purposes (thrift shop cafe /restaurant) This information included records from the County Tax Assessors office The documents reflected appraised values of construction completed on the budding which included an aluminum patio an enclosed (� patio and storage Although these documents provide some background they do not clarify if an actual (legal) conversion of the budding and property (from PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE CALIFORNIA, APPROVING A MINOR DESIGN REVIEW OF AN EXISTING COMMERCIAL BUILDING FOR PROPERTY LOCATED AT 16474 LAKESHORE DRIVE WHEREAS Richard Knapp filed an application with the City of Lake Elsinore requesting approval of a Minor Design Review for an existing commercial budding for minor alterations to the budding fagade (paint and material) resurfacing and striping of the parking lot area and landscaping and irrigation improvements for property located at 16474 Lakeshore Drive (APNs 378 301 005/021) (the Project ) and WHEREAS the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of considering and approving conditionally approving or denying Minor Design Review requests for commercial projects and WHEREAS public notice of the Project has been given and the Planning Commission has considered evidence presented by the Community Development Department and other interested parties at a public meeting held with respect to this item on June 17 2008 NOW THEREFORE THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE DETERMINE AND ORDER AS FOLLOWS SECTION 1 The Planning Commission has considered the proposed design for the Project and has found it acceptable The Planning Commission finds and determines that the Project is consistent with the Lake Elsinore Municipal Code SECTION 2 The California Legislature has determined that certain classes of projects do not have a significant effect on the environment and are therefore exempt from the California Environmental Quality Act (Cal Pub Res Code §§ 21000 et seq CEQA ) and the State Guidelines for Implementation of CEQA (14 C C R §§ 15000 et seq the CEQA Guidelines ) A Class 3 exemption exists for Construction and location of limited numbers of new small facilities or structures installation of small new equipment and facilities in small structures and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure CEQA Guidelines section 15303 (c) says that development of a store motel office restaurant or other similar structure not exceeding 2 500 square feet in floor area would be appropriate for this class of exemption This project qualifies for a Class 3 exemption because it involves the conversion and minor modification to a structure not exceeding 2 500 square feet in floor area Therefore the Planning Commission hereby finds and determines that the Project is exempt from CEQA and Municipal Code Chapter 17 82 the Planning Commission makes the following findings for the approval of the Project 1 The Project as approved will comply with the goals and objectives of the intended General Plan and the Zoning District in which the Project will be located The Project complies with the goals and objectives of General Plan designation Neighborhood Commercial as well as the C 1 (Neighborhood Commercial) Zoning District Approval of this Project will assist in achieving the development of a well balanced and functional mix of land uses by providing additional office use within the C 1 (Neighborhood Commercial) Zoning Distnct The Project will provide a well rounded design while maintaining consistency and compatibility with existing development m the immediate area Overall the Project will enhance the existing developed areas within General Plan designation Neighborhood Commercial and Zoning Designation C 1 (Neighborhood Commercial) of the Lake Elsinore Municipal Code 2 The Project complies with the design directives contained in Section 17 82 060 and all other applicable provisions of the Municipal Code The Project complies with all setback height and lot coverage requirements as outlined in the C 1 (Neighborhood Commercial) Zoning Distnct of the Lake Elsinore Municipal Code The Project will complement the quality of existing projects in that the applicant is providing architectural elements pursuant to the General Plan Community Design Element Design Guidelines a front entry wood trellis porch with windows natural stone base columns decorative window surrounds hardishmgle siding and rafter tail wood beams 3 Subject to the attached conditions of approval the Project is not anticipated to result in any significant adverse environmental impacts A Class 3 CEQA exemption may be invoked when the development proposal involves the conversion and minor modification to a small structure Pursuant to CEQA Guidelines 15303(c) the Project is exempt from environmental review because it involves the conversion and minor modification to an existing structure Moreover the Project has been reviewed by all City divisions and departments which have imposed certain conditions of approval on the Project to ensure that no adverse impacts occur In light of those conditions of approval as well as the design features of the Project itself the Project will not also been conditioned to comply with all aspects of the Lake Elsinore Municipal Code The Applicant shall meet all required development standards pursuant to the C -1 (Neighborhood Commercial) Zoning Distnct of the Lake Elsinore Municipal Code SECTION 4 Based upon the evidence presented the above findings and the conditions of approval the Planning Commission hereby approves the Minor Design or money order made payable to the Riverside County Clerk in the amount of $64 00 00 to enable the City to file the Notice of Exemption Said filing fee shall be provided to the City within 48 hours of project approval 3 Applicant shall place a weatherproof 3 x 3 sign at the entrance to the project site identifying the approved days and hours of construction activity and a statement that complaints regarding the operation can be lodged with the City of Lake Elsinore Code Enforcement Division at (951) 674 3124 The sign shall be placed on site prior to the issuance of a grading or budding permit whichever occurs first 4 All Conditions of Approval shall be reproduced upon page one of building plans submitted to the Building and Safety Division for Plan Check 5 Prior to issuance of any grading or budding permits the applicant shall sign and complete an Acknowledgement of Conditions and shall return the executed original to the Community Development Department for inclusion in the case records 6 The Applicant shall comply with all requirements of the City s Grading Ordinance Construction generated dust and erosion shall be mitigated in accordance with the provisions of Municipal
