The City of Lake Elsinore appreciates your attendance. Citizens' interest provides the
Planning Commission with valuable information regarding issues of the community.
Meetings are held on the 1st and 3rd Tuesday of every month. If you are attending this
Planning Commission meeting, please park in the Parking Lot across the street from the
Cultural Center. This will assist us in limiting the impact of meetings on the Downtown
Business District. Thank you for your cooperation.
The agenda is posted 72 hours prior to each meeting outside of City Hall and is available at
each meeting. The agenda and related reports are also available in the Community
Development Department on the Friday prior to the Planning Commission meeting.

2. General Plan Amendment No. 2007-06, Industrial Design Review No.
2006-02, Conditional Use Permit No. 2006-02, and Tentative Parcel
Map No. 33531, "Elsinore West Business Park"
Director of Community Development Preisendanz provided a brief overview of
the proposed project and requested Planning Manager Weiner to review it with
the Commission and answer questions.
Planning Manager Weiner provided an overview of the project. He stated that
the applicant did not sign the Draft Conditions of Approval because the Fire
Conditions had not been worked out yet, and the City didn't want to delay the
project and staff wanted to give the applicant a chance t()see them.
The applicant, Michael Quirk, San Clemente, California, read and agreed with the
Conditions of Approval but requested a number.pfConditions be revised. The
first Condition that he referred to was Condition No. 8 and requested an
exception to the construction hours for the concrete pours for early morning and
night time because the project is in an industrial/commercial area and does not
surround any residential neighborhoods.
Planning Manager Weiner stated that this would noipe a problem but would like
some advisement as to 24/48 hournQtige as to the wotkbeing done.
Mr. Quirk referred to Condition No. 15 regatdingputside storage and requested
storage for Building No's2, 3, 4b, & 5.
Chairman O'Neal asked whafkind of outside storage he needed?
Mr. Quirk stated that heJ1eedeq~torag13.J6r various equipment such as trucks,
plumbing equipment, etc. as. long as ifstays below the wall and inside the interior
of the gate. He indicated th(;lthe did not include this through Planning because
of parking issues andi~~~ted that it didn't have to be included on the Conditional
Use Permit but requested consideration by the Planning Commission for future
use.

Planning Manager Weiner stated that if there is going to be a Conditional Use
Permit for outdoor storage, that request would have to be brought back to the
Commission separately. He indicated that the City's Public Works Director had
concerns about the truck turning radius. Also, staff had related concerns
conditioning the project if there was going to be outdoor storage. Planning
Manager Weiner said staff would work with the applicant on this.
The applicant stated that this would work for him.
The applicant referred to Condition No. 17 regarding Design Review expiration
period, and indicated that Planning Manager Weiner said that the City is working

on an Ordinance to revise this and had concerns about the current market place
and the economic conditions at the present time and they were seeking a
minimum design review of eighteen (18) months and would like to request
consideration for phasing of the project.
Planning Manager Weiner stated that staff would be bringing forth a Text
Amendment regarding time extensions. Also, staff would have to analyze a
phasing plan regarding construction and vehicle circulation.
The applicant asked Public Works Director Seumalo to explain Condition No. 68
and Condition No. 84 because they were both related.
Public Works Director Seumalo stated that the dedication has to be consistent
with the current General Plan and the City would work with the applicant
regarding dedication for the proposed circulation.
The applicant needed clarification on Condition NO.1 04 regarding participating in
Public Safety and Maintenance Services .CF'D.
Planning Manager Weiner stated that the City would work with the Finance
Department for clarification on flexibility before taking project to City Council.

PLANNING COMMISSION COMMENTS
Commissioner Zancalli stated that he .had no problem with the phased
construction regardIrrgthe current market, and regarding the outdoor storage
issue, he stated that asthey.gt3trnore tengnts, the Commission can review this at
that time,.and would try to>be as flexIble as possible but there could be some
limits. He also indicated thatthis is a good project for the area.
Commissioner Flores stated that he had no problems with Condition Numbers 8
and 15, as long a staff and the applicant work together. He asked Planning
Manager Weiner to clarify Condition No. 17 regarding Phasing.
Planning Manager Weiner stated that in terms of Phasing, the City is agreeable
to working out any phasing issues with the applicant.
Commissioner Flores asked that the word "Department" be added to Department
of County Fire and asked for clarification from Public Works Director Seumalo on
Condition No. 56 regarding 10 year storm runoff.
Public Works Director Seumalo stated that the City collects an area drainage fee
that has a Master Plan Storm Drain Improvement associated with it, and when
the City has enough funding for this, it will be joined with Riverside County Flood
Control to implement projects.

Commissioner Mendoza asked Planning Manager Weiner if the Draft
Acknowledgment of Conditions form was signed.
Planning Manager Weiner stated that they were holding off because there were
some late revisions to the Fire Conditions but the applicant stated that everything
was agreeable and the final Acknowledgement of Conditions form would be
signed at the conclusion of the Planning Commission meeting.
Commissioner Mendoza stated that regarding Condition No. 8 relating to
construction activity hours, he had no problems with the times of construction
activity as long as it specifically related to pouring the concrete and the
Conditional Use Permit would be reviewed once it goes to the Planning
Commission.
Vice Chair Gonzales asked the applicant when he planned on starting
construction.
The applicant stated within the next eighteen (18) months.

Planning Consultant Miller provided an overview of the project.
The owner, Glen Daigle, Oak Grove Equities, Inc., Murrieta, California, stated
that the applicant, Jorge Cely read and agreed to the Conditions of Approval and
indicated he was pleased with the way staff handled the project.
The applicant, Jorge Cely, Gensler Architects, Newport Beach, California, read
and agreed with the Conditions of Approval.

Commissioner Flores had no questions.
Commissioner Mendoza stated that although the project meets all of the
requirements of the City, he believed there to be an over saturation of Banks
going into this area and would prefer a variety of businesses there.
Vice Chair Gonzales has no problem with the design of the project but doesn't
want a fast food restaurant there.
Commissioner Zanelli also stated that although the applicant met all of the
requirements, he agreed with Commissioner Mendoza and would have preferred
a Bank go in on the other side of the freeway instead of the current location.
Chairman O'Neal thought this was a nice project.

4. Residential Desian Review No. 2006-08; for the Development of 7
Sinale-Familv Dwellina Units at the Northeast Intersection of
Summerhill Drive and Scenic Ridae Dries.
Chairman O'Neal opened the Public Hearing at 6:36 pm.
Director of Community Development Preisendanz provided a brief overview of
the proposed project and stated that staff is recommending that the Planning
Commission deny the project based on findings that staff has made. He
requested Planning Manager Weiner to review it with the Commission and
answer questions.
Planning Manager Weiner provided an overview of the<project and stated that
staff's concern was with the proposed architectural style identified by the
architect as "McMansion" and indicated that originally staff asked the applicant to
embellish the homes original architectural design/identified as Spanish Colonial
and asked the architect to provide more trqe to form architecture on all four (4)
sides that would be closer to the Spanish>Golonial architecture. When staff
received the latest submittal for "McMansion" architecture, they had concerns
and didn't feel that this "McMansion" was appropriate for this area and
recommended denial of this project.
Chairman O'Neal confirmed with Planning Manager>Weiner that the term
"McMansion" is a pejorative term not a style.

The architect, LarryVesley, Riverside, California, gave a Power Point
presentation regarding~.i.s.pr()je8tand ....ippicated that this project is a 7 lot in-fill
project and the>g9al of <this developrnent is to be compliment surrounding
developments by being compatible in character, style, size, color, and materials
and not to overbuild the.area. He also stated that staff requested a design of the
homes, and he gave them a style of "McMansion".
Chairman O'Neal asked Mr. Vesley if he was a licensed architect.
Mr. Vesley said yes<and stated that he has had his own firm for 20 years.
Chairman O'Neal asked Mr. Vesley if he labeled his project "Spanish Colonial".
Mr. Vesley stated that at one time he did label the project "Spanish Colonial".
Chairman O'Neal asked Mr. Vesley when he re-submitted his plans, did he label
them "McMansion", and asked him what that term meant to him.
Mr. Vesley indicated to Chairman O'Neal that "McMansion" means higher end,
everyday mansion for the middle income family.

Chairman O'Neal asked Mr. Vesley if he understood that the definition of the
word "McMansion" is a pejorative term.
Mr. Vesley stated yes.
REQUEST TO SPEAK
Harvey Harper, Tuscany Hills in Lake Elsinore, commended staff for denying a
developer a project. He stated that Tuscany Hills is considered one of the
prestigious areas of Lake Elsinore and referred to it as the golden egg of Lake
Elsinore, and they don't need cookie cutter homes in the area. He indicated that
the architect could build nicer homes because the communitywill not always be
as depressed as it is now, it will continue to grow and if they bring inexpensive
homes in the area, it will lower the dollar value of the entire hill. If anything is
going to be built there, it should be nice.
The owner of the subject property, Mirey Andaya, Riverside, California, stated
that they are building something better than what is currently in thatarea.
George Bloomfield, Mission Viejo, commentedthaf the architect seemed to be
using existing architecture which mgy be so many Y$ars old and he thought there
should be consideration for improvement and to add greater detail. Therefore,
he commended the Planning Commi$sionfor. making better decisions.
Chairman O'Neal asked Mr. Bloomfield about his architectural background.
Mr. Bloomfield indicated thathis father and brother are both architects, involved
in design considerations with properties, ahdJhat his firm did the branding for the
City of Lake Elsinore. ifH.e. continueo by $tating that he has a vested interest in
the City's image overall.
Evelyn Moreno, Lake Elsinore, .stated that she lives approximately 3 blocks
above where the deveJQpmentiis proposed and has seen a downfall of the
community at this location. She indicated that something should be done about
the empty lot, .but doesn'tagree with the layout of the development, and it should
be a nicer looking development.
Chairman O'Neal stated that the Planning Commission has been directed by the
City Council to require four sided architecture, not just one sided architecture.

PLANNING COMMISSION COMMENTS
Commissioner Mendoza stated that it looked like the "cut backs" were on the
streets because he didn't see any sidewalks. He also indicated that the
architectural styles were submitted on 9/06, 6/07, and 11/07, and every time they
were submitted, staff had recommendations to the styles that needed to be

changed. He stated that when the architect was supposed to correct
deficiencies, he re-named it "McMansion". Therefore, he concurred with staff's
recommendation of denial of the project.
Vice Chair Gonzales stated that he agreed with staff for denial of the project.
Commissioner Zanelli stated that he agreed with staff for denial. He would like to
see the applicant work with staff to agree on a design.
Commissioner Flores agreed with staff for denial of the project.
Chairman O'Neal stated to Mr. Vesley that although he .isa skilled and talented
architect, he decided that he didn't have to deal with the.City of Lake Elsinore's
requirements for building houses. He also indicated that none of the drawings
look like Spanish architecture and after staff requested revisions to the
architecture, he came back with "McMansion" architecture which is "cookie
cutter" houses. Therefore, Chairman O'Neal agreed with staff for denial of the
project.

Director of Community Development Preisendanz thanked the Planning
Commission for their support and also for the Commission for their support for
tonight's decision and stated that as the City brings projects forward, we are
trying to raise the bar which makes the City a better place to live.
Deputy City Attorney Santana had no comments.
Commissioner Zanelli asked Public Works Director Seumalo what can be done
about Shrier and Gunnerson being under water.
Public Works Director Seumalo stated that as that something similar happened to
Gunnerson and indicated that at this time there is no funding for this but he said
he would assign Dave Soloman, Capital Improvement Plans Engineer to work
out funding for this.
Chairman O'Neal stated that since there is some controversy about the
intersection at Riverside and Gunnerson, it would behoove the City to straighten
the street rather than raise it.
Public Works Director Seumalo stated thatif>.the street was raised at Shrier,
Gunnerson would also., have to be reali~ped. He, indicated that Cal-Trans is in
the midst of designing a Jeft.turn pocket for Riverside Drive at Gunnerson and
said that the City coqld have the signal if Vi{e took over the left turn pocket project.
He stated that the City was initially excitedpbout this because a sign is needed
there. Staff was confident that wecQ\,Jld design the signal to Cal- Trans standards
within the existing right-of-way. AlsO;uthe Traffic Engineer said Cal- Trans thinks
that they would have to do an oversight project and it could take years to get the
project started.

BACKGROUND
The first phase of development of this Industrial Complex known as Collier Avenue
Business Park included Tentative Parcel Map 29325 which subdivided a ten (10) acre
parcel into eleven (11) industrial parcels ranging in size from 24,829 square feet to 82,764
square feet. There was an associated Design Review for Industrial Project No. 99-4 that
included ten (10) new buildings and one (1) existing building ranging in size from 8,400
square feet to 33,780 square feet. Mitigated Negative Declaration No 99-4 was completed
pursuant to Section 15070 of the California Environmental Quality Act (CEQA). These
items were approved and adopted by the City Council on September 14, 1999. The
Industrial buildings and associated improvements were completed on all of the parcels
except for one. The applicant is requesting approval to construct the final building on this
one remaining vacant parcel as part of this current entitlement.
The second phase of development was a request for approval and adoption of Mitigated
Negative Declaration No. 2003-04, Tentative Parcel Map No. 29999, Conditional Use
Permit (CUP) No. 2003-09, and Design Review for Industrial Project No. I 2003-05. These
items were approved by City Council on February 10, 2004. Tentative Parcel Map No.
29999 was recorded in November of 2005; however the Design Review and CUP expired
on February 10, 2005.
PROJECT DESCRIPTION
The applicant is now requesting approval of the same industrial project that was previously
approved as Industrial Design Review No. 2003-05, but expired on February 10, 2005 and
the one (1) remaining building that will complete Industrial Design Review No. 99-4. The
application consists of a request for approval of a Conditional Use Permit to allow for
outdoor storage and Industrial Design Review to allow for the construction and associated
improvements for nine (9) industrial buildings. The following details each of these
elements:

Conditional Use Permit No. 2008-05 (Outdoor Storage)
The applicant is requesting approval to allow outdoor storage for this industrial complex.
According to Chapter 17.56.040.A.2 of the Lake Elsinore Municipal Code, "All storage
yards shall be enclosed on all sides with a screen a minimum of six feet (6') in height as
measured from the highest grade elevation either side of the screen. ..furthermore, "No
material shall be stored higher than the screen." These requirements have been included
in the Conditions of Approval. Chapter 17.56.040A.7 states that, "All outdoor storage is
subject to the approval of a Conditional Use Permit pursuant to Chapter 17.74...."
Therefore, the applicant is requesting approval of Conditional Use Permit No. 2008-05.
Industrial Design Review No. 2007-02
Site Plan
The applicant is requesting approval to construct eight (8) buildings (Buildings A thru H) on
each of the eight (8) parcels within Parcel Map No. 29999 and one building (Building J) on
the remaining lot of Parcel Map No. 29325. Buildings C and D are actually one (1) building
divided into two (2) separate units. Each of the parcels will include the required number of
parking spaces pursuant to Chapter 17.66 (Parking Requirements) of the Lake Elsinore
Municipal Code (LEMC). The minimum building setbacks of twenty feet (20') along Hunco
Way and Pasadena Street have been met.
Pursuant to the City of Lake Elsinore's General Plan, the maximum Floor Area Ratio (FAR)
allowed for Limited Industrial is .35. The proposed Site Plan shows that Buildings A, B, F,
G, H, and J exceed this maximum FAR (Building A-40.2 %, Building B -49.9%, Building
F - 35.5%, Building G - 37.7%, Building H - 36.2%, Building J - 35.3%). The FAR
overage of the entire site is .37, two percent (2%) over the maximum allowed. The
applicant is requesting consideration to be allowed to exceed the maximum FAR for the
above mentioned buildings.
The proposed buildings are divided into office space and warehouse/manufacturing areas.
The office space area includes a receptionist area, bathroom, and hallways. The total
building area for all buildings is 144,432 square feet. The buildings range in size from
9,552 square feet (Building E) to 27,327 square feet (Buildings A & B). Details of each
building are listed on Sheet 1 of the attached plans.
Architectural Design
The applicant is proposing to use the same style of architecture that was used in the first
phase of the development which is a typical industrial contemporary style found in the
industrial areas of the City. However, the applicant will be upgrading the front elevations by
adding masonry tile to each entry. Other features include varying roof lines with and without
cornice trim, wall planes with projections and recessions at the entries and grooved reveal

lines that separate the various colors proposed. Clear anodized aluminum storefront
windows with solar bronze glazing will be provided for additional interest.
Parking
According to Chapter 17.66.030.C ofthe LEMC one (1) parking space for every 250 square
feet of office use and one (1) parking space for every 500 square feet of warehouse use
are required for each parcel. Each parcel meets the parking requirements of the LEMC. A
detail of the net floor areas and corresponding parking requirements for each building is
shown on the Site Plan. The parking calculations show that with the number of buildings
proposed and the uses listed. A total of 307 parking spaces would be required. The
applicant is providing a total 325 parking spaces meeting and exceeding the LEMC
requirement. This figure includes nineteen (19) handicap spaces, which meets and
exceeds the State Americans with Disabilities Act (ADA) for handicap parking spaces.
Landscaping
Chapter 17.56.100 of the LEMC requires that a minimum of 15 feet and an average of 20
feet of landscaped setback be provided for industrial projects fronting the public right of
way. The project complies with this requirement and shows a minimum of a twenty foot
(20') landscaped setback along Hunco Way and Pasadena Street.
In addition, the applicant will provide approximately 63,443 square feet or sixteen percent
(16%) landscape coverage pursuant to Chapter 17.56.100(c) that requires a minimum of
twelve percent (12%) landscape coverage.

ANALYSIS
Staff found that all development standards established by the Lake Elsinore Municipal
Code relating to the proposed industrial project, including setbacks, building height,
landscaping and parking requirements have been met. Therefore, with the majority of
requirements met and the relatively minor deviations from the Floor Area Ratio (FAR)
requirement, Staff feels that the project has substantially met the requirements of the
General Plan and Chapter 17.74, (Conditional Use Permit), Chapter 17.56 (M-1, Limited
Manufacturing District), Chapter 17.66 (Parking Requirements) and Chapter 17.82 (Design
Review) of the Lake Elsinore Municipal Code.
Staff also determined that the outdoor storage component of the project will meet the
requirements of Chapter 17.74 (Conditional Use Permit) in that all outdoor storage areas
will be conditioned to provide an enclosed area with opaque gates for each storage area
proposed.
The architectural design proposed follows the design elements, including colors and
materials, which have been established within the "Phase One" of the industrial complex.
These elements include varying roof lines, varying wall planes, tile, and large clear
anodized aluminum windows wI solar bronze glazing. The design is also compatible with
the adjacent surrounding industrial buildings.
The landscape design for the project site complies with the requirements set forth within
Lake Elsinore Municipal Code Chapters 17.52.090 and 17.66.100. The amount of planting
area exceeds the minimum landscaping required. The landscaping palette proposed is
consistent with the plant palette that has been established by the adjacent "Phase One"
industrial complex.
ENVIRONMENTAL DETERMINATION
Mitigated Negative Declaration No. 2003-04 was reviewed, circulated and adopted by City
Council on February 10, 2004 meeting the requirements of the California Environmental
Quality Act (CEQA) for the previously entitled industrial project. The current project, which
includes Conditional Use Permit No. 2008-05 and the Industrial Design Review No. 2007-
02, will not result in a change in the density or intensity of development other than that
which was analyzed in the originally adopted Mitigated Negative Declaration. Moreover, the
entitlements do not involve any changed circumstances or new information that would
generate a need for additional environmental analysis. Therefore, in accordance with the
CEQA Guidelines no further environmental evaluation is necessary.
RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution No. 2008-

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL
ADOPT FINDINGS THAT THE PROJECT IS CONSISTENT WITH THE
MULTIPLE SPECIES HABITAT CONSERVATION PLAN (MSHCP)
WHEREAS, Dave Wakefield, Davcon Investments, LLC., filed an application with
the City of Lake Elsinore requesting approval of Conditional Use Permit No. 2008-02
and Industrial Design Review No. 2007-02 for approval of the design and construction
of nine (9) industrial buildings ranging in size from 8,400 square feet to 33,870 square
feet with related improvements (the "Project"); and
WHEREAS, the total area of the Project Site is approximately nine (9) acres and
is located on Hunco Way between Collier Avenue and Pasadena Avenue (APN's 377-
120-040 thru 047 and 377-120-032) (the "Project Site"); and
WHEREAS, Section 6.0 of the MSHCP indicates projects which are proposed for
development in an area not covered by an MSHCP criteria cell shall be analyzed
pursuant to the MSHCP "Plan Wide Requirements" and the City of Lake Elsinore shall
make findings that the Project is consistent with those requirements; and
WHEREAS, public notice of the Project has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on March 4, 2008.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the Project and its
consistency with the MSHCP "Plan Wide Requirements" prior to making a
recommendation that the City Council adopt Findings of Consistency.
SECTION 2. In accordance with the MSHCP, the Planning Commission makes
the following findings for MSHCP consistency:
1. The Project is a project under the City's MSHCP Resolution, and the City must
make an MSHCP Consistency finding before approval.
The Project Site is not located within an MSHCP Criteria Cell. However,
pursuant to the City's MSHCP Implementing Resolution, the Project is required to
be reviewed for consistency with the following "Plan Wide Requirements":
Section 6.1.2 Protection of Riparian/Riverine Areas and Vernal Pool Guidelines,
Section 6. 1.3 Protection of Narrow Endemic Plant Species Guidelines, Section
6.1.4 Guidelines Pertaining to Urban/Wildlands Interface, Section 6.3.1
Vegetation Mapping, Section 6.3.2 Additional Survey Needs and Procedures,
and Section 6.4 Fuels Management.

2. The Project is subject to the City's LEAP and the County's Joint Project Review
processes.
As stated above, the Project is not located within a MSHCP Criteria Cell and
therefore it was not processed through a LEAP or Joint Project Review.
3. The Project is consistent with the Riparian/Riverine Areas and Vernal Pools
Guidelines.
No riverine/riparian areas or vernal pools are present on the Project Site. The
Project is therefore consistent with the Riparian/Riverine Areas and Vernal Pool
Guidelines set forth in Section 6.1.2 of the MSHCP. No further action regarding
this section of the MSHCP is required.
4. The Project is consistent with the Protection of Narrow Endemic Plant Species
Guidelines.
The Project Site has already been graded. The Project Site is located adjacent
to two industrial complexes, one on the northeast and one on the southwest, a
junk yard on the northwest, and a commercial complex on the southeast. There
is no suitable habitat for Narrow Endemic Plan Species on the Project Site
because it has been disturbed. No further action regarding this section of the
MSHCP is required.
5. The Project is consistent with the UrbanNVildlands Interface Guidelines.
The Project is surrounded by existing development on all sides. Therefore, the
Urban/Wildlands Interface Guidelines set forth in Section 6.1.4 of the MSHCP are
inapplicable. No further action regarding this section of the MSHCP is required.
6. The Project is consistent with the Vegetation Mapping requirements.
There are no resources existing on the Project Site that would be subject to the
requirements of Vegetation Mapping set forth in Section 6.3. 1 of the MSHCP. No
further action regarding this section of the MSHCP is required.
7. The Project is consistent with the Additional Survey Needs and Procedures.
The Project is subject to Burrowing Owl surveys. As mentioned above, the
Project Site has been completely graded in conjunction with development of the
adjacent industrial complex. The Project is surrounded by development. There is
no suitable habitat for Burrowing Owl on the Project Site. No further action
regarding this section of the MSHCP is required.

8. The Project is consistent with the Fuels Management Guidelines.

9. The Project will be conditioned to pay the City's MSHCP Local Development
Mitigation Fee.
The developer will be required to pay the City's MSHCP Local Development
Mitigation Fee.
10. The Project is consistent with the MSHCP.
The Project is consistent with all applicable provisions of the MSHCP. No further
actions related to the MSHCP are required.
SECTION 3. Based upon all of the evidence presented, the above findings, and
the attached conditions of approval, the Planning Commission hereby recommends that
the City Council find the Project consistent with the MSHCP.
SECTION 4. This Resolution shall take effect from and after the date of its
passage and adoption.

WHEREAS, Dave Wakefield, Davcon Investments, LLC., filed an application with
the City of Lake Elsinore requesting approval of Conditional Use Permit No. 2008-05,
for the establishment of several outdoor storage areas in association with the
development of an industrial complex located on Hunco Way between Collier Avenue
and Pasadena Avenue (APN's 377-120-040 thru 047 and 377-120-032) (the "Project");
and
WHEREAS, the City of Lake Elsinore recognizes that certain uses have
operational characteristics that, depending upon the location and design of the use, may
have the potential to negatively impact adjoining properties, businesses or residents
and therefore are permitted subject to the issuance of a conditional use permit, which
allows the City to comprehensively review and approve the use; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of considering and approving, conditionally approving,
or denying conditional use permits; and
WHEREAS, pursuant to the California Environmental Quality Act (Cal. Pub. Res.
Code 21000, et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. 15000, et seq.:
"CEQA Guidelines") public agencies are expressly encouraged to reduce delay and
paperwork associated with the implementation of CEQA by using previously prepared
environmental documents when those previously prepared documents adequately
address the potential impacts of the proposed project (CEQA Guidelines Section
15006); and
WHEREAS, CEQA Guidelines Section 15162 establishes the standard to be
used when determining whether further environmental documentation is necessary and
says that when an environmental document has already been adopted for a project, no
subsequent environmental documentation is needed for subsequent entitlements which
comprise the whole of the action unless substantial changes or new information are
presented by the project; and
WHEREAS, on February 10, 2004, the City of Lake Elsinore approved and
certified Mitigated Negative Declaration No. 2003-04 for the previously approved
Industrial Project No. 2003-05, which evaluated the environmental impacts that would
result from development of the industrial complex; and
WHEREAS, the Project does not present substantial changes or new information
regarding the potential environmental impacts of development and it is found that no
further environmental review would be required; and

WHEREAS, on March 4, 2008, at a duly noticed public hearing, the Planning
Commission considered evidence presented by the Community Development
Department and other interested parties with respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed Conditional
Use Permit No. 2008-05 and finds that the requirements of Chapter 17.74 of the Lake
Elsinore Municipal Code have been satisfied.
SECTION 2. The Planning Commission finds and determines that in accordance
with CEQA Guidelines Section 15162, Conditional Use Permit
2008-05 does not propose substantial changes and does not present any new
information, circumstances, or changes to the Project that was analyzed for the
previously approved Mitigated Negative Declaration No. 2003-04. The Conditional Use
Permit application is part of the whole action analyzed in Mitigated Negative Declaration
No. 2003-04. The Conditional Use Permit does not change density or intensities of use.
Therefore, it is not necessary to conduct any further environmental review for the
Project.
SECTION 3. That in accordance with State Planning and Zoning Law and the
Lake Elsinore Municipal Code, the Planning Commission makes the following findings
for approval of CUP 2007-25:
1. The proposed use, on its own merits and within the context of its setting, is in
accord with the objectives of the General Plan and the purpose of the planning
district in which the site is located.
Issuance of this Conditional Use Permit will facilitate the creation of a well
balanced and functional mix of residential, commercial, industrial, open space,
recreational and institutional land uses. The proposed land use substantially
conforms to the objectives of the General Plan and the purpose of the planning
district in which the site is located.
2. The proposed use will not be detrimental to the general health, safety, comfort, or
general welfare of persons residing or working within the neighborhood of the
proposed use or the City, or injurious to property or improvements in the
neighborhood or the City.
All applicable City departments and agencies have been afforded the opportunity
to review the use permit and their comments have been addressed in the
conditions of approval attached to the staff report for this Project. Conditions
have been applied relating to the installation and maintenance of landscaping,
walls, regulations of points of vehicular ingress and egress and control of
potential nuisance. The Project will not result in any negative impacts to the

general health, safety, comfort, or welfare of the surrounding neighborhood or the
City.
3. The site for the intended use is adequate in size and shape to accommodate the
use, and for all the yards, setbacks, walls or fences, landscaping, buffers and
other features required by Title 17 of the Lake Elsinore Municipal Code.
The proposed outdoor storage areas have been designed in consideration of the
size and shape of the property, thereby strengthening and enhancing the
immediate industrial area. Further, the Project will complement the quality of
existing development and will create a visually pleasing, non-detractive
relationship between the proposed and existing projects in that the facility design
has been reviewed to ensure adequate provision of screening from the adjacent
properties.
4. The site for the proposed use relates to streets and highways with proper design
both as to width and type of pavement to carry the type and quantity of traffic
generated by the subject use.
The outdoor storage areas have been reviewed in relation to the width and type
of pavement needed to carry the type and quantity of traffic generated. The City
has adequately evaluated the potential impacts associated with the proposed
facility prior to its approval and has conditioned the Project to be served by roads
of adequate capacity and design standards to provide reasonable access by car
and truck.
5. In approving the subject use, there will be no adverse affect on abutting property
or the permitted and normal use thereof.
The proposed use has been thoroughly reviewed and conditioned by all
applicable City departments and outside agencies, eliminating the potential for
any and all adverse effects on the abutting property.
6. Adequate conditions and safeguards pursuant to Lake Elsinore Municipal Code
Section 17.74.50 have been incorporated into the approval of the Conditional
Use Permit to insure that the use continues in a manner envisioned by these
findings for the term of the use.
Pursuant to Lake Elsinore Municipal Code Section 17.74.050, the Project has
been scheduled for consideration by the Planning Commission at the regularly
scheduled meeting on March 4, 2008.
SECTION 4. Based upon the evidence presented, the above findings, and the
attached conditions of approval, the Planning Commission hereby approves Conditional
Use Permit No. 2008-05.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF
THE CITY OF LAKE ELSINORE APPROVAL OF INDUSTRIAL DESIGN
REVIEW NO. 2007-02
WHEREAS, Dave Wakefield, Davcon Investments, LLC., filed an application with
the City of Lake Elsinore requesting approval of Industrial Design Review No. 2007-02
for the design and construction of nine (9) industrial buildings ranging in size from 8,400
square feet to 33,870 square feet located on Hunco Way between Collier Avenue and
Pasadena Street (APN's 37-120-040 thru 047 and 377-120-032) (the "Project"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of considering and making recommendations to the
City Council for industrial design review applications; and
WHEREAS, pursuant to the California Environmental Quality Act (Cal. Pub. Res.
Code 21000, et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. 15000, et seq.:
"CEQA Guidelines") public agencies are expressly encouraged to reduce delay and
paperwork associated with the implementation of CEQA by using previously prepared
environmental documents when those previously prepared documents adequately
address the potential impacts of the proposed project (CEQA Guidelines Section
15006); and
WHEREAS, CEQA Guidelines Section 15162 establishes the standard to be
used when determining whether further environmental documentation is necessary and
says that when an environmental document has already been adopted for a project, no
subsequent environmental documentation is needed for subsequent entitlements which
comprise the whole of the action unless substantial changes or new information are
presented by the project; and
WHEREAS, on February 10, 2004, the City of Lake Elsinore approved and
certified Mitigated Negative Declaration No. 2003-04 for the previously approved
Industrial Project No. 2003-05, which evaluated the environmental impacts that would
result from development of the industrial complex; and
WHEREAS, the Project does not present substantial changes or new information
regarding the potential environmental impacts of development and it is found that no
further environmental review would be required; and
WHEREAS, on March 4, 2008, at a duly noticed public hearing, the Planning
Commission considered evidence presented by the Community Development
Department and other interested parties with respect to this item.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the Industrial Design
Review prior to making a decision to recommend that the City Council approve the
application. The Planning Commission finds that the Industrial Design Review satisfies
all requirements setforth in Chapter 17.82 of the Lake Elsinore Municipal Code.
SECTION 2. The Planning Commission finds and determines that in accordance
with CEQA Guidelines Section 15162, Industrial Design Review 2007-02 does not
propose substantial changes and does not present any new information, circumstances,
or changes to the Project that was analyzed by Mitigated Negative Declaration No.
2003-04. The Design Review application is part of the whole action analyzed in
Mitigated Negative Declaration No. 2003-04 and will not change density or intensity of
use within the industrial complex. Therefore, it is not necessary to conduct any further
environmental review for the Project.
SECTION 3. That in accordance with State Planning and Zoning Law and the
Lake Elsinore Municipal Code, the Planning Commission makes the following findings
for the approval of Industrial Design Review 2007-02:
1. The Project, as approved, will comply with the goals and objectives of the
General Plan, Specific Plan and the Zoning District in which the Project is
located.
The Project complies with the goals and objectives of the General Plan because
it will assist in achieving the development of a well balanced and functional mix of
residential, commercial, industrial, open space, recreational, and institutional land
uses. The Project will serve to greater diversify and expand Lake Elsinore's
economic base.
2. The Project substantially complies with the design directives contained in the
General Plan Urban Design Element and all other applicable provisions of the
Lake Elsinore Municipal Code.
The Project is appropriate to the site and surrounding qevelopments in that the
industrial buildings have been designed in consideration of the size and shape of
the property. Sufficient setbacks and enhanced onsite landscaping have been
provided thereby creating interest and varying vistas as a person moves along
abutting streets and within the center. In addition, safe and efficient circulation
has been achieved onsite.
The Project will compliment the quality of existing development and will create a
visually pleasing, non-detractive relationship between the proposed development
and existing projects through the use of architectural design that is similar to
existing buildings in the neighboring industrial complexes. A variety of materials

and colors are proposed that blend with surrounding developments and provide
evidence of a concern for quality and originality.
3. Subject to the attached conditions of approval, the Project is not anticipated to
result in any significant adverse environmental impacts.
The Project was reviewed and conditioned by all applicable City departments to
ensure that the industrial buildings blends into existing development, creates the
least amount of disturbance, and does not negatively impact the residents or
businesses of Lake Elsinore. The Project will not have a significant effect on the
environment.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the Project to ensure development of the
property in accordance with the objectives of Chapter 17.82.
Pursuant to Section 17.82.070 of the Lake Elsinore Municipal Code, the Project
has been scheduled for consideration and approval of the Planning Commission
on March 4, 2008.
SECTION 4. Based upon all of the evidence presented, the above findings, and
the conditions of approval imposed upon the Project, the Planning Commission hereby
approves Industrial Design Review 2007-02.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

GENERAL CONDITIONS
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and
hold harmless the City, its Officials, Officers, Employees, and Agents from any
claim, action, or proceeding against the City, its Officials, Officers, Employees, or
Agents to attach, set aside, void, or annul an approval of the City, its advisory
agencies, appeal boards, or legislative body concerning the project attached
hereto.
2. The decision of the Planning Commission shall be final fifteen (15) days from the
date of the decision, unless an appeal has been filed with the City Council
pursuant to the provisions of Chapter 17.80 of the Lake Elsinore Municipal Code.
PLANNING DIVISION
3. Applicant shall place a weatherproof 3' x 3' sign at the entrance to the project site
identifying the approved days and hours of construction activity and a statement
that complaints regarding the operation can be lodged with the City of Lake
Elsinore Code Enforcement Division at (951) 674-3124. The sign shall be
installed prior to the issuance of a grading permit.
4. All Conditions of Approval shall be reproduced upon page one of building plans
submitted to the Building and Safety Division for Plan Check.
5. Prior to issuance of any grading or building permits, the Applicant shall sign and
complete an "Acknowledgement of Conditions," and shall return the executed
original to the Community Development Department for inclusion in the case
records.
6. The Applicant shall comply with all requirements of the City's Grading Ordinance.
Construction generated dust and erosion shall be mitigated in accordance with
the provisions of Lake Elsinore Municipal Code Chapter 15.72 and using
accepted control techniques. Interim erosion control measures shall be provided
thirty (30) days after the site's rough grading, as approved by the City Engineer.

7. The Applicant shall comply with the City's Noise Ordinance (Chapter 17.78).
Notwithstanding the foregoing, with regard to hours of operation, construction
activity shall be limited to the hours of 7:00 AM to 5:00 PM, Monday through
Friday, and no construction activity shall occur on Saturdays, Sundays or legal
holidays.
8. The proposed location of onsite construction trailers shall be approved by the
Community Development Director or Designee. A cash bond of $1,000.00 shall
be required for any construction trailers placed on the site and used during
construction. Bonds will be released after removal of trailers and restoration of
the site to an acceptable state, subject to the approval of the Community
Development Director or Designee.
9. The Applicant shall comply with all applicable City codes and ordinances.
Conditional Use Permit No. 2008-05:
10. The Conditional Use Permit shall comply with all applicable requirements of Title
17 of the Lake Elsinore Municipal Code, unless modified by approved Conditions
of Approval.
11. The Conditional Use Permit granted herein shall run with the land and shall
continue to be valid upon a change of ownership of the site or structure which
was the subject of this approval.
12. All outdoor storage areas shall be enclosed on all sides with a screen a minimum
of six feet (6') in height as measured from the highest grade elevation either side
of the screen. The screen shall be decorative, solid masonry wall. Gates shall
be six feet (6') opaque material.
13. No material shall be stored higher than the screen.
14. Storage areas shall not encroach upon parking, landscaping, drive aisles,
required truck loading areas or required yard areas.
15. No storage of scrap, waste or other material not utilized in the production process
is permitted.
Industrial Design Review No. 2007-02:
16.Approval for Industrial Design Review No. 2007-02 will lapse and be void unless
building permits are issued within one (1) year following the date of approval.
17. Unless specifically provided otherwise in these conditions, any alteration or
expansion of a project for which there has been a "Design Review" approval as
well as all applications for modification or other change in the conditions of
approval of a "Design Review" shall be applied for in accordance with the
provisions of Section 17.82.120.

18. No structure which has received a "Design Review" or "Minor Design Review"
approval shall be occupied or used in any manner or receive a Certificate of
Occupancy until the Director of Community Development has determined that all
Conditions of Approval have been complied with.
19.AII site improvements approved with this request shall be constructed as
indicated on the approved site plan and elevations. Revisions to approved site
plans or building elevations shall be subject to the review of the Community
Development Director.
20. Plan Check shall conform to the submitted plans as modified by Conditions of
Approval, or the Planning Commission/City Council through subsequent action.
21.AII roof mounted or ground support air conditioning units or other mechanical
equipment incidental to development shall be architecturally screened or
shielded by landscaping so that they are not visible from neighboring property or
public streets. Any material covering the roof equipment shall match the primary
wall color.
22. Prior to issuance of a Certificate of Occupancy for any building onsite, a Uniform
Sign Program shall be submitted for review and approval by the Planning
Commission.
23. Applicant shall comply with all ADA (Americans with Disabilities Act)
requirements.
24. Covered trash enclosures shall be constructed per City standards as approved
by the Community Development Director or Designee. Details of the covered
trash enclosure shall be included in the Plan Check submittal package. The
covered trash enclosure shall be constructed prior to issuance of Certificate of
Occupancy.
25. No exterior roof ladders shall be permitted.
26.AII exterior downspouts shall be concealed within the buildings.
27. Materials and colors depicted on the plans and materials board shall be used
unless modified by the Director of Community Development or Designee.
28. Parking stalls shall be double-striped with four-inch (4") lines two feet (2') apart.
29.AII exposed slopes in excess of three feet (3') in height shall have permanent
irrigation system and erosion control vegetation installed and approved by the
Planning Division.
30. On-site surface drainage shall not cross sidewalks.

Prior to Issuance of Building/Grading Permit:
32. Prior to issuance of Building Permit, the Applicant shall submit a photometric
study to the Community Development Department for review and approval. The
study shall show locations of all exterior lighting fixtures and shall verify that a
minimum 1-foot candle of illumination is achieved throughout the onsite parking
area. Moreover, the study shall demonstrate that a minimum of 5-foot candles
are achieved at building entrances.
33. All exterior wall mounted and freestanding light fixtures shall be submitted for
review and approval by the Director of Community Development. Light fixtures
shall compliment the architectural style of the buildings onsite.
34. Exterior security lighting shall be shielded and directed on-site so as not to create
glare onto neighboring properties. The proposed light fixtures shall compliment
the building architecture and shall be reviewed and approved by the Director of
Community Development or Designee.
35. The color, finish and pattern of all decorative paving onsite shall be submitted for
review and approval by the Director of Community Development.
36. Three (3) sets of the Final Landscaping/Irrigation Detail Plan shall be submitted,
reviewed and approved by the City's Landscape Architect Consultant and the
Community Development Director or Designee. A Landscape Plan Check &
Inspection Fee will be charged prior to final landscape approval.
a. All planting areas shall have permanent and automatic sprinkler
system with 100% plant and ground cover coverage using a
combination of drip and conventional irrigation methods.
b. All planting areas shall be separated from paved areas with a six inch
(6") high and six inch (6") wide concrete curb.
c. Plantings within fifteen feet (15') of ingress/egress points shall be no
higher than thirty-six inches (36").
d. Any ground mounted transformers and mechanical or electrical
equipment shall be indicated on landscape plan and screened as part
of the landscaping plan.
e. Shrubs and vines shall be planted around the onsite trash enclosures
to soften the structures.
f. Final landscape plans shall include planting and irrigation details and
shall include all tree and shrub container sizes to be reviewed and
approved by the City's landscape architect consultant.
g. The landscape plan shall provide for ground cover, shrubs, and trees
and meet all requirements of the City's adopted Landscape Guidelines.

Special attention to the use of Xeriscape or drought resistant plantings
with combination drip irrigation system to be used to prevent excessive
watering.
h. A Landscape Maintenance Bond shall be provided prior to issuance of
Certificate of Occupancy. The bond shall cover ten percent (10%) of
the total cost of landscaping improvements onsite. Release of the bond
shall be requested by the Applicant at the end of the required one year
maintenance period subject to the approval of the City's Landscape
Architect Consultant and Community Development Director or
Designee.
i. All landscaping and irrigation shall be installed within affected portion
of any phase at the time a Certificate of Occupancy is requested for
any building. Final landscape plan must be consistent with approved
site plan.
j. One twenty-four inch (24") box size tree shall be installed for every
thirty-linear feet (30') of street frontage, selected from the approved
City street tree list.
37. Prior to issuance of building permits, the Applicant shall provide assurance that
all required fees to the Lake Elsinore Unified School District have been paid.
38. Prior to issuance of building permits, the Applicant shall provide assurance that
the Public Building Impact Fee has been paid.
39. Prior to issuance of building permits, the Applicant shall provide assurance that
the Library Capital Improvement Fund fee has been paid.
40. Prior to issuance of building permits, the Applicant shall provide assurance that
all Multiple Species Habitat Conservation Plan fees have been paid.
41. Prior to issuance of building permits, the Applicant shall provide evidence that all
Riverside County Fire Department standards and requirements have been
complied with.
ENGINEERING DIVISION
42. All Public Works requirements shall be complied with as a condition of
development as specified in the Lake Elsinore Municipal Code (LEMC) prior to
Certificate of Occupancy approval.
43. Pay all Capital Improvement and Plan Check fees (LEMC 16.34, Resolution 85-
26) at the time of plan check submittal.
44. Pay all development fees including TIF, TUMF and Area Drainage. The amount
of the fees shall be paid at the current rate at the time of payment.

45. Submit a "Will Serve" letter to the City Engineering Division from the applicable
water agency stating that water and sewer arrangements have been made for
this project. This letter shall be submitted prior to issuance of Building Permit.

12.04) Plans must be approved and signed by the City Engineer prior to
construction. Construction shall be completed prior to Certificate of Occupancy
approval.
47.Street improvement plans and specifications shall be prepared by a Calif.
Registered Civil Engineer. Improvements shall be designed and constructed to
City of Lake Elsinore Standards. Engineering Staff shall review requests for the
use of Riverside County Road Department Standards, latest edition.
48. Applicant shall enter into an agreement with the City for the construction of public
works improvements and shall post the appropriate bonds prior to
commencement of work.
49. Roadway design grade for local streets should not exceed 9%. The maximum
grade of 15% shall be submitted to the City Engineer for approval.
50. Interior streets shall be designed with 9% as the desired grade and intersecting
streets shall meet at a maximum grade of 6 % for a distance of 50-feet for each
leg of the intersection.
51. Pay all fees and meet requirements of encroachment permit issued by the
Engineering Division for construction of improvements within the City of Lake
Elsinore right-of-way.
52. All compaction reports, grade certifications, monument certifications (with tie
notes delineated on 8 %" x 11" Mylar) shall be submitted to the Engineering
Division before final inspection of public works improvements is scheduled.
53. The applicant shall install 2 permanent bench marks to Riverside County
Standards, one on the centerline at the intersection of 3rd Street and Pasadena
Street and one on the centerline at the intersection of the project's main entry
onto Chaney Street and Chaney Street.
54. Applicant shall obtain all necessary off-site easements for off-site grading from
the adjacent property owners prior to issuance of grading permit if applicable.
55. Arrangements for relocation of utility company facilities (power poles, vaults, etc.)
out of the roadway or away from an access point shall be the responsibility of the
property owner or his agent.
56. Provide fire protection facilities as required in writing by Riverside County Fire.

57. Provide street lighting and show lighting improvements as part of street
improvement plans. Street lights shall be constructed in accordance with the City
Standard street light spacing.
58. In accordance with Project phasing plan, submit a traffic control plan showing all
permanent traffic control devices for both on site and offsite improvements which
shall be approved prior to occupancy of corresponding Project phase. All traffic
control devices and signing and striping shall be installed prior to issuance of the
Certificate of Occupancy for corresponding phase.
59.AII improvement plans shall be digitized. At Certificate of Occupancy applicant
shall submit tapes and/or discs which are compatible with City's ARC Info/GIS or
developer to pay $300 per sheet for City digitizing.
60.AII utilities except electrical over 12 kv shall be placed underground, as approved
by the serving utility.
61.Apply and obtain a grading permit with appropriate security prior to building
permit issuance. A grading plan signed and stamped by a Calif. Registered Civil
Engineer shall be required if the grading exceeds 50 cubic yards or the existing
flow pattern is substantially modified as determined by the City Engineer. If the
grading is less than 50 cubic yards and a grading plan is not required, a grading
permit shall still be obtained so that a cursory drainage and flow pattern
inspection can be conducted before grading begins.
62. Provide soils, geology and seismic report including street design
recommendations. Provide final soils report showing compliance with
recommendations.
63.An Alquist-Priolo study shall be performed on the site to identify any hidden
earthquake faults and/or liquefaction zones present on-site.
64.AII grading shall be done under the supervision of a geotechnical engineer and
he shall certify all slopes steeper than 2 to 1 for stability and proper erosion
control. All manufactured slopes greater than 30 ft. in height shall be contoured.
65. Prior to commencement of grading operations, applicant to provide to the City
with a map of all proposed haul routes to be used for movement of export
material. Such routes shall be subject to the review and approval of the City
Engineer.
66. Applicant to provide to the City a photographic baseline record of the condition of
all proposed public City haul roads. In the event of damage to such roads,
applicant shall pay full cost of restoring public roads to the baseline condition. A
bond may be required to ensure payment of damages to the public right-of-way,
subject to the approval of the City Engineer.

67. Project drainage shall be conveyed to a public facility or accepted by adjacent
property owners by a letter of drainage acceptance or conveyed to a drainage
easement.
68.AII natural drainage traversing site shall be conveyed through the site, or shall be
collected and conveyed by a method approved by the City Engineer.
69. On-site drainage facilities conveying off site drainage shall be contained within
drainage easements shown on the final map. A note should be added to the final
map stating: "Drainage easements shall be kept free of buildings and
obstructions" .
70. Submit Hydrology and Hydraulic Reports for review and approval by City
Engineer prior to issuance of Building Permit. Developer shall mitigate any
flooding and/or erosion caused by development of site and diversion of drainage.
71.AII drainage facilities in this tract shall be constructed to Riverside County Flood
Control District Standards.
72. Provide a detention facility sized to hold the increase in storm water runoff.
73. Storm drain inlet facilities shall be appropriately stenciled to prevent illegally
dumping in the drain system, the wording and stencil shall be consistent with the
NPDES program permit and approved by the City Engineer.
74. A drainage acceptance letter shall be required from the downstream property
owners for out-letting the proposed stormwater run-off on private property.
75. The Applicant shall be responsible for all Master Planned Drainage fees and will
receive credit for all Master Planned Drainage facilities constructed.
76. Provide Tract Phasing Plan for the City Engineer's approval.
77. Submit Faithful Performance and Labor and Materials Bonds for all public
improvements for each Phase as approved by the City Engineer.
78.Applicant will be required to install erosion control measures using the best
available technology to mitigate any urban pollutants from entering the
watershed.
79.Applicant shall provide the City with proof of his having filed a Notice of Intent
(NOI) with the Regional Water Quality Control Board for the National Pollutant
Discharge Elimination System (NPDES) program with a storm water pollution
prevention plan prior to issuance of grading permits.
80.Applicant shall obtain approval from Santa Ana Regional Water Quality Control
Board for their storm water pollution prevention plan (SWPPP) including approval
of erosion control for the grading plan prior to issuance of grading permits. The

construction which describes BMP's that will be implemented for the
development and including maintenance responsibilities.
81. Education guidelines and Best Management Practices (BMP) shall be provided
to residents of the development in the use of herbicides, pesticides, fertilizers as
well as other environmental awareness education materials on good
housekeeping practices that contribute to protection of stormwater quality and
met the goals of the BMP in Supplement "A" in the Riverside County NPDES
Drainage Area Management Plan.
82.Applicant shall provide first flush BMP's using the best available technology that
will reduce storm water pollutants from parking areas and driveway aisles.
83. Intersection site distance shall meet the design criteria of the CAL TRANS Design
Manual (particular attention should be taken for intersections on the inside of
curves). If site distance can be obstructed, a special limited use easement must
be recorded to limit the slope, type of landscaping and wall placement.
84.ln accordance with the Project phasing plan, dedicate and improve full half width
street right-of-way and street section on Pasadena Street for the full project
frontage. Right-of-way dedication and street improvements shall be consistent
with the General Plan Circulation Element.
85. Provide construction improvements along Hunco Way extending from the
existing improvement area to the future Pasadena Street. Improvements shall
include asphalt repairs to the existing section of Hunco Way, finish paving of the
existing Hunco Way and completed roadway construction of Hunco Way and
Pasadena. Design and construction shall be completed to issuance of first
occupancy.
86.Applicant shall dedicate right-of-way and improve the intersection of Pasadena
Street and Hunco Way such that both corners of this intersection are completed.
These improvements as well as the configuration of the access from this corner
onto the property shall be approved by the City Engineer.
87. Install a street light at the new southeast corner of Hunco Way and Pasadena.
88. Applicant shall cause to be recorded a CC&R's with recordation of irrevocable
reciprocal parking, circulation, and loading as approved by the City attorney and
City Engineer.
89. Provide reciprocal access and parking easements over buildings 'G' and 'H'.
90.ln accordance with the City's Franchise Agreement for waste disposal &
recycling, the applicant shall be required to contract with CR&R Inc. for removal
and disposal of all waste material, debris, vegetation and other rubbish
generated during cleaning, demolition, clear and grubbing or all other phases of

General Conditions
With respect to the conditions of approval for the referenced project, the Fire
Department recommends the following fire protection measures be provided in
accordance with Riverside County Ordinances and/or recognize fire protection
standards:
THESE CONDITIONS ARE FOR A SHELL BUILDING ONLY.
Shell building will receive a shell final only. No Certificate of Occupancy (human
occupant and/or materials) will be issued until the building occupant has been
identified with their occupancy classification and have been conditioned by Lake
Elsinore Fire Services. Occupant or tenant identification is imperative for orderly
and prompt processing. Upon identification of the occupant or tenant a Fire
Protection Analysis report maybe required prior to establishing the requirements for
the occupancy permit. Failure to provide a comprehensive data analysis and/ or
technical information acceptable to the Fire Department may result in project delays.
A complete commodity listing disclosing type, quantity, level of hazard and potential
for "Reactivity" must be provided. The forgoing is necessary to properly classify the
building (s). Failure to provide comprehensive data and/or high technical information,
will result in project delay and requirement for a complete Fire Protection study for
review.
HIGH PILE/RACK STORAGE
A separate permit may be required for high-pile storage and/or racks. Sprinkler
plans and/or sprinkler review must be submitted by a licensed sprinkler contractor
with storage and/or rack plans to Lake Elsinore Fire Services for review and
approval of the 2007 CFC Article 32 compliance. Complete Article 32 information re:
all commodities stored, rack dimensions, placement in building, sprinkler densities,
etc. must be provided with suppression system for racks and/or high-pile storage
review. A complete listing of commodities, classified using CFC Article 32,2007
Edition and NFPA 13, 2002 Edition guidelines by a licensed Fire Protection Engineer
(or other consultant approved by this jurisdiction). (Current plan check fee is
$348.00)
ROOFING MATERIAL
All buildings shall be constructed with class B roofing materials as per the California
Building Code.

Blue retro reflective pavement markers shall be mounted on private street, public
streets and driveways to indicate location of fire hydrants. Prior to installation,
placement of markers must be approved by Lake Elsinore Fire Services.
MIN REQ FIRE FLOW
Minimum required fire flow shall be 3125 GPM for 4 hour duration at 20 PSI residual
operating pressure, which must be available before any combustible material is
placed on the job site. Fire flow is based on type V-B construction per the 2007 CBC
and building(s) having a fire sprinkler system.
ON/OFF LOOPED HYD
A combination of on-site and off site super fire hydrants, on a looped system with the
average spacing between Super fire hydrant (s) (6" x 4" x 2 %" x 2 % ") shall be not
exceed 350 feet between hydrants and have a maximum distance of 210 feet from
any point on the street or road frontage to a hydrant as measured along approved
vehicular travel ways. The required fire flow shall be available from any adjacent
hydrants (s) in the system.
RAPID HAZMAT BOX
Rapid entry Hazardous Material data and key storage cabinet shall be installed on
outside of the building. Plans shall be submitted to the Lake Elsinore Fire Services
for approval prior to installation (Current plan check fee is $126.00)
AUTO/MAN GATES
Gate (s) shall be automatic or manual operated, minimum 24 feet width, with a
setback of 35 feet from face of curb/flow line. Gate access shall be equipped with a
rapid entry system. Plans shall be submitted to the Fire Department for approval
prior to installation. Automatic/manual gate pins shall be rated with shear pin force,
not to exceed 30 foot pounds. Automatic gates shall be equipped with emergency
backup power. Gates activated by the rapid entry system shall remain open until
closed by the rapid entry system. (Current plan check fee is $126.00)
WATER PLANS
The applicant or developer shall separately submit two copies of the water system
plans to the Fire Department for review. Plans shall conform to the fire hydrant
types, location and spacing, and the system shall meet the fire flow requirements.
Plans shall be signed/approved by a registered civil engineer and the local water
company with the following certification: "l certify that the design of the water system
is in accordance with the requirements prescribed by the Lake Elsinore Fire
Services."

BUILDING PLAN CHECK
Building plan check deposit fee of $1,056.00, shall be paid in a check or money
order to the City of Lake Elsinore before plans have been approved by our office.
WATER CERTIFICATION
The applicant or developer shall be responsible to submit written certification from
the water company noting the location of the existing fire hydrant and that the
existing water system is capable of delivering 3125 GPM fire flow for a 4 hour
duration at 20 PSI residual operating pressure. If a water system currently does not
exist, the applicant or developer shall be responsible to provide written certification
that financial arrangements have been made to provide them.
WATER PLANS
The applicants or developer shall separately submit two copies of the water system
plans to the Fire Department for review and approval. Calculated velocities shall not
exceed 100 feet per second. Plans shall conform to the fire hydrant types, location
and spacing, and the system shall meet the fire flow requirements. Plans shall be

PRIOR TO BUILDING FINAL INSPECTION

system for seismic and gravity loads to support the sprinkler system. All fire
sprinkler risers shall be protected from any physical damage. The post indicator
valve and fire department connection shall be located to the front, within 50 feet of a
hydrant, and the minimum of 25 feet from the building (s). A statement that the
building (s) will be automatically fire sprinkled must be included on the title page of
the building plans. (Current sprinkler plan check fee is $614.00 per riser)
Applicant or developer shall be responsible to install a .L. Central Station Monitored
Fire Alarm System. Monitoring System shall monitor the fire Sprinkler system (s)
water flow, P.I.V.'s and all control valves. Plans must be submitted to the Fire
Department for approval prior to installation. Contact Fire Department for guideline
handout (current monitoring plan check fee is $192.00)
EXTINGUISHERS
Install portable fire extinguishers with a minimum rating of 2A-10BC and signage.
Fire Extinguishers located in public areas shall be in a recessed cabinet mounted
48" (Inches) to enter above the floor level with Maximum 4" projection from the wall.
Contact Fire Department for proper placement of equipment prior to installation.

PROJECT REQUEST
The applicant is requesting Conditional Use Permit (No. 2008-04), and Industrial Design
Review (No. 2007-01) approval to construct a new 46,982 square foot concrete tilt up
industrial building on 3.03 acres of land. Review is pursuant to the East Lake Specific
Plan and the applicable Chapters of the Lake Elsinore Municipal Code (LEMC).
PROJECT LOCATION
The 3.03-acre project site is located on the west side of Corydon Street, between
Palomar Road and Como Street (APN: 370-120-060), within the East Lake Specific
Plan.
ENVIRONMENTAL SETTING
The site is bounded on the west and north by existing industrial buildings and vacant
industrial land. A mobile home park to the south, and residential land to the east (within
the County of Riverside Wildomar Area).

PROJECT BACKGROUND
The properties to the northeast are presently developed with two (68,990 square foot and
77,820 square foot) warehouse/manufacturing/metal buildings, and associated parking
facilities and site improvements. These particular buildings were approved by the City
Council in March, 1994 and July, 2004, respectively. The original building (March, 1994)
was constructed under a Community Development Block Grant loan program for flood
reconstruction as a result of the 1980 floods.
The applicant is now requesting approval of a 46,982 square foot warehouse/concrete
tilt up industrial building on the front 3.03 acre parcel of land located adjacent to
Corydon Road.
PROJECT DESCRIPTION
CONDITIONAL USE PERMIT NO. 2008-04
Pursuant to Section 7.5.5(b) of the East Lake Specific Plan, the applicant is requesting
a Conditional Use Permit for the establishment of an industrial use within the Airport
Use Area (AUA). As allowed in the Lake Elsinore Municipal Code (LEMC), the Planning
Commission is empowered to grant and deny applications for Conditional Use Permits
and to impose reasonable conditions upon the granting of Conditional Use Permits.
INDUSTRIAL DESIGN REVIEW No. 2007-01
Site Plan
The applicant is proposing to construct a concrete (tilt-up) building totaling 46,982
square feet. The total land area is 131,987 square feet or 3.03 acres. The building will
occupy approximately thirty eight percent (38%) of the total site area which complies
with the City of Lake Elsinore's General Plan which allows a maximum of (AO) floor
area ratio (FAR) or building coverage per parcel.

Circulation and Parkina Space Lavout
Main access to the site will be taken from two (2) driveways proposed along Corydon
Road. One hundred and nine (109) parking spaces will be provided, including five (5)
handicap spaces. Customer parking spaces are planned for the front of the building
(adjacent to Corydon Road), and employee parking will be provided at the rear portion
of the site. The applicant is also providing an outdoor employee break area with seating
tables and benches at the rear portion of the building. Loading spaces are identified at
the mid point of the east elevation and at the northwest corner of the west elevation.
Landscapina
The applicant is proposing to provide landscaping on eighteen percent (18%) of the
project site. This exceeds the minimum landscaping coverage requirement of twelve
percent (12%) per the Lake Elsinore Municipal Code (LEMC). A minimum of five
percent (5%) of the landscaping will be located within the parking and driveway areas
per Section 17.66.100.0 of the LEMC. The landscape plan includes a "modern" design
with drought tolerant material. Much thought has been given to the landscape design
and theme which includes a drainage system complimentary of the existing drainage
pattern traversing the site from Corydon Road.
Architecture/Colors and Materials
The applicant is proposing to construct a single-level pre-cast concrete (tilt-up) building
totaling 46,982 square feet (with 3,000 square feet identified for office space, and
43,982 square feet proposed as warehouse area). In addition, twelve foot high (12') roll-
up doors are proposed at the southeast and northwest corners of the building,
respectively. Standard sized loading spaces (Type C - 12' x 55'), designated for
loading purposes only, will be provided along the east and west building elevations.
The applicant is proposing to construct a rectangular shaped building, typical of the
neighboring industrial complexes. The building will include a pop-out front entrance for
visual relief and shadowing at the central portion of the front elevation (fronting Corydon
Road). In addition, pop-out tower elements are proposed at the corners of the building's
front elevation.
The building will include 24" x 24" ceramic accent tiles, and decorative painted accent
bands to add architectural interest and detail. The decorative painted bands are
identified along the middle and top portion of the building, below the proposed roof-line.
The roof line of the pop-out elements are approximately two and a half feet higher than
the main building roof line, providing articulation and variation to an otherwise straight or
flat roof line.

Finish materials for the building exteriors include color treatments as well as score lines
to create horizontal and vertical visual interest. The proposed building will incorporate
storefront windows and anodized aluminum frames. The maximum building height is
thirty five feet (35')(with a maximum of 37.5 feet at the pop out elements), compatible to
adjacent industrial buildings.

ANAL YSIS
This industrial/warehouse complex has the potential of creating the need for additional
employment. The proposed industrial/warehouse complex has been found in
conformance with all applicable development standards of the AUA (Airport Use Area)
District of the East Lake Specific Plan. In addition, the project has been designed with
enhanced architectural characteristics such as raised parapets, varying color treatments
and materials, and wall breaks to create interesting building elevations. Staff believes
that the proposed project will compliment the existing development in the surrounding
area.
ENVIRONMENTAL DETERMINATION
Pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code SS 21000 et
seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. SS 15000 et seq.), this project has
been reviewed and found consistent with the East Lake Specific Plan and
Environmental Impact Report.
RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution No. 2008-_
approving Conditional Use Permit No. 2008-04, and adopt Resolution No. 2008-_
recommending to the City Council approval of Industrial Design Review No. 2007-01.
This recommendation is based on the Findings, Exhibits, and attached Conditions of
Approval.

FINDINGS THAT THE PROJECT KNOWN AS INDUSTRIAL PROJECT
NO. 2007-01 IS CONSISTENT WITH THE WESTERN RIVERSIDE
MULTIPLE SPECIES HABITAT CONSERVATION PLAN
WHEREAS, an application has been filed with the City of Lake Elsinore by
Norman Brody, to request a Design Review of Industrial Project No. 2007-01 for a
single-level industrial building totaling 46,982 square feet on 3.03 acres of vacant land
("the Industrial Design Review"), which will be located at the west side of Corydon
Street between Palomar Road and Como Street (the "Site"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of reviewing and making recommendations to the City
Council for Design Review of industrial projects; and
WHEREAS, the Western Riverside Multiple Species Habitat Conservation Plan
(the "MSHCP") requires that the City of Lake Elsinore adopt consistency findings
demonstrating that the proposed development is consistent with the MSHCP criteria
and the MSHCP goals and objectives; and
WHEREAS, action taken by the Planning Commission and City Council with
regard to the industrial design review is a discretionary actions subject to the MSHCP;
and
WHEREAS, pursuant to the California Environmental Quality Act (Cal. Pub. Res.
Code 99 21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. 99 15000 et
seq.), this project was reviewed and found consistent with the East Lake Specific Plan
and Environmental Impact Report; and
WHEREAS, public notice of the Project has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on March 4, 2008.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the Project's
consistency with the MSHCP prior to recommending that the City Council adopt
Findings of Consistency with the MSHCP.
SECTION 2. That in accordance with the MSHCP, the Planning Commission
makes the following MSHCP Consistency Findings:

1. The Project is a project under the City's MSHCP Implementing
Resolution, and the City must make an MSHCP Consistency finding before
approving the Project.
Pursuant to the City's MSHCP Implementing Resolution, prior to approving any
discretionary entitlement, the City is required to review the Project to ensure
consistency with the MSHCP criteria and other "Plan Wide Requirements." The Project,
as proposed, is not located within an MSHCP criteria area.
The Project was reviewed and found consistent with the fol/owing "Plan Wide
Requirements": Protection of Species Associated with Riparian/Riverine Areas and
Vernal Pool Guidelines (MSHCP & 6.1.2), Protection of Narrow Endemic Species
(MSHCP & 6.1.3), Urban/Wildlands Interface Guidelines (MSHCP & 6.1.4), Vegetation
Mapping (MSHCP & 6.3.1), Additional Survey Needs and Procedures (MSHCP & 6.3.2),
Fuels Management (MSHCP & 6.4), and payment of the MSHCP Local Development
Mitigation Fee (MSHCP Ordinance & 4.0).
2. The Project is subject to the City's lake Elsinore Acquisition
Process (lEAP) and the County's Joint Project Review processes.
The Project Site is within the Elsinore Area Plan, but is not located within a Criteria Cel/.
As such, the Joint Project Review process was not required.
3. The Project is consistent with the RiparianlRiverine Areas and Vernal
Pools Guidelines.
Section 6. 1.2 of the MSHCP focuses on protection of riparian/riverine areas and vernal
pool habitat types based upon their value in the conservation of a number of MSHCP
covered species. The site is highly disturbed and denuded of aI/ vegetation. The site
has previously been used for the stockpiling of fill. As such, there are no impacts to
riparian/riverine areas, vernal pools or fairy shrimp. The Project is therefore consistent
with Section 6.1.2 of the MSHCP.
4. The Project is consistent with the Protection of Narrow Endemic
Plant Species Guidelines.
The Project is located in a Narrow Endemic Plant Species Survey Area as mapped in
Section 6. 1.3 of the MSHCP. The site is highly disturbed and denuded of aI/ vegetation,
and has previously been used for the stockpiling of fill. There is no suitable habitat
present on the project site for Narrow Endemic Plant Species. As such, the Project is
therefore consistent with Section 6.1.3 of the MSHCP.

5. The Project is consistent with the Additional Survey Needs and
Procedures.
The Project is located within the Burrowing Owl survey area as identified in Section
6.3.2 Additional Survey Needs and Procedures of the MSHCP. The site is highly
disturbed and denuded of all vegetation, and has previously been used for the
stockpiling of fill. There is no suitable habitat present on the project site for Burrowing
Owl. As such, the Project is consistent with Section 6.3.2 of the MSHCP.
6. The Project is consistent with the UrbanlWildlands Interface
Guidelines.
The Project Site is not within an MSHCP Criteria Cell and does not abut any areas
proposed for conservation. However, the Project has minimized potential indirect
impacts using Best Management Practices and has precluded planting of highly
invasive weedy species within project boundaries. As such, the Project is consistent
with Section 6.1.4 of the MSHCP.
7. The Project is consistent with the Vegetation Mapping requirements.
The Project Site is not within a MSHCP Criteria Cell and is not located within areas that
require mapping of vegetation. As such, the Project is consistent with the MSHCP
Section 6.3.1 Vegetation Mapping requirements.
8. The Project is consistent with the Fuels Management Guidelines.
The Fuels Management Guidelines presented in Section 6.4 of the MSHCP are
intended to address brush management activities around new development within or
adjacent to the MSHCP Conservation Area. The Project Site is not in a Criteria Cell and
does not abut any areas proposed for conservation. As such, the Project is consistent
with the Fuels Management Guidelines.
9. The Project will be conditioned to pay the City's MSHCP Local
Development Mitigation Fee.
As a condition of approval, the Project will be required to pay the City's MSHCP Local
Development Mitigation Fee at the time of issuance of building permits.
10. The Project is consistent with the MSHCP.
For the foregoing reasons, the Project is consistent with the MSHCP.
SECTION 3. Based upon all of the evidence presented, and the above findings,
the Planning Commission hereby recommends the City Council of the City of Lake
Elsinore adopt findings that the Project is consistent with the MSHCP.

SECTION 2. The Planning Commission hereby finds and determines that the
Project is found consistent with the East Lake Specific Plan and Environmental Impact
Report pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code 99
21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. 99 15000 et seq.).
SECTION 3. That in accordance with Lake Elsinore Municipal Code Chapter
17.74, the Planning Commission makes the following findings for the approval of
Conditional Use Permit 2008-04:
1. The proposed use, on its own merits and within the context of its setting, is in accord
with the objectives of the General Plan, the East Lake Specific Plan, and the
purpose of the planning district in which the site is located.
In order to achieve a well balanced and functional mix of residential, commercial,
industrial, open space, recreational and institutional land uses, staff has thoroughly

evaluated the land use compatibility, noise, traffic and other environmental hazards
related to the proposed Conditional Use Permit for an industrial warehouse located
on the west side of Corydon Street between Palomar Road and Como Street.
Accordingly, the proposed land use complies with the objectives of the General Plan,
the East Lake Specific Plan and the purpose of the planning district in which the site
is located.
2. The proposed use will not be detrimental to the general health, safety, comfort, or
welfare of persons residing or working within the neighborhood of the proposed use
or the City, or injurious to property or improvements in the neighborhood or the City.
In accord with the purposes of the Chapter 17.74 (Conditional Use Permits) of the
Lake Elsinore Municipal Code, the City realized that the proposed industrial
warehouse located on the west side of Corydon Street between Palomar Road and
Como Street may have potential to negatively impact the welfare of persons residing
or working within the neighborhood or the City. Considering this, staff has
substantiated that all applicable City Departments and Agencies have been afforded
the opportunity for a thorough review of the use and have incorporated all applicable
comments and/or conditions related to installation and maintenance of landscaping,
street dedications, regulations of points of vehicular ingress and egress and control
of potential nuisances, so as to eliminate any negative impacts to the general health,
safety, comfort, or general welfare of the surrounding neighborhood or the City.
3. The site for the intended use is adequate in size and shape to accommodate the
use, and for all the yards, setbacks, walls or fences, landscaping, buffers and other
features required.
The proposed industrial warehouse located on the west side of Corydon Street
between Palomar Road and Como Street has been designed in consideration of the
size and shape of the property, thereby strengthening and enhancing the immediate
Airport Use Area of the East Lake Specific Plan. Further, the project as proposed,
will complement the quality of existing development and will create a visually
pleasing, non-detractive relationship between the proposed and existing projects, in
that the industrial warehouse use has been reviewed to ensure adequate provision
of screening from the public rights-of-way or adjacent properties.
4. The site for the proposed use relates to streets and highways with proper design
both as to width and type of pavement to carry the type and quantity of traffic
generated by the subject use.
The proposed industrial warehouse located on the west side of Corydon Street
between Palomar Road and Como Street has been reviewed as to its relation to the
width and type of pavement needed to carry the type and quantity of traffic
generated, in that the City has adequately evaluated the potential impacts
associated with the proposed industrial warehouse use prior to its approval and has
conditioned the project to be served by roads of adequate capacity and design
standards to provide reasonable access.

5. The project complies with the design directives contained in Section 17.82.060 and
all other applicable provisions of the Municipal Code.
The proposed use has been thoroughly reviewed and conditioned by all applicable
City Departments and outside Agencies, eliminating the potential for any and all
adverse effects on the abutting property. In addition, the proposed project complies
with the goals and objectives of the General Plan, and the East Lake Specific Plan in
that the approval of this industrial warehouse use will assist in achieving the
development of a well-balanced and functional mix of residential, commercial,
industrial, open space, recreational and institutional land uses as well as
encouraging industrial land uses to diversify Lake Elsinore's economic base.
6. Subject to the attached conditions of approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Notwithstanding the fact that the Project is exempt from CEQA pursuant to the
California Environmental Quality Act (Cal. Pub. Res. Code ~~ 21000 et seq.:
"CEQA') and the CEQA Guidelines (14 C.C.R. ~~ 15000 et seq.), this project has
been reviewed and found consistent with the East Lake Specific Plan and
Environmental Impact Report. The Project will not have a significant effect on the
environment.
7. Conditions and safeguards pursuant to Chapters 17.74.050 have been incorporated
into the approval of the Conditional Use Permit to ensure that the use continues in a
manner envisioned by these findings for the term of the use.
The City realizes that certain uses have operational characteristics that, depending
upon the location and design of the use, may have the potential to negatively impact
adjoining properties, businesses, or residents. Those types of uses therefore
require a more comprehensive review in order to mitigate any determined impact.
After extensive review of the Project it was determined that the conditions of
approval imposed upon the Project ensure that adjoining properties, businesses,
and residents will not be negatively impacted by the proposed project.
SECTION 4. Based upon all of the evidence considered, the above findings, and
the conditions of approval imposed upon the Project, the Planning Commission hereby
approves Conditional Use Permit 2008-04.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

APPROVAL OF DESIGN REVIEW FOR INDUSTRIAL PROJECT NO.
2007-01
WHEREAS, an application has been filed with the City of Lake Elsinore by
Norman Brody, to request a Design Review of Industrial Project No. 2007-01 for a
single-level industrial building totaling 46,982 square feet on 3.03 acres of vacant land
("the Industrial Design Review"), which will be located at the west side of Corydon
Street between Palomar Road and Como Street at APN 370-120-060 (the "Site"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of reviewing and making recommendations to the City
Council for Design Review of industrial projects; and
WHEREAS, public notice of the Industrial Design Review has been given, and
the Planning Commission has considered evidence presented by the Community
Development Department and other interested parties at a public hearing held with
respect to this item on March 4,2008.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed request
for Industrial Design Review No. 2007-01 prior to recommending approval to the City
Council. The Planning Commission finds and determines that the Industrial Design
Review request is consistent with the Lake Elsinore Municipal Code and the East Lake
Specific Plan.
SECTION 2. The Planning Commission hereby finds and determines that the Project
is found consistent with the East Lake Specific Plan and Environmental Impact Report
pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code 99 21000 et
seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. 99 15000 et seq.).
SECTION 3. That in accordance with Section 17.82 (Design Review) of the Lake
Elsinore Municipal Code, the Planning Commission makes the following findings for the
approval of Industrial Design Review No. 2007-01:
1. The project, as approved, will comply with the goals and objectives of the General
Plan, the East Lake Specific Plan, and the Zoning District in which the project is
located.

Airport Use Area designation in that the approval of this industrial warehouse
building will assist in achieving the development of a well-balanced and functional
mix of residential, commercial, industrial, open space, recreational and institutional
land uses as well as encouraging industrial land uses to diversify Lake Elsinore's
economic base.
2. The project complies with the design directives contained in Section 17.82.060 and
all other applicable provisions of the Municipal Code.
The proposed Industrial Design Review located at APN: 370-120-060 is appropriate
to the site and surrounding developments in that the proposed industrial warehouse
building has been designed in consideration of the size and shape of the property,
thereby creating interest and varying vistas as a person moves along the street.
Further the project as proposed will complement the quality of existing development
and will create a visually pleasing, non-detractive relationship between the proposed
and existing projects in that the architectural design, color and material and site
designs proposed evidence a concern for quality and originality.
3. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Notwithstanding the fact that the Project is exempt from CEQA pursuant to the
California Environmental Quality Act (Gal. Pub. Res. Code && 21000 et seq.:
"CEQA') and the CEQA Guidelines (14 C.C.R. && 15000 et seq.), this project has
been reviewed and found consistent with the East Lake Specific Plan and
Environmental Impact Report. The Project will not have a significant effect on the
environment.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of the
property in accordance with the objectives of Chapter 17.82.
Pursuant to Section 17.82.070 of the Lake Elsinore Municipal Code, the proposed
Industrial Design Review located on the west side of Corydon Street between
Palomar Road and Como Street, has been scheduled for review and consideration
by the Planning Commission.
SECTION 4. Based upon all of the evidence presented, the above findings, and
the conditions of approval imposed upon the Industrial Design Review, the Planning
Commission hereby recommends that the City Council approve Industrial Design
Review No. 2007-01.

GENERAL
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, and Agents from any claim, action,
or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set
aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or
legislative body concerning the project attached hereto.
PLANNING DIVISION
2. Design review approval for Industrial Project No. 2007-01 will lapse and be void unless
building permits are issued within one (1) year.
3. All Conditions of approval shall be reproduced on page one of building plans prior to their
acceptance by Building Division. All Conditions of Approval shall be met prior to the
issuance of a Certificate of Occupancy and release of utilities.
4. All site improvements approved with this request shall be constructed as indicated on the
approved site plan and elevations. Revisions to approved site plans or building elevations
shall be subject to the review of the Community Development Director. All plans
submitted for Building Division Plan Check shall conform with the submitted plans as
modified by Conditions of Approval, or the Planning Commission/City Council through
subsequent action.
5. Structures shall be placed on-site as depicted on the site plan and/or as modified by the
Community Development Director or designee.
6. Trash enclosures shall be constructed per City standards as approved by the Community
Development Director or designee, prior to issuance of building permit.
7. The Planning Division shall approve construction trailers utilized during construction. All
construction trailers shall require a $1,000.00 cash bond for each.
8. All roof mounted or ground support air conditioning units or other mechanical equipment
incidental to development shall be architecturally screened or shielded by landscaping so
that they are not visible from neighboring property or public streets. Any roof mounted
central swamp coolers shall also be screened, and screening plan shall be approved by
the Community Development Director, prior to issuance of building permit.
9. All loading zones shall be clearly marked with yellow striping and shall meet City
Standards for Type "C' loading zones (12' x 55').
10. Any alteration or expansion of this Design Review approval shall be reviewed according
to the provisions of Chapter 17.82 (Design Review) of the Lake Elsinore Municipal
Code.

11. Materials and colors depicted on the plans and materials board shall be used unless
modified by the Community Development Director or designee.
12.AII exterior on-site lighting shall be shielded and directed on-site so as not to create
glare onto neighboring property and streets or allow illumination above the horizontal
plane of the fixture. All light fixtures shall be consistent with the architectural style of the
building.
13. All exterior downspouts shall be concealed or architecturally screened and painted to
match the exterior color of the building as approved by the Community Development
Director or Designee.
14.AII building signage shall comply with the East lake Specific Plan and Chapter 17.94
(Signs - Advertising Structures) of the lake Elsinore Municipal Code (lEMC).
15.AII drive aisles and loading areas shall be kept and maintained free and clear of any
materials/merchandise so as not to obstruct on-site circulation and deliveries.
16. Parking stalls shall be double-striped with four-inch (4") lines two feet (2') apart.

planters (paver to include curb width).

PRIOR TO BUilDING/GRADING PERMITS
22. Prior to issuance of any grading permit or building permits, the applicant shall sign and
complete an "Acknowledgement of Conditions" form and shall return the executed
original to the Planning Division for inclusion in the case records.
23. Three (3) sets of the Final landscapingllrrigation Detail Plan shall be submitted,
reviewed and approved by the City's landscape Architect Consultant and the
Community Development Director or designee, prior to issuance of building permit. A
landscape Plan Check & Inspection Fee will be charged prior to final landscape
approval based on the Consultant's fee plus forty percent (40%) City fee.

a. All planting areas shall have permanent and automatic sprinkler system with
100% plant and grass coverage using a combination of drip and conventional
irrigation methods.
b. Applicant shall plant street trees selected from the City's Street Tree List, a
maximum of thirty feet (30') apart and at least twenty-four-inch (24") box in size.
c. All planting areas shall be separated from paved areas with a six inch (6") high
and six inch (6") wide concrete curb.
d. Planting within fifteen feet (15') of ingress/egress points shall be no higher than
thirty-six inches (36").
e. Landscape planters shall be planted with an appropriate parking lot shade tree
pursuant to the LEMC and Landscape Design Guidelines.
f. Any transformers and mechanical or electrical equipment shall be indicated on
landscape plan and screened as part of the landscaping plan.
g. The landscape plan shall provide for ground cover, shrubs, and trees and meet
all requirements of the City's adopted Landscape Guidelines. Special attention to
the use of Xeriscape or drought resistant plantings with combination drip
irrigation system to be used to prevent excessive watering.
h. All landscape improvements shall be bonded 100% for material and labor for two
years from installation sign-off by the City. Release of the landscaping bond
shall be requested by the applicant at the end of the required two years with
approval/acceptance by the Landscape Consultant and Community Development
Director or Designee.
I. All landscaping and irrigation shall be installed within affected portion of any
phase at the time a Certificate of Occupancy is requested for any building. All
planting areas shall include plantings in the Xeriscape concept, drought tolerant
grasses and plants.
J. Final landscape plan must be consistent with approved site plan.
k. Final landscape plans to include planting and irrigation details.
24.Applicant shall comply with the requirements of the Elsinore Valley Municipal Water
District. Proof shall be presented to the Chief Building Official prior to issuance of
building permits and final approval.

25. The Multiple Species Habitat Conservation Fee (MSHCP) will be due upon issuance of
each building permit.
26. Prior to issuance of building permits, applicant shall provide assurance that all required
fees to the Lake Elsinore Unified School District have been paid.
27. Prior to issuance of building permits, applicant shall provide assurance that all
requirements of the Riverside County Fire Department have been met.
28. Prior to issuance of building permits, applicant shall pay park-in-lieu fee in effect at time
of building permit issuance.
29. The applicant shall at all times comply with Section 17.78 (Noise Control) of the Lake
Elsinore Municipal Code.
30. The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project site
identifying the approved days and hours of construction activity (Le., 7:00 A.M. - 5:00
P.M., Monday through Friday with no construction activity to occur on Saturdays,
Sundays or legal holidays) and a statement that complaints regarding the operation can
be lodged with the City of Lake Elsinore Code Enforcement Division (951) 674-3124.
The sign shall be installed prior to the issuance of a grading permit.
ENGINEERING DIVISION
31.A grading plan signed and stamped by a Calif. Registered Civil Engineer shall be
required if the grading exceeds 50 cubic yards or the existing flow pattern is
substantially modified as determined by the City Engineer. If the grading is less than 50
cubic yards and a grading plan is not required, a grading permit shall still be obtained so
that a cursory drainage and flow pattern inspection can be conducted before grading
begins.
32. Prior to commencement of grading operations, applicant to provide to the City with a
map of all proposed haul routes to be used for movement of export material. Such
routes shall be subject to the review and approval of the City Engineer.
33.AII grading shall be done under the supervision of a geotechnical engineer and he shall
certify all slopes steeper than 2 to 1 for stability and proper erosion control.
34. Phasing Plan shall be approved by the City Engineer.
35.An Encroachment Permit shall be obtained prior to any work on City right-of-way.
36. Arrangements for relocation of utility company facilities (power poles, vaults, etc.) out of
the roadway or alley shall be the responsibility of the property owner or his agent.
Overhead utilities shall be undergrounded.

37. Underground water rights shall be dedicated to the City pursuant to the provisions of
Section 16.52.030 (LEMC), and consistent with the City's agreement with the Elsinore
Valley Municipal Water District.
38. Applicant shall obtain any necessary County permits and meet all County requirements
for any work within County right-of-way.
39. The applicant shall install permanent bench marks per Riverside County Standards and
at locations to be determined by the City Engineer.
40. The applicant shall install blue dot markers at Fire Hydrant locations per Riverside
County Standards.
41. Provide fire protection facilities as required in writing by Riverside County Fire.
42.Applicant shall pay all applicable development fees, including but not limited to TUMF,
MSHCP, TIF and area drainage fees. The fees shall be the amount in effect at the time
of payment.
43. 10 year storm runoff shall be contained within the curb and the 100 year storm runoff
shall be contained within the street right-of-way. When either of these criteria are
exceeded, drainage facilities shall be provided.
44.AII drainage facilities in this project shall be constructed to Riverside County Flood
Control District Standards.
45.AII compaction reports, grade certifications, monument certifications (with tie notes
delineated on 8 %" x 11" Mylar) shall be submitted to the Engineering Division before
final inspection of public works improvements will be scheduled and approved.
46. Slope maintenance along right-of-ways and open spaces shall be maintained by a
property owner's association or other maintenance mechanism approved by the City.
47.AII waste material, debris, vegetation and other rubbish generated during cleaning,
demolition, clear and grubbing or other phases of the construction shall be disposed of
at appropriate recycling centers. The applicant should contract with CR&R Inc. for
recycling and storage container services, but the applicant may use the services of
another recycling vendor. Another recycling vendor, other than CR&R Inc., cannot
charge the applicant for bin rental or solid waste disposal. If the applicant is not using
CR&R Inc. for recycling services and the recycling material is either sold or donated to
another vendor, the applicant shall supply proof of debris disposal at a recycling center,
including verification of tonnage by certified weigh master tickets.

48. The site shall be graded to minimize the effects of drainage flowing offsite.
49.AII natural drainage traversing the site shall be conveyed through the site, or shall be
collected and conveyed by a method approved by the City Engineer.
50. Roof drains shall not be allowed to outlet directly through coring in the street curb.
Roofs should drain to a landscaped area.
51.Applicant shall comply with all NPDES requirements in effect; including the submittal of
Water Quality Management Plan (WQMP) as required per the Santa Ana Regional
Water Quality Control Board.
52. Education guidelines and Best Management Practices (BMP) shall be provided to
residents of the development in the use of herbicides, pesticides, fertilizers as well as
other environmental awareness education materials on good housekeeping practices
that contribute to protection of storm water quality and met the goals of the BMP in
Supplement "A" in the Riverside County NPDES Drainage Area Management Plan.

53. Applicant shall provide BMP's that will reduce storm water pollutants from parking areas
and driveway aisles. (Required for lot of one acre or more)
54. City of Lake Elsinore has adopted ordinances for storm water management and
discharge control. In accordance with state and federal law, these local storm water
ordinances prohibit the discharge of waste into storm drain system or local surface
waters. This includes non-storm water discharges containing oil, grease, detergents,
trash, or other waste remains. Brochures of "Storm water Pollution, What You
Should Know" describing preventing measures are available at City Hall.
55. PLEASE NOTE: The discharge of pollutants into street, gutters, storm drain system, or
waterways -without Regional Water Quality Control Board permit or waver - is strictly
prohibited by local ordinances and state and federal law.
56. Dedicate right-of-way and construct street improvements (part-width improvements) on
Corydon Street, along the property frontage, such that the centerline to property line is
50 feet and centerline to curb face is 40 feet. The improvements include ac pavement,
curb and gutter, sidewalk, street lighting, and signing and striping. Adequate ac
transition beyond project limits shall be provided. In addition, adequate drainage
protection shall be provided at the end of the transition area.
57. The developer shall provide cash in-lieu of improvements (half-width) for the proposed
raised median on Corydon Street.

58. The developer shall not oppose the consideration of a right in/out only access for the
proposed southeast driveway on Corydon Street once warranted.
59. Provide street lighting and show lighting improvements as part of street improvement
plans as required by the City Engineer.
60. Applicant shall submit signing and striping plans and traffic control plans for the required
street improvements for the project and for onsite improvements. All signing and striping
and traffic control devices shall be installed prior to occupancy.
61.A Calif. Registered Civil Engineer shall prepare the street and traffic improvement plans.
Improvements shall be designed and constructed to Riverside County Road Department
Standards, latest edition, and City Codes (LEMC 12.04 and 16.34).
Prior to Issuance of a Grading Permit
62. Submit grading plans with appropriate security, Hydrology and Hydraulic Reports
prepared by a Registered Civil Engineer for approval by the City Engineer. Developer
shall mitigate any flooding and/or erosion downstream caused by development of the
site and/or diversion of drainage.
63.A portion of the proposed project may affect "wetlands" or "jurisdictional streambeds",
therefore, a copy of permit approvals from respective Federal or State agencies shall be
provided to the City.
64.An approved Drainage Study shall be provided.
65. The grading plan shall show that no structures, landscaping, or equipment are located
near the project entrances that minimize sight distance standards.
66. Construction Project access and hauling route shall be submitted and approved by the
City Engineer,
67. Provide soils, geology and seismic report including street design recommendations.
Provide final soils report showing compliance with recommendations.
68. An Alquist-Priolo study shall be performed on the site to identify any hidden earthquake
faults and/or liquefaction zones present on-site.
69. The applicant shall obtain all necessary off-site easements and/or permits for off-site
grading and/or drainage acceptance from the adjacent property owners prior to grading
permit issuance.

70.Applicant to provide erosion control measures as part of their grading plan. The

71.Applicant shall provide the city with proof of his having filed a Notice of Intent with the
Regional Water Quality Control Board for the National Pollutant Discharge Elimination
System (NPDES) program with a storm water pollution prevention plan prior to issuance
of grading permits. The applicant shall provide a SWPPP for post construction, which
describes BMP's that will be implemented for the development including maintenance
responsibilities. The applicant shall submit the SWPPP to the City for review and
approval.
72.An approved WQMP plan shall be provided.
Prior to Issuance of Building Permit
73. All Public Works requirements shall be complied with as a condition of development as
specified in the Lake Elsinore Municipal Code (LEMC) prior to building permit.
74. Submit a "Will Serve" letter to the City Engineering Division from the applicable water
agency stating that water and sewer arrangements have been made for this project and
specify the technical data for the water service at the location. such as water pressure
and volume etc. Submit this letter prior to applying for a building permit.
75. No structures, landscaping, or equipment shall be located near the project entrances
that compromise sight distance requirements.
76. Pay all Capital Improvement TIF and Master Drainage Fees and Plan Check fees
(LEMC 16.34).
Prior to Occupancy
77. Pay all fees and meet requirements of an encroachment permit issued by the
Engineering Division for construction of off-site public works improvements
(LEMC12.08, Res.83-78). All fees and requirements for an encroachment permit shall
be fulfilled before Certificate of Occupancy.
78.AII compaction reports, grade certifications, monument certifications (with tie notes
delineated on 8 1/2" x 11" Mylar) shall be submitted to the Engineering Division before
final inspection of off-site improvements will be scheduled and approved.
79.AII public improvements shall be completed in accordance with the approved plans or
as conditions of development to the satisfaction of the City Engineer.

80.AII required easements, dedications, or vacation as conditions of this development shall
be completed and recorded.
81.AII signing and striping and traffic control devices onsite and on Corydon Street shall be
installed.
82. Water and sewer improvements shall be completed in accordance with Water District
requirements.
83. Proof of maintenance responsibility and acceptance shall be provided for all open
space, slopes, and drainage facilities, outside the public right-of-way.
84. TUMF fees shall be paid. The TUMF fees shall be the effective rate at the time when
the Certificate of Occupancy is obtained.
85. The applicant shall pay cash in-lieu of the median improvements on Corydon Street.
The cost shall be based on an estimate approved by the City Engineer.
86. The applicant shall submit as-built plans and shall be responsible for revising the mylar
plans. A digital copy of all completed public improvement plans shall also be provided. A
bond (amount to be determined by the City Engineer) is required to guarantee
compliance of this requirement.
COMMUNITY SERVICES DEPARTMENT
87. The Developer shall pay park fees in the amount of $0.10 per square foot for all interior
commercial space.
88. Developer shall participate in the City-wide Landscape and Lighting Maintenance
District.
89. Developer shall comply with all City Ordinances regarding construction debris removal
and recycling as per Section 8.32 of the Lake Elsinore Municipal Code.
RIVERSIDE COUNTY FIRE DEPARTMENT
90. The applicant shall comply with all Riverside County Fire Departments requirements
and standards. Provide fire protection facilities as required in writing by the Riverside
County Fire Department.

APPLICANT:
On February 19, 2008, the Planning Commission continued Conditional Use Permit No.
2007-17 to the regularly scheduled Planning Commission meeting of March 4, 2008. The
Planning Commission continued the project in order to allow the applicant to work with the
City's Engineering Division to complete a parking study for the proposed Riverside
Recovery Resources operation located at 600 3rd Street (APN: 377-151-064).

Although staff has endured to bring this application forward, there are remaining items
between the existing Outlet Center Specific Plan and proposed Uniform Sign Program to
be addressed. Therefore, with the consent of the applicant, staff is requesting that this
item be continued.
PROJECT LOCATION
The project site is generally located on the east side of Collier Avenue approximately 600
linear-feet south of Nichols Road. (APN's: 389-210-052, 062 & 063).
