The Clerk then reported to Council that he has received a check
from H. S. 1F,'agner in the amount of 0200 to cover the annual rental for 1940 on '
the City sewer farm.

Thereupon the Clerk presented to Council a communication from
Stuart; A. Cundiff, Commercial Engineer for the Nevada- Caifornia Corporation
relative to his agreement with Council regarding the expense involved in the
lowering of their pole 1112816 located on the City Baseball rield and submitted
therewith a statement of recorded data as evidence of their right to maintain the
pole in that position and therefore requested that Council authorize the payment
of 0115 of the era,ense involved.

matter be referred to the City Clerk for checking the records to verify -the evidence sub-

Thereupon the report of Engineer F. Curt Miller was presented :to'Zouncil,in which he
stated that Clarence CroF, contractor, who was awarded t4e contract for grading j,he City
Baseball Field has moved 23,282 cubic ya-rds of mgterial: which figured on the basis of his
bid of ll� per cubic yard makes the sum of tt2561.02 being due .,hia,.

to Council which on motion duly made, and on call vote, carried were ordered paid and the Clerk
was instructed to issue warrants in payment of same.
Thereupon there being no further business to come before Council on'motion duly made and
carried Council adjourned to meet in regular session on Monday January, 22,1940 at<the hour of

presented to Council in which he reported that t'ne tax collector of Riverside County
has been given notice that the City of Elsinore 's agreement to purchace certain

Whereupon 1t vras,rnaved by,, CounAlman Perrot and seconded' by Councilman

Thereupon a ,communication front Anna irl.° Horton;' Secr'etery of the Elsinore
Chamber -of ^om,- orce was presented to Council ih =Tjihich -she renbrted that many, com-
plaints have been registered relat ive to local interference w th'radia race- ption'"
and. requested that if it is possible Council take necessary action to correct this
situation.
Upon Council's condideration of the mc-t'ter it was agreed that the situation
be referred to the City Clz.rk for checking.
Thereupon a cormmunication from Richard Graves, Executive Secretary of the
League of California Cities w =s presented to Council in i =;hich he submitted a state-
me-at covering League dues for the year 1940, in the amount of toy and advised that
said bill is based upon the revised dues schedule a.dopted by the League Convention
held in - akland, 'September 1939.
Thereupon it was moved by Councilman ^`ills -Tnd seconded by Courcilm:;n Perrot
that said bill be approved and communication filed, which motion upon vote was
carried.
Thereupon a communication from R. D. Baumgardner was presented to Council
advising that he represented a group requesting that the City Council forward a
resolution to Supervisor Stanfield requesting that the County Board of Supervisors
pass an ordinance requiring the use of mufflers on motor driven boats on Lake
Elsinore, except on Saturdays, Sundays and legal holidays. between 7 AM and 7 PM.
Thereupon it was moved by Councilman Perret that the Clerk be directed
to forward a letierto the Board of Supervisors requesting the adoption of an
Ordinance regulating the use of motor driven boats on Lake Elsinore.
The motion receiving no second was declared lost.
Vhereupon it was moved by Councilman Mills and seconded by Councilman
Macy that the communication from Baumgaadner be received and filed for the time
being, which motion upon vote was carried.

Thereupon Earl Johns .a representative -of The Nevada, California Corporation appeared
before Council and reported that it vjill - .be.necessary for;the.:City to :file an application
for the continuance of the present electric energy contract prior to April 12, 1940 and
submitted an application for CounciV s:'use. _•
Whereupon it was moved by Councilman Mills and seconded by Councilmen Macy that the
application form; submitted berreferred-:t:o the City Attorney for .,his approval which motion
upon vote was carried,
Whereupon it was moved by_Councilman Mills and, seconded'by'Councilman Macy that the Clerk
be .instructed to,,publish•a notice inviting bidsron gasoline to "b "e furnished the-City on the
basis of a one year contract which motion upon vote was carried.•

Thereupon the Clerk reported to Council that he was in
receipt of checks from the County Auditors office covering an apportion-
ment of receipts from the sales of certain tax delinquent properties
in the City of Elsinore, in amounts as follows:
General Taxes: $1009.28
1920 Street Improvement: 1.55
1926 Water Improvement: 731,09
!'thereupon it was moved by Councilman Perret and seconded by
Councilman_PJfacy that said checks be received and deposited to the credit
of the proper funds, which motion upon vote was unanimously carried.
Thereupon the Clerk presented to Council a communication
signed by a number of property owners residing on N. Main and Ellis
Streets requesting that Council give serious consideration the matter
of installation of sewer service in this district and that action on
said matter be taken without delay.
Upon Councils due consideration of the matter and a. duscussion
on the project with q number of the petitioners who were present, it
was agreed b7I Council that the matter be referred to Councilman Lovejoy
with instructions that
he check with the State Relief Administration
to ascertain if such a project could be '
sponsored by the City through
their organization, and that he report on the matter to Council at the
earliest time possible

Council Perret--Park Commissioner then reported. to, Council that it is his
desire to plant ornamental shade trees in the park-way ,in,ftont-of the City Park
and requested that "Council inf orm,him as to their views" on the matter.
Whereupon it was moved by Councilman Macy and seconded by Councilman
Lovejoy that the -Park C;ormiissione'r be authorized to purdhase the ' 7 number of
trees required for planting in the parkway in front of the City Park, which
motion upon vote was unanimously carried.

Thereupon the Clerk presented to Council a communication from
E. Q. Sullivan, District Engineer Division of State Highways,. with, which
he submitted a copy of letter from the Head- quarters office in Sacramento
advising that the streets recently submitted by the City for inclusion in
the system of streets of Major Importance have been approved as Streets of
Major Importance.
Whereupon i`t was moved by Councilman Mills and seconded by Council-
man Perret that said communications be received and filed, which motion upon
vote was carried.
Thereupon Memorandum, of Agreement, submitted by the State Division
of Highways,` providing for proposed expenditure of one- quarter cent gasoline
tax `funds ''for Streets of Major Importance which will accrue to the City
during* the fiscal year ending June 30th, 1940, was presented to Council for
consideration.
(Thereupon Resolution J344 was intorduced and read being a Resolution
of the City Council of the City of Elsinore adopting Budget and approving
Memorandum of Agreement for expenditure of ; cent.Gas Tax allocated for
Streets of Major Importance and authorizing that the Mayor and Clerk be
directed to sign the same for and on behalf of the City, of Elsinore.

A communication from Alice M. Scott was then presented.to
Council in which she advised that she _has.been_ appointed census
enumerator for this district and therefore will be unable to serve on
the Municipal Election Board, April 9th.
Whereupon it was agreed by Council that.this matter.be referr
ed to the Inspector of the Election Board, so that he may arrange to
fill'the existing vacancy.
Thereupon a communication from Edward E. Blake was presented
to Council in which he reported that Mr. Ed Keifer, who represents the
N.Y.A. in this district, has offered him the position of Supervisor of
-a proposed project at the,:new,Baseball Park which would employ ten boys
during the entire summer, taking care of said grounds, at no cost to
the dity and further advisedthat if Council think favorably of this
proposed project, that Mr. heifer will- be,.glad to come before Council
and give them any further information which they.may desire.

of the Cit;T of Elsinore, which was the balance in the fund received from con -
tributions'from citizens for the Elsinore Municipal' Baseball Park project.

man Lovejoy that said,check be accepted and deposited to the credit of the
general fund which motion upon vote was carried.
Thereupon the annual franchise
p tax report of the Calif. Plater and
Telephone Co. was submitted to Council together with their check in the
amount 'of $143.79 covering franchise tax for,the year 1939, based on 20 of
the gross receipts for the year 1939 which amounted `'to`$7,189.45'•
Whereupon it was. moved by Councilman Mills and seconded by Council-
man Lovejoy that said report be received and filed and check accepted and
deposited to the credit of,the general fund, which motion upon vote was
carried.
Thereupon Councilman Lovejoy reported to Council that he has received
from the S.R.A. the required proceedings,.submitted.'for Councils execution
which provide for the necessary authorization to enter into an agreement with
the S.R.A. for assignment of relief workers for the proposed sewer project.
The Clerk then presented said proceedings to Council for their con -
sideration.
Whereupon it was moved by Councilman Mills and seconded by Council-
man Perret that said proceedings be referred, to the City Attorney for "his legal
approval, which motion upon vote was carried:
Thereupon :Wilbur Behrend a representative from the Elsinore 'Chamber
of Commerce appeared. before Council and on behalf of the Chamber requested
that Council 'take necessary action to` authorizer that the'Miunicipal Lakeshore
Beach be cleaned up and "put'in shape so that it will attract visitors to our
community this summer.
Whereupon it was moved by Councilman I.:acy and seconded by Councilman
Perret that`Councilman'Lovejoy be 'authorized to have the' -City Beach cleaned up
and put in good condition, which motion upon vote was unanimously carried.
Thereupon Councilman Perret reported to Council that the City Park
Department is badly in need of a new lawn mower and requested that it be author-
ized that a new lawn mower be purchased.
Whereupon it was agreed by' Council ' that Councilman Perret be authorized
to purchase anew lawn mower for 'the City Park Department.
Council then took up ',for consideration the matter of improving the
Municipal Baseball Park by sowing lawn grass on the infield and providing necessary
sprinklers to take care of same.

the development of such a' project, and offered to °discuss further and
assist Council in the development of such a project.

Council is interested in the proposed development of an N.Y.A. project
and extend to him an invitation to meet with the City Councilmat their

of the proposed Baseball Park project, which motion upon vote was

Thereupon IuTr. Galrielson appeared before Council and submitte
a tentative bid of`10c =per foot for digging of ditches for the proposed
sewer and water line projects.
Upon Councils coisideratiori -of the matter it was agreed that
a further check be made of the work required and Mr. Galrielson was
inacted to return to Elsinore next Monday _to. check the proposed work
With Council, which he agreed'to'do.
This being the time fixed by law for canvassing the °returns
of the General Municipal Election held on Tuesday April 9th, 1940
in the City of Elsinore.

man Lovejoy that the matter be referred to Councilman Macy, Plater Commissioner
with authority to place this insurance as he ma7= see fit, which motion upon
vote was carried.
Thereupon the Clerk presented to Council the written proposal of
A. L. Cabrielson, Contractor, to do the trenching for the proposed water line
and two sewer line projects, for 100 per lineal foot.
Whereupon it was moved by Councilman Mills and seconded by Council -
man Macy that the Clerk be directed to notify T.Tr. Gabrielson that Council at
the present time are not in a position to act on the matter, which motion upon
vote was carried.
Thereupon the Clerk reported to Council that he has received notice from Mr.
E. E. Kiefer, District Yamager, Riverside County N.Y.A. Projects that due to
other engagements he was unable to attend this meeting of council but advised
that he would be in Elsinore on Tuesday April 23rd and would call to discuss
matters relative'to the possibility of developing an N.Y.A. Project for Etsimore.
Whereupon it was moved by Councii1man Macy and seconded by Councilman
Perret that Councilman Lovejoy be authorized to take necessary action to develop
an N.Y.A. Project for and on behalf of the City of Elsinore, which motion upoh
vote wqs carried.
Thereupon Council took up for consideration the matter of double parking
on the business streets of Elsinore and upon die consideration, of the matter it was
moved by Councilman Macy and seconded by Councilman Perret that the Street
Commissioner be authorized to have "No Double Parking" signs made and posted to
prevent this dangerous situation which motion upon vote was carried.

and that a notice be published fixing said time and date for a hearing on said

Thereupon the Clerk presented to Council a petition signed by thirty-
five property owners living in the vicinity of the intersention of Chestnut St,
and Heald Avenue requesting that Council do not allow any church or place of
worship either permanent or temporary to be held or constructed on the Southeast
corner of Heald Avenue and Chestnut Street,
Whereupon it was moved by Councilman Yills and seconded by Councilman
Lovejoy that said petition be received and ordered filed for future consideration
which motion upon vote was carried.
Thereupon a communication from E. H. Shaul, Building Inspector was
presented to Council in which he reported to Council that Pairs. Ora L. Bandy has
erected a small frame building on herproperty without having secured a building
permit and that said building was placed within two feet of an adjoining dwell-
ing, thereby creating a fire hazard and therefore suggested to Council that said
building be ordered condemned or at least that Mrs Bandy be required to cover
said building with corrugated iron.

similar action was filed last year, which is still pending and the
Attorney advised that he obtained a stipulation from the Telephone Co.

zone R -3 to that of zone "C" and also the petition "of the Elsinore Townsend Hall
Association: signed by Mary A. Gardner and "It7abel M. Townsend, requesting that

Mills that it be ordered that the City Council sitting as the City Planning
Commission hold a meeting on June "17th, 1940..at the hour of 7:30 P.M. for the
purpose.of considering the applications to "amend the zoning"Ordinance..and that
it be further ordered that a notic`e,of said,meetin be published, ivhah motion

Thereupon a representative of "the Elsinore Young I,:ens Business Assn
appeared before Council and "requested,that_they be,pranted permission to hang a

by their organization on Saturday June 1st, 1940 at the Palomar Hotel.

banner as requested, providing that it be properly and securely hung, and that it

Thereupon R. E. Butler, E. Reavis and J, H. Wilson, members of the
Grand Avenue Improvement Association, appeared before and addressed Council relative
to the possibility of interesting the Federal Government in using Lake Elsinore
for defense purposes and requested Councils approval and cooperation in the matter.

Thereupon the Clerk reported to Council that he was requested by
the ?^later and License Clerk to call to Councils attention that the old eletric
fan used in the office is out of order and beyond repair and request that
Council authorize that a new fan be _purchased for use in the City Clerk and
Water and License Clerk's office.
Upon Councils consideration of the matter it was agreed that it
may be advisable and possibly more satisfactory to first investigate if it
would not be more desirable to install some sort of ventilating and cooling
system in said office.

man Macy that the matter of providing some sort of cooling system for the
Clerk and Water Clerk's office be referred to Councilman Lovejoy, with authority

Thereupon the City Planning Commisiion filed its final report
on the application of the Townsend Hall Association, recommending that
siad application to amend the zoning ordinance to provide for the re-
zoning of Lots 19,201 21, & 22 in Block 3 and Lots 19, 20, 21, & 22 in
Block 4 of Lakeshore drive Addition from Zone "B" to Zone R -2 be approve l.
Whereupon it was moved by Councilman Mills and seconded by
Councilman Perret that the Council order that'July 8th be fixed as the
date for a public hearing on the proposed amendment of the zoning
ordinance and that notice of said public hearing be given by publication

Resolution of the City Council providing that Resolution #314 fixing
the salaries of appointive City officers be amended to provide that the

to its provisions, however that he has forwared his request to the State '

a "service station at' at ' the corner of Main and Franklin Streets and requested
that they'be granted' permission to build two driveways on Mahn Street and
one driveway on Franklin Street and to remove two'`trees that -are now "in'the
parkway area.
Upon "Councils due consideration of the matter, "it was'. moved by
Councilman- NTills and seconded -by Councilman' °Perret that "'the Gilmore'011
Company be granted permission to remove I the ' -two trees in the parkway `and

to Council in which he advised that with reference to Councils request
that he prepare an ordinance amending the zoning ordinance to provide
that Lots 19 to 22, Blocks 3 & 4 of Lakeshore Drive Addition be nut in
an R2 -Zone, he finds that said Lots are now in Zone B -1 and in accordance
with the provisions of Sect- 9 of the Zoning ordinance, said lots are
now abailable for use as a trailer camp.

be received and placed on file.
Thereupon a communication from E. Q. Sullivan, Distric Engineer,
State Division of Highwwai'TS was presented to Councils, submitting for City
files a copy of the,final report showing expenditures made by the State'
under Project 3(A) of the Memorandum of Agreement providing for expenditure
of one- quarter cent funds for Streets of Major Importance in the City of
Elsinore.

Thereupon a communication from City Attorney Best wps presented
to Council in which he advised that the Complaint and Summons served on the
Yayor in the case of Corlin vs City of Elsinore -- et, al. was turned over
to him to be acted upon and after his investigation of the matter it appears
that the City has no interest in the property mentioned in the complaint
to quiet title except delinouent city taxes and as the City will receive its
share from the tax sale which has been held on this property =, he filed a
wualified Disclaimer of the City of Elsinore, submitting a copy of same for
City files.

said amount be charged to the SpecialGas Tax Imp. Fund and the balance

Thereupon Councilman P „ills Street Commissioner reported to
Council.that it is his desire, at an early date to submit to the State
Department a list of Streets of Major Improtance, proposed for improve-
ment in 1941 and presented to Council for approval a list of said
streets. He also suggested that he deems it advisable that E. Pottery
Street is subject to a great quantity of flood waters and that the
application of a seal coat would prevent possible damage to said street.
Whereupon it was moved by Councilman Perret and seconded by
Councilman Lovejoy that the Streets proposed by the Street Commissioner
for Improvement in 1941 be approved ty Council and that the Street -
Department be authorized to purchase the necessary oil required for
the application of a seal coat on the improved section of East Pottery

Thereupon a communication from W. W. H. Beach was presented to
Council in which he called to Council's attention that the City Insurance
Policy, covering non - ownership cars will expire on September 12th and re-
quested that he be granted a renewal of this policy.
Whereupon it was moved by Councilmen Mills and seconded by Council -
man Macy that said insurance policy be ordered renewed, which motion upon
vote was carried.
Thereupon Ordinance #239 was presented to Council on'second reading
being an Ordinance of the City Council of the City of Elsinore,_ amending'
Section 19 of Ordinance #161 respecting bowling alleys.
Whereupon it was moved by Councilman Lovejoy and ,seconded by Council -

Mayor lend his good offices towards making this campaign,•a success.by`ssizng
a Proclamation for- October to be the month to `start a more beautiful South -
ern California by planting flowers; trees and'sihrub's and home owners re-
juvenating their lawns."

Thereupon the Clerk reported to Council that Mrs. E. J. GOOdme
has requested that Council give consideration to the improvement of
Avenue, -6 in.the Pepper Grove Tract by grading said street_ and also to,__..
widenrthe railroad crossing leading into said street.
Upon Councils consideration of said request it was agreed
that said matter be taken under advisement.
Thereupon Resolution f349 was intiorduced and read being a
Resolution of the City Council providing that the salaries of the Chief
of Police and Assistant Chief of Police now fixed at $95.00 each, be
paid from funds as follows: 50% from the In Lieu Tax Fund, 30%
from the Liquor Control Fund and 20% from the General Fund, also
providing that the salary of the Garbage Collector be fixed at '115.00
per month effective as of October lst, 1940.
Thereupon it was moved by Councilman Mills and seconded by
Councilman Macy that Resolution #349 be passed and adopted as read,
which motion was carried by the following vote:

Thereupon Council took up for further consideration the matter
of adopting and passing an Ordinance providing for the regulation of

regulating the operation of motor driven boats on Lake Elsinore, be
tabled, which motion was carried by the following vote:

The minutes of the lest refuler meeting held on Nov. 12th
were, then,repd by_ the Clerk and there being no -correction or omissions

Thereupon Mr. C. 0. hart appeared before Council and reporte
that to let rid of a sump hole in the street in front of his property
oh- Graham Ave. he applied for a. hermit to raise his curbing, which
permit was granted by the State highway Dent, and that said curb has
been completed for some time but no action !:as been taken by the
State "i?,hifay Dept. to raise the level of the Street and as he bras
a- n,xious to heal' the sump hole filled up before the winter rains started
he again conferred ��ith the himh,:,ays offi, -oils re�7=sdine the matter
and ;_as advised by them that they -could not a: -sume the responsibility
of making this fill unless the City officials of Elsinore would
autr,,orize the -ork and assume responsibility if water z; *as diverted
to cause it to overlow other private property and he requested that
Council take some action on the matter.
Upon Councils due consideration of the hatter it was agreed
that there was noth.ing,council could do about the matter and it was
therefore moved bT-y Councilman Lovejoy, and seconded by Councilman
Pills that since there is nothing Council can do regarding siad
matter that Council proceed v - -ith their regular business, which motion
upon vote was carried.
Thereupon a communication from the City Clerk of Corona
was presented to Council in which he advised that the next meeting of
the Citrus Belt Deivision of the League of Ca'if. Citrus -ill be
held in Corona on Friday - ovember 29th at the Kinney Hotel at 7:OOP.M.
at requested that the enclosed card for reservations be returned
promptly.
;)hereupon it was agreed by Council that the Clerk be
instructed to mail the card and make reservations for four from
Elsinore.
Thereupon Councilman Lovejoy reported to Council that a
Glo Fire Gas Log has been placed in the Clerk's office on trail and
that it has proved to be very satisfactory.
i7hereunon it was moved be Councilman PaPills and seconded by
Councilman Perret that is be authorized to purchase the Glo Fire Gas
Log and a screen to be placed in front of it, -hick ration upon vote
was unanimously carried.

Thereupon the Treasurer's and Clerk's monthly reports were
prsented to Council and on motion duly made and carried were accepted

Whereupon the Clerk presented to Council a communication from
the State Division of Highways with reference to the matter of curb
grade on Graham Ave, between Kellogg and Lowell Sts., advising that
they will be willing to issue a permit similar to Permit #88605,
permitting a curb grade app =xMately six inches lower than the grade
of the center of the street, providing the City will request the
issuance of such a permit.
Whereupon it was moved by Councilman Mill and seconded by
Councilman Macy that sie.d communication be received and filed which
motion upon vote was carried.
Thereupon a communication from the City Clerk of Indio was
presented to Council advising that the neat meeting of the Citrus Belt
Division of the League of California Cities, will be held in Indio on
Friday Dec. 20th at the Woman's Club House and requested that the
enclosed card for making reservations be returned promptly.
Thereupon Council took up for consideration the matter of
providing for a Street Xmas Tree and it was reported that the Lions
