development of single-family residences on sensitive habitat
and covered species were accounted for in the MSHCP and the MSHCP EIR.
The Planning Commission hereby finds that the single-family residence at Reid
Street (APN: 375-022-002) was sited on the least sensitive portion of the lot.
Consideration was given to access, topography/terrain, zoning standards
including setbacks, soil types, presence of earthquake fault lines, leach fields,
presence of oak trees and high fire hazard areas. The building foot print area is
appropriate and complies with the MSHCP Criteria Area.
Moreover, the Project has been reviewed by all City divisions and departments,
which have imposed certain conditions of approval on the Project to ensure that
no adverse impacts occur. In light of those conditions of approval, as well as the
design features of the Project itself, the Project will not have a significant effect
on the environment.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of the
property in accordance with the objectives of Chapter 17.82.
Pursuant to Section 17.82.070 of the Lake Elsinore Municipal Code, the
proposed Minor Design Review has been scheduled for consideration and

comply with the Lake Elsinore Municipal Code. For example, Condition of
Approval Number 8 has been included which states; "All site improvements shall
be constructed as indicated on the approved site plan and elevations, with
revisions as noted herein. The applicant shall meet all required setbacks and
development standards pursuant to Section 17.23 (R-1 Single-Family
Residential). Any revisions to the Minor Design Review attached hereto shall be
processed in a similar manner as the original Minor Design Review. All plans
submitted for Building Division plan check shall conform to the submitted plans
as modified by the Conditions of Approval."
SECTION 4. Based upon the evidence presented, the above findings, and the
conditions of approval, the Planning Commission hereby approves the Minor Design
Review application.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

GENERAL CONDITIONS
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and

PLANNING DIVISION
3. Minor Design Review approval of a single-family dwelling unit located at 29880
Reid Street (APN: 375-022-002) will lapse and become void one (1) year of the
approval date unless a building permit is issued and construction commenced
and diligently pursued toward completion.
4. All Conditions of Approval shall be reproduced upon page one of building plans
submitted to the Building and Safety Division for Plan Check. All Conditions of
Approval shall be met prior to the issuance of a Certificate of Occupancy and
release of utilities.
5. Prior to issuance of any grading or building permits, the Applicant shall sign and
complete an "Acknowledgement of Conditions," and shall return the executed
original to the Community Development Department for inclusion in the case
records.
6. The proposed outdoor storage tank shall be located within the side or rear yards.
If location must be within the front yard, the applicant shall provide a method of
screening subject to the review and approval of the Director of Community
Development or his designee.

7. Prior to the issuance of a building permit the Applicant shall submit both "will
serve" letters attached hereto from Elsinore Water District and Elsinore Valley
Municipal Water District (EVMWD).
8. All site improvements shall be constructed as indicated on the approved site plan
and elevations, with revisions as noted herein. The applicant shall meet all

9. Prior to the issuance of any building permit for the Project, the Developer shall
enter into an agreement with the City and the Redevelopment Agency of the City
of Lake Elsinore to provide (a) 15% of the units constructed in the Project as
affordable housing units in accordance with the requirements of Section
33413(b)(2) of the California Community Redevelopment Law (Health & Safety
Code Sections 33000 et seq.), or (b) an alternative equivalent action as
determined by the City which may include (without limitation) dedication of vacant
land, construction of affordable units on another site, or payment of an in-lieu fee
at the rate of $2.00 per square-foot of assessable space for each dwelling unit in
the Project. For purposes of this condition, "assessable space" means all of the
square-footage within the perimeter of a structure, not including any carport,
walkway, garage, overhang, patio, enclosed patio, detached accessory structure,
or similar area. The amount of the square-footage within the perimeter of a
residential structure shall be calculated by the building department of the City in
accordance with the standard practice of the City in calculating structural
perimeters.
10. All materials and colors depicted on the plans and materials board shall be used
unless modified by the Applicant and approved by the Community Development
Director or designee.
11. All roofing materials shall have a minimum Class "A" Fire rating, and so noted on
the construction plans.
12. The Applicant is to meet all applicable City Codes and Ordinances.
13. A cash bond of $1 ,000.00 shall be required for any construction trailers placed on
the site and used during construction. Bonds will be released after removal of
trailers and restoration of the site to an acceptable state, subject to the approval

14. The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project
site identifying the approved days and hours of construction activity (see
Condition # 15) and a statement that complaints regarding the operation can be
lodged with the City of Lake Elsinore Code Enforcement Division (951) 674-3124.
The sign shall be placed on the property prior to the issuance of a grading permit.
15. The Applicant shall comply with the City's Noise Ordinance. Construction activity
shall be limited to the hours of 7:00 AM to 5:00 PM, Monday through Friday, and
no construction activity shall occur on Saturdays, Sundays or legal holidays.
16. The Applicant shall comply with all requirements of the City's Grading Ordinance.
Construction generated dust and erosion shall be mitigated in accordance with
the provisions of Municipal Code, Chapter 15.72 and using accepted control
techniques. Interim erosion control measures shall be provided thirty (30) days
after the site's rough grading, as approved by the City Engineer.
17. All garages shall be constructed to provide a minimum interior clear space of
twenty feet (20') x twenty feet (20') for two cars.
18. Any exterior air conditioning or other mechanical equipment shall be ground
mounted and screened so that they are not visible from neighboring property or
public streets. Air conditioning units and related equipment may not encroach
more than two-feet (2') into the required minimum side yard setback.
19. The Applicant shall plant twenty-four inch (24") box street trees, selected from
the City Street Tree List, a maximum of thirty feet (30') apart and along all street
frontages. All planting is subject to the approval of the Community Development
Director or designee prior to issuance of a Certificate of Occupancy.
20. The Applicant shall provide shrubs and plant materials as shown on the
landscape plan. Any changes to this plan shall be subject to the approval of the
Community Development Director or designee. The landscape plan
improvements and plantings shall be fully installed prior to issuance of a
Certificate of Occupancy.
21. All planting within fifteen feet (15') of ingress/egress points shall be no higher
than 36 inches.
22. The Applicant shall provide an irrigation system for landscaped areas onsite as
shown on the landscape plans. The irrigation system shall be fully installed and
operational prior to the issuance of a Certificate of Occupancy.

23. The Applicant shall provide a rain sensor as shown on the landscape plan. The
rain censor shall be installed prior to the issuance of a Certificate of Occupancy.
24. All exposed slopes in excess of three feet (3') in height shall have permanent
irrigation system and erosion control vegetation installed, as approved by the
City's Landscape Architect. A Planting and Irrigation Plan shall be submitted,
approved and planted prior to the issuance of a Certificate of Occupancy. Fees
are required for review of plans and inspections.
25. All driveways shall be constructed of concrete per Building and Safety Division
standards.
26. The Applicant shall provide the decorative garage door per the approved plans or
one that is approved by the Community Development Director or designee.
27. The applicant shall provide six (6) foot decorative return walls per the City's
Single Family Residential Design Guidelines prior to Certificate of Occupancy.
The return walls shall be constructed of split face block or slump stone. Any
modification or change in material shall be approved by the Director of
Community Development or designee.
28. The applicant shall provide a six (6) foot decorative block wall around the
perimeter of the property. The six (6) foot measurement shall be from the high
side of grade.
29. All walls or fences located in any front yard shall not exceed thirty-six inches
(36") in height with the exception that wrought-iron fences may be five feet (5') in
height. Chain link fences shall be prohibited.
30. All walls and/or fencing need to be located off the property line. If the Applicant
proposes to place any walls and/or fencing on the property line he/she must
submit a notarized agreement between the subject property owner and the
adjacent property owner to the Planning Department and/or the Building
Department prior to installation.
31. The Applicant shall be required to remove and replace any existing chain link
fencing and any fencing that is in poor condition. It will be the responsibility of the
Applicant to contact the effected neighboring property owners. If the existing
fencing is in good condition, this requirement may be waived per the approval of
the Community Development Director or Designee.

STREET IMPROVEMENTS
51. Work done under an encroachment permit for off-site improvements of utility
lines shall be delineated on the street improvement plans and approved and
signed by the City Engineer prior to issuance of building permits.

Engineering Division for construction of off-site public works improvements
(LEMC12.08, Res.83-78). All fees and. requirements for an encroachment permit

GRADING

Engineer. The grading plan shall show volumes of cut and fill, adequate contours
and/or spot elevations of the existing ground as surveyed by a licensed
surveyor or civil engineer. Contours shall extend to minimum of 15 feet beyond
property lines to indicate existing drainage pattern. Apply and obtain a grading
permit with appropriate security prior to grading permit issuance.
56. Provide soils, geology and seismic report, as part of this report address the
requirement of the Alquist-Priolo Earthquake Fault Zoning Act. Provide final soils
report showing compliance with recommendations.
57. Applicant to provide erosion control measures as part of their grading plan. The
applicant shall contribute to protection of storm water quality and meet the goals
of the BMP in Supplement "A" in the Riverside County NPDES Drainage Area
Management Plan.
58. All grading shall be done under the supervision of a geotechnical engineer and
he shall certify all slopes steeper than 2 to 1 for stability and proper erosion
control. The geotechnical engineer shall make recommendation for the minimum
distance of building foundation to the top and toe of slopes.

DRAINAGE:
59. On-site drainage shall be conveyed to a public facility, accepted by adjacent
property owners by a notarized letter of drainage acceptance, or conveyed to a
drainage easement.
60. All natural drainage traversing the site shall be conveyed through the site, or
shall be collected and conveyed by a method approved by the City Engineer.
61. Roof drains shall not be allowed to outlet directly through coring in the street
curb. Roofs shall drain to a landscaped area. Driveways shall be sloped to drain
into landscaping prior to entering street facilities.
62. Submit, along with grading plans, Hydrology and Hydraulic Reports for review
and approval by City Engineer. Developer shall mitigate any flooding and/or
erosion downstream caused by development of the site and/or diversion of
drainage.
63. If sump pumps are used to divert run off into street, provide a notarized letter
stating that it will be maintained in good operating condition by the owner of the
property.
FEES:
64. Pay all Capital Improvement and Plan Check fees (LEMC 16.34). The current
traffic mitigation fee is $1,369.00; the current drainage fee is $507.00 (Riverside
Drive South Dist.) and the current TUMF amount is $10,046.00; the amount of
fees shall be adiusted accordinq to the fee schedule current at the time of
payment.
65. Provide payment for cash in-lieu of street construction for future off-site public
improvements prior to building permit. (Res. 86-35) In-lieu payment shall be
calculated by developers' engineer or architect and submitted for City Engineer's
approval. The estimate shall be based on current cost of street improvements
from property line to centerline of the street within the property limits, plus a 15%
added cost for engineering and construction administration. The street
improvements shall include 6' wide concrete sidewalk, curb and gutter, and 3"
AC over 5" AS pavement section to center line of the street.

discharge control. In accordance with state and federal law, these local storm
water ordinances prohibit the discharge of waste into storm drain system or

the construction and operation of a three-hundred and thirty-six (336) square-foot single-
story "Tuff-Shed" boat house on an approximate .52 acre vacant site. The project site has
a split zoning designation of High Density Residential (R-3) and Recreational (R) and is
within the Lakeshore Overlay District. The site has a General Plan land use designation of
Future Specific Plan I (Lake Edge).
Review is pursuant to Chapter 17.05 (L-Lakeshore Overlay District), Chapter 17.28 (R-3,
High Density Residential District), Chapter 17.36 (R-Recreational District), Chapter 17.66
(Parking Requirements), Chapter 17.82 (Design Review), Chapter 15.64 (Flood Damage
Protection), Chapter 15.68 (Floodplain Management), and Chapter 17.14 (Residential
Development Standards) of the Lake Elsinore Municipal Code.
PROJECT LOCATION AND SITING
The project site is generally located at 17937 Lakeshore Drive (APN'S: 375-250-020 &
021). The existing site, which fronts along Lakeshore Drive slopes downward from
Lakeshore Drive to the lake. There is an existing boat launch ramp located on the
southwest side of the subject property and currently contains approximately eight (8)
Eucalyptus trees located in the middle of the lot. The applicant is proposing to access the
lot via a new driveway along the southwest side of the lot. The proposed driveway will
extend along the southwest portion of the lot, where it turns north to access the boat

storage building. Furthermore, the driveway will connect to the existing boat launch ramp
that extends into the lake.
As previously mentioned, the .52 acre vacant lot currently has a split zoning designation
with the first forty-seven feet (47') of property, west of Lakeshore Drive, zoned Multiple-
Family Residential (R-3), and the remainder of the property west of the R-3 (Multi-
Residential) boundary line zoned Recreation (R). The applicant is proposing to locate the
boat house within the Recreation zone at an elevation of 1,268 feet, located approximately
at the middle of the lot.
In addition to the split zoning designations for the subject property, the entire site is located
within the Lakeshore Overlay District boundary. It is important to note, that the Lakeshore
Overlay District placed upon the property supersedes the R-3 (Multi-Family Residential)
and R (Recreation) zoning districts as it relates to the permitted uses, uses subject to a
Conditional Use Permit, and all other applicable development standards. In other words,
any proposed use or development for the subject property located at 17937 Lakeshore
Drive (APN'S: 375-250-020 & 021) will have to comply with Chapter 17.05 (L-Lakeshore
Overlay District) of the Lake Elsinore Municipal Code (LEMC).
BACKGROUND
The applicant/property owner owns a boat that he has launched from the subject property
onto Lake Elsinore for many years. The applicant lives in the San Diego area and has to
tow his boat to and from the site each time he visits his property at 17937 Lakeshore Drive.
The applicant wishes to leave the boat onsite and secure it within a three hundred and
thirty six (336) square-foot storage boat house.
In August of 1999, the City of Lake Elsinore City Council considered a similar request by
the applicant to construct a metal storage building on the project site to store his boat. The
Council at that time felt the use was appropriate and authorized the applicant to apply for a
Minor Design Review application for the storage building. The applicant subsequently
made the application, but the application was deemed incomplete by staff and ultimately
expired in December 2000 due to inactivity and insufficient information. The applicant is
again interested in constructing a private boat storage building onsite. The current project
proposes a three-hundred and thirty-six square-foot (336') single-story "Tuff-Shed".

The applicant is proposing to construct an approximately three-hundred and thirty-six (336)

subject lot. The proposed structure will be constructed at an elevation of approximately
one-thousand two-hundred sixty-eight feet (1,268'). From Lakeshore Drive, the boat house
will be screened by approximately eight (8) existing Eucalyptus trees. It should be noted
that the boat storage structure will be visible from both Lakeshore Drive as well as lake
patrons that are utilizing the lake. Although, it is a quite a distance from the subject lot to
across the lake, it is possible that the boat storage structure could be visible to other
property owners on the other side of the lake.
Architecture
The proposed three-hundred thirty-six (336) square-foot boat house will include vertical
"Hardi-Panel" siding on all four (4) elevations. The south elevation will include a ten-foot
(10') by seven-foot (7') garage door, vertical siding, and a concrete tile roof. The applicant
is also proposing a roof mounted statue of an eagle. The north elevation will also include
horizontal vertical "Hardi-Panel" siding and a concrete tile roof. The west elevation includes
two (2) doors, vertical-siding, and a concrete tile roof. The east elevation includes one (1)
window, vertical "Hardi-Panel" siding, and a concrete tile roof.

5. That in approving the subject use at the specific location, there will be no adverse
effect on abutting property or the permitted and normal use thereof.
6. That adequate conditions and safeguards pursuant to Lake Elsinore Municipal Code
Section 17.74.050 have been incorporated into the approval of the Conditional Use
Permit to insure that the use continues in a manner envisioned by these findings for
the term of the use.
Minor Desiqn Review (Chapter 17.82.080) Findinqs
1. The Project, as approved, will comply with the goals and objectives of the General
Plan and the Zoning District in which the Project is located.
2. The Project complies with the design directives contained in Section 17.82.060 and
all other applicable provisions of the Municipal Code.
3. Subject to the attached conditions of approval, the Project is not anticipated to result
in any significant adverse environmental impacts.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the Project to ensure development of the property
in accordance with the objectives of Chapter 17.82.
If the Planning Commission is unable to make any of the required findings listed above; the
Conditional Use Permit and Minor Design Review cannot be approved. In other words, the
Planning Commission must be able to make all of the findings in order to approve the
Conditional Use Permit and Minor Design Review.
Based on the application, plans submitted, and all the evidence presented, staff believes
that the Findings NO.1 for both the Conditional Use Permit and the Minor Design Review
cannot be made.
The proposed project is not consistent with the zoning district within which the property lies.
As mentioned above, the proposed property located at 17937 Lakeshore Drive (APN'S:
375-250-020 & 021) has a split zoning designation Multi-Family Residential (R-3) and
Recreation (R) Zoning districts. Additionally, the property is located within the Lakeshore
Overlay District; which supersedes all development and permitted uses of the Multi-Family
Residential (R-3) and Recreation (R) Zoning districts. The development standards set forth
in the Lakeshore Overlay District ordinance control development of this site.
Therefore, Chapter 17.05 (L-Lakeshore Overlay District) of the Lake Elsinore Municipal
Code (LEMC) must be utilized to determine whether the proposed boat house is permitted.
Considering this, Chapter 17.05 of the LEMC, does not permit (either through permitted
uses or conditional uses) the construction and/or operation of a "boat house" structure.
Furthermore, subsection 17.05.060 entitled "Prohibited Uses" states:

'~ny uses not specifically listed as allowed, either or ownership right within
Permitted/Conditional Use or Special Permit, are prohibited, but not limited
to, new residential dwellings, off-site advertising structures, storage of any
kind unless connected with existing occupied residential dwellings but will be
applicable to all other City Codes, parking lots and unauthorized
vending/peddling and selling".
Staff has determined that a proposed "boat house" structure would not be permitted
due to the fact that the subject lot is vacant and the structure will not be an
accessory for an existing occupied residential dwelling unit. In other words a "boat
house" structure would be permitted, subject to a Conditional Use Permit, if there
was an occupied existing dwelling unit on the property. Otherwise, a stand alone
boat house structure is not permitted.
For these reasons, Staff recommends that the Planning Commission deny the
Conditional Use Permit and Minor Design Review applications.
ENVIRONMENTAL DETERMINATION
Pursuant to the California Environmental Quality Act (CEQA), the proposed Conditional
Use Permit No. 2006-17 and the Minor Design Review of a boat storage facility located at
17937 Lakeshore Drive (APN'S: 375-250-020 & 021) is not a project given that it is
recommended that the project be denied.
If the Planning Commission wishes to approve Conditional Use Permit No. 2006-17 and
the Minor Design Review of the proposed boat house structure located at 17937 Lakeshore
Drive (APN'S: 375-250-020 & 021), the Planning Commission would need to direct staff to
conduct a preliminary environmental analysis to determine what type of CEQA
documentation is required. The proposed CUP cannot be approved until the proper CEQA
documentation is prepared.

The applicant is requesting approval of a Uniform Sign Program for The Lake Elsinore
Outlet Center. The pertinent Lake Elsinore Municipal Code chapters relating to sign
programs are: Chapter 17.94 (Signs - Advertising Structures), Chapter 17.38 (Non-
Residential Development Standards), and the Lake Elsinore Outlet Center Specific Plan.
PROJECT LOCATION
The project site is generally located on the east side of Collier Avenue approximately 600
linear-feet south of Nichols Road. (APN's: 389-210-052, 062 & 063).
ENVIRONMENTAL SETTING
The site is bounded on the north by existing commercial businesses, the 1-15 Freeway to
the east, vacant land to the south, and Army Corps of Engineers Jurisdictional Waters to
the west.

BACKGROUND
As the Planning Commission is aware, the project was continued from the March 4, 2008
Planning Commission meeting. The project was continued off calendar to allow the
applicant time to address issues of inconsistency between the existing Outlet Center
Specific Plan and the proposed Uniform Sign Program. The applicant responded and the
project has been re-scheduled and noticed for the March 18, 2008 Planning Commission
meeting.
As such, the applicant is requesting approval of the subject new Uniform Sign Program for
the Lake Elsinore Outlets. The original Uniform Sign Program was originally approved in
conjunction with the adoption of the Specific Plan which was approved by the City Council
in July 1990.
PROJECT DESCRIPTION
The applicant has applied for a new Uniform Sign Program that will include redesigned
monument signs and the freeway oriented tower and pylon signs.
Pylon Sign
The existing project identification freeway pylon sign, located at the northern end of the
project site, will be redesigned with a fabricated aluminum pole cover with reveals. The
freeway pylon sign will be constructed to a total height of eighty feet (80') from the finish
grade. It should be noted that the existing freeway pylon sign is also at eighty feet (80') in
height. The sign will include a full color LED electronic readerboard with a painted "red"
border. In addition, the pylon sign will identify the outlet title, the City of Lake Elsinore logo,
and a "directional" description to the site.

Tower Sian
The Sign Program will allow for the redesign of the existing "freeway tower" structure and
associated tower mounted signage. The "freeway tower" structure is located in the central
portion of the project site. Existing banding, molding elements and outlet center signage
on all four sides of the "freeway tower" will be removed to allow for three (3) seventy (70)
square foot tenant sign panels. In addition, redesigned one hundred and forty (140) square
foot outlet center signs will be added to the tenant sign panels on the east and west sides
of the tower structure which are visible from the freeway and Collier Avenue.
Monument Sians
The Sign Program includes standards for the project entry monument signs on-site. The
project proposes three (3) detailed entry monument signs, located adjacent to the entry
driveways on Collier Avenue. The proposed entry monument signs will include a modern
style design with tenant panels and a maximum total height of nine feet (9').
ANALYSIS
The objective of the proposed sign program is to provide standards and specifications
regarding quality, composition, size and placement of signage in order to ensure
consistency throughout the Outlet Center. Moreover, the sign program would be used by
staff when reviewing the proposed signage in the Lake Elsinore Outlet Center. Finally, the
Sign Program will assist the landlord and/or Property Management Group in selection and
approval of the proposed signage.
The proposed sign program is consistent with the goals and objectives of Chapter 17.94 of
the Lake Elsinore Municipal Code in that it will avoid the indiscriminant and substandard
assembly, location, illumination, coloring and size of signs and will mandate proper
maintenance within the Outlet Center (Exhibit "B"). Additionally, the Sign Program
complies with Section 17.94.170.0 of the Lake Elsinore Municipal Code, which requires
that; "Businesses in an integrated development shall comply with a uniform sign program
approved by the Planning Commission."
It should be noted that staff is in general support of the proposed sign program with the
exception of the "directional language" identified on the freeway oriented pylon sign. Staff
feels that the proposed oval directional information description identified on the freeway
pylon sign should be replaced with the new City logo. A condition of approval has been
added requiring the inclusion of the City's logo. This will give proper identification to the
Outlet Center as well as continue to promote the City's new branding and image.
ENVIRONMENTAL DETERMINATION
Staff determined that the Project is categorically exempt from the California Environmental

RECOMMENDATION
It is recommended that the Planning Commission adopt; Resolution No. 2008-_ adopting
Uniform Sign Program No. 2007-07 based on the Findings, Exhibits "A" and "B" and the
proposed Conditions of Approval.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, APPROVING UNIFORM SIGN
PROGRAM NO. 2007-07
WHEREAS, Architectural Design & Signs filed an application with the City of
Lake Elsinore requesting approval of Uniform Sign Program No. 2007-07 for the
commercial retail development known as The Lake Elsinore Outlets, which is generally
located on the east side of Collier Avenue approximately 600 linear-feet south of
Nichols Road. (APN's: 389-210-052, 062 & 063) (the "Project"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of considering, approving, conditionally approving, or
denying Uniform Sign Programs; and
WHEREAS, public notice of the Project has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public meeting held with respect to this
item on March 18, 2008.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has reviewed and analyzed Uniform
Sign Program 2007-07 according to the standards and guidelines set forth in Lake
Elsinore Municipal Code Section 17.94, and the Outlet Center Specific Plan.
SECTION 2. The Planning Commission finds and determines that this project is
consistent with the Lake Elsinore Municipal Code and the Outlet Center Specific Plan
and that this action is exempt from the requirements of the California Environmental
Quality Act (CEQA) pursuant to Section 15311.a., Exemption for Accessory Structures.
SECTION 3. That in accordance with State Planning and Zoning law and the
City of Lake Elsinore Municipal Code, the Planning Commission makes the following
findings for the approval of Sign Program No. 2007-07:
1. The project, as approved, will comply with the goals and objectives of the General
Plan, the Outlet Center Specific Plan, and the Zoning District in which the project is
located.
The Project complies with the goals and objectives of the General Plan in that the
approval of this Sign Program will assist in achieving the development of a well-
balanced and functional mix of residential, commercial, industrial, open space,
recreational and institutional land uses, diversifying Lake Elsinore's economic base,
in that the proposed signage will enhance the quality of development and set a

2. The project complies with the design directives contained in Section 17.82.060 and
all other applicable provisions of the Municipal Code.
The Project is appropriate to the site and surrounding developments. The project
has been designed in consideration of the size and shape of the property, thereby
creating interest and varying vistas as a person moves along the streets. Further
the project as proposed will complement the quality of existing development and will
create a visually pleasing, non-detractive relationship between the proposed and
existing projects in that the architectural design, color and material and site designs
proposed by the subject sign program evidence a concern for quality and originality,
in that the applicant has creatively included designs that will raise the standards
within the community for on-site signage.
3. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Pursuant to the California Environmental Quality Act (CEQA), the Project, as
reviewed and conditioned by all applicable City Divisions and Departments and
Agencies, will not have a significant effect on the environment pursuant to Article 19,
Section 15311 of the CEQA Guidelines.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of the
property in accordance with the objectives of Chapter 17.82.
Pursuant to LEMC Section 17.82.070, the Project has been scheduled for
consideration and approval of the Planning Commission, and has been adequately
conditioned to ensure full compliance with both the Lake Elsinore Municipal Code
(LEMC) and the Outlet Center Sign Program.
SECTION 4. Based upon all of the evidence presented, the above findings, and
the conditions of approval imposed upon the Uniform Sign Program, the Planning
Commission hereby approves Uniform Sign Program No. 2007-07.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

CONDITIONS OF APPROVAL
UNIFORM SIGN PROGRAM NO. 2007-07
LAKE ELSINORE OUTLET CENTER
GENERAL
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, and Agents from any claim, action,
or proceeding against the City, its Officials, Officers, Employees or Agents to attach,
set aside, void, or annul an approval of the City, its advisory agencies, appeal boards,
or legislative body concerning the project attached hereto.
UNIFORM SIGN PROGRAM NO. 2007-07
2. The decision of the Commission shall be final fifteen (15) days from the date of the
decision unless an appeal has been filed with the City Council pursuant to the
provisions of Chapter 17.80.
3. Prior to issuance of any sign permit the applicant shall sign and complete an
"Acknowledgement of Conditions" form and shall return the executed original to the
Planning Division for inclusion in the case records.
4. The applicant shall apply for a sign permit and pay appropriate fee for any sign
installed at the project site.
5. The location, size, style, and color for all signs shall comply with the Sign Program
(Approved herein). Any additions or revisions to the Sign Program shall require
Planning Division review and approval.
6. No portion of the proposed monument sign shall be located closer than five feet (5') to
any property line, nor be located in such a manner as to constitute a hazard to
pedestrian or vehicular traffic.
7. The approval for Sign Program No 2007-07 for the project known as The Lake
Elsinore Outlet Center shall lapse and become void one (1) year following the date on
which the Sign Program became effective, unless prior to the expiration of one year, a
building permit related to the Sign Program is issued and construction commenced and
diligently pursued toward completion. The Sign Program granted herein shall run with
the land for this one (1) year period and shall continue to be valid upon a change of
ownership of the site.
8. Any alteration or expansion of this Sign Program approval shall be reviewed according
to the provisions of Chapter 17.94 (Signs-Advertising Structures) of the Lake Elsinore
Municipal Code.
9. All exterior sign lighting shall be reviewed and approved by the Community
Development Director or designee.

10. The applicant shall incorporate the City brand and logo into the proposed freeway
pylon sign. Said logo shall be reviewed and approved by the Community Development
Director or designee.
11. The project shall comply with all requirements of the California Department of
Transportation (Caltrans) for advertising units and display structures.
ENGINEERING
12. The location of the proposed monument sign shall be behind the City right-of-way and
shall be located to meet City sight distance requirements.
